RESPONSIBILITIES

TrafalgarTours Limitedand UniworldRiverCruises inc,referred to asthe Operators,undertake thefollowingduties:1.The Operatorsshall beresponsible to thepassenger forsupplying theservices andaccommodationsdescribed in thisbrochure,except

wheresuch servicescannotbe suppliedortheitinerary usedischangeddueto delaysorothercausesof whateverkindornaturebeyondthecontrol of theOperators.In such circumstances,the Operatorswill do theirbest to supply comparableservices, accommodationsand

itinerariesand thereshall beno refundin thisconnection.2.This brochurerepresentsthe entireagreement between thepassenger andthe abovementioned Operators.3.In theabsence of theirown negligence,neither theOperators northeir agentsor co-operatingorganisationsshall beresponsible for

any cancellationsor for acts of any otherservice providersconcerned, diversionsor substitution of equipmentof any act, variations,postponements,omission ordefault whatsoeverby aircarriers, landcarriers, hoteliersorhotels, transportation companies,or any otherpersonsproviding any of theservices andaccommodationsto passengersincludingany results thereof,such aschangesin services,

accommodationsorfacilitiesnecessitatedby same.Norshall they beliableforany lossordamageto baggageor property,orforinjury,illnessor death,or forany damagesor claimswhatsoeverarisingfrom loss,negligenceor delay from theact,error,omission default

ornegligenceof any person nottheirdirectemployeeor undertheirexclusivecontrol,includingany act,error,omission,default,ornegligenceof any country,governmentor governmental authority,officeror employee.All baggageand personal effectsare atall timesandin all circumstancesat therisk of thetour participant.Baggage insuranceis recommended.The carriers,accommodation andother

suppliersproviding servicesare independentcontractorsand arenot agents,employees, servantsor jointventureersof theoperators ortheiraffiliates.All certificatesand othertravel documentsforservicesissuedby theoperatorsare subjectto thetermsandconditions

specifiedby thecarriersand suppliersandto thelawsof the countriesin which theservicesaresupplied.Carriageby sea issubjecttotheCarrier's Conditionsof Carriage,which areexpressly incorporatedinto thiscontract,copies of which areavailableupon request.TheOperatorsare notresponsible forany criminal conductby thirdparties.

4.Wherethe passengeroccupiesa motorcoach seatfittedwith a safety belt,neitherthe Operatorsnortheiragentsor co-operatingorganisationsorservice providersconcernedwill beliable forany injury,illnessor death orfor any lossor damagesor claimswhatsoeverarisingfrom any accidentor incident,if thesafety beltis notbeing worn atthe timeof such accidentor incident.

5.Transportation companies,airlinesetc.arenot to beheldresponsibleforany act,omission oreventduringthetimepassengersarenot onboardplanes, transportation or conveyances.We rely on international conventionswhich may apply to the services provided

by us,our suppliersor agentswith respectto any claim of any naturebroughtby you againstus asa result of theprovision of thoseservices.International conventionsthat apply may include:Warsaw Convention 1929,(as amended by HagueProtocol andMontrealProtocol)in relation to airtravel,or Montreal Convention;theBerne Convention forrail travel;Athens Convention 1974 forcarriageby

sea;the Geneva Convention forcarriage by roadand theParis Convention 1962 forhotels.We areto beregardedas havingall benefitsoftheseconventionson limitingour liability in relation to any claim fordeath,injury, loss,damage anddelay to passengersandluggage.Enrolmentin andpayment fora tourshall constituteagreement andacceptance by thepassenger of theterms andconditions setforth

in thisbrochurewhich cannotbevaried exceptin writingby an officerof theCompany.6.All mattersarising aresubject to English law.

7.Every effortismade to ensurebrochureaccuracy atthe timeof goingto press;however, Trafalgarcannotbe heldresponsibleforprintingof typographical errors,orerrors arisingfrom unforeseen circumstances.All bookingsmade with any providerof any transport,facilities,meals, othergoodsor of any servicesare subjectto termsand conditions

imposedby them in relation to mattersnot coveredparticularly andexpressly by ouragreement with any of theabove-mentionedtwoOperatorsin theTrafalgargroup of companies.

If you decidethatyou do not wantto visita country orpart of a country you intendedto visitbecause of any law,condition orrequirementof any government authority, official,servant oragent,you areresponsibleforany costs, expenses,charges, fees,lossesordamageincurredas a consequenceand any cancellation oramendment fees.

Noneof thecompanies in theTrafalgar groupof companies,or any of theirservants oragents, accept any responsibility orliability foryouracts, omissions,defaults, conduct,state of health,condition orcircumstances.

OTHERCONDITIONS

It isyour responsibility to comply with theterms, conditionsor requirementsof any serviceprovider, orany country orgovernmental

authorities,or to bearany costsor lossesincurred asa consequenceof you notcomplying with them.

BOOKINGARRANGEMENTS

Yourbooking arrangementsareto bemadeby yourTravel Agentand theperson effectingthe bookingshall bedeemed to haveacceptedthebooking conditions.

ADDITIONALOPTIONALEXCURSIONS
