FOREWORD
On the occasion to release the performance evaluation results for all publicagencies in April last year, I made reference to the great lengths countriesare going, to create global competitiveness for their economies, in the faceof rapidly decreasing resources. I also made reference to a number of professional and moral rituals that our governance system was beingsubjected to, to enable the country to find its rightful niche in the globaleconomic race.
Many of these precepts subsequently found their way into the newConstitution, and are therefore well on the way to full implementation.Chapters 4, 6, 11, 12 and 13 of the new Constitution are particularlypertinent in this regard.
Cognizant of the need to sustain the momentum of performanceimprovement, and the significance of the Constitutional provisions, myoffice has moved swiftly to consolidate the gains realized since the reformagenda in general was conceived in 1993, and the inception of performance contracting in particular, in 2004, in order to fully buttress theperformance improvement momentum. A number of significant milestoneshave been attained in this regard. These include the following:
1. Incorporation, early in 2005, of the Customer Service DeliveryCharter in the performance contracts for all service oriented andregulatory public agencies;
2. Rolling out of Customer Service Delivery Charters to 16institutions which interface directly with the grass root Mwananchi.The roll-out of Charters is in the process of being expanded tocover other ‘front-office’ agencies of the Government;
3. Piloting of the “ e-service delivery” project with the Ministry of Immigration and Registration of Persons to fast-track processing of national Identity Cards and Passports. This is a tripartite programto track processing of the two documents, including possiblequeries and complaints during the process. The tripartite axiscomprises the public (customer), Government agency, and thePerformance Contracting Department, to which communication
between the two is looped, to facilitate tracking of customersatisfaction. The “ e-service delivery” project will be extended toother service institutions as they finalize their back-officeautomation;

4. Stakeholder engagement to partner in tracking implementation of the service charters. My office has initiated programs to involvecivil society in this regard;
5. Partnering with the Public Complaints Standing Committee to track public complaints using the Service Charter as the service deliverystandards benchmark;
6. Movement from haphazard identification of performance indicatorsand setting of targets to the development of a clear set of SectorPerformance Standards, based on international best practices;
7. Carried out a nation-wide customer satisfaction survey early thisyear, which indicated a Customer Satisfaction Index of 63.5%,which compares favorably with those of New Zealand (68% in2007) and Canada (67% in 2005) which also used the CommonMeasurement Tool (CMT) to carry out the survey;
8. Movement from a manual version of target setting, vetting andevaluation to an automated platform, which was applied for thefirst time this year, resulting in enormous savings in time andfunds, in addition to improving accuracy and efficiency;
9. The process of negotiating performance contracts has alsowitnessed a revolution, up from a situation where ad hoc Task Force Members would handle individual institutions, to the currentpractice of joint negotiation by sectors, which has assisted ineliciting and drawing on collective synergies to achieve the nowcommonly shared Vision 2030;
10. Further, the Performance Contracting Department in my office haslaunched an ambitious program to train and cascade thePerformance Management system, including the Service DeliveryCharters, to all the districts in the country. The program is a jointventure between the Government of Kenya on the one hand, andthe UNDP and other development partners who contribute tobasket funds, on the other. Under the program, a total of 8,200Provincial and District Departmental Heads, ConstituencyDevelopment Funds officials and Civil Society were trainedbetween 1st November 2010 and 2nd March, 2011;
11. In addition, my office, through the Performance Contracting
Department, Ministry of Finance and Ministry of Planning,National Development and Vision 2030, is preparing to roll out“Target Sector Hearings” in order to secure public participationand ownership in the process of target setting, and to create a clear

