PURPOSE

Bhavnagar Energy Company Limited (BECL) invites Expression of

Interest (EOI) through International Competitive Bidding (ICB) route for

Pre-Qualification Requirements from Bidders for Ash handling and

Disposal system package for 2 x 250 MW Lignite based Thermal Power

Project at village Padva, Bhavnagar Dist. in the State of Gujarat, India as

per the Brief Scope of Work mentioned hereinafter.

Tender specification documents will be issued only to the short listed

Bidders among those Bidders who have submitted the EOI.

ABOUT BECL:

Bhavnagar Energy Company Limited, a joint venture company has been

formed with GPCL, GSIL, GMDC, GIPCL, GNFC, GSFC & GACL as

promoters. BECL has been promoted to exploit lignite resources in

Bhavnagar District in Saurashtra region for power generation purposes.

BECL is setting up 2 x 250 MW Lignite based Thermal Power Project at

Village, Padva, Taluka Ghogha, District Bhavnagar. The Power Project

of 2 x 250 MW is planned for implementation as per the following

Schedule:

Zero Date : December 2010 Placement of order

for Ash handling and disposal system

package.

Completion of trial operation:1ststream - 20 months from zero date

2ndstream - 22 months from zero date

APPROACH TO SITE

The project site details are:

a) Site location Located at Village Padva, Taluka

Ghogha, District Bhavnagar, is accessible

CONSULTANT

TATA Consulting Engineers Limited (TCE), Bangalore are the Consulting

Engineers for the project, appointed by BECL.

I) SCOPE OF WORK

The scope of work under the specification shall include design, engineering,

manufacture, supply & delivery at site of plant & equipment, mechanical, I&C

systems, electrical equipment and systems, technological steel structures, civil &

building structural works, storage, handling at site, insurance, erection, painting,

start-up, trial-operation, testing, commissioning and performance guarantee test,

guarantee and warranty for ash handling and disposal system for 2 X 250 MW

LIGNITE BASED TPP AT PADVA, BHAVNAGAR DIST. and hand over to the

Purchaser an operating plant. The package shall include plant & equipment and

all the auxiliary facilities as indicated below:-

1. Bed Ash Handling System

Chain conveyor system to convey bed ash from the bed ash coolers

below the furnace bed to the intermediate bed ash surge hopper(ISH)

and Dense phase pressure pneumatic conveying system to evacuate

bed ash from ISH to the bed ash silos. The peak generation rate of bed

ash from the SG of each Unit would be 140 TPH. There would be two

(2) streams of bed ash handling system from the ISH up to the bed ash

silos. The bed ash handling system from the ISH up to the silos would

be in two or three stages. The anticipated bed ash handling system

capacity of each stream would be about 140 TPH under emergency and

70 TPH in continuous running mode.

2. Fly Ash Handling System

Dense phase pressure pneumatic conveying system to evacuate Fly

ash from the fly ash hoppers of proposed Circulating Fluidizing Bed

Combustion Steam Generators. The generation rate of fly ash from the

SG of each Unit would be 65 TPH. The fly ash handling system from

the fly ash hoppers up to the silos would be in two or three stages

through fly ash ISH / intermediate silo to main silo. The anticipated fly

ash handling system capacity would be about 130 TPH under

emergency and 65 TPH in continuous running mode.

3. Adequate capacity compressors for conveying the total ash (Bed ash

and fly ash of two Units) to intermediate surge hoppers/ intermediate

silos and from Intermediate surge hoppers to Main Silos.

4. Adequate capacity blowers with heaters for fluidizing the ISH /

intermediate silos, main silos and ESP hoppers.

5. Complete arrangement / equipments for conveying the ash from both

the Units to the destination as specified in the tender.

6. Complete piping, valves, fittings and other accessories as required by

the system.

