i. Bidder shall be an Original Manufacturer/lrnporter/Authorized Distributor/Bonefide Dealer whereinoriginal manufacture/l mporter/ means as following.

a. Orighal Manufacturer means a person/firm having its own unit that performs all the manufacturing. and processing operations needed to produce bottles (desired in the Bid) in their appropriate

specifications, Quality testing with a valid license issued under relevant Act and rules there under.

b. lmporter means a person/firm having valid import licencec. Authorized distributor or Bonefide delaers should have authorization from the manufacturer

company that the official manufacturing company is supplying the desired bottles.

(Explanation / lnstructions to bidders: - All the bidders have to submit a certificate issued bycompetent authority under relevant Act and rules there under for the items which are coveredunder this Act (Bidder should mark it as Enclosure -1). For Authorized distributor or Bonefide delaers

have to submit necessary certificate. (Bidder should mark it as Enclosure - 2 )

Note: [oan ]lcensees are not elisible to oarticioate in the Bid.

ii. Average annual turnover as defined in companies Act 1956 in the last three financial years shall not beless than 10 lakhs for SSI units of Rajasthan. For others the average annual turnover in the last threefinancial years should not be less than 20 lakhs.

iii. The dates scheduled for Receipt & Opening of Bid are fixed. However, the Director, Department ofAnimal Husbandry, Raiasthan, Jaipur, Rajasthan reserves the right of postponing the date of openingthe Technical or Financial bidi or both in the event of any unforeseen circumstances.

lf the last date for submission of Bid and opening of Bid happens to be a public holiday, the notifieddates shall automatically get postponed to the next working date.

Failure to upload the properly filled and signed Bid (Partt & ll) shall render the Bid invalid.

The Director, Oepartment of Animal Husbandry, Rajasthan, Jaipur, Rajasthan shall not be heldresponsible for non-receipt of the Bid due to failure in uploading thereof for any reason whatsoever.

ln the event of bid being submitted by a firm it must be duly signed by an authorized signatory. ln theevent of a partnership firm it must be signed by himself or on his behalf by a person holding a powerof attorney authorizing him to do so and in the case of company the bid should be executed in themanner laid in the Articles of Association. A letter of resolution must be attached in favour of theauthorized signatory. Any change in the Constitution of the Firm/qompany shall be notified forthwithby the Sidder to the Director, Department oI Animal Husbandry Rajasthan, Jaipur, Rajasthan andsuch change shall not relieve any former member of the Firm/ Company from the liability under thecontract. No new partner/ partners shall be accepted in the Firm/ Company by the Bidder/BidinB firm

in respect of the contract unless he/ they agree to abide by all its terms and conditions and submit tothe Diredor, oepartment of Animal Husbandry, Raiasthan, Jalpur, Rajasthan a written agreeme:rt,tothis effect. Receipt or acknowledgement of any partner subsequently accepted as above wilt bind allofthem and will be sufficient to discharge for any of the purposes of the contract.

2. OTHER GENERAT CONDITIONS

Remittance charges on payment made to the firms will be borne by the firms.

Direct or indirect canvassing on the part of Bidders or th€ir representative shall disquallfy their Bids.

The quantlty indicated in the catalogues are mere estimates and are intended to give an idea tothe Bidders, so as to enable them in decision to under-take the responsibilities of making supplieson most comoetitive rates to the Department keeping in view their manufacturing and supplyingcapacities. The figures indicated in the catalogue do not constitute any commitment on the part ofdepartment to purchase any of the articles in the quantities shown therein against each or in anyquantity whatsoever.

Appropriate category of Bidders as per prevalent/ existing rules at the time of opening of bid shallbe eligible for Price & purchase preference as per rules.

Any provision not included in this document shall be Eoverned by the relevant rules mentioned inthe Rajasthan Transparency in Public Procurement Rules 2013, RTpp Act, 2012 and GF&AR followedin Rajasthan and time to time amendment in respective rules.

Any objection against the quantity of the approved item indented i.e. being more or less comparedto the proportion of quantity mentioned in the Bid document, will not be entertained and shall notbe acceptable as a ground for non-supply.

The Purchase Committee will have the right of rejection of all or any of the quotations withoutgiving any reason for the same. The right to conclude parallel rate contracts with another firm forthe stores detailed in this catalogue is also reserved by the Director, Department of AnimalHusbandry Rajasthan, Jaipur, Rajasthan.

The Director, Department of Animal Husbandry, Rajasthan, Jaipur, Rajasthan can extend theoriginal rate contract, subject to original Terms and Conditions for a period deemed fit by him, butnot exceeding three months, for which the Bidder will have to abide.