linkage between the processes of planning, budgeting and results.This is an initiative where Permanent Secretaries will be requiredto subject their performance indicators and targets to publicscrutiny before securing exchequer finance and signingperformance contracts.
These are the elements that create the pedestal for the mandate of myoffice, particularly the element of supervising the performance of publicinstitutions. They also constitute the launch pad for the achievement of Vision 2030. But even as we celebrate the results of the 7th Cycleperformance contracts, I am concerned that a number of key publicinstitutions have not found the need to join the larger fraternity of publicinstitutions in embracing performance contracts. The National Bank of Kenya and the Development Bank of Kenya are institutions in point. As Ihave said in the past, implementation of performance contracts is notselective policy which excepts some public agencies. Supervision of theperformance of public institutions by my office, revolves around theperformance contracting system; this system is not optional. The wholecountry will henceforth be expecting to see all public offices andinstitutions, including the Central Bank of Kenya, signing performancecontracts.
There are a number of offices and groups I wish to acknowledge for thesuccesses my office has realized so far, in the propagation and
implementation of performance contracting.My gratitude goes first to His Excellency the President for remainingsteadfast in his support of the performance contracting process. ThePermanent Secretary/ Secretary to the Cabinet and Head of the PublicService and my Permanent Secretary, for ensuring sustained impetus in thegrowth of the system, which now covers 470 public agencies.
Accolades are due too, to our Permanent Secretaries, Chairmen and Chief Executives of State Corporations, Chairmen, Mayors and Clerks of LocalAuthorities, Chancellors, Vice Chancellors and Chairmen of Councils of our Public Universities, Chairmen and Principals of Tertiary Institutions,
and indeed all public officers, for the sustained enthusiasm with whichthey have embraced the system.

PREFACE
Evaluation of the performance of all public institutions on performancecontract for the 2009/10 Financial Year (excepting institutions whosefinancial year is the calendar year) was completed in October 2010.
Over a relatively short period of time, the evaluation process andmethodology have gone through radical evolution. First, early in 2010, asmall team of IT experts from the Office of the Prime Minister, thePerformance Contracting Department, the Directorate of e-Governmentand the Ministry of Local Government set out to automate the processes of target setting, negotiation and vetting of performance contracts, and theevaluation methodology.
The team succeeded in automating the inputting and substitution processesin target setting, negotiation and vetting of performance contracts but,more significantly, was able to break down a hitherto complexmeasurement formula to an automated platform. The team proceeded tocapture performance contract matrices of all public institutions, includingthe indicators and targets, in the platform. All that public institutions arerequired to do then is to fill in the “achievement” column in these matricesand obtain the composite score at the touch of a button. As a result, outsidethe moderation period at which evidence of achievement is examined, theentire performance evaluation process for all public institutions for the2009/10 FY took three weeks, a far cry from the over four months that itused to take before automation. The extended benefit of the automationwas the dramatic reduction of ad hoc Evaluation Task Force membersfrom over 100 to only 18!
Secondly, the evaluation formula has been improved to make it possible tocompute the criteria range and to eliminate repeated use of disparate“upper/lower” criteria value and disparate spans. This has made theformula even more user friendly. The process of automation is continuousand the next frontier is:
1. Making the process fully web-based to minimize the need for lengthyinter-personal interventions, thereby saving valuable managementtime;
2. Rolling out software for real-time monitoring of performance andproject implementation;
3. Improvement of the performance contracting system as a whole is adynamic process which continuously incorporates new value-addingconcepts and global developments in performance management.
I wish to take the opportunity to thank all those who make it possible tosustain the process. First and foremost my gratitude goes to His Excellency

EXECUTIVE SUMMARY
The policy decision to introduce Performance Contracts in themanagement of the Public Service was conveyed in the EconomicRecovery Strategy for Wealth and Employment Creation (ERS), (2003-2007).
The process began in October 2004 when 16 pilot State Corporationssigned and implemented Performance Contracts. In the Financial Year,2008/2009, a total of 425 Agencies (43 Ministries/Departments, 139 StateCorporations, 175 Local Authorities and 68 Tertiary Institutions) signedand implemented Performance Contracts. Two (2) Ministries/Departmentsdid not sign Performance Contracts during the year under review. TheFinancial Year 2009/2010 is the sixth year of full scale implementation of Performance Contracts in the Public Service by all Government
Ministries/Departments, State Corporations, Local Authorities and TertiaryInstitutions.
For the Financial Year 2009/2010, the process of evaluation andmoderation was made much easier through automation. With support fromofficers from e-Government, the Performance Contracting Department wasable to develop a Performance Contracting Management and TrackingSystem, hereinafter referred to as The System. The Agencies were able toundertake self evaluation and were moderated by members of the Ad-HocEvaluation team.
In the Financial Year 2009/2010, none of the Ministries/Departments,State Corporations, Local Authorities and Tertiary Institutions achievedthe “ Excellent” 1 grade.
For the Ministries/Departments, 31, representing 68.9 per cent, attained the“Very Good ”2 grade while 14, representing 31.1 per cent, achieved the“Good” 3 grade. None of the Ministries/Departments attained the “ Fair ”4or the “ Poor ”5 grades.
Out of 162 State Corporations that were evaluated, 105, representing 64.8per cent, achieved the “ Very Good ” grade and 52, representing 32.1 percent, achieved the “ Good ” grade. One (1) State Corporation, representingone 0.6 per cent, achieved “ Fair ” grade and four (4) representing 2.5 percent, attained “ Poor ” grade.

