Blackpool Council partnership creates space efficient, premium style gym

The requirement:‘Sport Blackpool’ – the leisure services division of Blackpool Council – offers a wide variety of sport and leisure activities throughout the town. In order to enhance service provision, the authority made the decision to add a fourth venue to their portfolio – a town centre gym facility, located on the ground floor of the new Blackpool Council offices. With over 700 staff employed in the four-storey building, the gym needed to have the look, feel, and finish of a private facility, and yet cater for both corporate customers and the wider community.

The solution:ESPO’s provision of framework 345 enabled Blackpool Council to generate a full and compliant Invitation To Tender (ITT) for the supply, delivery, installation, and maintenance of cardiovascular and strength equipment, which Matrix Fitness duly won. Matrix Fitness worked closely with the Council’s Leisure Services’ team to suggest efficient layouts that would maximize available space before supplying top-of-the-range cardio equipment from their 7xi series – created to enhance workout experiences and aid exercise adherence – including treadmills, ellipticals, and cycles. Stylish black strength equipment from Matrix Fitness’ premium Ultra range was also supplied, along with a selection of Inclusive Fitness Initiative (IFI) accredited pieces of cardio and strength equipment.

Matrix Fitness has also been involved with the rollout of the new facility; providing marketing support including wall displays, leaflets and banners. The fitness equipment supplier also arranged for ‘Team Matrix’ sporting ambassadors – Colin Jackson CBE and Wigan Warriors – to attend the facility’s launch event.

Case study

The results:Each supplier on framework 345 was selected for their experience and ability to provide customers with a comprehensive range of products that combine quality and value, and satisfy all fitness equipment requirements, including the supply, delivery, and installation.

By utilising ESPO framework 345, the council benefitted from:

• A simplified process – the framework is already EU/UK compliant, and terms and conditions were pre-agreed under the framework.

• A quick and competitive route to purchase a comprehensive range of fitness equipment including supply, delivery, installation and maintenance of cardiovascular, strength equipment, and associated products.

• A fit for purpose solution – each supplier listed on the framework was assessed during the procurement process for their financial stability, track record, experience, and technical and professional ability.

London Waste and Recycling Board saves over £400,000 with collaborative procurement.

The requirement:Established by the Greater London Authority Act 2007, The London Waste and Recycling Board (LWARB) was developed to promote and encourage the production of less waste and increase the proportion of waste that is re-used or recycled. Since then, the methods of collection, treatments and disposals of waste are proving to be more beneficial to the environment in London.

In previous years, LWARB awarded grants totalling £5m to 29 projects, across 26 boroughs to encourage improved recycling services.

The primary objective was to compliantly buy the most cost effective products available; this led to LWARB working with ESPO.

The solution:LWARB provided ESPO with specifications following consultation with the boroughs, which ESPO then procured via its market leading framework.

To ensure LWARB gained the most out of framework 860, ESPO recently ran a further competition on behalf of LWARB for nine London boroughs.

This was to the value of over £400,000 and for a range of products including plastic wheeled bins, kerbside recycling boxes and bags, food waste caddies and compostable liners, and waste housing units.

Case study

The results:By conducting a further competition, the participating London boroughs achieved a saving of up to 25% for their combined requirements.

This signified that framework 860 was an excellent vehicle for buying these goods and identified the additional savings that can be made by collaborating requirements.

As LWARB continue to drive efficiencies in spending by combining boroughs requirements they carry on using the ESPO framework to procure their waste and recycling products.

Robert Smyth Academy saves 20% using ESPO’s Bread & Morning Goods framework

The requirement:Robert Smyth Academy was seeking both a competitive and compliant solution to its food purchasing requirements. Quality and cost would both be key factors in its decision.

The solution:The Academy’s Catering Manager, Emma Spencer, contacted ESPO and was invited to attend one of the regularly held area meetings hosted by ESPO’s Food and Catering team.

During this event Emma had the opportunity to meet the suppliers appointed under ESPO framework 833 for Bread & Morning Goods and to assess and provide feedback on product samples.

Price lists were provided, allowing Emma to compare the Academy’s existing costs for purchasing these products against the pricing available under the framework.

Case study

The results:By using the ESPO framework the Academy realised cost savings of 20% compared to its previous direct purchase arrangement with the same supplier.

In addition to the saving, the Academy had the peace of mind in knowing that all ESPO frameworks are fully compliant with all EU and UK legislation.

Lincolnshire County Council saves 7% using ESPO’s Highway De-Icing Salt framework (220)

The requirement:

Lincolnshire County Council needed a compliant, bespoke procurement solution for its highway de-icing requirements for the coming winter season. This included the supply of the bulk salt to a custom specification, delivery of the material to Lincolnshire plus additional related services such as storage, sheeting, and movement to depots.