The contract for the supply can be repudiated at any time by the Director, Department of AnimalHusbandry, Rajasthan, Jaipur, Rajasthan if the supplies are not made to his satisfaction after givingan opportunity to the Bidder of being heard and after reasons for repudiation being recorded byhim in writing.

Extra stipulation or any other condition contrary to the above Bid conditions are not acceptable and

shall render the Bid liable to rejection.

Specific narration of quality, specifications & classification etc. should be written in covering ietterPart 1(Technical Bid) except rates if the Bidder so desires.

Bidders must make their own arrangements to obtain import license, if necessary.

lf a Eidder irnposes conditions which are in addition to or in conflict with the conditions mentioned

herein, his Bid is liable for rejection summarily

The Director, Department of Animal Husbandry, Raiasthan, Jaipur, Rajasthan reserves the right to

accept any Bid not necessarily the lowest, reject any Bid without assigning any reasons, accept Bid

for all or anyone or more of the articles for which Bidder has submitted quotation or distribute

order for items of stores to more than one firm.

The Bidder shall furnish the following documents at the time of execution of agreement

> Attested copy of Partnership Deed in case of Partnership Firms

> Registration number and year of re8istration in case partnership firm is registered with

registrar of firms.

Address of residence and office telephone numbers in case of sole Proprietorship

Registration issued by Registrar of companies in case of company.

Original document for verification.

3. APPROVAT OF FIRMS & SUPPLIES THEREOF

To ensure continued supply without any interruption, the Bid inviting authority reserves the right to

fix more than one firm to supply the requirement among the qualified Eidders. Orders will be placed

periodically based on the stock positions of stores and supplying capacity of firms.

To the extent possible, no negotiations shall be conducted after the pre-bid stage. NeSotiations may,

however, be undertaken only with the lowest or most advanta8eous bidder under the followingcircumstances-

(a) when ring prices have been quoted by the bidders for the subject matter of procurement; or

(b) when the rates quoted vary considerably and considered much hiSher than the prevailing market

rates.

The Bidders, who are declared as L-1 Suppliers for any number of items quoted in the Bid, shall be

required to execute necessary agreements and Performance security within 15 days from the date of

Lol/LA as specified in the Bid terms, for the supply of the lnstruments for which their offered /negotiated rates have been declared as L-1. Execution of the agreement and depo.sition of therequired Performance security shall entitle tlie approved L-1 lupplier the priority for receiving andexecuting the purchase orders placed by Director. Department of Animal Husbandry, Rajasthan,Jaipur, Rajasthan.

deviding Quantities among more than one bidder at the time of award according to Rule 74 of RTPPRules,2013.

FATL CTAUSE

The price charged for the Store supplies under the contract by successful Bidder shall in no eventexceed the lowest price at which the successful Bidder sells the stores of identical description to any

other persons during the period of the contract.

lf any time, during the period of the contract, the Bidder reduces the sales price chargeable under the

contract, he shall forth with notify such reduction of sale price to the Director, Department ot Animal

supplied after the date of comlng into force of such reduction or sale shall stand correspondinglyreduced. - -

Articles rejected by the purchasint officer or by his authorized person will have to be replaced by theBidder at his own cost within the period specified. lf however, due to exigencies of government worksuch replacement either in whole or in part is not considered feasible, the Director, Department ofAnimal Husbandry, Rajasthan, Jaipur, Rajasthan after giving opportunity to the Bidder oI being heard,shall for recorded reasons, be free to recover / deduct a suitable amount corresponding to the cost ofrejected supplies including any other losses from the payments or any other dues to be made to thesupplier. His decision in this matter will be final. The defaulting supplier is liable to indemnifyDIRECTOR, DEPARTMENT OF ANIMAL HUSBANDRY, RAJASTHAN, JAIPUR, without any protest ordemur, for any losses to him on this account.

Legal proceedinE if any arislng out of the Bid shall have to be lodted in courts situated in Jaipur Cityonly.

The purchase Committee can relax any of the terms and conditions of the Bid. ln case of urgency theTerms & Conditions will be relaxed by the DIRECTOR, DEPARTMENT OF ANIMAI HUSBANDRY,RNASTHAN, JAIPUR, subject to subsequent confirmation by the Store Purchase Committee inaccordance with RTPP Act, 2012 & RTPP Rules, 2013.

5. INSURANCE

The goods will be delivered FOR at Office store in perfect condition. The supplier, if he so desires, may

insure the valuable goods against loss by theft, destruction or damage by fire, flood, exposure to weather

or otherwise viz ( war rebellion, riot etc). The insurance charges will be borne by the supplier and the

state department will not be liable to pay o. reimburse any such charSes incurred by the supplier.