7. Necessary conveying equipments like ash conditioners, rotary feeders,telescopic chutes, etc.

8. Handling and hoisting facilities including cranes, hoists, etc.

9. Construction of ISHs /intermediate silos and main silos.

10. Construction of control room, switchgear room, compressor building etc.

11. Ventilation, Air conditioning system.

12. HT/LT Switch gear, LT transformers and other electrics.

13. Control and power cables.

14. Control panels, desks, mimics, etc.

15. Control and instrumentation including PLC panel systems.

16. Area illumination.

17. Complete civil work including supply of cement, steel and requiredmaterials, site grading and levelling, building for plant and equipment,control room building, Main RCC silos for ash storage with otherfoundations as required by the system, roads, drainage and pavementsetc.

18. Ash disposal system for bed and fly ash.

19. Any other facilities to complete the plant as per system requirement.

II) QUALIFICATION REQUIREMENTS (QR)

The EOI is open to any single Bidder who has supplied, erected and

commissioned the following:

1.0 At least one (1) number of Dense phase pressure pneumatic conveying

system of capacity not less than Thirty Five (35) tonnes per hour for

extracting the fly ash of coal/lignite-fired boiler in power plant and

conveying ash to storage silo with minimum distance of Five hundred

(500) meters. The above system should have been in satisfactory

operation for a period of at least two (2) years as on the original

scheduled date of EOI Document Opening

OR

2.0 At least one (1) number of dry fly ash handling system (Lean phase

pneumatic conveying system) of capacity not less than thirty five (35)

tonnes per hour for extracting the fly ash of coal/lignite-fired boiler in

power plant and conveying ash to storage silo with minimum distance of

two hundred (200) meters. The above system should have been in

satisfactory operation for a period of at least two (2) years as on the

original scheduled date of EOI Document Opening.

3.0 In case of the Bidder meeting the QR in Cl. 2.0, he should have

association with a design consultant under whose design a dense phase

pressure pneumatic conveying system should have been in operation

meeting the QR Cl 1.0. In such a case, the Bidder and the design

consultant should along with the bid enclose a Letter of Consent (LOC)

signed by both the parties. On award of contract, the Bidder and the

design consultant shall submit a Joint Deed of Undertaking (JDU) duly

executed by both parties for the successful performance of the system.

4.0 Financial Requirements

The Bidder shall be financially sound and shall have adequate financial

resources to execute the contract concurrently with his other

commitments and shall meet the following conditions.

a) The Bidder shall have Positive Net Worth as per the latest audited

financial statement.

b) The Bidder shall have during the last three years, an Average Annual

Turn Over of not less than Rs. 500 Million.

c) The Bidder shall furnish his audited profit and loss account and

balance sheet for the last three financial years.

5.0 Documentary evidence to satisfy the qualifying requirements mentioned

in 1.0 to 4.0 shall be furnished.

III) Bidder shall note the following clauses and furnish confirmation for

acceptance of these clauses in the EOI documents.

1.0 The successful Bidder shall furnish a Contract Performance Guarantee in the

form of an on demand Bank Guarantee for 10% of the total contract value for

the faithful performance of the contract after the Letter Of Award (LOA).

2.0 The scope of work of the Bidder shall be on the basis of single Bidder

responsibility. The contract will be entered into only with the successful

Bidder. He only shall be contractually bound to the Owner for the completion

of the entire scope of works. Thus the Bidder shall be solely responsible and

liable for all the technical, management and all other services required to

complete the entire scope of work detailed in the tender specification.

3.0 Sourcing of all equipment/systems should be with the approval of the

Purchaser & only from the reputed manufacturers/suppliers/sub-vendors who

have supplied at least one similar or larger size equipment/systems as

stipulated in the tender specification each of which are in satisfactory

operation for a minimum period of two years.

4.0 A sample Format of Letter of Consent (LOC) to fulfill the Qualification

Requirements Clause II (3.0) is enclosed as Annexure I. The bidder shall

furnish the LOC indicating the Scope of work of the design consultant

clearly detailed.

5.0 A sample Format of Joint Deed of Undertaking (JDU) to fulfill the Qualifying

Requirements clause II (3.0) is enclosed as Annexure II. The bidder shall

furnish the Joint Deed of Undertaking (JDU) indicating the Scope of work of

the Design Consultant clearly detailed. The bidder shall furnish the

unsigned copy of the Joint Deed of Undertaking (JDU) in completely filled

up form along with his EOI documents.

