(5) An y a p pl i ca t i o n w h i c h r e q u i r e s t h eprepara tion of an environment impact assessment sha llbe submit ted for publ ic comment in accordance withs e c t i o n 2 8 b e f o r e a n y C e r t i f i c a t e i s i s s u e d b y t h e
Authority.
36. (1) Af t e r c on s i d e r i n g a l l r e l ev a n t m a t t e r s ,i n c l u d i n g t h e c o m m e n t s o r r e p r e s e n t a t i o n s m a d eduring the public comment period, the Authority mayissue a Certificate subject to such terms and conditionsas i t thinks fit , including the requirement to undertakea ppropriat e mitiga tion mea sures.
(2) Wh e r e t h e A u t h o r i t y r e f u s e s t o i s s u e aCertificate, i t shall provide to the applicant in writing
its rea sons for such a ction.
37. The Authority shall monitor the performance ofth e activity to ensure complia nce with a ny conditions inthe Certificate, and to confirm that the performance ofth e a ctivity is consistent w ith
(a ) the description provided in the applicationfor a Certifica te; and
(b) t h e i n f o r m a t i o n p r o v i d e d i n a n yenvironmenta l impact a ssessment .
38. (1) Wh e r e a n a c t i v i t y d e s i g n a t e d u n d e rsubsection 35(1) constitutes a development requiringth e express gra nt of permission under t he Town a ndCountry P lan ning Act, t he developer sha ll deal directlyw i t h t h e e n t i t y r e s pon s i b le f or t ow n a n d c ou n t r y

39. Sections 35 to 38 inclusive sha ll not a pply t o(a ) any activity with respect to which, prior to
the da te on w hich review und er this sectionfirst became applicable, all f inal approvalsn e c e s s a r y t o p r o c e e d a l r e a d y h a d b e e n
ob t a i n e d f r om a l l ot h e r g o v er n m e n t a lentit ies requiring such a pprovals; an d(b) any activity with respect to which, prior to
the e ffec t ive da te on which rev iew underthis section first became applicable, outlinep l a n n i n g p e r m i s s i o n o r f u l l p l a n n i n gpermiss ion under t he Town a nd C ount ryP lan ning Act ha d alrea dy been obta ined.
40. Any f i na l de c i s i on b y t h e Au tho r i t y t o r e fu seissuance of a Certificate or to issue a certificate with
conditions may be appealed to the Commission by theperson seeking such Cert ifica te.
41. (1) The Auth ori ty m a y prescr ibe in a ccorda ncewith section 26 (e) the designation of a defined portionof the environment w ithin Trinida d a nd Toba go as a n

(2) For the purpose of subsection (1), designa tionsha ll be ma de by Notice published in th e Gazette.
42. In pursuance of section 41(1), the Notice shallinclude
(a ) a comprehensive description of the area orspecies to be so designa ted;
(b) the rea sons for such designat ion; a nd(c) t h e s p e c i f i c l i m i t a t i o n s o n u s e o f o r
act ivi t ies within such area or with regardt o s u c h s p ec ie s w h i c h a r e r e q u i r e d t oa d e q u a t e l y p r o t e c t t h e i d e n t i f i e denvironmental concerns.
43. Any designat ion of a n environment a lly sensitivearea or environmentally sensitive species
(a ) may permi t the wise use of such a rea orspecies and provide for the undertaking ofappropriate mitigation measures, but shallno t o therwise be deemed to au thor i se o rp e r m i t a n y a c t i v i t y n o t p r e v i o u s l ya u t h o r i s e d o r p e r m i t t e d w i t h r e s p e c t t osuch a rea or species; a nd
(b) s h a l l o n l y r e q u i r e c o m p l i a n c e w i t h t h es p e c i f i c l i m i t a t i o n s o n u s e o r a c t i v i t i e sspecified in th e designa tion.
44. Sections 41 to 43 shall not apply to any activity
w ith respect to w hich, prior t o the da te of designa tion ofa n e n v i r o n m e n t a l l y s e n s i t i v e a r e a o renvironmentally sensitive species, all final approvalsnecessary to proceed had already been obtained from orf o r w h i c h a p p l i c a t i o n h a d b e e n m a d e t o a l lgovernmenta l entit ies requiring such a pprovals.