The solution:

Under our EU compliant framework (220), ESPO ran a quick, simple mini-competition exercise to obtain bids for Lincolnshire’s specific requirements. This identified the various components of cost to deliver the product and services required by the council. Tenders were comprehensively evaluated and the results were presented to the winter service team at Lincolnshire.

Case study

The results:A 7% saving was made on the previous contract’s pricing and a 14% saving against the incumbent supplier’s tendered price.

Bio Products Laboratory achieves annual savings of £50,000 and improves document processes and governance

The requirement:As a forward-thinking organisation committed to research, development and technology in a constantly changing market, Bio Products Laboratory wanted to look at how best to manage its document services which had previously been devolved across the group. They were looking for a single supplier to provide managed, cost effective print services with options for the future.

The solution:In order to achieve best value, Bio Products Laboratory decided to use the national public sector Multifunctional Devices and Services, Managed Print Services and Print Audit Services agreement (RM1599). Developed collaboratively by the Crown Commercial Service, ESPO and YPO, the agreement offers a range of products, services and suppliers to cater for the varying needs of different public sector organisations.

As a single agreement accessible to the whole sector, it aims to deliver value for money whilst also providing customers with complete transparency of pricing, standardised terms and pre-defined service levels. It is also compliant with procurement rules and regulations, ensuring fair and open competition between suppliers. Bio Products Laboratory appointed Konica Minolta to provide an extended print service under lot 2 of the agreement which offers a full catalogue of multifunctional devices and services, including Print Room services from four suppliers.

Through specialist consultation activities, Konica Minolta established a foundation of complete and precise data which identified specific document workflows, individual needs and service level demands within Bio Products Laboratory. Following detailed analysis, including environmental impacts such as electricity, toner use and CO2 emissions, Konica Minolta designed and implemented an optimal solution involving a number of different of initiatives. Initiatives included the installation of 62 networked devices (less than half of the previous number of devices installed) and the introduction of simple steps such as double-sided default print settings to support reductions in print volumes.

Further efficiencies and performance improvements have been achieved through continuous supervision of devices to monitor use, combined with proactive remote monitoring and automatic technician and consumables dispatch.

Case study

The results:Bio Products Laboratory has estimated that including the costs of replacing printers, they were previously spending in the region of £150,000 per year on print services. Through the solution delivered by Konica Minolta, Bio Products Laboratory now has improved visibility of print costs through detailed management information reports and can demonstrate projected annual savings of £50,000. Further savings have also been achieved through an approximate 30% reduction in print volumes.

Sandwell MBC forecasts savings of over £20,000 by using ESPO’s Banking Services framework (384)

The requirement:Sandwell Metropolitan Borough Council had banked with the Co-operative Bank since the Council was created in 1974. The existing contract agreement had been in place for seven years and was under review when the Co-operative Bank stated that it was intending to strategically withdraw from the local authority market by March 2015. This gave the Council a specific time frame in which to retender its requirement for general banking services.

The solution:The Council had started work on producing its own tender documentation when it became aware that ESPO was in the process of establishing a national framework solution that would offer three lots; general banking services, merchant acquiring services and bill payment services.

After contacting ESPO and reviewing the guidance documentation available, it was decided that as an extensive pre-qualification process had already been undertaken by ESPO, the lowest risk and most time efficient methodology would be to utilise this EU compliant framework.

As the procurement process was considerably shortened, this allowed for a longer implementation period once the contract had been awarded. The easy to access template documentation was helpful and only needed minor modification to suit the Council’s requirements and was easily compatible with the Council’s In-Tend eSourcing software.

Case study

The results:Following the further competition exercise carried out by the Council under the Banking Services framework (384), the Royal Bank of Scotland (RBS) was successfully awarded the contract which will be effective from 1 April 2015.

The Council has a 6 month period to work with RBS to ensure a smooth transition of service providers. This has proved to be a very beneficial exercise for the Council and by utilising the framework it is anticipated that savings in the region of £20,000 could be achieved.

Using ESPO frameworks – the small print

What are the Public Contracts Regulations? All public sector contracts for goods, services or works by public sector bodies are subject to EU procurement rules which have been implemented into UK legislation. The Public Contracts Regulations will apply where the value of the contract is over the financial threshold stated in those Regulations.

The purpose of the procurement legislation is to open up public procurement to EU-wide competition. The legislation is intended to ensure that contracts are awarded fairly, transparently and without discrimination on the grounds of nationality and that all potential bidders are treated equally.

