WHEREAS, it is in the interest of the State and Society that college and uni ersity education, in both !ublic and !ri ate institutions, !ro ide facilities therein for acade"ic de elo!"ent as #ellas conditions for intelligent social !artici!ation$

WHEREAS, it is necessary for the attain"ent of this ob%ecti e, that ra!!ort be !ro"oted bet#eenschool authorities and students, by establishing student rights and defining studentres!onsibilities$

&'W, (HEREF'RE, ), FER*)&A&* E+ AR-'S, President of the Phili!!ines, by irtue of the !o#ers ested in "e by la#, do hereby !ro"ulgate the follo#ing anual of Student Rightsand Res!onsibilities+

SE-()'& 1+ Ad"ission+ . E ery !erson enrolling in a !ost/secondary acade"ic or ocationalcourse in a college or uni ersity authori0ed or recogni0ed by the go ern"ent shall en%oy thefollo#ing rights

a2 (he right to ad"ission to any such college or uni ersity u!on "eeting its s!ecific acade"icre3uire"ents and reasonable regulations ado!ted by the institution concerned #ith the a!!ro alof the *e!art"ent of Education authorities$

b2 (he right to be infor"ed, before ad"ission, of all school !olicies, rules and regulationsgo erning acade"ic duties, co/curricular and e4tra/curricular acti ities, disci!line and s!ecificassess"ents for tuition and other fees+

SE-()'& + *eclaration of Rights+ . E ery student enrolled in a college or uni ersityauthori0ed or recogni0ed by the go ern"ent shall en%oy the follo#ing rights

a2 (he right to due !rocess, #hich shall include the right to be infor"ed in #riting and to beheard and to defend hi"self before a body created by the school ad"inistration, at least one"e"ber of #hich should be designated by the duly constituted student go ern"ent, of any

charge that "ay lead to his sus!ension, e4!ulsion or si"ilar disci!linary action !ursuant toschool rules and regulations$

b2 (he right to be heard on and to !ro!ose school !olicies$

c2 (he right to organi0e a free student go ern"ent that can ad"inister, legislate and ad%udicate#ithin its a!!ro ed constitutional %urisdiction$

d2 (he right to !artici!ate through his student go ern"ent in setting u! student acti ity fees andother student acti ity funds and in the disburse"ent thereof$

e2 (he right to organi0e #ithin the ca"!us, under la#, and to see recognition for suchorgani0ation by filing #ith the !ro!er school authority a #ritten state"ent of !ur!ose anddescri!tion of organi0ational structure and !rocedures and a s!ecified "ini"u" "e"bershi!3ualifications and listings$ Pro ided, ho#e er, (hat such recognition "ay be re o ed u!on !roof of iolation of its o#n state"ent of !ur!oses and !rocedures or of the rules and regulations of the

institution$

f2 (he right to a ail and use of ca"!us facilities as "e"bers of authori0ed student organi0ations,sub%ect to unifor" regulations as "ay be re3uired for the coordinated use of school roo"s andconference halls or field s!aces Pro ided, (hat the facilities shall be used for the !ur!osescontracted and for no other !ur!ose$

g2 (he right to use the na"e of the institution as a student or "e"ber of authori0ed ca"!usorgani0ations, sub%ect to unifor" !rescribed rules #ith res!ect to off/ca"!us acti ities$

h2 (he right to hear lecturers or s!ea ers chosen u!on the reco""endation of the recogni0ed

student organi0ations$

i2 (he right to !ublish and issue #ithin the bounds of la#, good "orals and school regulationsand ob%ecti es, regular student/controlled !ublications free fro" censorshi! or any !ressureai"ed at controlling editorial !olicy or staff a!!oint"ents Pro ided, (hat the !ublicatione4!enses shall be !aid out fro" student funds$

%2 (he right to free research in connection #ith acade"ic #or , and the !ublication, discussionand e4change of his findings and reco""endations, sub%ect to e4isting la#s and regulations$

