    Environment Protection

    The protection of environment is a global issue and it is not an isolated problem of any

    area or nation. The problem of environmental pollution in an increasingly small world

    concerns all countries irrespective of their size, level of development or ideology.

    Notwithstanding political division of the world into national units, the oceanic worldis interconnected whole; and winds that blow over the countries are also one.

    The problem of environmental protection is not new in its origin. It is as old as the

    emergence of Homo sapiens on the planet and it was realized in the times of Plato

    2500 years ago. However, different dimensions of the problem of environment

    protection and its management have take a serious turn in the present era.

    In fact, the concern for environment protection in India can be traced back to the

    period between 321 to 300 B.C. The ancient Indian law on environment protection is

    found in Kautilya's Arthashatra. It was the dharma of each individual in the society toprotect the nature. The people worshipped the objects of nature. The trees, water, land

    and animals gained important position in the ancient times. The cultural and religious

    heritage of Indian shows a deep concern for the protection and preservation of the

    environment.

    The world history reveals that almost all religious and philosophical writings

    expressed concern for protection and adequate use of natural resources and also need

    for preserving natural wealth for the sake of future generations.

    Thus, in the ancient time, water, animals and plants mostly attracted a favourable

    attention of each member of the society. It was the religion which controlled the

    activities of individuals. The dharma of environment was to sustain and ensure

    progress and welfare of all. The most important and noteworthy development of this

    period was that each individual knew his duty to protect the environment and he tried

    to act accordingly.

    It is not that in India there were no laws earlier to protect the environment from

    pollution and that it is recent phenomenon to have laws to protect the environment.

    Even from the last century, in India, there have been various statutory provisions,specific legislations and application of common law principles the object of which is

    to protect the environment. Thus, broadly speaking, the legal remedies which are

    available in India for protecting the environment from pollution are common law

    remedies and statutory remedies.

    OBJECTIVES OF ENVIRONMENT PROTECTION

    The main objectives of the Environment Protection are as follows:-

    1. Controlled, restricted and mindful use and exploitation of natural

    resources;

    2. Maintenance and protection of environmental quality;

    3. Protecting and balancing of the eco-system;

    4. Achievement of substantial development;

    5. Environment awareness among the people;

    6. Working out the pollution problems;

    7. Environmental education and training;

    8. Punishment of the polluter.

    Further my paper will consist of environmental pollution and it remedies under

    different laws, it will also deal with justice delivery system under various

    environmental law and major problem in delivering justice and role of Supreme Court

    and high court in environment protection.

    1
