E-signatures for non-BE companies

• Belgian law requires e-signature on each tender.

• For BE companies: e-ID or the certifcate purchased by a Belgian company (Certipost)

• Problem: contrary to Community law

– Additonal costs for non-domestic suppliers

– >< to accept any signature that was legally produced in any other Member State.

• Solution:

– no problem, if not mandatory for foreign companies (paper channel)

– Free format for e-signature with certificate chosen by company.

– Legal solution (by proxy)

– Disadvantages/benefits.