45. For the purposes of sections 41 to 43 inclusive,the Authority shall co-ordinate with any governmentale n t i t i e s h a v i n g r e s p o n s i b i l i t y f o r p l a n n i n g a n dm a n a g e m en t i n s u ch a r e a s o r w i t h r e s p ect t o s u chspecies.
46. Any fina l action designat ing an environmenta llysensitive area or environmentally sensitive speciessha ll be capa ble of a ppea l to the Commission.
47. The Auth ority m a y, a s prescribed by r ule, requirea ny person w ho relea ses a pollutan t from a ny premiseso r v e h i c l e , o r w h o e n g a g e s i n t h e h a n d l i n g o f a n yhazardous substance, on a one-time or periodic basist o

48. (1) Where an a pplica tion is ma de under section
50(3), 53(3), 57(4) or 60(2) for the grant of a permit orl i cence under sec t ion 50(1) , 53(1) , 57(1) o r 60(1) ,r e s p ec t i v el y, a n d t h e Au t h o r i t y r e q u i r e s f u r t h e ri n f or m a t i o n f or t h e p u r p os e of d e a l i n g w i t h t h eappl icat ion, the Authori ty may require the person toprovide results of resea rch or a na lysis to be underta kenby such person.
(2)The Author i ty may, as p rescr ibed by ru le ,revoke, suspend, vary or cancel any provision in suchpermit or licence where the Authority determines such
a ction is necessar y.
(3) Any conditions imposed in respect of a permit ,or a revocat ion, suspension, var ia t ion or cancel la t iontakes effect when notice is served on the holder of thepermit or such later t ime as the Authority may directin t he notice.
(4) Any such revoca tion, suspension, va ria tion orcancellation of a permit or licence shall be capable ofappea l t o t he Comm is s io n by t h e pe rmi t o r l i c ence

(2) The t e rms a nd c ond i t i o n s o f a p e r m i t ma y

(3) A person sha ll apply to the Authority for th egra nt of an Air Pollution Permit in a ccordance with t heform a s determined by th e Auth ority.
51. (1) N o p er s o n s h a l l r e l e a s e o r c a u s e t o b ereleased any air pollutant into the environment whichis in viola tion of any a pplica ble stan da rds, conditions or
permit requirements under t his Act.(2) No person sha ll emit or ca use to be emitt ed
a n y n o i s e g r e a t e r i n v o l u m e o r i n t e n s i t y t h a nprescr ibed in rules made under sect ion 26 or by anya pplica ble stan da rds, conditions or requirement s underth is Act.

56. The Authority shall as soon as practicable afterth e commencement of th is Act, submit t o the Minister ap rog ramme to de f i ne t h o s e was t e s w h i c h shou ld bedeemed hazardous wastes, to establish requirementsfor the handl ing and disposal of hazardous wastes , toestablish appropriate standards and design criteria for
hazardous waste handl ing and disposal faci l i t ies , andto e s t ab l i sh l i c e ns in g an d p e r m i t t i ng r e qu i r e m en t sw ith respect to such w a stes.
57. (1) Th e Au t h or i t y m a y r e q u i r e a n d g r a n t ap er m i t t o a u t h o r i s e a n y p er s o n s w a s t e d i s p os a lac t iv i t i es , o r l i cences fo r the opera t ion of any was tehandling facility, subject to such terms and conditionsas i t t h inks fi t .
(2) The term s a nd conditions of a l icence underth i s s ec t i on may r e l a t e t o t h e de s ign , c ons t ru c t i on ,opera t ion , main tenance and moni tor ing of any was teha ndling fa cility.

58. No person sh a ll ha ndle or dispose of a ny w a ste orhazardous waste in a manner which is in violat ion of
any applicable licence, permit, standards, conditions orrequirement s under t his Act.

60. 61. a ccidenta l spills or other releas es of polluta nt s, or otherincidents with respect to hazardous substances, whichm a y p r e s e n t a r i s k t o h u m a n h e a l t h o r t h eenvironment.
(2) The de s i gna t i on o f such c a t ego r i e s by t h eAuthor i ty sha l l be submi t ted for publ ic comment ina ccorda nce wit h section 28.
(3) After th e f inal designat ion of a ny ca tegoriesu n d e r t h i s s e ct i o n , a n y p e r s on i n c h a r g e of a n ypremises or vehicle shall, as soon as he has knowledge
of a release or other incident referred to in this sectionassoc ia ted wi th such premises o r veh ic le , no t i fy theAuthority of such release or incident and provide to theAuthority

62. F o r t h e p u r p o s e s o f t h i s P a r t a n d P a r t V I I I ,environmental requirement means the requirementupon a person to
(a ) c o m p l y w i t h t h e p r o c e d u r e s f o r t h er e g i s t r a t i o n o f s o u r c e s f r o m w h i c hp o l l u t a n t s m a y b e r e l e a s e d i n t o t h eenvironment;
(b) comply with the procedures and s tandardswith respect to permits or licences requiredf o r a n y p e r s o n t o i n s t a l l o r o p e r a t e a n yprocess or source from w hich polluta nt s w illbe or may continue to be released into theenvironment;
(c) provide in a t imely manner complete anda ccu r a t e i n f or m a t i on i n a n y r e q u i r e dsubmiss ion to o r communica t ion wi th the

(j ) control the release of pollutants in such amanner as to comply wi th any permi t o rlicence granted under section 50(1), 53(1),57(1) or 60(1);
(k ) submit timely payment of required fees or
charges paya ble to the Auth ority; a nd(l ) c o m p l y w i t h a l l o t h e r p r o c e d u r e s ,
s ta ndards , p rogrammes a nd requirementsin such a manner as may be prescribed byrule or regulation.