6.0 The requirement of documentary evidence called for in Qualification

Requirements Clause II (5.0) is indicated in Annexure III. The bidder shall

comply with these requirements.

7.0 The Bidder shall furnish the following details also along with EOI documents:

o Contracts in hand/pending jobs and their status along with Value.

o Major legal cases and their statutory liabilities.

o Recent Coal or lignite based ash handling system executed with value.

8.0 In case, certificate(s) submitted by the Bidder is found to be a forged one /

bogus one, the Bidder will not only be disqualified for the tender but also

would be blacklisted / debarred by BECL and the matter would be informed

to other PSUs / Statutory Bodies.

9.0 TIME SCHEDULE OF THE PROJECT

First stream shall achieve successful completion of Trial operation within

twenty 20 months and the second stream within twenty two 22 months from

the date of letter of award.

10.0 Notwithstanding anything stated above BECL reserves the right to verify all

statements/information submitted to confirm the Bidders claim on

experience and to asses the Bidders capability and capacity to perform the

contract should the circumstances warrant such an assessment in the overall

interest of the project.

11.0 BECL reserves the right to reject any or all EOIs or cancel/withdraw theInvitation for EOI without assigning any reason whatsoever and in such case

no Bidder/intending Bidder shall have any claim arising out of such action.

12.0 The payment will be made in Indian Rupees only.

13.0 The bidder cannot be an associate for other bidder(s) who are bidding for

this Ash Handling System Expression of Interest.

14.0 The bidder may furnish EOI with more than one associate(s) as design

consultant as per QR condition II (3.0). However he is limited to choose

while submitting the techno-commercial bid only one associate who are

qualified for the conditions stipulated in the notice inviting EOI. No new

associate will be permitted at the time of submitting the Techno commercial

Bid.

IV) PARTICIPATION FEE

The Participation fee (non-refundable) for an amount of Indian Rupees

25000 (Twenty five thousand) in the form of Demand Draft drawn from

Nationalised Bank or Pay Order in favour of Bhavnagar Energy Company

Limited, or US $ 550 payable at Gandhinagar, to be submitted along with

the EOI documents. EOI documents received without the Participation

fee will be rejected.

V) EOI DOCUMENTS SUBMISSION AND OPENING

1.0 The EOI documents shall be submitted in one original and three

identical copies indicating clearly as original and copy.

2.0 LANGUAGE

The EOI documents prepared by the Bidder, and all correspondence and

documents relating to the EOI shall be in the English language.

3.0 SIGNATURE OF THE EOI DOCUMENTS

3.1 The EOI must contain the name and place of business of the person or

persons making the EOI and each page of the EOI must be signed and

sealed by the Bidder with his usual signature. The name of all persons

signing should be typed or printed below the signature.

3.2 Satisfactory evidences of authority of the person signing on behalf of the

Bidder shall be furnished with the Bid.

3.3 The Bidders name stated on the proposal shall be the exact legal name of

the firm.

4.0 The EOI documents (one original and Three identical copies) bearing the

EOI reference no. shall be submitted in SEALED COVERS / ENVELOPES

5.0 The name of the Bidder and his address should be clearly indicated outside

the covers. In addition, the envelope or container should indicate the "EOI

reference No. and Name of the work for which the EOI is submitted, EOI

opening date and time". EOI with no indication given on the outside of the

envelope to indicate that it is an EOI which therefore gets opened before

the due date shall be liable to be disqualified. All the pages of the EOI shall

be serially numbered. The Bidders are instructed to properly paste the

covers before applying wax seal and it is warned that failure to do so would

result in rejection of such EOI.

6.0 Submission of EOI documents through Fax, Telex, E-mail will not be

accepted.

7.0 EOI submitted without the proper documentary evidence to substantiate

fulfilment of the qualifying requirements as specified are liable for rejection

without assigning any reason.

8.0 BECL takes no responsibility for delay loss or no-receipt of documents or

any letter sent by post either way.

