GENERALDIRECTIONSFORTHEGUIDANCEOF THETENDERER

1. Thesedirectionsareprovidedtoassistthetendererinpreparingandsubmittinghistender.Thetendershall

containallinformationanddatarequiredtobefurnishedandshallbepreparedandsubmittedinaccordancewith theinstructionssetforthherein.

2. Allnecessarydocuments,suchascopiesofspecifications(excludingstandardspecificationbooks,composite

schedule of rates, etc.), contract documents, including bill of quantities, estimated scheduled rates and any other documents required in connection with the preparation of tender or execution of works, signed, by the Engineer-in-changewillaccompanythetenderformandthecost.ofsuchannexeddocumentswillreflectedin the cost of the tender form.

3.Thetenderwillnotbereimbursedforanycostsofanykind,whatsoever,incurredinconnectionwiththe

preparationandsubmissionofhistender.

4. Nosingletendershallincludemorethanonework:Atendererwhowishestotenderfortwoormoreworksshall submittenderforeachwork,separately.

5. Thememorandumofworktenderedfor,andthescheduleofmaterialsandequipmenttobesuppliedbythe Engineer-n-

chargeandtheratesatwhichtheyaretobechargedfor(annexedhereto)shallbefilledintheofflce of the engineer -in-charge before the tender form is issued. At this stage the tenderer should ensure that the tenderformsoissuediscompleteinallrespects.

6. Thetenderershallnotethattileultimateresponsibilityforthequalityofworkanditsconformitywiththe

specificationsanddrawingsrestssolelywiththesuccessfu1bidderwhosetenderisaccepted.

7. Thetenderershall,athisownexpense,inspectandexaminethesiteandsurroundingsandobtainforhimself,on hisownresponsibility,allinformationthatmaybenecessaryforpreparingthetenderandenteringintocontract, and shall determine and satisfy himself by such means as he may consider necassaryor desirable as to all matterspertainingtothetender. Thetenderershallalsosatisfyhimselfbeforesubmittinghistenderastothe nature of grounds, hydrological and climatic conditions, the form and nature of the site, the natureand layout oftheterrain,theavailabilityoflabour,water,electricpowerandtransportationfacilitiesinthearea.Thetenderer shall specially investigate into the sources of materials to be used for the works and satisfy himself about the qualityandquantitiesofmaterialstobeusedfortheworksandsatisfyhimselfaboutthequalityandquantities ofmaterialsavailableforthecompletionoftheworkandthemeansofaccesstothesite,theaccommodationhe may require and, in general, shall himself obtain all necessary information, as to the risks, contingencies and othercircumstanceswhichmayinfluenceoraffecthistender. Theengineerinchargeshallnotassumeany responsibilityregardinginformationgathered,interpretationordeductionwhichthetenderermayarriveat,from thedatathatmaybefurnishedwiththecontractdocuments.

8(a) Thetenderershallfillupthebidscheduleandindicatethepercentagerateaboveorbelowthescheduleofrates

forthe“Scheduleitems”onwhichheiswillingtoundertakeeachitemofwork.Nopremiumwillbequotedbythe contractor against non scheduled/items rates, for which the rate and amount has already been filled in by the engineer-in-chargeinthebidschedule,

8.(b) 1ncasetendersarecalledonitemratebasis,thetenderershallquotehisownunitrateinthebidscheduleon

whichheiswillingtoundertakeeachitemofwork,

9.(i) Thetenderershallworkouttheamountagainsteachitemofworkinthebidscheduleandwillindicatethetotal. amountofhistender(includingthecostonon-scheduled/itemsratesforwhichtherateandamounthasalready beenfilledinbytheengineer-in-chargeinthebidschedule)onwhichheiswilltocompletetheworks.Thetotal amountworkedoutinthebidscheduleshallbeenteredbythetendererinhistenderashistenderpriceforthe work.Incaseofdiscrepancybetweenamountsinfiguresandinwordstheamountin,wordsshallprevail.

(ii) Shouldanydiscrepancybefoundintheamountofpayitemsorifacolumnofamountisfoundblankafterfilling inaunitrate,theunitratefilled,bythetendererwillbeextendedinworkingoutoftheamountofthetenderand thetotalamountofthebidschedulewillbeadjustedaccordingly.

(iii) Ifaunitrateisleftblank,buttheamountagainsttheitemisfilled,theunitratewillbeworkedoutonthebasis

oftheamountdividedbythequantityoftheitemshowninthebidschedule.

(iv) Ifit is found that the tenderer has not entered any unit rate and amount against any of the pay items of the bid

schedule,theengineerinchargeshallfillintheblanksbynothingtheword“Nil”insuchblanksatthetimeof opening of the tender. Such pay items shall be deemed to be covered by the rates of other items.

(v) If the tenderer does not accept the adjusted/corrected amount of tender according to the above provision, his

tender shall be rejected and the earnest money forfeited.

10. Thetenderwhichproposesanyalterationintheworksspecifiedinthebidscheduleorinthetimeallowedfor

carryingouttheworksorinanyotherconditionmentionedbytheengineer-in-charge,willbeliabletorejection, Thetenderershallsigneachandeverypageofthetenderandcontractdocuments,withoutmakinganyalteration. All enclosures issued with the contract documents, shall be attached with the tender duly signed by the tenderer. Anyadditionoralterationmadeafterfillingtheformshallbedulyattestedbythetenderer.Non- complianceofthisconditionshallrenderthetenderliabletorejection.

