The motion detailed below was prepared at the request of Port & Harbors Director Steve Corporon, who asked that it be placed before the City Council for consideration at its meeting of March 17, 2016. If adopted, the motion provides for approving Amendment No. 3 to the agreement in the amount of $9,850. Amendment No. 3 provides for design of the breakwater modifications that were authorized by the City Council at its meeting of February 18, 2016. The rationale for Amendment No. 3 is detailed in Mr. Corporon's transmittal memorandum and requires no elaboration on the part of my office. I concur with the Port & Harbors Director's recommendation. Mr. Corporon will be attending the City Council meeting of March 17 , 2016, in order to address any questions and/or concerns that Councilmembers may have. A motion has been prepared for City Council consideration. Approving Amendment No. 3 to Contract No. 14-42- Design of Hole­in-the-Wall Harbor Reconstruction, PND Engineers, Inc.

At its meeting of September 18, 2014, the City Council adopted a motion approving Contract No. 14-42, Design of Hole-in-the-Wall Harbor Reconstruction, between the City of Ketchikan and PND Engineers, Inc. at a cost not to exceed $74,030. The motion detailed below was prepared at the request of Port & Harbors Director Steve Corporon, who asked that it be placed before the City Council for consideration at its meeting of March 17, 2016. If adopted, the motion provides for approving Amendment No. 3 to the agreement in the amount of $9,850. Design of Hole In The Wall Reconstruction; Contract No. 14-42, Amendment 3

On September 18, 2014, the City Council awarded initial design work for the reconstruction of Hole In The Wall Harbor to PND Engineering Inc. of Juneau for an initial amount of $74,030 for permitting and design work up to 35%.

On February 5, 2015, the City Council approved Amendment No. 1 in the amount of $125.480 to complete all design work and contract support up through and including the bid award. All of the work under the original contract and amendment No. 1 was funded by a grant from the Ketchikan Gateway Borough.

On August 20, 2015, the City Council approved Amendment No. 2 for construction administration and inspection services in the amount of $189,604.

On February 18, 2016, the City Council approved additional repairs to the breakwater as part of the construction contract with Western Dock and Bridge, Contract 15-24, in an amount not to exceed $220,000. The extent of the repairs entailed complete replacement of the deteriorated and broken wooden piles with steel piles which will reduce the number of piles required; however, the design work required to ensure the size and placement of the piles and other structural elements was adequate was above and beyond the scope of work in PND's approved design contract.

Attached for consideration is Amendment No. 3 for the design work required for the replacement of the Hole In The Wall breakwater in an amount not to exceed $9,850. This design work has already commenced due to the restriction on all in-water construction work having to be completed by March 20 in accordance with the ACOE permit. Funding should be available from the project contingency.

I recommend the City Council authorize the Manager to execute Amendment No. 3 to Contract 14-42 with PND Engineers, Inc. in the amount of $9,850 for design, construction administration and inspection services for the project to reconstruct Hole In The Wall Harbor for a new total contract amount not to exceed $398,994.

Subject Hole in the Wall Harbor- Log Boom Breakwater Engineering Services Fee Proposal

Dear Mr. Corporon:

PND Engineers, Inc. (PND) appreciates the opportunity to provide this proposal for additional engineering services on the Hole in the Wall Harbor Replacement project. We understand that the City of Ketchikan desires to repair the existing floating log boom breakwater by replacing the existing timber anchor piles in their entirety \vith steel pipe piles having protective HDPE sleeves installed over the steel piles. The HDPE pile sleeves will prevent wear on the piles and reduce maintenance costs for the Harbor. Lateral pile support will be provided by steel frames connected at the pile tops. The anchor piles and lateral restraint will be designed to accommodate reinstallation of the existing log boom and for possible future minor enlargement of the existing boom. The log boom will be reinstalled in its existing location and alignment. PND will provide a fast track design with the goal of the piles being installed by Western D ock & Bridge, LLC (WDB) prior to the upcoming in-water work restrictions beginning on March 20'"· PND will produce stamped design drawings and technical specifications for the work, however bid documents will not be provided since the work will negotiated with \XIDB. The work will be constructed under a Nationwide Permit for Maintenance and the City shall notify the USACE.

PND proposes to provide additional engineering services under a Fixed Fee (FF) basis through final design for the improvements defined above. Total fixed fees arc $9,850.

We appreciate the opportunity to continue to provide engineering services to the City of Ketchikan on this project. Please let me know if we have perceived your needs appropriately for this project. Award of Contract No. 16-16 -Planning and Design of Port Improvements, Moffatt and Nichol

Moved by Coose, seconded by Zenge the City Council approve Contract No. 16-16, Planning and Design of Port Improvements, between the City and Moffatt & Nichol in an amount not to exceed $249,835; authorize funding from the Port Department's 2016 Planning & Design of Port Improvements Capital Account; and direct the city manager to execute the contract documents on behalf of the City Council.

Port and Harbors Director Corporon answered questions from the Council.

Moved by Coose, seconded by Kiffer to amend by removing $31,000 by reducing the number of public meetings to be held.

Motion to amend passed with Sivertsen, Coose, Zenge, Harris, Isom, Kiffer and Gage voting yea.
