LANDMAN AFFIDAVIT REGARDING THE INTEREST OF THE ESTATE OF CAROL BLAKE

Ryan Waller personally appeared before me, being duly sworn, deposes and says:

1. My name is Ryan Waller. I am a Landman for Newfield Production Company, whose address is 1001 17th Street, Suite 2000, Denver, CO 80202 ("Newfield").

2. As Operator of the Grace 3-16-3-3WH, Newfield has requisitioned the preparation ofa Drilling and Division Order Title Opinion covering Township 3 South, Range 3 West, Section 16, Duchesne County, Utah.

3. Said Drilling and Division Order Title Opinion has identified Carol Blake as a remainderman to a life estate that was covered by a lease in the aforementioned lands. In January 2012, Newfield became aware that the life estate owner had passed away, and began searching for the remaindermen to ratify the lease. In April 2012, Newfield identified the heirs of Carol Blake as Stacey Gilbert, Terri Britten and Todd Blake, and requested its lease broker search for these indi viduals for the purpose of ratifying or leasing their mineral interest.

4. Newfield's lease broker made contact with and obtained a ratification from Stacey Gilbert in May 2012, but was unable to make contact with Terri Britten or Todd Blake.

5. Newfield, through its lease broker, conducted an extensive internet search in an attempt to locate Terri Britten and Todd Blake using the following sources: ' Spokeo, Switchboard, White Pages, Facebook, and Ancestry.com.

6. In attempting to contact the individuals identified in the internet searches, they were either the wrong Terri Britten or Todd Blake, or would not return calls or letters.

7. By letters dated January 30, 2013, Newfield extended final offers to lease or participate as working interest owners to Terri Britten and Todd Blake. Said letters were addressed to assumed but unconfirmed addresses and Stacey Gilbert was also sent a copy.

8. In February 2013 Newfield was notified by Stacey Gilbert that the Estate of Carol Blake was involved in probate proceedings in the state of Utah.

9. As of the date of this affidavit, Newfield has not seen documentation that allows for execution on behalf of the Estate of Carol Blake, nor distribution of said estate. As a result, the Estate of Carol Blake is considered to be a non-consenting owner for purposes of Docket No. 2013-007, Cause No. 139-102.