11. Thetenderershallfillinthetenderdocumentsinink:Errors,ifany,shallbescoredoutandcorrectionsrewritten

legiblyandattestedbythetenderer.Anyadditionoralterationmadeafterthefillingtheformshallbeduly attestedbythetenderer.Noncomplianceofthisconditionshallrenderthetenderliabletorejection.Anytender withunattestedcorrectionshallbeattestedbythetendererinthepresenceofothertenderersatthetimeof openingofthetenderexceptthatnocorrectionshallbepermissibleintherateoramountofthebidscheduleor in the tendered price after the opening of the tender.

12. Additionalclause(s)foraparticularworkshallbetypedonseparatesheetsbytheengineer-in-charge,whichwill

beannexedtothecontractdeleteanyadditionalclause(s)intheadditionalclauses(s)sheet(s),providedbythe engineerincharge.

13. Thequantitiesmentionedinthebidscheduleareestimatedquantities,tobeusedforpreparingtenders,andthe engineer-

in-chargedoesnotexpresslynorbyimplicationagreethattheactualamountofworkstobeperformed willcorrespondtherewith.Nopaymentwillbemadeonaccountofanticipatedprofitsforworkcoveredbythe contractwhich,isnotperformed,norwillanyadjustmentintheunitratessetforthinthebidschedulebemade because of an increase or decrease in the actual quantities from the estimated quantities indicated therein, exceptasdeterminedinaccordancewiththeprovisionsofclause42ofthegeneralconditionsofcontract.

14. Notenderwithoutearnestmoneyshallbeentertained.Earnestmoney,calculated@2%oftheestimatedcostof

thework(roundedsuitably),shallbeintheformof‘depositatcallreceipt’.Theearnestmoneyoftheunsuccessful tenderersshallnormallybereturnedbytheengineer-in-chargewithinaweekofopeningofthetendersandin anycasenotlaterthanthirty(30)daysfollowingthedatesetforopeningoftendersexceptincaseswherethe tendersaretobeacceptedbytheUniversityEngineer,inthosecasestheearnestmoneyofonlythethreelowest bidderswillberetainedandreturnedtotheunsuccessfulbiddersnotlaterthansixty(60)daysofopeningofthe tenders. In the event of the tender being accepted, a receipt for the earnest money forwarded therewith, shall thereuponbegiventothecontractor.Theearnestmoneyofthesuccessfultendereronexecutionofthecontract covering work will be adjusted towards the amount of security deposit to be retained from the first amount(s) payabletothecontractorunderthecontract.

15. The successful tenderer will be required to enter into a contract, furnish the performance security (wherever

required)andtocommencetheworkwithinthetimesspecifiedinthememorandumofwork.Shouldthesuccessful tendererrefuseorfailforanyreasontoenterintocontract,ortofurnishtheperformancesecurityortocommence theworkwithinthetimespecifiedinthememorandumofwork,itshouldconstituteajustcausefortheannulment

oftheawardandintheeventofsuchannulment,theentireearnestmoneyshallbeforfeitedtoGovernment,as compensationforsuchdefault.

16.(i) Thetendershallbesignedbytheperson(s)dulyauthorisedtodoso.Intheeventofatenderbeingsubmitted

byafirm,itshallbesignedseparatelybyeachmemberthereof,orintheeventoftheabsenceofanypartner,it shallbesignedonhisbehalfbyapersonholdingapowerofattorneyauthorisinghimtodoso.Suchpowerof attorney should be produced with the tender and it must disclose that the firm is duly registered under the partnershipAct,1932oranyotherlawinforce.

(ii) Thetendersubmittedbyajointventureoftwoormorefirmsshallbeaccompaniedbyadocumentofformation of the

joinventure, duly registered and authenticated by a competent court, in which shall be stated precisely, the conditions under which it shall function, its period of validity, the person(s) authorisedto represent it and accept its obligations the participation of several firms forming the joint venture and any other information necessarytopermitafullappraisalofitsfunction.

(iii) AtendersubmittedbyacorporationmustbearthesealofthecorporationandbeattestedbyItsSecretary.

(iv)Inallcases,thetendermustbesignedbyanindividualorindividualshavingpowerstolegallybindthefirm, joint venture, corporation’ or companies on whose behalf they are signing.

17. Eachtenderershallbedeemedtohavesatisfiedhimselfbeforetenderingastothecorrectnessandsufficiency

ofhistenderandoftheratesandpricesstatedinthebidschedule,whichratesandpricesshall,exceptinsofar asitisotherwiseexpresslyprovidedinthecontract,coverallobligationsunderthecontractandallmattersand things necessary for the proper completion and maintenance of the work.

18. Thetenderermaymodifyorwithdrawhistenderaftersubmission,providedthatthemodificationornoticeof

withdrawalisreceivedinwritingbytheEngineer-in-chargepriortotheprescribeddeadlineforsubmissionof tenders.The tenderer’s modification or notice of withdrawal shall be prepared, sealed, marked and delivered, withtheinnerenvelopesadditionallymarkedMODIFICATION’or:WITHDRAWAL”asappropriate.Notender maybemodifiedsubsequenttothedeadlineforsubmissionoftenders. Withdrawalofatenderduringthe intervalbetweenthedeadlineforsubmissionoftendersandtheexpirationoftheperiodoftendervalidityi.e., sixty(60)daysasspecifiedbythetendererintheformof Tendermayresultintheforfeitureofthetender security.

19. ThetenderershallsubmittheoriginaltenderDocumentscompleteinallrespectsandkeepacopyofthetender

forhisownrecord.Theoriginalshouldbesealedinaninnerandanouterenvelope,dulymarkingtheenvelopes as “ORIGINAL”.Theinnerandouterenvelopesshall:(a)beaddressedto,(b)andbearthefollowing identifications:Tenderfor(NameofContract)(ReferenceNumberofTender),andthewords“DONOTOPEN BEFORE (Time and date, set for opening)”. The inner envelopes shall indicate the name and address of the tenderer to enable the tender to be returned unopened in case it is declared to have been received late is otherwise unacceptable. If the outer envelope is not sealed and marked as instructed above, the Engineer-in- charge will assume no responsibility for the misplacement or premature opening of the tender submitted. A tenderopenedprematurelybecauseofimproperidentificationwillberejected.