9.0 DATE AND TIME FOR RECEIPT OF EOI DOCUMENTS

EOI Documents must reach this office on or before 14.30 Hours (IST) on

14th October 2010. Any EOI offer received after the expiry of the time

specified for receiving the EOI documents are liable for rejection.

10.0 EOI DOCUMENTS OPENING

The EOI documents received from the Bidders as above will be opened at

Registered Office, BECL, on 15th October 2010 12.00 Hours (IST)

onwards.

11.0 The envelope containing Participation Fee as well as other documents

sought for shall be opened on the date set for opening of the EOI in the

presence of such Bidders who may be present. The Bidders are at liberty to

be present or authorise their representatives not more than two to be

present at the time of opening of EOI.

1. That in consideration of the award of contract by the Owner (hereinafter

referred to as the Contract) we, the Design Consultant and Contractor do

hereby declare and guarantee that we shall be jointly and severally bound

to the BECL (Owner) for the successful performance of the dense phasepressure pneumatic conveying system for the Ash handling system of the 2

X 250 MW LIGNITE BASED TPP AT PADVA, BHAVNAGAR DIST. fully

meeting the guarantee parameters as per the contract and further shall be

fully responsible for the correctness of design and construction of dense

phase pressure operated pneumatic conveying system in accordance with

the contract specifications. Further, we the Design Consultant and the

Contractor hold ourselves jointly responsible for the timely execution of all

activities in accordance with the contract.2. Without prejudice to the generality of the Undertaking in Para 1 above, the

methods of achieving the objectives set forth above shall be as follows:

(a) The Design Consultant shall be responsible for the preparation of

design, design calculation, design data and drawings for dense phase

pressure pneumatic conveying system for the Ash handling system of

the 2 X 250 MW LIGNITE BASED TPP AT PADVA, BHAVNAGAR

DIST. and shall provide all additional necessary technical assistance

as required by the owner / purchaser in answering owner / purchasers

queries by the way of correspondence and participation in co-

ordination meetings during the execution of the contract to . . ..

quality surveillance to the contractor during construction at the Owners

Project Site. Without prejudice to the overall responsibility of the

Design Consultant as to the successful commissioning and

performance of the equipment, the Design Consultant shall, in addition,

depute technical experts from time to time to the Contractors

work/Owners Project site, as mutually agreed upon between the

Owner and the Contractor in accordance with the stipulation in the

Contract.

(b) The Contractor shall be responsible to manufacture that portion of the

equipment to be manufactured at its works or its vendors works as per

the Design Consultants design and to the Design Consultants quality

acceptance level. Further, the Contractor shall erect, commission and

carry out the testing of dense phase pressure pneumatic conveying

system for the Ash handling system of the 2 X 250 MW LIGNITE

BASED TPP AT PADVA, BHAVNAGAR DIST. fully meeting the

parameters as per the Contract in accordance with the DesignConsultants advice, procedure and guidance. The Contractor will be

responsible for the timely completion of all the activities related to the

Contract

3. In the event of any breach in the performance of the obligations set forth

above, we the Design Consultant and the Contractor shall jointly and

severally pay the loss or damage to the Owner on its demand except

consequential damages namely loss of power, loss of profit, loss of interest.

Further any extension of time, relaxation or indulgence by the Owner to the

Contractor shall not prejudice the rights of the Owner under this

Undertaking against the Design Consultant or the Contractor.

4. We, the Design Consultant and the Contractor agree that this undertaking

shall be irrevocable and further agree that this Undertaking shall continue to

be enforceable till the end of warranty period under the Contract. We

further agree that this Undertaking shall be without prejudice to the various

liabilities of the Contractor including Contract Performance Guarantee as

well as other obligations of the Contractor in terms of the Contract.

5. The Performance, rights and responsibility of the Parties shall be inaccordance with the Contract and further the liability of the Contractor /

Design Consultant under this undertaking shall not in any case exceed the

limits as stipulated in the Contract.

