    Ethics Roundup 2014: Colorados Most Wanted

    2014 saw its fair share of scandals in Colorado. From a disgraced legislator under criminal indictment, toa group of Pueblo officials meeting in secret, Ethics Watchs 2014 Ethics Roundup highlights the mostdespicable and concerning actions of those we trust to protect us and represent our interests.

    State Senator Steve King (R-Grand Junction) was featured in the Ethics Watch Top Scandals of 2010report , then a Colorado State Representative, after a double -dipping scand al in which he used hiscampaign account to improperly reimburse himself for $1,400 in travel expenses that were also paid forthrough state mileage reimbursement payments, and overcharged the state for a rental vehicle.Senator King has returned to the 2014 Ethics Roundup for a new controversy after being fired from theMesa County Sheriffs office for falsifying a time card. He also allegedly improperly charged ColoradoMesa University for work he did not actually perform. Now under felony indictment and the subject of aBrady Letter, Senator King dropped out of an uncontested race to be the Mesa County Sheriff but hasrefused to resign from his position in the state legislature. Thankfully his term ends in January 2015.

    El Paso County Sheriff Terry Maketa has reached his term limit and his scandal limit in 2014. SheriffMaketa is embroiled in an ongoing scandal involving allegations that include an attempt to give himselfan award meant for rank and file police officers, misuse of public funds in connection with inappropriatesexual relationships with three subordinates, responding to an EEOC complaint, mishandling an internalaffairs file in an attempt to influence an election, and the existence of an unreported million dollaraccount under th e Sheriffs Offices control. Sheriff Maketa has announced plans to retire on Dec 31,2014, two weeks before his last term official ends.

    Ongoing issues surrounding the conduct of several deputies and officers in the Denver SheriffDepartment came to light this year, forcing Denver Sheriff Gary Wilson to step down after a four-yeartenure. The Denver Sheriff Department has been plagued by allegations of abuse of power and was nothelped this year by news that Mayor Michael Hancock hired an interim sheriff with a troubling criminal

    record of his own. Public confidence in the integrity of law enforcement is a must. The Denver SheriffDepartments ongoing troubles undermine the public trust in those entrusted with the peoples safety.

    After secret email meetings and questionable closed executive sessions, both held in violation of theColorado Sunshine Law, came to light, Pueblo City Councilmembers Sandy Daff, Chris Kaufman, andAmy Nawrocki were forced to resign or face a recall election. These councilmembers discussed publiccity business over group emails with Pueblo County Transportation Director Greg Severance, and heldimportant discussions about spending of tax dollars in executive session of council meetings. The publicdemanded transparency and forced the resignation of two members, while planning a recall for thethird member on January 27, 2015. These Pueblo secret meetings scandals prove once again thatColoradans take transparent government very seriously, and public officials who act in secret imperil

    their careers.

    Senator Steve King

    State Senator Steve King (R-Grand Junction) was a member of theColorado House of Representatives for four years before being elected to theState Senate in 2010. Then-Representative King was featured in the Ethics

    Watch Top Scandals of 2010 report after a double - dipping scandal in whichhe used his campaign account to improperly reimburse himself for $1,400 intravel expenses that were also paid for through state mileagereimbursement payments, and overcharged the state for a rental vehicle. 1

    Senator King is back and in this 2014 Ethics Roundup for a newcontroversy after being fired from the Mesa County Sher iffs office forfalsifying a time card. 2 He also allegedly improperly charged Colorado MesaUniversity for work he did not actually perform. Now under felonyindictment, Senator King dropped out of an uncontested race to be the MesaCounty Sheriff after being selected as the Republican nominee but refused toresign his position as a state Senator. 3 After his indictment, Ethics Watchcalled on Senator King to resign immediately instead of waiting for his termto expire in January 2015, especially because he was serving as chair of theyear-round Legislative Audit Committee. 4 Although Senator King did notresign, Senate Minority Leader Bill Cadman replaced him on the LegislativeAudit Committee. 5