20. Thetenderershallindicateinthespaceprovidedinthetenderhisfullandproperaddressatwhichnoticemay

belegallyservedonhimandatwhichallcorrespondenceinconnectionwithhistenderandthecontractistobe sent.

21. Thepresentationoftenderimpliesfullacceptanceonthepartofthetendereroftheseinstructionsandallother

conditionssetforthinthecontractdocument.

22. AnytenderreceivedbytheUniversityEngineer(Engineer-in-chargeafterthedeadlineforsubmissionoftenders

prescribedintheNoticeInvitingTenderswillbereturnedunopenedtothetenderer.

23. TheEngipeer-in-chargeorhisdulyauthorisedoffice(notbelowtherankofAssistantEngineerwillopentenders in the presence of intending tenderers or their authorized agents, who may be present at the time. The officer opening the tender, will announce the names of the tenderer, tender rates and the presence of requisite tender security.

24. PromptlyaftertheopeningofTenders,theEngineer-in-chargewillundertakeadetailedevaluationoftenders.

TheEngineer-in-chargewilldeterminewhethereachtenderissubstantiallyresponsivetotherequirementsof the tender documents and conforms to all the terms, conditions and specifications of the tender documents withoutmaterialdeviationorreservation.Ifatenderisnotsubstantiallyresponsivetotherequirementsofthe tenderdocuments,itwillberejectedbytheEngineerin-charge,andmaynotsubsequentlybemaderesponsive bythetendererhavingcorrectedorwithdrawnthenon-confirmingdeviationorreservation

25. Except for information to be read out by the Engineer-in-charge at the time of opening tenders in accordance

with para 23 above, no information relating to the examination, clarification, evaluation and comparison of tendersandrecommendationsconcerningtheawardofcontractshallbedisclosedtotenderersorotherpersons not officially concerned with such process. Any effort by a tenderer to influence the process of examination, clarification,evaluationandcomparisonoftenders,andindecisionsconcerningawardofcontract,mayresult inthe_rejectionofhistender.

26. Toassistintheexamination,evaluationandcomparisonoftenders,theEngineer-inchargemay..asktenderers

individual1yforclarificationoftheirtenders,includingbreakdownsofunitrates.Therequestforclarification .and1heresponseshallbeinwritingorbycable,butnochangeinthepriceorsubstanceofthetendershallbe sought,offeredorpermittedexceptasrequiredto.cot;1firmthecorrectionofarithmeticalerrorsdiscoveredby theEngineer-in-chargeduringtheevaluationofthetender.

27. TheEngineer-in-chargeshallhavetherightofrejectingalloranyofthetenderswithoutassigninganyreason

thereof.TheEngineer-in-chargewillnotbeboundtoawardthecontracttothelowestortoanyothertenderer.

28. Theunitratesandpricesenteredinthe.bidschedulewillbetheratesatwhichthecontractorwillbepaid

(Subjecttotheadjustment.specifiedinclause55oftheannexedconditions)andshallbedeemedtoincludeall costs of performing the work, including income tax, super tax, and/or other charges, duties and taxes of the government, autonomous, semi autonomousand local. bodies, profits and costs of accepting the general risk, liabilitiesandobligationssetforthinorimpliedfromthecontract.

29. Priortotheexpirationoftheperiodoftendervalidity(60days)prescribedinthetenderformoranyextension

GENERALCONDITIONSOFCONTRACT DEFINITIONSANDINTERPRETATIONS

DefinitionsClause1:

Inthecontract(ashereinafterdefined)thefollowingwordsandexpressionsshallhavethemeaningsherebyassigned tothem,exceptwherethecontextotherwiserequires:-

(1) “Agentmeansthepersonappointedbythecontractortoactonhisbehalfinhis absence;

(2) “Certificate of completion” means the certificate of completion given by the engineer-in-charge pursuant to

clause40oftheseconditions;

(3) “Contract”meansthecontractagreement,thedocumentssetoutthereinandincludestheconditionsofcontract,’

thetenderandacceptancethereof,thespecifications,thedrawings,thebidschedule,scheduleofratesandthe prices;

(4) “Contractor” means the person or persons, firm or company whose tender has been accepted by the engineer-

in-charge,andshallincludethecontractorsdulyauthorizedrepresentative,successorandassigns.

(5) “Contractprice”meansthesumnamedinthetender,subjecttosuchadditiontheretoordeductionstherefrom

asmaybemadeundertheprovisionsofthecontract;

(6) “Constructional Plant” means all appliances, or things required in or about the execution, completion, or

maintenance of the works or temporary works, but does not include the materials or other things intended to formorformingpartofpermanentortemporaryworks;

(7) “Drawings”meansthedrawing(s)referredtointhecontractdocumentsandanymodificationsofsuchdrawing(s)

asmayfromtimetotimebefurnishedorapprovedinwritingbytheengineer-in-charge;

(8) “EngineerIncharge”meanstheUniversityengineeroranyotherofficerwhoforthetimebeingandfromtimeto

timeinchargeoftheworksandincludesanofficerappointedbytheUniversitytoactasengineer-in-chargefor thepurposesofthecontract;

(9) “University”meansUniversityAuthoritiesofBahauddinZakariyaUniversity,Multan.

