Litigation at the UPCThe new European Patent with Unitary Effect and the Unitary Patent Court system will pro-vide owners of existing and future (classical) European patents with the option for at leastseven years to opt-out, i.e. to litigate their EPs at the national courts instead of at theUPC. IP owners should therefore review their patent portfolios well in advance to decidewhich patents they want to opt out of the UPC system.
