Minutes of 02.271st Executive Committee (EC) meeting of the Council held on 15

th July, 2016 at

Chennai (Tamil Nadu). . The decisions are subject to ratification by central council of the PCI.

* Consideration of the approval of Diploma / Degree / Pharm.D / Pharm.D (Post Baccalaureate) course

and examination in pharmacy at the undermentioned institutions

It was decided to recommend to the Council to grant approval for conduct / extension of approval / u/s 12

of the Pharmacy Act, 1948 of Diploma / Degree / Pharm.D / Pharm.D (Post Baccalaureate) course and

examination in pharmacy subject to the following conditions -

a) the institution shall submit SIF every year as per the Time-Schedule prescribed by the Council.

b) the institution shall submit annual affiliation fee on or before due date.

c) the institution shall appoint the teaching faculty with the qualification and experience as prescribed

under the “Minimum Qualification for Teachers in Pharmacy Institutions Regulations, 2014”.

Besides above conditions, institutions seeking approval of Pharm.D / Pharm.D (Post Baccalaureate)

course shall comply with the following conditions -

1. The institution shall comply with the requirements of Pharm.D. Regulations, 2008 particularly

regarding appointment of teaching staff, equipments and Hospital facility.

2. Further the PCI recommends that Pharmacy Practice Faculty including HOD shall undergo at least 1

Continuing Education Programme / Training Programme of minimum 3 days duration every year and

participation in atleast one seminar/conference every year.

3. In view of above, please intimate per return of mail the number of such Continuing Education

Programmes / Training Programmes / Seminar / Conference etc. attended by HOD and pharmacy

practice faculty during the last one year with documentary evidence i.e. participation certificate etc.

4. The institution to submit full compliance of the Pharm.D Regulations, 2008 as per following details:-

Training of HOD of Pharmacy Practice Department and Pharmacy Practice Faculty

The HOD & the faculty of Pharmacy Practice Department who are not qualified with M.Pharm

Pharmacy Practice Qualification or Pharm.D Qualification and have other specialized training of

qualification in the Pharmacy Practice Department, shall undergo the training as per Regulations 3 vi)

of Appendix–B of Pharm.D Regulations, 2008. The following details be submitted –

222.4 It was noted that Hon’ble Calcutta High Court vide order dt.1.7.2016 instructed the PCI

to file the affidavit that PCI will regularize the excess admissions made by the petitioner

institutions based on AICTE approval. Since the date of hearing was 18.7.2016, the

affidavit conveying the above decision was filed by the PCI. It was decided to ratify the

action taken by the PCI in filing the affidavit in the Hon’ble Calcutta High Court

light of Memo No.662 dt.1.7.2015 issued by the DTE, Haryana.

237.2 It was noted that –

a) regarding consent of the State Govt., Puran Murti College of Pharmacy, Sonipat, has

submitted a copy of the letter dt.1.7.2015 from the Director General Technical

Education, Haryana which states as under:-

- ‘No objection certificate from State Government will not be required for seeking

affiliation for increase in intake / introduction of additional courses in the existing

technical institutions / establishment of new technical institution.’

b) the Government of Haryana was requested on 28.1.2014 to intimate this Council

whether the State Govt. has done away with the procedure of issuing the

NOC/Permission to new pharmacy institutions. No response from the State

Government is received till date.

c) however in another case (Doon Valley, Karnal) similar communication from the DTE

Haryana was accepted by the 95th CC (May, 2014).

237.3 In view of above, it was decided to -

a) inspect the above cited institution.

b) forward the DTE’s communication dt.1.7.2015 to the Haryana State Govt. stating that

since no reply is received to Council’s earlier communication, it is presumed that the

State Govt. has done away with the procedure of issuance of the State Govt.’s NOC

for staring of new pharmacy courses in Haryana and delegated such powers to DTE

Haryana.