(10) “Periodofmaintenance”meanstheperiodduringwhichthecontractorisobligedtoguaranteetheworkor

definedportionsoworkagainst-defectandduringwhichheisobligedtoperformanymaintenanceprocedure that may be specified by the engineer-in-charge and shall be calculated from the date of the certificate of completion given by the engineer-in-charge under the said clause from the respective dates so certified.

(11)“Maintenance”meanstherepairs,amendment,reconstructionandincludestherectificationofdefectsimperfections,

shrinkages and other faults except fair wear and tear as may be required of the contractor in writing by the engineer-in-chargeduringtheperiodo~maintenance;

(12) “Programmeofwork”meanstheprogrammeofworksubmittedbythecontractorandapprovedbytheengineer- in-

chargeandincludesandamendmenttheretomadefromtimetotimeandapprovedbytheengineer-in-charge;

(13) “Scheduleofrates”meansthescheduleofratesissuedbythegovernmentandasinforceonthedateofreceipt

ofthetender;

(14) “Site means the lands and other places on, at, over under, in or through which the works are to be executed or carriedoutinpursuanceofthe,contractoranyadjacentland,orpathorstreet,whichmaybeallottedorusedfor the purpose of carringout the contract or any lands or, places provided by the engineer-in- charge for the purposeofthecontracttogetherwithsuchotherplacesasmaybespecificallydesignatedinorpursuanttothe contractasformingpartofthesite.

(15) “Specifications”meansthespecificationreferredtointhetenderandany‘modificationthereoforaddition

theretoasmayfromtimetotimebefurnishedorapprovedinwritingbytheengineer-in-charge;

(16) “TemporaryWorks”meansalltemporaryworksofeverykindrequiredinorabouttheconstruction,completion

ormaintenanceoftheworks;

(17) “Works”meanstheworkstobeexecutedinaccordancewiththecontract,andincludesanypermanentworksas

requiredforthepel1ormanceofthecontract;

Clause4: Except if arid to the extent otherwise provided by the contract, the conditions of contract. and additionalconditionsannexedheretoshallprevailoverthoseofanyotherdocumentformingpart of the contract. Subject t? the foregoing, the several documents forming the contract are to be taken as mutually explanatory of one another; but in case of any error~ omission, ambiguity or discrepancy’ is found between these documents the same shall be reported to the engineer-in- chargewhoshallcorrectsucherrororomissionorexplainandadjusttheambiguityordiscrepancy, as because may be, and shall thereupon issue to the contractor instructions directing in what manner the work is to be carried out. Clause7: Thecontractorshall(a)within15daysofthereceiptbyhimofthenotificationoftheacceptanceof his tender furnish to the engineer-in-charge in cash, bank draft, Cashier’s Chequeor payment orderorBankGuaranteefromthebankofPunjaboranyscheduledbankofPakistanorapproved Insurance Companies in Pakistan, the amount to make up the full performance security’ where required and specified in the tender and/or (b) permit Government at the time of the making any payment to him for work done under the contract to deduct such sum as specified in item (h) of memorandum and moneys or deductions so paid or made shall be held as additional security deposit. Clause8: (1)Thecontractorshall,if.sorequiredbytheengineerinchargesubmitinwritingtotheengineer- in-Chargewithintheperiodspecifiedbyhimforhisapprovalaprogrammeshowingtheorderof procedure and the method in which he proposes to carry out the works. The time and progress chartshallbepreparedindirectrelationtothetimeperiodstatedin.item(g)ofthememorandum hereto annexed for the completion of individual items thereof and the works as a whole. It shall indicatetheforecastofthedatesforcommencementandcompletionofvarioustradeprocessfor sectionoftheworks,andshallbeamendedasmayberequiredbyagreementbetweentheengineer- in-chargeandthecontractorwithinthelimitationoftimeimposedinthecontractdocuments.

(3)Thesubmissiontoandapprovalbytheengineer-in-chargeofsuchprogramme,orthefurnishing of such particulars or information shall not relieve the contractor of .any of his duties or responsibilitiesunderthecontract.

(4)Intheeventofthenon-submissionoftheprogrammeorrevised/amendedprogrammeofwork by the contractor for approval by the engineer-in-charge with in the period specified by the engineer-in-charge,thecontractorshallbeliabletopayascompensationanamount,eqt1alto1% perdayorsuchsmalleramountastheengineer-in-charge(whosedecisioninwritingshallbefinal) may decide on the total tendered amount of the work, subject to a maximum of 2% of contract amount.

Clause9: The contractor shall be responsible for the true and proper setting out of the work in relation to originalpointslinesandlevelsofreferencegivenbytheengineer-in-chargeinwriting,andforthe correctness(subjectasabovementioned)oftheposition,levels,dimensionsandalignmentsofall parts of the works and for the provision of all necessary instruments, appliances and labourin connectiontherewith.Ifatanytimeduringtheprogressofthework,anyerrorshallappearorarise intheposition,levels,dimensions,oralignmentsofanypartoftheworks,thecontractoronbeing required so to do by the engineer-in-charge, shall at his own expense, rectify such error to the satisfaction of the engineer-in-charge, unless such error is based on incorrect data, supplied in writingbytheengineer-in-charge,inwhichcase.theexpensesofrectifyingthesameshallbeborne by the Government. The checking of any setting out or of any line or levels by the engineer-in- chargeshallnotinanywayrelievethecontractorofhisresponsibilityforthecorrectnessthereof, andthecontractorshallcarefullyprotectandpreserveallpoints,marks,lines,levels,benchmarks, site-rai1s, pegs, slope-stakes; batten-boards. stakesfor location, and other things used in setting outthework.