6. PAYMENTS

Advance payment will not be made.

Unless otherwise agreed between the parties, payment for the delivery of the stores will be made on

submission of bill/s ln proper form by the Bidder to the Purchase Officer in accordance with theprocedure laid down.

iii.. All remittance Eharges will be borne by the Bidder.

iv. Payment of those goods which need testing shall be made only when such tests have been ca rried outand test results received conforming to the prescribed specification.

7. RECOVERIES

Recoveries of liquidated damages, short supply, breakage, rejected articles shall ordinarily be made from

bills. Amount may also be withheld to the extent of short supply, breakage, rejected articles and in case

of failure in satisfactory replacement by the supplier aiong with amount of liquidated damages shall be

recovered from his dues and Performance security available with the department. ln case recovery is not

possible recourse will be taken under Rajasthan PDR Act or any other law in force.

9. Filling an appeal

lf any Bidder is aggrieved that, any decisicn of the Procuring Entity is in cont:'avention to the provision of

the Act or the Rules or the Guidelines issued there under, he may file an appeal to the first or secondAppellate Authority, within a period of ten days from the date of such decision, clearly giving the specificground on which he feels aggrieved.

Fee for first appeal shall be Rs. 2500 and for second appeal shall be Rs 10,000

10. Validity of BidsBids shall be vatid for a Period of 90 days from the date of opening of technical bid.

11. All the Provisions of RTPP Act 2012 and RTPP Rules 2013 will be applicable in this bid .

2. Submission of Financlal Bid

The Bid form duly filled as per BOQ (Financial bid) giving the rates for various items in individual should be

uploaded separately as Part - ll here after called. "Financial Bid".

1. Bid cost, Processing Fees and Bid Security by way of DD/Banker page (30) must be submittedseparately prior to the date of opening of the Bid.

2. lsl marked items would be preferred and non lsl items will be considered only when lsl category isnot available in the participating Bid.

3. BID SECURITY

i. The Bid Security shall be 2% ol the estimated value of each item as given in the 5'h column ofcatalogue (page 29) for each item of drug quoted. ln lieu of the Bid Security, a Bid-SecuritYdeclaration shall be taken from UnCertakings and Corporations Autonomous bodies, registeredsocieties, co-operating societies whach are owned or controlled or managed by of Gol & GoR. raw material needed. Any of the above points if taken, as argument for non supply/ late supply willnot be entertained.

4- RATES

Rates and necessary particulars should incorporate net rates only. Separate free toods or cash discounts

should not be offered. Rate must be valid for the entire period of the Bid and must be offered conforming

to the following:-

i. Rates must be offtred net only a8ainst the specified packing of the items. The net rate must be

,( inclusive of all charges by way of packing, forwarding, incidental or transit charges including transitinsurance and any other levies or duties etc. Chargeable on the product. lf rates are quoted giving

any free goods quantity or cash discounts the same shall not be considered.

ii. Only SGST/CGST/IGST charges and surcharge if applicablewill be payable over net rate.

iii. Excise duty or surcharge prevailing on the date of submission of the rate must be included in the net

rate and should also be shown separately in the Financial Bid (BOa). ln the event of any subsequent

variation (increase or decrease) in these char8es by the government (state or central) the same will

stand modified accordingly.

iv. Other statutory increase or decrease shall be agreed upon mutually between Director, Department

of Animal Husbandry, Rajasthan, laipur, and Bidder and revised rates shall be applicable on order

received by the contractor on or subsequent to the date of such increase / decrease in government

d uty.

v. The rates should be confined as far as possible to the packing units mentioned in the catalo8ue and

different rate for different packing should be avoided. Further only total price should be offered

against specified item. ln no case the rate should be split up showing the cost of any on the

component pans of the specified item. lf split price are found, the item may be treated as rejected.

vi. The rates must be written both in words and figures.

Comparison of rates of firms outside and those in Ralasthan shall be made as per existlng rules at thetime of opening of financial Bid.