1. II, 1.0 At least one (1) number of Dense phase pressurepneumatic conveying system of capacity not lessthan Thirty Five (35) tonnes per hour for extractingthe fly ash of coal/lignite-fired boiler in power plantand conveying ash to storage silo with minimumdistance of Five hundred (500) meters. The abovesystem should have been in satisfactory operationfor a period of at least two (2) years as on theoriginal scheduled date of EOI Document Opening

2. II, 2.0 At least one (1) number of dry fly ash handlingsystem (Lean phase pneumatic conveying system)

of capacity not less than thirty five (35) tonnes perhour for extracting the fly ash of coal/lignite-firedboiler in power plant and conveying ash to storagesilo with minimum distance of two hundred (200)meters. The above system should have been insatisfactory operation for a period of at least two(2) years as on the original scheduled date of EOIDocument Opening.

3. II, 3.0 In case of the Bidder meeting the QR in Cl. 2.0, heshould have association with a design consultantunder whose design a dense phase pressurepneumatic conveying system should have been in

operation meeting the QR Cl 1.0. In such a case,the Bidder and the design consultant should alongwith the bid enclose a Letter of Consent (LOC)signed by both the parties. On award of contract,the Bidder and the design consultant shall submit aJoint Deed of Undertaking (JDU) duly executed byboth parties for the successful performance of thesystem.

4. II, 4.0 Financial Requirements:

The Bidder shall be financially sound and shallhave adequate financial resources to execute thecontract concurrently with his other commitmentsand shall meet the following conditions.

The Bidder shall have Positive Net Worth as per

the latest audited financial statement.

6. II, 4.0b.

The Bidder shall have during the last three years,an Average Annual Turn Over of not less than Rs.500 Million.

7. II, 4.0c.

The Bidder shall furnish his audited profit and lossaccount and balance sheet for the last threefinancial years.

8. II, 5.0 Documentary evidence to satisfy the qualifyingrequirements mentioned in 1.0 to 3.0 shall befurnished.

9. III, 1.0 The successful Bidder shall furnish a ContractPerformance Guarantee in the form of an ondemand Bank Guarantee for 10% of the totalcontract value for the faithful performance of thecontract after the Letter Of Award (LOA).

10. III, 2.0 The scope of work of the Bidder shall be on thebasis of single Bidder responsibility. The contractwill be entered into only with the successful Bidder.He only shall be contractually bound to the Ownerfor the completion of the entire scope of works.Thus the Bidder shall be solely responsible and

liable for all the technical, management and allother services required to complete the entirescope of work detailed in the tender specification.

11. III, 3.0 Sourcing of all equipment/systems should be withthe approval of the Purchaser & only from thereputed manufacturers/suppliers/sub-vendors whohave supplied at least one similar or larger size

equipment/systems as stipulated in the tenderspecification each of which are in satisfactoryoperation for a minimum period of two years.

12. III, 4.0 A sample Format of Letter of Consent (LOC) tofulfill the Qualification Requirements Clause II (3.0)is enclosed as Annexure I. The bidder shall furnishthe LOC indicating the Scope of work of the design

consultant clearly detailed.

13. III, 5.0 A sample Format of Joint Deed of Undertaking(JDU) to fulfill the Qualifying Requirements clauseII (3.0) is enclosed as Annexure II. The bidder shallfurnish the Joint Deed of Undertaking (JDU)indicating the Scope of work of the DesignConsultant clearly detailed. The bidder shall furnishthe unsigned copy of the Joint Deed ofUndertaking (JDU) in completely filled up formalong with his EOI documents.

14. III, 6.0 The requirement of documentary evidence called

for in Qualification Requirements Clause II (5.0) isindicated in Annexure III. The bidder shall complywith these requirements.

15. III, 7.0 The Bidder shall furnish the following details alsoalong with EOI documents:

15.1 Contracts in hand/pending jobs and their statusalong with Value.

15.2 Major legal cases and their statutory liabilities.

15.3 Recent Coal or lignite based ash handling system

executed with value.

16. IV. PARTICIPATION FEE

The Participation fee (non-refundable) for anamount of Indian Rupees 25000 (Twenty fivethousand) in the form of Demand Draft drawn fromNationalised Bank or Pay Order in favour ofBhavnagar Energy Company Limited, payableat Gandhinagar, to be submitted along with theEOI documents.