Out of the 175 Local Authorities that were evaluated, none was in the“Excellent” grade. Twenty one (21), representing 12 per cent, achievedthe “ Very Good ” grade. A total of 128 Local Authorities, representing73.1 per cent, achieved the “ Good ” grade. Five (5) Local Authorities,representing 2.9 per cent, and 21 Local Authorities, representing 21 percent, achieved the “Fair” and “ Poor ” grades respectively.
Out of the 61 Tertiary Institutions, 24, representing 39.3 per cent, achieved“Very Good ” grade, Thirty six (36), representing 59.1 per cent, achieved“Good ” grade. None of the Tertiary Institutions achieved the “ Fai r” whileone (1) representing 1.6 per cent achieved the “ Poor ” grade.
Over the last six years of the implementation of Performance Contracts byPublic Agencies, there is sufficient evidence to conclude that the Agencieshave embraced the Performance Contracting Strategy as shown by
improved performance. Further, the implementation of the strategy hasalso enhanced service delivery. From the results, it is clear that sustainedapplication of the Performance Contracting Strategy is a necessary pre-requisite for streamlining the management and operations of the PublicService so as to work better more efficiently. However, for the Strategy tobe fully integrated and become effective, it is imperative that it isextended to all institutions within the three arms of Government andcascaded to all levels.

4. On 15th January, 2004, the Government, vide Cabinet Memo No.CAB(03)115, directed that all Permanent Secretaries/AccountingOfficers of Ministries/Departments and Chief Executive Officers of State Corporations be placed on Performance Contracts by June2004.
5. To roll out the strategy, the Government established the PerformanceContracts Steering Committee (PCSC) in August 2003. TheCommittee was gazetted on 8th April, 2005. The PCSC is responsiblefor the overall administration and coordination of PerformanceContracts in the public service. In the process of implementingperformance contracts, the Committee is assisted by an Ad-HocNegotiation/Evaluation Task Force comprising experts drawn fromoutside the public service. The Ad-Hoc Task Forces are responsiblefor negotiating Performance Contracts, evaluating and moderatingperformance of Ministries/Departments on behalf of the PermanentSecretary, Secretary to the Cabinet and Head of Public Service. TheAd-Hoc Evaluation Task Force also evaluates and moderates theperformance of State Corporations, Local Authorities and TertiaryInstitutions.
6. Performance Contracts were first introduced on 1st October, 2004 in16 largely commercial State Corporations. In 2005/2006, all the then35 Government Ministries/Departments, 116 State Corporations andfive pilot Local Authorities signed Performance Contracts and wereevaluated in September 2006. In 2006/2007, all the 38 GovernmentMinistries/Departments, 127 State Corporations and 175 LocalAuthorities signed Performance Contracts and were evaluated inOctober 2007. During 2007/2008 all the 38 GovernmentMinistries/Departments, 130 State Corporations and 175 LocalAuthorities signed Performance Contracts and were evaluated inOctober 2008. Evaluation of performance in respect of the FinancialYear 2008/2009 involved 45 Ministries/Departments, 139 StateCorporations, 175 Local Authorities and 68 Tertiary Institutions.During the FY 2009/2010, 45 Ministries/Departments, 156 StateCorporations, 175 Local Authorities and 61 Tertiary Institutionssigned Performance contracts and were evaluated.
7. With the introduction of Performance Contracting and TrackingManagement System, the process of evaluation and moderationinvolved two steps. The first step involved self evaluation by eachAgency using the Automated System. The second step involvedmoderation of the results of each Agency based on the concreteevidence availed by each Agency. The self evaluation and themoderation were conducted at the same venue for each category of the Ministries/ Departments, State Corporations and Tertiary

Institutions. For the local Authorities the Moderators met with theCouncils in five centres- Kisumu, Nakuru, Embu, Mombasa andNairobi.
8. This report is divided into six chapters. Chapter One covers theintroduction; Chapter Two contains the process of performancecontracting and evaluation; Chapter Three contains the performanceevaluation methodology; Chapter Four contains the performanceevaluation results of Ministries/Departments, State CorporationsLocal Authorities and Tertiary Institutions; Chapter Five contains thelessons learnt, and Chapter Six contains the observations,conclusions, recommendations and the way forward.