GUARANTEE/ WARRANTY CTAUSET

The Bidder shall give guarantee that the goods/ stores/ articles would continue to conform to thedescription and quality as specified i.e. up to the date of expiry or at least for next 3 year from the date of

delivery, for items having no expiry date and that notwithstanding the fact that the purchaser may have

inspected and / or approved the said goods/ stores / articles.lf during the specified period the said goods/

stores/ articles are discovered not to conform to the description and quality as said for/ or have

determined, and the decision of the purchase officer in that behalf will be final and conclusive.The

purchaser will be entitled to reject the said goods/ stores / articles or such portion there of as may bediscovered not to conform to the said description and quality. On such re.iection the said goods/ stores /articles will be at the sellers risk and all the provisions relating to reje.tion of goods, etc., shall apply. The

gidder shall, if so called upon to do so, replace the goods etc. Or such portion there of as is rejected by

the Purchase Officer, otherwise, the Bidder shall pay such damage as may arise by reason of such breach

of the condition here in contained. Nothing here in contained shall prejudice any other right of thePurchase Officer in that behalf under this contract or otherwise.

ln case, any item supplled by the approved firm does not conform to the required standard the paymentthereof, if received by the supplier shall have to be refunded to the indentint officer/ Director,Department of Animal Husbandry Rajasthan, Jaipur, Raiasthan. Apart from this such supplier shall beliable to be dealt with under provisions of relevant Act. The supplier will not have any rightful claim tothe payment of cost for substandard supplies which are consumed either in part or whole. rt may benoted that supply ofgoods less in welght and volume than those mentioned on the labelofthe containeris an offence and the same will be dealt in accordance with the existing law and in such case even thecontract is liable to be cancelled.

The names & specifications of articles ! rhich are offered should be mentioned against each item of thecatalogue. Mere indication of English/ USA,,/ lndian will not serve the purpose.

ln the case of supply of imported item the suppliers shall furnish a certificate along with the bill to effectthat the firm has completed all the formalities in connection with the import.

DETIVERY OF GOODS

Delivery of goods shall be Siven F.O.R at the Orfice Store of the Addhional Director, Regional VeterinaryBiological unit (8P [ab), Jaipur. The department will pay no cartage or transportation orloadin&/unloading charge for the purpose.

PERFORMAI{CE SECURITY

All firms whose offers are accepted will have to deposit a performance security equalto 5% (five percent)of the total value of approximate quantity as per Bid catarogue (1% in case of MSME of Raiasthan). TheBid security of successful Bidder will be adiusted toward Performance security and balance will be given inone of the following forms only.

a. cash through E-GRAss deposlted under head "9443- civil Deposits-lo3 - performance securitys, (Kha)Deposits not bearing interest.

b. Bank Draft or Banker cheque of a scheduled bank in favour of Director, bepanment of Animal.Husbandry Rajasthan,.,aipur.

c. National saving certificates and any other script/ instrument under Nationar saving schemes forpromotion of small savings issued by a post office in Ra.iasthan, ifthe same can be pledged under therelevant rules. They shall be acceited at their surrender value at the time of Bid and formallytransferred in the name of procuring entity at the time of submission of Agreement.

d. Unconditional Bank guarantee/s ofa scheduled bank.e. FDR of scheduled bank which should be in the name of procuring entity on account of bidder and

discharged by the bidder in advance. rn this regard the provisions of rure 75(4) of RTpp Rures, 2013 wibe applicable.

ln case of breach of any terms and conditions of the contract or on unsatisfactory performanc€, theamount of Performance security shall be liable for forfeiture in full or part by DIRECTOR, DEPARTMENT OFANIMAL HUSBANDRY, RAJASTHAN, JAIPUR, RAJASTHAN shall be finat. tf a Bidder faits to deposit thesecurity or to execute the agreement within the period specified, it will be treated as a breach of theterms and conditions of Bid and will result in forfeiture of Bid Security besides any other action for thisdefault with respect to RTPP Act,2012 & RTpp Rules, 2013.

The expenses of completinS and stamping the agreement shall be paid by the Bidder who shall furnish to

the DIRECTOR, DEPARTMENT OF ANIMAL HUSBANDRY, RAJASTHAN, JAtpUR, RAJASTHAN one executedstamped counter part of the agreement free of charge.

NOTE;-Undertakings, Corporations, autonomous bodies, registered societies, co-operative socjeties which

are owned, controlled or Managed by GOI/GOR, need not to furnish amount of performance

security.They would be required to submit a declaration in lieu of performance security.

Firms registered with the Director of lndustries, Rajasthan, Jaipur as MSME unit shall furnish the amount

of Performance security @1% of the estimated cost of the items quoted in the Bid.

It is to be noted that earlier years Bid Security/Performance security, even if lying in this department, shall

not be considered towards this contract and therefore Bid Security /Performance security should be

furnished afresh.