Clause10: The contractor shall execute the whole and eveypart of the works in the most substantial and workman-like manner, and both as regards material and otherwise in every respect in strict accordancewiththespecificationsTheworkexecutedbythecontractorshallalsoconfirmtothe design(s)and/ordrawingsandinstructionsinwritingrelatingtotheworksignedbytheengineer- in-chargeandlodgedinhisoffice,andtowhichthecontractorshallbeentitledtohaveaccessas such office, or on the site of the work fl1r the purpose of inspection during office hours. Clause15: Thecontractorshallsupplyathisowncostallmaterials(exceptsuchmaterials,ifany,asmayin accordancewiththecontractbesuppliedfromthedepartmentstore)constructionalplants,tools, appliances,imp1ements,ladders,cordage,tackles,scaffoldingsandtemporaryworks,requisiteor properfortheexecutionoftheworks,whetheroriginal,alteredorsubstituted,andwhetherincluded inthespecificationorotherdocumentsformingpartofthecontractreferredtointheseconditions ornotorwhichmaybenecessaryforthepurposeofsatisfyingorcomplyingwithrequirementsof the engineer-in-charge as any matter as to which under these conditions he is entitled to be satisfied,orwhichheisentitledtorequiretogetherwithcarriagetherefore,toandfromthework. The contractor shall also supply without charge, the requisite number of persons with the means andmaterialsnecessaryforthepurposeofsettingoutworks,andcounting,weighing,andassisting inmeasurementorexaminationatanytime,andfromtimetotimeoftheworkormaterials.Failinghis sodoingthesamemaybeprovidedbytheengineer-in-chargeattheexpenseofthecontractor,and the expenses may be deducted from any money due to the contractor under the contract, or from hissecuritydeposit.Thecontractorshallalsoprovideallnecessaryfencingandlightsrequiredto protectthepublicfromaccident,andshallbeboundtobeartheexpensesofdefenceofeverysuit actionorotherproceedingsatlawthatmaybebroughtbyanypersonforinjuriessustainedbyhim owingtoneglectintakingtheaboveprecautionsand10payanydamagesandcostswhichmaybe awarded in any such suit, action or proceedings to any such person, or which may with the consentofthecontractorbepa1dtocompromiseanyclaimbyanysuchperson

Clause16: Thecontractorshallgivenotlessthanfivedaysnoticeinwritingtotheengineer-in-chargeofhis subordinates in charge of the work, before covering up or otherwise placing beyond the reach of measurementanyworkinorderthatthesamemaybemeasured,andcorrectdimensionsthereofbe taken before the same is so covered up or placed beyond the reach of measurement and shall not coveruporplacebeyondthereachofmeasurementanyworkwithouttheconsentinwritingofthe engineer-in-charge of his subordinate in charge of the work. If any work is covered up or placed beyond the reach of measurement, without such notice having been given and consent obtained, the same shall be uncovered at the contractor’s expenses, and no payment or allowance shall be madeforsuchworkorthematerialswithwhichthesamewasexecuted.

(2) (i) Theengineer-in-chargeshallhavefullpoweratthetimestoobjecttotheemployment and to

require the contractor to remove forthwith from the site, the agent, workman, foremanoranyotherpersonemployedbythecontractororanysub-contractor,whoin theopinionoftheengineer-in-chargemisconducthimselforisincompetentornegligent intheproperperformanceofhisdutiesorwhoseemploymentisotherwiseconsidered by the engineer-in-charge to be undesirable, and the contractor shall comply with the request forthwith.

(ii) Nosuchagent,workmanforemanorotheremployeesafterhisremovalfromtheworkby

request of the engineer-in-charge shall be re-employed or reinstated by hecontractor for the purposes of and in connection with the contract at any time, except with the priorapprovalinwritingoftheengineer-in-charge.

Clause19: The contractor shall in accordance with the requirements of the engineer-in-charge afford all reasonableopportunitiesforcarryingouttheworkbyanyothercontractor(s)specialistcontractor(s) executing a part of the original work or ancillary to the work, employees/workmen of such contractor(s)orthoseoftheGovernment,whomaybeemployedinexecutionof,ornearthesiteof work not included in the contract. If, however, the contractor provides any material services/ assistance or facilities to any such contractor or to the government on the written request of the engineer-in-charge,heshallbepaidareasonablesumasdeterminedbytheengineer-in-chargeor paidaccordingtoprovisioninbidscheduleifalreadymadetherein.

(a) The permanent use or occupation of land by the works or any part thereof or (save as

hereinafterprovided)surfaceorotherdamageasaforesaid

(c) Interferencewhethertemporaryorpermanentwithanyrightoflight,air,wayorwater,or

otherassessmentofquasheasementwhichistheunavoidableresultoftheconstruction of the works in accordance with the contract.

(d) Injuries or damage to persons or property resulting from any act or neglect done or

committed during the currency of the contract of the University it agents, servants or other contractors (not being employed by the contract) or for respect of any claims, demands, prceedings, damages, costs charges, and expenses in respect thereof or in relationthereto.

Clause22: (l) The contractor shall give all notices, and at his own cost pay all fees, required to be

given‘orpaidbyanynationalorstatestatute,ordinanceorotherlawsoranyregulation orbye-lawsofanylocalorotherdulyconstitutedauthorityinrelationtotheexecution oftheworksor.ofanytemporaryworksandbytherulesandregulationsofallpublic bodiesandcompanieswhosepropertyorrightsareaffectedormaybeaffectedinany waybytheworksoranytemporaryworks.