    Falsifying a Time Sheet

    Senator King worked part time for the Mesa County Sherriffs officewhen the State Senate was out of session. On June 6, 2014, then-Sheriff

    Stan Hilkey fired Senator King for falsifying a time sheet andinsubordination. 6

    Senator King originally submitted a time sheet for May 2014 whichlisted 106 hours but did not account for mandatory hour long breaks that

    Sheriffs employees are required to take. After being asked to correct thisdeficiency, Senator King returned a new timesheet that listed 119 hours,with additional hours tacked onto the end of each day. 7

    When confronted with questions about the adjusted time sheetSenator King reportedly stormed out of Undersheriff Rebecca Spiess officeand took the remainder of the week off. Senator King was fired a few dayslater and the Mesa C ounty Sheriffs office requested an investigation ofSenator King by the Colorado Bureau of Investigation (CBI). 8 Thatinvestigation was transferred to the 18th Judicial District A ttorneys office (inArapahoe County) to avoid any conflict of interest arising from the fact thatthe former Mesa County Sheriff, Stan Hilkey, is now the head of theColorado Department of Public Safety, which oversees CBI. 9

    Criminal charges were filed by 18 th Judicial District Attorney GeorgeBrauchler at the end of July 2014, charging Senator King with defrauding theMesa County Sheriffs Office and Colorado Mesa University of $2,000 to$5,000 from July 1, 2013 to December 19, 2013 during his part-timeemployment at both institutions. Senator King has hired Denver defenselawyer David Kaplan to defend him against felony counts of embezzlement ofpublic property, forgery, and theft, along with two misdemeanor counts offorgery and official misconduct. 10 Some preliminary proceedings have takenplace and Senator King is expected to make a plea at his next courtappearance on January 23, 2015. 11

    In addition to the firing and ongoing criminal prosecution, SenatorKing is now also the subject of a Brady letter. A Brady letter (named forthe U.S. Supreme Court case Brady v. Maryland in 1963) is a letter which

    prosecutors are required to provide to defense attorneys to inform them ofsustained misconduct by individual police officers. The existence of a Bradyletter calls into question the reliability and trustworthiness of a n officerstestimony in criminal cases. 12 Such a letter was transmitted to the districtattorneys office before charges were filed and remains part of the case

    record.

    Failure to Disclose Income, Employment, and a Conflict of Interest

    On Monday, September 8, 2014, the Denver District Attorneys Officereceived a complaint against Senator King by Kevin King (no relation to theSenator), who claimed the senator violated a number of laws that requirehim to disclose any money he or direct family members make from anysource, public or private. 13 The complaint alleged that Senator King did notnotify state officials in 2011 and 2012 that he was working for ColoradoMesa University (CMU). Nor did Senator King disclose that his company, theAmerican National Protective Services, had a $17,850 contract with theuniversity in 2008. In 2012, Senator King then applied for a temporaryposition at CMU that was never advertised. After the interview process,Senator King was offered a contract, but failed to disclose any of the incomestemming from these contracts on his required Personal Finance DisclosureStatements.

    During the time Senator King was contracting with CMU, five bills wereintroduced into the legislature that were directly impacting the university,and King was a prime sponsor of those bills (four of which passed). 14 However, it is unclear whether Senator King was earning money from theschool when the bills were being voted on in the legislature. Failing todisclose a conflict of interest is a Class 2 misdemeanor and a violation ofstate Senate rules. 15

    On October 20, 2014, t he Denver District Attorney s office determinedthat they did not have sufficient evidence to pursue charges against SenatorKing regarding the alleged failures to disclose. 16 Chief Deputy DistrictAttorney Joseph Morales explained in a letter to the complainant that in

    order to pursue charges, he would need to establish beyond a reasonabledoubt that Senator King exercises any substantial discretionary function inconnection with a government contract, purchase, payment, or otherpecuniary transaction. 17

    In November 2014, Kevin King filed a complaint in Denver DistrictCourt against Denver Deputy District Attorney Morales for his failure tolaunch an investigation into Senator Kings personal financial disclosurereports. 18 Kevin King is seeking a court order requiring Morales to go publicwith an explanation of why he chose not to charge the Senator. 19 This courtcase is ongoing.