THE PROCESS OF PERFORMANCE CONTRACTING ANDEVALUATION
9. The Performance Contracting Department has continued to developtools and instruments for implementing Performance Contracts andevaluating performance which include: subsidiary legislations forState Corporations and Local Authorities; Model PerformanceContracts; Performance Contracts Matrices; Training Manuals andInformation Booklets; Guidelines for Drafting and ImplementingPerformance Contracts and Evaluation of Performance. Of particularsignificance, has been the Automation of the evaluation andmoderation process as an instrument for enhancing efficiency,harmony, accountability and saving on the time taken for evaluation
and moderation.10. With Automation of the evaluation and moderation process, the
number of the members of the Ad-Hoc Task Force was reducedconsiderably as well as the time taken for the self evaluation andmoderation. A total of 18 Ad-Hoc members were involved in theevaluation and moderation of all the Agencies. Six (6) officers frome-Government worked closely with five (5) officers from thePerformance Contracting Department to provide the Technicalexpertise on the automated system. With this set up the moderationof Ministries/ Departments took only three (3) days, that of StateCorporations took four (4) days, that of Tertiary Institutions took two(2) days and that of the 175 Local Authorities took only 9 days. This
definitely represents a huge saving on Time and Funds whileenhancing efficiency and effectiveness of the process. The processwas undertaken in accordance with the Sixth Cycle EvaluationGuidelines ( Annex I ).
11. For the purpose of continuous monitoring and reporting onperformance, Public Agencies are required to file quarterly andannual performance reports in prescribed formats. Performanceevaluation for each public agency is based on the signed PerformanceContract and the Annual Performance Report.

PERFORMANCE EVALUATION METHODOLOGY12. Evaluation of the performance of Public Agencies entails the rating of
actual achievements against performance targets negotiated andagreed upon at the beginning of the financial year. The resultantdifferences are resolved into raw scores, weighted scores andultimately denominated into Composite Scores. The performancerating of the institutions is based on the following attributes andcriteria:

Good - Achievement between 70% and 99.99% of the set targetFair - Achievement between 50% and 69.99% of the targetPoor - Achievement between 0% and 49.99% of the target
Performance rated as Excellent, Very Good, Good, Fair or Poor isaccordingly translated into a composite score as shown in Table 1.

for the period starting 1st July, 2009 and ending 30th June, 2010 andwere evaluated in September 2010.

15. A total of 162 State Corporations that were on Performance Contractswere evaluated. In addition, the following four (4) State Corporationsdid not sign Performance Contracts during the year under review.

Kenya National Assurance Company (2000) Ltd has now adopted thenormal Government Financial Year and its performance will beevaluated at the end of the FY 2011/12.

CHAPTER FIVE
LESSONS LEARNT22. The lessons learnt during the process of negotiation, evaluation and
moderation were categorized into three broad areas: guidelines and methodology; impact on the ground; and; process of negotiation and evaluation.
5.1 Guidelines and Methodology
23. Under the guidelines and methodology, a number of lessons havebeen learnt.
(a ) There is a visible mismatch between annual work planning of public agencies and performance contracting. Similardiscrepancies are visible between Annual Reports andPerformance Contract reports.
(b) The use of the Automated System enhanced the standardizationof reporting formats and should continue.
(c) A significant number of Agencies appear not to be very familiarwith the Guidelines of evaluation.
5.2 Impact on the Ground
24. With regard to impact on the ground, the following lessons have beenlearnt.
(a ) There has been visible improvement in the overall performanceof institutions and even individual officers, since PerformanceContracts were introduced. Additional capacity building shouldbe directed towards improving qualitative management practicessuch as Monitoring and Evaluation of programmes/projects,reporting of achievement as well as documentation of theevidence of achievement.
(b) The performance ranking and public recognition have beeninstrumental in motivating Public Agencies to pursueachievement of the agreed targets competitively and withcommitment. This has resulted in remarkable improvement inperformance, and positive impact on service delivery.
5.3 Process of Performance Contracts Negotiation and Evaluation
25. The following lessons have been learnt with respect to the processesof negotiation and evaluation.