(2) TheContractorshallconforminallrespectswiththeprovisionsofanysuchfederal,

provincialandlocalstatutes,ordinanceorlawasaforesaidand”theregulationsorby- lays of any local or other duly constituted authority, which may be applicable to the works,ortoanytemporaryworksandwithsuchrulesandregulationsofPublicBodies and companies as aforesaid ‘and shall keep the government indemnified against all penaltiesandliabilitiesofeverykindforbreachofanysuchstatutes,ordinanceorlaw, regulationorby-laws.

(3) Thecontractorshallberesponsibleforthepaymentofallincometax,supertaxand other

government or local taxes arising out of the contract, which shall not be re- imbursedtohimbythegovernmentandtheratesandpricesstatedinthebidschedule shallbedeemedtocoverallsuchtaxes.

Clause25: Photographs of the works shall be taken by permission of the engineer-in-charge. Only signs or other advertisement approved by the engineer-in-charge may be displayed at or near the works. PhotographsoftheworksshallnotbepublishedwithoutpriorwrittenapprovaloftheUniversity Engineerwhichshallnotbeunreasonablywithheld.

ASSIGNMENTANDSUB-LETTING Clause26: Thecontractorshallnotassignthecontractoranypartthereoforanybenefitorbenefitorinterest orthereunderwithoutthepriorwrittenconsentoftheengineer-in-charge.

Clause28: (1) Allmaterialsandworkmanshipshallbeoftherespectivekindsdescribedinthecontract

andinaccordancewiththeinstructionsoftheengineer-in-chargeandshallbesubjected from time to time, to such tests as the engineer-in-charge may direct at the place of manufactureorfabricationoronthesiteoratalloranyofsuchplaces.Thecontractor shallprovidesuchassistance,instruments,machines,labourandmaterialsasarenormally required for examining, measuring and testing any work and the quality, weight or quantityofanymaterialusedandshallsupplysamples;ofmaterialsbeforeincorporation intheworksfortestingasmaybe selectedandrequiredbytheengineer-in-charge.

(2) Allsamplesshallbesuppliedbythecontractorathisowncostifthesupplythereofis clearly

intended by or provided for in the specifications or bill of quantities butif not thenatthecostofthegovernment.

(3) Thecostofmakinganytestshallbebornebythecontractor.ifsuchtestisclearly intended by

or providedfor in the specification or bill of quantities and (in thecases onlyofatestunderloadorofatesttoascertain whetherthedesignoranyfinishedor partiallyfinishedworkisappropriateforthepurposeswhichitwasintendedtofulfilis particularisedinthespecificationor billofquantitiesinsufficientdetailtoenablethe contractortopriceorallowforthesameinhistender.

(4) Ifanytestisorderedbytheengineer-in-chargewhichineither:-(a)

notsointendedbyorprovidedfor;or (b) (inthecasesabovementioned)isnotsoparticularised;or (c) Throughsointendedorprovidedforisorderedbytheengineer-in-chargetobe carried

out by an independent person at any place other than the site or the place ofmanufactureorfabricationofthematerialstested.

Then the cost of such test shall be borne by thecontractor if the test shows the workmanship or materials not to be in accordance with the provisions of the contract or the instructions of the engineer-in-chargebutotherwisebytheUniversity.

Clause29: Before any constructional material, fittings is brought to the site of work, the contractor shall submittotheengineer-in-chargerepresentativesamplesofthematerialfittings,etc.,theproposestouse.Thesamplesafterapprovalwillberetainedbytheengineer-in-chargeinhiscustodyandthe contractor shall be responsible for ensuring that materials and fitting, etc., conforming to such samples are used through outthe contract, failing which the material, fittings, etc., will not be accepted and shall be removed forthwith from the site of work if so desired by the engineer-in- charge.

meaningsofeffectofthiscontractspecifiedinthescheduleofmemorandumheretoannexed),the contractorshallbesuppliedwithsuchmaterialsandstoresasrequiredfromtimetotimetobeused by him for the purpose of the contract only, and the value of the full quantity of materials and stores so supplied at the rates specified in the said schedule or memorandum may be set off or deductedfromanysumsdueortobecomedue,tothecontractor,underthecontractorotherwise or against or from the security deposit. All materials supplied to the contractor shall remain the absolute property of the government, and shall not, on any account be removed from the site of works without the written permission of the engineer-in-charge and shall at all times be open to inspectionoftheengineer-in-charge.Anysuchmaterialunusedorinperfectlygoodconditionat the time of the completion of termination of the contract, shall be returned to the engineer-in- charge’sstore,ifbyanoticeinwritingunderhishandheshallsorequire,butthecontractorshall notbeentitledtoreturnanysuchmaterialsunlesswithsuchconsent,andshallhavenoclaimfor compensation on account of any such materials so supplied to him as aforesaid being unused by him,orforanywastageinordamagetoanysuchmaterials.

LABOUR Clause32: The contractor shall employ labour, provide all facilities and pay wages to his work people or employees in accordance with the labourlaws or enactments relating thereto and rules framed thereunder,inforcefromtimetotime.

Clause33:

Clause37: Ifbyreasonsoftheamountofextraoradditionalworkofanykindorvariationofform,qualityor quantityoftheworksoranypartthereoforderedbytheengineer-in-charge,oronthegroundofhis having been unavoidable hindered in the execution of the work or on any other ground or other specialcircumstancesofanykindwhatsoever,oranycausebeyondthereasonablecontrolofthe contractor, the work is delayed or impodedor the contracted prevented from whether by the engineer-in-chargeorotherwisehowsoever,orhinderedintheexecutionorcompletionofthework oranypartthereofwhethersuchdelayorimpedimentorpreventionorhindranceoccursbeforeor after the time or extended time fixed for completion the contractor shall apply in writing to the engineer-in-charge within thirty days of the date of such circumstances, the full and detailed particularsofhisclaimonaccountofwhichhedesiresanextensionasaforesaid.Theengineer-in- charge shall if in his opinion (which shall be final) reasonable grounds shown therefore by the contractoraresuchasfairlytoentitlethecontractortoanextensionoftimeforthecompletionof thework,authorizehimfromtimetotimeinwriting,eitherprospectivelyorretrospectively,such extension of time for the completion of the work or any part thereof, as may in his opinion be necessaryorproper.