    While both the criminal and civil cases are still ongoing, Senator Kingwill no longer be in the General Assembly in 2015, and his future in publicoffice is unclear.

    Terry Maketa has been El Paso County Sheriff since he was firstelected in 2002 and reelected in 2006 and 2010. Sheriff Maketas currentterm of office expires in January 2015; he was barred by term-limits fromrunning for re-election in 2014. However, due to a series of scandals in2014, the Sheriff announced plans to resign at the end of 2014.

    Sheriff Maketa is embroiled in an ongoing scandal involving allegationsthat include an attempt to give himself an award meant for rank and filepolice officers, 21 misuse of public funds in connection with inappropriatesexual relationships with three subordinates, 22 responding to an EEOCcomplaint, 23 mishandling an internal affairs file in an attempt to influence anelection, 24 and the existence of an unreported million dollar account underthe Sheriffs Offices control. 25

    Alleged affairs and favoritism

    Sheriff Maketas current woes began in early May when several sheriffcommanders complained that they felt pressured to vote to give SheriffMaketa an annual award meant for outstanding first responders. Sheriff

    Maketa would have been the only sitting department head to have receivedthe award in twenty years. 26

    Shortly after the award controversy erupted in the media, three malesheriff commanders simultaneously filed complaints against the Sheriff withthe Equal Employment Opportunity Commission (EEOC) and the El PasoCounty Commissioners. 27 The commanders were placed on administrativeleave the day the complaints were filed. 28 The complaints against SheriffMaketa alleged that he gave preferential treatment to three subordinateswith whom he allegedly was having affairs. The alleged preferentialtreatment included promotions, insulation from disciplinary action, and travelto conferences with the Sheriff as vacations rather than work functions paid for with public funds. 29 One piece of evidence that surfaced inconnection with this complaint was the now- infamous naked selfie ofSheriff Maketa with an unidentified woman. 30 Though not an ethics violationin and of itself, the photo did nothing to improve the public image of theSheriff, and lent credence to the claims in the EEOC complaint.

    Allegations Regarding the Release of Internal Affairs File

    The Sheriffs troubles continued when William Claspell, who left the ElPaso County Sheriffs office 15 years ago, submitted a claim to the county i nlate August 2014, claiming that Sheriff Maketas release of an internal affairsfile has greatly impacted his current job as a criminal investigator for theColorado Department of Corrections. 31 The release was triggered bystatements made by Bill Elder, Sheriff Maketas recently elected successor,denying that he had been the subject of an internal affairs investigationduring his time he worked in the Sheriffs office. Sheriff Maketa stated thatthere was an internal affairs file on Elder, but that it was recently stolenfrom the Sheriffs department. 32 Sheriff Maketa released Claspells file to

    prove that there was a file on Elder, who was a lieutenant in the officereporting to Claspell in the 1990s. Claspell is demanding $100,000 to

    compensate for the lost promotional opportunity, embarrassment, andmental distress that resulted from the release, as well as a public apologyfrom Sheriff Maketa. 33

    Alleged Secret Million Dollar Bank Account

    In an additional twist to Sheriff Maketas dubious tenure as El PasoCounty Sheriff, the FBI is investigating an allegedly unreported million dollaraccount controlled by the S heriffs Office. 34 The Sheriff s Office claims thatthe account was created with authority of the County Treasurer in 2006,however, the current and former County Treasurers dispute that claim.Regardless of the origin of the account, its existence was unknown to theCounty Treasurer until June 2013, and as a result it went unreported toauditors for many years. 35

