FOREWORD
1.1 This publication is a reference document which outlines the organisation structure the government of Enugu State of Nigeria and the roles each administratively independent establishment is expected to play as an integral part of the State Government. We expect this publication to address the erroneous impression that the structure of the Government is not formalised and the lack of information and appreciation about the functions and service responsibilities of the various establishments of government.
1.2 The overall approach is to document accurately and publish, what is currently in place in all government establishments as a base. This will then provide the foundation for future structural reviews and revisions that may be required to improve performance in the public service of Enugu State.
1.3 An essential ingredient of good governance is for leaders and operatives of an organisation to target to perform effectively in clearly defined functions and roles. A precursor to this is being clear about the functions and responsibilities of the establishment to which they belong and that of the functionaries of the establishment. Good governance is about focusing on the organisation’s purpose and on outcomes for citizens and service users. It is therefore fundamental that each Government functionary is clear about his/her establishment’s purpose and its intended outcomes for citizens and service users. This is also a bedrock for objective performance evaluation and management.
1.4 This publication is therefore an effort towards achieving the agenda for good governance by the Governor Sullivan I. Chime led administration as captured in the 4-point agenda on encouraging SERVICE AND ACCOUNTABILITY: “The public service must provide services to the people of the state; and every public servant, including political office holders, must be accountable to the people for the services for which he has been employed to render.”
1.5 The documentation of the structure, mandates and functions of MDAs as they are today (as is) is targeted primarily to improve performance across government MDAs. Subsequently, it is believed that it will help to achieve the target of a leaner, more efficient government because it will form the basis for studies and recommendations for possible rationalisation and further delineation of functions of the entire government organization to achieve efficiency and increased productivity. This also a goal of the 4-point agenda.
1.6 The procedure adopted for the development and approval of this documentation is painstaking and rigorous. However, the publication may still not be error proof. We also believe there are opportunities for improving the entire government organisation. Any feedback in these regards will be appreciated and should be forwarded to the Office of the Secretary to the State Government or the Head of Service.

1. INTRODUCTION
1.8 International experience shows that a clear and appropriate mandate and structure for the State government is an essential prerequisite for wider civil service reform. The lack of explicit information on, and understanding of, the organisation of the State government and the distribution of responsibilities among MDAs lead to confusion over roles in service delivery and dilutes accountability.
1.9 A first step to improving government performance and accountability is to make explicit what the current situation is and to make this description widely available. 1.10 The objective is to make available, information on the current State government organisation structure, MDA mandates together with their associated parastatals and agencies in the State. We expect this publication to address the erroneous impression that the structure of the Enugu State Government is not formalised and there is a lack of information and appreciation about the allotment of functions and service responsibilities amongst the various establishments of the government.
1.11 The overall approach is to document accurately, what is currently in place and make this available to the public service and the public at large. This base document will provide the foundation for future structural reviews and revisions that may be required to improve performance in the public service of Enugu State.
2. APPROACH AND PROCESS 2.1 The document of mandates and functions of MDAs was kick-started at the Performance Improvement Bureau (PIB), Office of the Head of Service with support from the SPARC Project of the UK’s DFID. The starting point for the collection of information was two documents previously drawn up by PIB. The first was a “Schedule of Duties for Ministries and Non-Ministerial Departments” that had not been published. The second, also prepared by PIB was a listing of the departments and agencies of the State Government which again had not been published. 2.2 The information from the two documents were combined into one draft and circulated to all MDAs by the Head of Service with a request for Ministries to review and amend the draft. The additions and amendments received were incorporated into the draft. Further information on Local Governments and Federal Ministries and Agencies with representation in the State was added. The legal provision establishing parastatals, commissions and state commercial enterprises were referenced to the “Laws of Enugu State 2004”and the supplement to the “Revised Laws of Enugu State, 2010”. 2.3. The revised draft was then circulated to all Commissioners and Permanent Secretaries to seek their comment and information as a way to resolve any gaps and confusions concerning the apportionment of mandates and functions among the institutions. The feedback obtained have been incorporated in this document. 2.4. The final draft was then presented for approval of the Executive Council of Enugu State. As part of its review and approval, an executive session was held on 8th December 2010 by the members of the Executive Council, Permanent Secretaries and Heads of Non- Ministerial Departments on the draft document earlier produced. The inputs and amendments adopted in that meeting have been reflected in the document