Clause38: Subject to any provision to the contrary contained in the contract, none of the permanent work shallsaveashereinafterprovidedbecarriedonduringthenightoronFridayorpublicholidays withoutthepermissioninwritingoftheengineer-in-chargesavewhentheworkisunavoidableor absolutelynecessaryforthesaveoflifeorpropertyorforthesafetyoftheworksinwhichcasethe contractorshallimmediatelyadvisetheengineer-in-charge.Providedalwaysthattheprovisionsof this clause shall not be applicable in the case of any work which it is customary to carry out by rotary or double shifts.

Clause39: (a) Thetimeallowedforcarryingouttheworkasenteredinthetendershallbestrictly

observedbythecontractor. Theworksshallthroughoutthestipulatedperiodofthe contractbeproceededwithallduediligenceinaccordancewiththeprogrammeofwork, asapprovedbytheengineer-in-chargeoranyamendedprogrammeorworkapproved bytheengineer-in-chargefromtimetotime(timeandqualitybeingdeemedtobethe essence of the contract on the part othe contractor) and the contractor shall pay as compensation amount equal to one per cent of the amount of contract, subject to a maximumof10%orsuchsmalleramountastheengineer-in-charge(whosedecisionin writingshallbefinal)maydecide,ontheamountoftheestimatedcoststatedinitem(b) of the memorandum of work annexed hereto for every day that the work remains uncommencedorunfinishedaftertheproperdate.

(b) Inordertoensuregoodprogressduringtheexecutionoftheworkthecontractorshall be

bound, in all cases in which time allowed for any work exceeds thirty days, to complete each part of the work or its component, as per programmeof work or any revision or amendment to it approved by the engineer-in-charge. In the event of the contractorfailingtocomplywiththiscondition,withoutsufficientreasonsacceptable totheengineer-in-charge,heshallbeliabletopayascompensationanamountequalto one per cent or such smaller amount as the engineer-in- charge (whose decision in writing shall be final) may decide on the estimated cost of the work as named in the item(b)ofthememorandumheretoannexedforeverydaythattheduequantity.orwork remainsincomplete.Providedalwaysthattheentireamountofthecompensationtobe paid under the provisions of this clause shall not exceed ten per cent of the estimated coststatedinitem(b)ofthememorandumofworkannexedhereto.

CERTIFICATEOFCOMPLETION Clause40: Without prejudice to the right of the under any such clause(s) herein contained, as soon as in the opinion of the engineer-in-charge, the works shall have been substantially completed and shall have satisfactorily passed any final test that may be prescribed by the contract, the engineer-in- chargewillissuetothecontractorascertificateofcompletioninrespectofthework,andtheperiod ofmaintenanceofworkshallcommencefromthedateofsuchcertificate,providedthatheengineer- in-chargemaygivesuchacertificatewithrespecttoanyindependentpartoftheworksbeforethe completionofthewholeoftheworks,andwhenanysuchcertificateisgiveninrespectofsucha part of the works, such part shall be considered as completed and the period of maintenance of such part shall commence from the date of such certificate. Provided also that a certificate of completiongiveninaccordancewiththeforegoingprovisionsofanypartoftheworksshallnotbe deemed to certify completion ‘of any ground or surface requiring reinstatement, unless such certificateshallexpresslysostate.Provided’furtherthatnosuchcertificateshallbegivennorshall theworksoranyofitspartsbeconsideredtobecompleteuntilthecontractorshallhaveremoved fromthepremisesonwhichtheworksoranysuchpartsshallbeexecuted,allscaffoldings,surplus materials of all kinds and rubbish, buildings and other construction materials of all kinds and cleanedoffthedirtfromallwoodwork,doorswindows,walls,floors,orotherpartsofanybuilding orbuildings,orroadworksandroadstructures,watersupply,sewerageordrainageworks,sanitary installations, gas and electric fittings, in, upon, or about which the works are to be executed, or whichhemayhavehadpossessionforthepurposeoftheexecutioncthereof,noruntiltheworks shall have been measured by the engineer-in-charge whose measurements shall be binding and conclusiveagainstthecontractor..

Ifthecontractorshallfailtocomplywiththerequirementsofthisclauseastotheremovalof

scaffoldings, surplus material of all kinds and rubbish as aforesaid and cleanings of dirt on or beforethedatefixedforthecompletionoftheworks,theengineer-in-chargemayattheexpenseof thecontractor,removesuchscaffoldingsorsurplusmaterialsofallkindsandrubbishanddispose ofthesameashethinksfit,andcleanoffsuchdirtasaforesaidand.thecontractorshallforthwith pay the amount of all expenses so incurred, and shall have no claim in respect of any such scaffoldingsorsurplusmaterialsofallkindsasaforesaid,exceptforanysumactuallyrealisedby sale thereof.

Clause41: Theengineer-in-chargeshallhavepowertomakeanyalterationin,omission,from,additionto,or substituted for, the original specification, drawing, designs and instructions that may appear to him to ‘be necessary or advisable during the progress of the work, and the contractor shall be bound to’ carry out the works in accordance with any instructions which may be given to him in writingsignedbytheengineer-in-charge,andsuchalterations,omissions,additionsorsubstitutions shallnotinvalidatethecontract,andanyaltered,additionalorsubstitutedworkwhichthecontractor may be directed to do in manner above specified as part of the work, shall be carried out by the contractor on the same conditions in all respects on which he agreed to do the main work, and at the same rates as are specified in the tender (bid schedule for the main work). The time for the completionoftheworkshallbeextendedintheproportionthatthealtered,additionalorsubstituted work bears to the original contract work and the certificate of the engineer-in-charge shall be conclusiveastosuchproportion.