    The FBI and the CBI are now teaming up on the criminal investigationof the various claims and complaints made against Sheriff Maketa, a total ofnine claims seeking almost $4 million in damages. 36

    Sheriff Maketa initially denied the accusations against him, but laterissued an apology video sent to county employees acknowledging somewrongdoing. 37 Despite the partial admission, a recall effort (since failed), andCounty Commissioners calling for his resignation, Sheriff Maketa continuedto insist that he would complete his term, which finally ends in January2015. 38 Unexpectedly, in mid-December, Sheriff Maketa announced that hewould leave office on December 31, 2014 two weeks before the end of histhird term. Sheriff Maketa s notice of retirement did not give any reason forthis decision. 39

    The Denver Sheriff Department

    The Sheriff Department for the City and County of Denver is differentfrom most Colorado sheriffs offices. Instead of providing law enfor cement inunincorporated areas (of which there are none in its jurisdiction) the Denver

    Sheriffs approximately 890 employees operate two jai ls and a work releasefacility in addition to providing court security among other public safetyduties. 40 The Denver Sheriff Department has been plagued by allegations ofabuse of power and was not helped this year by news that Mayor MichaelHancock hired an interim sheriff with a troubling criminal record of his own.

    Cops with Criminal Records

    In July of 2014, Gary Wilson, Sheriff of Denver, stepped down after afour-year tenure amid controversies surrounding the conduct of severaldeputies and officers in the department. 41 Mayor Hancocks choice ofreplacement for sheriff came with its own controversies. That month, aColorado Bureau of Investigation report revealed that the interimreplacement sheriff, Division Chief Elias Diggins, was arrested in 1996 for afelony of attempting to influence a public servant. 42 The CBI report statedthat Chief Diggins pleaded guilty to a lesser charge of false reporting whichis a misdemeanor. 43 It is unclear if Mayor Hancock was aware of this arrestrecord at the time that he made the appointment.

    Unfortunately, Chief Diggins is not the only deputy sheriff with acriminal record. The Denver Sheriff Department appears to have a lessrigorous hiring process than the citys police or fire departments, making thedepartment susceptible to patronage and bad hires. 44 The Denver Post

    reported that after a review of court records and job applications that therewere more than a dozen employees that were hired as deputies by theSheriff Department despite having a criminal record. 45 The Denver Post alsorevealed that department employees were often able to keep their positionsdespite engaging in theft, domestic violence, driving under the influence,

    trespassing and careless driving resulting in death. The report found thateven though the Sheriff Department performs criminal background checksperiodically on employees, the results are not factored into the formalpersonnel policies. 46 Although former-Sheriff Wilson had convened a taskforce to examine problems and make recommendations, the city disbandedthe task force after it told Denver to revise hiring policies for deputies. 47

    To complicate matters further, in 2013 the Denver Sheriff Departmentadopted a policy that allows them to discard pre-employment backgroundchecks after three years. 48 The policy change included job history, criminalbackground checks as well as psychological evaluations. 49 This policy makesit hard to determine whether a deputy has a prior criminal conviction.

    Abuse of Power

    The Denver Sheriff Department s propen sity to cost the city money inpayouts for excessive force is also well-documented. The Denver Post reported in August 2014 that nearly $13 million of the $16.7 million paid outby the city of Denver to settle legal claims in the past 10 years involved thepolice and the sheriff department. 50 Fifty-eight percent of that total payoutwas for cases where excessive force or civil rights violations were at issue. 51 In August of 2014, the Denver City Council approved the largest settlementpayment involving a case of excessive force at the Denver SheriffDepartment: $3.25 million. 52 The City Council went a step further and called

    for an independent review of the Sheriff Department while also agreeing togive a federal judge jurisdiction over the city to make sure that Denvercomplies with the settlement and implements reform. 53