12-lnspection o, Premises

The Director, Department of Animal Husbandry, Rajasthan, .laipur, Rajasthan or his authorizedrepresentative (s) has the right to inspect the factories / premises of those companies who have quotedfor the Bid, before accepting the rate quoted by them or before releasing any order (s) or at any point of

time during the continuance of the Bid.

13. Director, Department of Animal Husbandry, Rajasthan, Jaipur, Rajasthan has the right to re.iect the Bid or

terminate / cancel the orders issued or not to re-order, based on the facts brought out during suchinspections.

14. Director, Department of Animal Husbandry, Rajasthan, laipur, Rajasthan reserves the ght to cancel bid /bid proccedings and reject all bids without assigning any reason .

15. SUPPTY ORDERS

days from date of Registered post /or E-mailing of the supply order. Liquidated damages will be

lf the supplier, on receipt of the purchase orders deems that the purchase orders exceed hissupplying capacity declared in the Bid documents and the delay would occur in executing the order,

The Bidder / approved supplier shall not assign or sublet his contract or any part thereof to any otheraSency.

Every product supplied should be of good quality conforming to the specifications approved. suppliesofgoods less in weight and volume than those mentioned on the label ofthe container / packing is anoffence and shall be dealt with under the provisions of the relevant Act & other existing law.

Products that do not meet quality requirements shal riable tb be re.iected- Any complaintcommunicated to the supplier regarding the quality of the product supplied shall have to be attendedby the supplying firm within a period of 15 days from the receipt of the letter. lf the products do not conform to statutory standards, the entire stock will have to be taken back bythe Bidder within a period of 15 days from the receipt of th'e letter/ relevant communication, at theexpense of the Bidder / approved supplier and shall be liable for relevant action under the existinglaws ln such cases the defaurting supprier is riabre to indemnify Director, Department of AnimarHusbandry, Rajasthan, Jaipur, without any protest or demur, for any losses borne by him.

ln the event of non-suppry or short suppry for varid reason / hindrances beyond the contror, theBidder (supplier to whom order has been placed) shall have to apprise the Additional Director,Retional veterinary Biorogrcar unit (8 p Lab), Jaipur, Raiasthan about the same in writing, at-reast 15days prior to the expiry of the stipulated supply period and seek permission for extension of supplyperiod. Director, Department of Animal Husbandry, Raiasthan, .laipur, Ralasthan shall have thediscretion to permit ext€nsion in the stipurated period of suppries wrth or without LiquidatedDamates.

ln the event of failure of suppries or short suppries within the permissibre suppry period, and dueapproval of extension in the supply period has not been sought, the relcvant supply order shallautomatically stand cancelled up to the extent of non_supply or short supply. LIQUIDATED DAMA-GES.

The time specified for delivery in the Bid form shall be deemed to be the essence of the contract and

the successful Bidder shall arrange supplies within the stipulated period on receipt of the supply order

from the Purchase Officer.

ln case of extension in the delivery period with liquidated damages, the recovery shall be made on the

basis of following percentage of value of Stores pending to be supplied -

) Delay up to % period of the prescribed Delivery period-2.5%

) Delay exceeding 16 but not exceeding % of the prescribed delivery period - 5%

F Delay exceeding % but not exceeding % of the prescribed delivery period -7.5/o

> Delay exceeding % but is not exceeding the period equal to the prescribed delivery period - 10%

Note :- Fraction of a day in reckoning period of delay in supplies shall be eliminated if it is less thanhalf a day.

The maximum amount of liquidated damages shall be. 10%. Delay in supplies exceeding the period

equal to the prescribed delivery period shall render the supply order cancelled and any supplies

made beyond this period shall be the sole risk of the approved supplier. DIRECTOR, DEPARTMENT

oF ANTMAL HUSBANDRY, RAJASTHAN, JAIPUR, RAJASTHAN shall not be liable for any payments

whatsoever on this account.

QUALITY ASSURANCE

All supplies of vaccine bottles delivered to the Office Stores shall essentially be accompanied with Q.C

OK Report

The decision of DIRECTOR, DEPARTMENT OF ANIMAL HUSBANDRY, RAJASTHAN, JAIPUR, RAJASTHAN

as regards ascertaining the quality of the stores shall be final and binding upon the Bidder.

The Bidder shall be responsible for proper packing and delivery of the material to the consignee. Any

loss, damage or breakage, shortage observed on receipt of supplies and reported by the in-charge of

the effice Store will be the responsibility of thii supplier who shall be required.to make good the loss

within 15 days from the date of information sent by the ln-charge of the Office Store. No extra cost

on such account shall be admissible. Failure to make good the above losses shall be liable for

deduction of the corresponding amount from bills which shall be final and binding.