(b) c o m p e n s a t i o n f o r d a m a g e s t o t h eenvironment associated with publ ic landsor holdings which arise out of the violationreferenced in the Administrative Order;

(2) The Chai rma n a nd Deputy C hai rma n of theCommission sh a ll each be an a tt orney-a t-law of not lesstha n ten years s ta nding, and sha l l be appointed by thePresident.
(3) The members of the Commission, oth er tha nt h e C h a i r m a n a n d D e pu t y C h a i r m a n , s h a l l bea ppointed by t he P resident from a mong such persons a sa ppear t o the P resident to be qualified by virtue of theirknowledge of, or experience in environmental issues,engineering, th e na tur a l sciences or the socia l sciences.
(4) Al l members o f the Commiss ion sha l l ho ldo ff i ce u n d e r s u c h r e q u i r e m e n t s a n d co n d i t i on s o fservice and for such term, not less th a n t hree yea rs, asmay be determined by the President and set for th inth e terms of reference at the t ime of th eir a ppointment ,and shall be eligible for reappointment.

(13) The decision of th e Comm ission sh a ll be th a tof the majority of the members present, but the opinionof the presiding member shal l prevai l on any matterarising in the course of any proceedings which, in hisopinion, is a q uestion of la w.
(14) Th e d e c i s i on o f t h e C o m m i s s i o n i n a n yproceedings sha ll be delivered by th e presiding membera n d a n y m e m b e r m a y p r o v i d e a c o n c u r r i n g o rdissent ing opinion t o the decision of th e Commission.

(16) The presiding mem ber ma y, subject t o th erules of th e Commission a nd t o this Act, determine t he

provision of this Act or any other law may be evaded orviolat ed, commits a n offence and is l iable, on sum ma ryc on v i c t i on , t o a f i n e of t e n t h o u s a n d d o l la r s a n dimprisonment for six months.
95. (1) Where any member of the B oar d, as w ell asa ny Trust ee for t he Fu nd, employee of th e Auth ority orEnvi ronmenta l Off ice r, has any ac tua l o r reasonablyperceived interest in a matter which would otherwisecome before such individua l as pa rt of th e considera tion
or other action to be taken by the Authority, whethersuch interest is direct or indirect or arises because of apo t en t i a l f i nanc i a l i n t e r e s t o r a n immed ia t e f ami l yrelationship, such member of the Board, employee orEnvironmental Officer shall declare the nature of suchinterest a t th e first pra ctica ble opportun ity.
(2) In a ny insta nce wh ich a rises under subsection( 1 ) , s u c h m e m b e r o f t h e B o a r d , e m p l o y e e o rE n v i r o n m e n t a l O f f i c e r s h a l l n o t v o t e o r o t h e r w i s eparticipate in the decision-making process, or attempt
to influence in any way the decision or action taken ort o be t aken by t he Au tho r i t y, w i th r e s p ec t t o suchmatter.
(3) I f a ny a ct ion ha s a l ready been ta ken by theBoard or the Authority before such interest has been

Au tho r i t y o r Env i r o nmen ta l Off i c e r wh o kno w ing lyviolates the requirements of this section, commits anoffence a nd is lia ble, on summa ry conviction, to a fin e offive thousa nd dolla rs.
96. (1) Th e M i n i s t e r m a y m a k e r e g u l a t i on sprescribing ma tt ers required or permitted by th is Act tobe prescribed, or necessary or convenient for carrying
out or giving effect to t his Act.(2) With out limiting t he generalit y of subsection
(1), th e Minister sh a ll ha ve pow er to prescribe
(a ) the amount of charges and fees payable tot h e A u t h o r i t y f o r o r i n r e l a t i o n t oappl ica t ions , l i cences , permi t s o r fo r theprovisions of services or ma teria ls providedby th e Authority t o any person;
(b) t h e a m oun t o f a ny o the r c ha rge s o r f e e swhich may be specified in any programmedeve loped by the Author i ty to encouragep r o t e c t i o n a n d c o n s e r v a t i o n o f t h eenvironment;
(c) the manner of implementing pol ic ies andprogram mes r eferred to in section 16(1) (b) .
(3) Regulations under t his section ma y prescribespecific offences under this Act and provide that anyp e r s o n c o m m i t t i n g s u c h a n o f f e n c e i s l i a b l e , o nsummary conviction, to a fine of not more than twenty
thousand dol lars and imprisonment of not more thanone year.
97. All acts and things done or omit ted to be doneunder the Environmental Management Act, 1995 (thef or m e r Act ) s h a l l , n ot w i t h s t a n d i n g a n y l a w t o t h e

98. The Envi ronmenta l Management Act , 1995 i shereby repealed.