GLOSSARY OF KEY TERMS DIFFERENTIATING THE MDAS Agency An Agency is an administrative unit of government that provides a particular service on behalf of the government. An agency usually has a limited mandate and is often headed by a Director or equivalent. It is often slightly bigger than a Department of a Ministry. An agency is usually under the supervision of a Ministry. Examples of Agencies are: Enugu State Emergency Management Agency and the Small Towns Water and Sanitation Agency. The creation of an Agency requires the passage of a Bill by the State House of Assembly. Bureau A Bureau is an administrative creation of the Governor through approval of the State Executive Council, just like Ministries. It is an office, a government department or part of it, that provides information on a more specific subject or service area than a Ministry. It is smaller than a Ministry and most are headed by Permanent Secretaries or Directors- General, depending on the services they are expected to render to the public. The creation of a Bureau does not require the passage of a Bill by the State House of Assembly but is instead created by a Legal Notice posted in the Gazette from the Governor assigning responsibilities to the Bureau. Board A Board is a group of people appointed to make decisions and control or oversee the activities of a company/organization. Its activities are determined by the powers, duties/responsibilities conferred on it by an authority outside itself, e.g. the government. These duties are usually detailed in the laws that establish the Board. In government, some Boards provide social services to the public while others are commercially or economically oriented. Boards are headed by Chairmen and are answerable to their parent Ministries. Examples are: the State Staff Pensions Board; Enugu State Scholarship and Education Loans Board, Enugu State Universal Basic Education Board and the State Hospital Management Board. The creation of a Board requires the passage of a Bill by the State House of Assembly. Commission A Commission is a statutory body established by government to oversee specific functions. It has a high level of autonomy and its members have a specific duration for which they can serve. A Commission is headed by a chairman and the Governor appoints the members. Commissions are often categorized under Extra-Ministerial Departments. The creation of a Commission may or may not require the passage of a Bill by the State House of Assembly depending on whether it derives powers and recognition from the Constitution of the Federal Republic of Nigeria.

Extra-Ministerial Department An extra-ministerial department is a specialized government department created to carry out specific functions. It is a statutory body established by the constitution with a level of autonomy superior to a Ministry. Examples are Civil Service Commissions, Enugu State Independent Electoral Commission, and Judicial Service Commission. Government–owned Company Establishments of government that are incorporated under the Company and Allied Matters Act (CAMA) of 1990.All companies have Memorandum and Articles of Association. Ministry A Ministry is a government establishment with the statutory power of programme/policy initiation and implementation on specific areas of human life on behalf of government. It is a part of the executive arm of government. It is structured into departments, each headed by Directors and other civil servants serve as subordinates. The State government may have many Ministries each with a specialized field delivering specialized services to the public. The creation of a Ministry does not require the passage of a Bill by the State House of Assembly but by directive of the Governor published in the official gazette, assigning responsibilities to the Ministry. Usually, the State Ministries are headed by Commissioners appointed by the Governor, while Permanent Secretaries serve as Accounting Officers. Office An Office is a position of authority usually recognized by the Constitution of the Federal Republic of Nigeria to carry out statutory functions with a high level of independence. Examples are Office of the Accountant-General, and Office of the Auditor-General (State), which are statutory offices provided in the Constitution. The creation of an Office does not require the passage of a Bill by the State House of Assembly, as in most cases an Office derives its powers and recognition from the Constitution of the Federal Republic of Nigeria or in some cases (Office of the Secretary to the State Government and Office of the Head of Service) through Legal Notices published in the official gazette. Heads of Offices are appointed by and serve the Governor. Parastatal A Parastatal is an institution or organization established by the Government to discharge functions and attain objectives more readily achievable outside the civil service structure, regulations and systems e.g. commercial viability. Most parastatals provide economic, commercial or social services while others are a mixture. They are granted a measure of

