Mr. Miller:

I have spoken with my management and we can provide an additional week of time to respond to our inquiry regarding the free release surveys performed by PhiIotechnics. Accordingly, please provide your response no later than COB September 5,2008.

Your email is rather brief in its description of the methods that Philotechnics will be using to statistically analyze the free release data. As a result, I am curious regarding the response because I am uncertain how Chauvenet's criteria can be applied to this free release data and whether this is an appropriate statistical test for the free release data. Therefore, in your response, adequate justification should be provided as to why it is believed to be appropriate to apply Chauvenet's criteria to this data.

Although you have been granted an extension of time to respond, you should try to incur as little delay as possible in providing your response, as we are now on the fourth round of questions and answers related to the free release surveys. If based on your response, we conclude that items have been inappropriately free released or that the free release surveys were inadequate, we need to address that as expeditiously as possible.

I have been in contact with the experts at Philotechnics. They would llke to request one additional week in order to properly respond to this question. They would like the time to perfoim a statistical analysis on the free- release data and determine precisely how many data points fall outside of a 2-sigma boundary, using Chauvenet's criteria. The data analysis and subsequent review by their health physicist should be completed by August 5,2008.

RE: Follow Up Response to NRC Question 4.h from Philotechnics 15' Supplemental Decontamination Package.

Dear Mr. Miller:

In response to the inquiry by Dr. Katanic at NRC Region IV regarding our response to question 4.h., Philoteclinics has provided the following response to address the issues of concern. We appreciate the NRC granting additional time for the review of this data and realized the use of Chauvenet's criterion for potentially identifying outliers was not appropriate for this situation. With additional surveys of specific items potentially impacted by the variable background, we feel confident that we can adequately address the concern of proper release of these items.

1. Regarding the answer for 4.h. We identified an error regarding instrument efficiencies and have updated OLU' free release packages to show the corrected efficiencies for the hand-held meters. The original efficiency listed on all of the free release forms was incorrect; it was originally determined by taking the two pi (2n) efficiency for Sr-90 from the calibration certificate and multiplying by the source efficiency of 0.5 as per I S 0 7503-1. This efficiency determination is correct for MARSSIM surveys but does not apply to free release surveys. The correct efficiency that should have been used is the four pi (4n) efficiency for 9 - 9 0 as defined in Philotechnics Operations Procedure HP-WM-05. Using the corrected efficiencies for the hand-held nieters and the utilization of a more conservative background (explained below) resulted in variability of data within the typical range of acceptance that would be expected. This explains the discrepancies in the "black poly box" measurements you cite in your first example. The net activity for items 3-0359 and 3-0369 should have been reported as (-348 d p d 1 0 0 cm2) and (539 dpm/l00 cm2) respectively. The net difference between these two surveys is 887 dpid100 cm2 which suggest the black poly box (3-0369) did have some contamination; however, i t was below the free release criteria of 1,000 dpd100 cm2.

To address the variability of the static measurements and potential discrepancies of the backgrounds used for the free release of materials and equipment at Sabia's facility, Philotechnics has made to the following concessions: The first was to apply a more conservative background value to 6 of the 16 survey packages that showed a high number

. Overview Potentially contaniinated material and equipment must not be released for unrestricted use unless it has been dcnionstrated not to be contaminated above established relcase limits. This procedure contains the requirements for ensuring unconditional release criteria are met.

B. Applicability

I , This proccdure is applicable to activities performed at Pliiloteclinics-operated facilities and field projects when such work is governed by an NRC or Agreement state License issued to Philotechnics.

2. Custonier-required procedures and controls may be implemented to meet contractual requirements provided they are at I east as stringent as the controls menti oiied herein.

3, This procedure is applicable to all Philotechnics Iit=alth physics personnel.

4. ‘This procedure does not apply to survey and release plans developed in accordance with MARSSIM protocols.

D. General Considerations

1 , Treat all material from radiologically controlled areas as radioactive until surveyed.

2. Open wrapped or bagged materials using proper controls.

3 . Collect any liquids for analysis and/or disposition.

4. Ens~ire wet materials arc dried prior to surveying for ui1coilditioniil release.

E. Release of Material

I . Persoiml items (pens, clipboards, hard hats, etc.) should be surveyed by the owner concurrent with personnel contamination monitoring described in HP-WM-04.

2. Only qualified RCTs may perform unconditional release surveys. Individuals not qualified as RCTs may assist, work under instruction, or pre-screen materials.

3. Instrumentation selected for unconditional release surveys shall be appropriate for the type of radiation expected to be present.

3. Tools, materials, and equipment unconditionally released shall have contamination levels that are less than the limits in Attachment 1 iflid are ALARA.

5 . Surveys for total and removable contamiiiation shall be performed in accordaiice with HP-WM-03, Coiitcamination Surveys.

6. Smears should be counted 011 an appropriate fixed or semi-portable instrument, where available.

7. Carefully evaluate inaccessible areas.

a. Take measurements at openings of inaccessihle areas.

b. RUII a smear through the internal surfaces.

c. Ensure the methods used to evaluate inaccessi ble surlh.ces yield results that are representative of the fixed and total contamination levels present. If illis cannot be deterniiiied with reasonable certainty. then the item shall not be unconditionally released. Contact the RSO, Projcct RSO, or HP Supervisor, as applicable, for guidance.

8. IF the item meets the requirements for unconditional release. THEN

a. Remove or obliterate all radioactive inaterial markings and labels

b. Attach a green tag, or use some other prqject-approved method, to identify the item as being unconditionally released.

9. IF the item does not meet the requirements for iinconditioiially release. THEN handle as radioactive material.

10. Document unconditioiial release surveys in accordance with HP-WM-02, Contamination Surveys.