2 (he right to co"!etent instruction and ade3uate #elfare ser ices and curricular facilities

co""ensurate to the ca!acity of the school$

l2 (he right to e4ercise his rights as a citi0en in any off/ca"!us acti ity #ithout i"!airing hisstanding in the institution Pro ided, (hat he does not clai" to re!resent that institution+

SE-()'& 7+ *eclaration of Res!onsibilities+ . E ery student enrolled in a college or uni ersityauthori0ed and recogni0ed by the go ern"ent shall bear the follo#ing res!onsibilities

a2 (he res!onsibility to recogni0e and co"!ly #ith the !olicies and regulations concerning hisschool duties, ca"!us acti ities and disci!line #ithin the school$

b2 (he res!onsibility to u!hold the acade"ic integrity of his institution$

c2 (he res!onsibility to de ote hi"self to the increase of his no#ledge and understanding of the#orld around hi" in !re!aration for the total fulfill"ent of his duties to hi"self as a hu"an being and to society$

d2 (he res!onsibility to use the a!!ro!riate channels #ithin the educational co""unity for thee4ercise of his rights or to secure redress fro" grie ances$

e2 (he res!onsibility to fulfill the duties i"!osed u!on hi" by his legally constituted studentgo ern"ent or other legally constituted student officers or organi0ations to #hich he hasoluntarily affiliated$

f2 (he res!onsibility to su!!ort and coo!erate #ith the legiti"ate !ro%ects and acti ities of hisstudent go ern"ent #ithin the fra"e#or of de"ocratic action$

g2 (he res!onsibility to defend and u!hold the integrity of recogni0ed student organi0ations inaccor #ith their a o#ed !ur!oses, organi0ational structure, !rocedures, "e"bershi!3ualifications, and listings$

h2 (he res!onsibility, #hen acting as an official re!resentati e of the college or uni ersity, toabide by the #ritten instructions of the co"!etent school authorities$

i2 (he res!onsibility, #hen using the na"e of a duly authori0ed school organi0ation or of his

school, #ithout being an official re!resentati e, to conduct hi"self #ith dignity and de!ort"ent$

%2 (he res!onsibility, in his !ublications, to abide by the la#s of the land, school regulations andthe ethics of %ournalis"$

2 (he res!onsibility to allo# and !rotect the e4!ression of di ergent !oints of ie# in all !ublic"eetings, se"inars or conferences, and !ublications, in accord #ith the highest traditions of theacade"ic co""unity$

l2 (he res!onsibility to res!ect the rights of his fello# students, the faculty and the schoolad"inistration+

SE-()'& 8+ Recognition of Student 'rgani0ations a Prere3uisite in the rant of -a"!usFacilities and Financial Su!!ort+ . 'nly student organi0ations recogni0ed officially by theuni ersity or college ad"inistration shall be entitled to the grant of ca"!us facilities andfinancial su!!ort as "ay be authori0ed or gi en by said ad"inistration+

SE-()'& 5+ :i"itation )"!osed by Recognition+ . Recognition "ay !ro!erly li"it the "anner in #hich organi0ations or !ublications "ay use the na"e of the college or uni ersity off/ca"!us+

)t "ay also !ro!erly li"it the "anner in #hich the organi0ations "ay e"!loy uni ersity financesor facilities in ta ing action affecting "atters off/ca"!us Pro ided, (hat no disci!linary action"ay !ro!erly be ta en against a student, or his organi0ation or !ublication for acti ities off/ca"!us in the e4ercise of the rights of citi0enshi!, !ro ided that they do not !ur!ort to re!resentor in ol e the institution #ithout its consent+

SE-()'& 6+ Rules and Regulations+ . (he Secretary of Education shall issue the a!!ro!riaterules and regulations including such sanctions as "ay be necessary to i"!le"ent the !ro isionsof this 'rder+

SE-()'& ;+ (his 'rder shall ta e effect i""ediately+