independence through their Boards, to enable them achieve the purpose for which they were set up, subject to compliance with Government policies. They are supposed to have their own budgets and are usually under the supervision of Ministries. Parastatals are headed by General Managers, Managing Directors or Directors -General whose mode of appointment, powers, etc are provided in the enabling law that established them. Some parastatals are government companies who operate for profit and are incorporated under the Companies and Allied Matters Act. Examples of parastatals are the State Housing Development Corporation and Enugu State Water Corporation.

Local Government Authorities
CONSTITUTIONAL FUNCTIONS (as set out in the Fourth Schedule, National Constitution) “1. The main functions of a local government council are as follows: (a) the consideration and the making of recommendations to a State commission on economic planning or any similar body on – (i) the economic development of the State, particularly in so far as the areas of authority of the council and of the State are affected, and (ii) proposals made by the said commission or body; (b) collection of rates, radio and television licences: (c) establishment and maintenance of cemeteries, burial grounds, and homes for the destitute or infirm; (d) licensing of bicycles, trucks (other than mechanically propelled trucks), canoes, wheel barrows and carts; (e) establishment, maintenance and regulation of slaughter houses, slaughter slabs, markets, motor parks and public conveniences; (f) construction and maintenance of roads, streets, street lighting, drains and other public highways, parks, gardens, open spaces, or such public facilities as may be prescribed from time to time by the House of Assembly of the State; (g) naming of roads and streets and numbering of houses; (h) provision and maintenance of public conveniences, sewage and refuse disposal; (i) registration of all births, deaths and marriages; (j) assessment of privately owned houses or tenements for the purpose of levying rates as may be prescribed by the House of Assembly of the State; and (k) control and regulation of (i) out-door advertising and hoardings (ii) movement and keeping of pets of all description (iii) shops and kiosks (iv) restaurants, bakeries and other places for the sale of food to the public (v) laundries (vi) licensing, regulation and control of the sale of liquor 2. The functions of a local government shall include participation of such council in
the Government of a State as respects the following matters: (a) the provision and maintenance of primary, adult and vocational education; (b) the development of agriculture and natural resources, other than the
exploitation of minerals; (c) the provision and maintenance of health services; and (d) such other functions as may be conferred on a local government council by
the House of Assembly of the State. The Enugu State Local Government Act, Cap109 of 2000 Part IX (55) adds further provisions: Subject to this Law or any other enactment, every Local Government shall be responsible for, and have power to make bye-laws, for all or any of the following matters, that is –
a. Health centres, maternity centres, dispensaries and health clinics, ambulance services, leprosy clinics and preventative health services;
b. Meat inspection and abattoirs c. Nursery, primary and adult education; d. Information and public enlightenment; e. Provision of scholarships and bursaries; f. Provision of public libraries and reading rooms; g. Agriculture and animal health extension services and veterinary clinics;

h. Rural and semi-urban water-supply; i. Fire services; j. Provision of roads (other than trunk roads) their lighting and drainage; k. Support for arts and culture; l. Control of pollution; m. Control of beggars, or prostitution and repatriation of destitutes; n. Provision of homes for the destitute, the inform and orphans; o. Provision of public utilities including roads and water transport; p. Public housing programmes; q. Regulation and control of buildings; r. Town and country planning; s. Operation of commercial undertakings; t. Control of traffic and parking; u. Pipe sewerage systems; and v. Rural electrification
It should be noted than any of these powers may be negated or superseded by the enactment of superior State law.