(a ) The continued use of an external team of independentNegotiators, Evaluators and Moderators has ensured anindependent outcome.
(b) Regular monitoring of the implementation of the PerformanceContracts is a vital aspect for its success. Providing feedback onquarterly reports and taking corrective action, where necessary,are key ingredients for the attainment of a performance culture.
(c) Factoring in specific sector performance standards into thePerformance Contracting framework will enhance visibility andachievement of key results.

OBSERVATIONS, CONCLUSIONS, RECOMMENDATIONS ANDWAY FORWARD
6.1 Observations
26. The overall performance of Ministries/Departments has improvedwith 68.9 % in the “Very Good” category compared to 33% in thesame category in the FY 2008/2009. Similarly, the performance of State Corporations has improved significantly with 64.8% in the“Very Good” category compared to 45% in the same category inthe FY 2008/2009. It is note worthy that only 32.1% of the StateCorporations are in the “Good” category compared to 51% in thesame category in FY 2008/2009.
For Local Authorities, the number in the “Very Good” category hasdoubled from 6% in FY 2008/2009 to 12% in FY 2009/2010 whilethe number in the “Good” category has reduced from 84% in FY2008/2009 to 73.1% in FY 2009/2010. However, a few LocalAuthorities are still performing poorly such that the number in the“Poor” has increased from 6% in FY 2008/2009 to 12% in FY2009/2010.
For the Tertiary Institutions, the performance continues to improvewith 39.3% in the “Very Good” category up from 35% in FY2008/2009. It is also significant that only 1.6% of the TertiaryInstitutions are in the “Poor” category compared to 6% in the FY2008/2009.
6.2 Conclusions27. It is evident that as a result of introduction of the Performance
Contracts Strategy, there is greater efficiency, accountability, andimproved service delivery.
28. The Performance Contracting Department should monitor theimplementation of the Performance Contracting Strategy on acontinuous basis in order to identify gaps and plan to undertakecapacity development for the Public Agencies as necessary.
6.3 Recommendations
29. Based on the lessons learnt and an overview of the implementationof the Performance Contracts Strategy, the followingrecommendations are made.
(i) To ensure smooth implementation of the PerformanceContracts Strategy, particularly with regard to providingfeedback on quarterly, mid-year and annual reports, there is

an urgent need to strengthen the capacity of the PerformanceContracting Department.
(ii) To motivate growth and improvement, an award category forthe three (3) most-improved public agencies should beintroduced and maintained.
(iii) There is a need to institute visible sanctions as deemedappropriate for Public Agencies ranked in the “Poor” grade.
(iv) All Public Agencies should be evaluated not only on theirrecorded improvements, but also on their ability to attain andmaintain internationally recognized Sector PerformanceStandards. This would make it possible to compare theperformance of Public Agencies in Kenya with similaragencies within the region as well as in other developingcountries.
(v) A mid-term review should be undertaken for all PublicAgencies during the contract year in order to assess progresstowards achievement of the annual performance targets.
(vi) To ensure sustainability of the Performance ContractsStrategy as a management tool, it should be legislated andentrenched in the Laws of Kenya.
(vii) Each Public Agency should create and/or strengthen aPerformance Contract unit at a senior level directlyresponsible for the implementation of the Strategy.
(viii) There is a need to review the existing legal and institutionalframeworks that currently govern the operations of PublicAgencies to harmonize them with the requirements of thePerformance Contracts Strategy.
(ix) There is a need to assess the impact of the PerformanceContracting process at the grassroots level.
6.4 Way Forward
30. Performance Contracting should cover all Public Agencies in thethree arms of Government, without exception.
31. With the use of the Automated System of self evaluation andModeration, there is a need to enhance the capacity of members of
the Ad-hoc Task Force involved in the exercise.

There is room for furthering performance on any indicator whoseachievement is assigned a criteria value of 2.49. In this regard,achievement above 100% may be assigned higher criteria value inproportion to the “additional” performance.Very Good - Achievement of the set target in the performance

4. Computation of the Raw Score
Computation of the Raw Score entails determining the proportion of the span (as indicated above) which will go into the achievement units(or values) in order to determine wherein within the range, theachievement falls. It therefore presumes the criteria value range inwhich the specified achievement level falls is already known.
The Methodology for calculating raw score is dependent oncriteria value range in which achievement falls. It is more likemeasuring the distance which performance has “traveled” insidethe span of respective range. It is therefore not the same fordifferent criteria value ranges.