    The Denver Sheriff Department has long had a history of violence and

    inappropriate behavior. In 2005, an investigation was launched based onreports that deputies smuggled drugs and conspired with inmates. 54 TheDenver Post presented a review of disciplinary letters issues since January2013 and the findings are astounding. There have been cases wheredeputies accidentally fired a bullet in the floor of an office at Denver HealthMedical Center, allowed inmates to mistakenly walk out, misplaced a gun ina McDo nalds bathroom, or even started a physical altercation over cupcakeswhile on duty. 55 The Denver Post reviewed 60 disciplinary letters that revealsheriffs deputies getting into trouble for everything from assaulting inmatesto failing to qualify their weapons. 56

    The Denver Sheriff Departments cumbersome disciplinary processmakes reform difficult. According to a Denver Post analysis, it took anaverage of more than 10 months for the Sheriff Department to discipline oneof its deputies and in many cases took more than a year. 57 The investigationprocess and disciplinary process has become a major focus as the SheriffDepartment has come under closer scrutiny. Ste phanie OMalley, DenversExecutive Director of Safety, defines the problem as the process in whichdisciplinary cases go through a 10-step process from the time a complaint isfiled to a punishment is decided. 58 The number of open cases in the

    The publics demand for transparent government was on full display inPueblo this year, where two City Council members resigned and a third facesa recall election after secret email meetings and questionable closedexecutive sessions, both held in violation of the Colorado Sunshine Law,came to light.

    Throughout the summer of 2014, several Pueblo City Council membersdiscussed public city business over group emails with Pueblo CountyTransportation Director Greg Severance. 60 These emails were discoveredafter The Pueblo Chieftain filed a Colorado Open Records request to obtainemails exchanged between council members Ami Nawrocki, Chris Kaufman,President Sandy Daff, and Severance. 61

    The Sunshine Law defines a meeting as any kind of gathering,convened to discuss public business, in person, by telephone, electronically,or by other means of communication involving three or more members of alocal public body such as the Pueblo City Council. 62 The law requires that thepublic be given notice of any meeting and that such meetings be open to thepublic. 63

    Council member Nawrocki told KRDO NewsChannel 13 that she did notbelieve her e-mail violated the law, while Council member Kaufman calledthe news stories about the emails a horrible distraction. 64 Council

    President Daff also denied to reporters that she did anything wrong.65

    meetings laws confirmed that the city council members secret emailsviolated the Sunshine Law. 66

    A few days later, the public packed the council chamber to hold thethree council members accountable for their unlawful actions. 67 The meeting

    was filled with harsh testimony and requests for the council members toresign for the secret emails conducted between them and Greg Severance.Other council members were disgusted with the language and claimed manyof the ema ils were mean - spirited. Council members Nawrocki and Kaufmanapologized for their actions during the meeting. 68

    Fallout from this scandal continued on August 12, 2014, when Councilmember Chris Kaufman announced he was resigning from his post becauseof the pain that this incident has caused his family, his staff, and hisreputation. 69

    A citizen group launched a recall campaign against the other twocouncil members involved in the secret email meetings. 70 Instead of facing arecall, Council President Sandy Daff announced her resignation in October. 71 The remaining Council member involved in the secret meetings, AmyNawrocki, is the subject of a recall election on January 27, 2015. 72

    Secret email meetings werent the o nly actions of the Pueblo CityCouncil showing disregard for the Sunshine law this year. In April, CityCouncil member Chris Nicoll went public with accusations that the citycouncil was illegally discussing use of tax revenue in closed-door executivesessions. 73 Council member Nicoll told the media about the executive

    sessions despite fellow Council member Kaufman warning all city councilmembers that discussing the use of the tax in public would simply generatestrong opposition. 74 The Pueblo Chieftain then filed suit asking a state judgeto review the recordings of those executive sessions to determine whetherthe Sunshine law was violated. 75

    These Pueblo secret meetings scandals prove once again thatColoradans take transparent government very seriously, and public officialswho act in secret imperil their careers.