The Public Contracts Regulations require all public sector bodies seeking to make a purchase of goods, services or works (over the relevant threshold) to advertise their contract opportunities in the EU’s Official Journal, and to follow procedural rules set down in the Regulations for how the procurement must be undertaken. ESPO’s frameworks are compliant with the Public Contracts Regulations.

The new Public Contracts Regulations 2015 came into force on 26 February 2015.

Why are they called frameworks and not contracts?Frameworks are often referred to as ‘contracts’. This is a commonly used misnomer. Legal definitions vary, but in

essence a contract is a legally binding agreement between two parties which commits them to exchanging goods and/or services in return for a consideration (normally money).

Frameworks are different, as they do not normally include a legally binding commitment on the customer to receive the goods/services and to make payment. Only when the customer places an order under the terms of the framework does it become a contract between the customer and the supplier.

So what is a framework?The Public Contracts Regulations 2015 define a framework agreement as:

“Framework agreement” means an agreement between one or more contracting authorities and one or more economic operators, the purpose of which is to establish the terms governing contracts to be awarded during a given period, in particular with regard to price and, where appropriate, the quantity envisaged.

The Regulations apply when public authorities seek to acquire goods, services or works. The framework agreement may, itself, be a contract to which the EU procurement rules apply.

Alternatively it may be a simple agreement under which contracts are only formed when goods, services or works are called off.

Why use a framework?Frameworks are a particularly effective means of acquiring goods and services the requirements for which occur on a periodic or regular basis, and especially lend

themselves to collaborative procurement as they enable the requirements of many organisations to be aggregated, thereby securing economies of scale, whilst at the same time eliminating the need to run separate competitive tendering exercises for each requirement, reducing the amount of time and effort required to procure the requirement.

What form do ESPO frameworks take?

ESPO frameworks fall into three categories:

• Call-off frameworks – Frameworks where goods and/or services are defined and priced, and against which you can simply place an order with the supplier that best meets your requirements.

• Further competition frameworks – Frameworks where one or more suppliers have been evaluated against criteria such as financial stability, track record, experience and technical and professional ability within their market. The specific goods and/or services required may however vary from one customer to another, making it difficult to pre-define requirements and provide pricing. These frameworks are structured to enable customers to define their own specific requirements and run a further competition to identify the best solution.

• Frameworks which include both a call-off and a further competition option – where, if the solutions meet your needs you can simply place an order, or you can run a further competition if appropriate.

What is it about ESPO that enables it to create compliant frameworks?The Public Contracts Regulations 2015 designate some organisations as “Central Purchasing Bodies”. ESPO is classed as a “Central Purchasing Body” which means:A contracting authority which -(a) acquires goods or services intended for one or more contracting authorities;

(b) awards public contracts intended for one or more contracting authorities;

or

(c) concludes framework agreements for work, works, goods or services intended for one or more contracting authorities;

In regard to Central Purchasing Bodies: A contracting authority may acquire supplies or services, or both from a Central Purchasing Body offering a centralised purchasing activity.

Contracting Authorities may acquire works, supplies and services, or any one or more of them, by –

(a) using contracts awarded by a central purchasing body;

(b) using dynamic purchasing systems operated by a central purchasing body;

or

(c) using a framework concluded by a central purchasing body.

A contracting authority fulfils its obligations under Part 2 of the Regulations if it undertakes one of the activities listed above.

Note however that contracting authorities will be responsible for fulfilling the obligations imposed under Part 2 of the Regulations in respect of any parts of the procedure that it conducts itself, such as conducting a reopening of competition (i.e. further competition) under a framework agreement that has been concluded by the Central Purchasing Body.

How does ESPO recover its costs?ESPO is a not-for-profit self-funded organisation. We recover the cost of procuring frameworks and specialist procurement services in two ways:

• ESPO recovers its overheads via a retrospective rebate from the suppliers in proportion to framework usage. The aggregated demand of all our customers, and the high use of our frameworks, enables the rebate to be set at a very low level, averaging less than 1% of framework turnover. You will not be charged any additional fees for using our frameworks.

• Requirements for specialist procurement services will be discussed with you and a fee would be payable by the customer based upon our estimates of the cost involved in undertaking the procurement.

This is a transparent process and the fee would be agreed with you in advance. The combination of our existing level of expertise, together with our not-for-profit status, results in us being able to offer a highly competitive service. ESPO does not charge any upfront access or membership fees to use our procurement solutions.

Commercial sensitivityThe information you will find in this document, on our website, and in our User Guides, is commercially sensitive.

Public sector organisations have a duty of confidence towards such information, and you are required to treat it in confidence and not release it to the open market. Doing so may leave both you and ESPO exposed to legal claims. Customers are also reminded that parts of the documents such as the User Guides must not be copied or replicated without the express permission of ESPO’s Head of Procurement.