And,ifthealtered,additional.orsubstitutedworkincludesanyitemofwork,forwhichnorateis specified in this contract, then such items or work shall be carried out at the rates entered in the scheduleofrates,whichwasinforceatthetimeofacceptanceofthecontract,minus/plusthesame percentage deduction or additions which the total tender amount of the schedule items in the bid schedulebearstothecostofthesescheduleitemscalculatedatparwiththescheduleofrates,with referencetowhichthetenderfortheworkwassubmittedbythecontractor.

Ifsuchaltered,additionalorsubstituteditem(s)ofworkisnotenteredinthesaidscheduleofrates orthebidschedule,thenthecontractorshallwithinsevendaysof.thedateofreceiptoftheorders tocarryouttheworkinformtheengineer-in-chargeoftheratewhichitishisintensiontochargefor suchitemsofwork,andiftheengineer-in-chargedoesnotagreetothisrate,ortheapprovaltothis rate(orthenegotiatedrate,ifany),isnotcommunicatedtothecontractorwithinaperiodofthirty (30) days reckoned from the date -of receipt by the engineer-in-charge of the proposed rate, the engineer-inchargeshallbyanoticeinwritingbeatlibertytocancelhisordertocarryoutsuchitem ofworkandarrangetocarryitoutinsuchamannerashemayconsideradvisable,providedalways that if the contractor shall commence work or incur an expenditure in regard thereto, before the ratesshallhavebeendeterminedaslastlyhereinaftermentioned,heshalldosoathisownriskand cost.

No deviation from specification stipulated in the contract or additional items of work shall be carried out by the contractor unless the rate of the substituted, altered or additional items have beenapprovedinwritingfailingwhichgovernmentwillnotbeboundtoentertainanyclaimonthis account. The interpretation of the engineer-in-charge in the event of any dispute due to any ambiguityinthespecificationornomenclatureshallbebindingandfinal.

Clause42: If at any time after the commencement. ofthe work, the engineer-in-charge shall for any reason whatsoever,notrequirethewholethereofasspecifiedinthetender(bidscheduleannexedhereto)

to be carried out, or increase or decrease in the quantity or work included in the contract or omit any such work, or change the contract or quality or kind of any such work, or change the levels, lines position and dimensions of .any part of the works, or require the contractor to execute additionalworkofanykindnecessaryforthecompletionofthework,theengineer-in-chargeshall give notice in writing of this fact to the contractor, who shall have no claim to any payment or compensation whatsoever on account of any, profit or advantage which he might have derived fromtheexecutionoftheworkinfull,butwhichhedidnotderiveinconsequenceofthefullamount of the work not having been carried out, neither shall he have any claim for compensation by reasonsofanyalterationhavingbeenmadeintheoriginalspecifications,drawings,designs,and instructionswhichshallinvolveanycurtailmentorincreaseofthework,asoriginallycontemplated; nor shall the contractor be entitled to any adjustment in the unit rate/price or amount of the contract,iftheaggregateeffectofallsuchalterations,additions,omissions,oradjustments(other than those arising out by reasons of price variation under clause 55 hereof) on completion of the wholeoftheworks,doesnotexceed20percentofthesumnamedinparagraphpf1(one)ofthis tender.

If, on completion of the whole of the works, it shall be found that a reduction or increase greater than20percentofthesumnamedinparagraph1ofthetenderresultsfromtheaggregateeffectof all increases, decreases, omissions or adjustments (other than those arising out because of price variation under clause 55 hereof), as a result of the requirement of the engineer-in-charge, the amount of the contract price shall be adjusted by such sum(s) as may be determined by the engineer-in-chargeandthecontractor,Intheeventofdisagreement,theengineer-in-chargeshall fixsuchsumasshall,inhisopinion,bereasonableandproper,regardbeinghadtoallmaterialsand relevantfactorsincludingthecontractor’scostandoverheads.

(2) Theworksshallatorassoonaspracticable‘afterexpirationofthe.periodofmaintenance

bedeliveredtotheengineer-in-chargeinasgoodandperfectcondition(fairwearand tearexcepted)tothesatisfactionoftheengineer-in-chargeasthatinwhichtheywereat thecommencementoftheperiodofmaintenance,thecontractorshallexecuteallsuch worksofrepair,amendment,reconstruction,rectificationandmakinggoodofdefects, imperfection,shrinkageorotherfaultsasmayberequiredofthecontractorinwriting by the engineer-in-charge during the period of maintenance or within fourteen days afteritsexpirationasaresultofaninspectionmadebyoronbehalfoftheengineer-in- chargepriortoitsexpiration.

(3) Allsuchworksshallbecarriedoutbythecontractorathisownexpense,ifthenecessity’ thereof

shall, in the opinion of the engineer-in-charge, be due to use of materials or workmanshipnotinaccordancewiththecontractortoneglectorfailureonthepartof thecontractortocomplywithanyobligationexpressedorimpliedonthecontractor’s panunderthecontract.Ifintheopinionoftheengineer-in-chargesuchnecessityshall beduetoanyother.cause,thevalueofsuchworkshallbeascertainedandpaidfor,as ifitwereanadditionalwork.

(4) Ifthecontractorshallfailtodoanysuchworkasaforesaid,requiredbytheengineer-in- charge, the engineer-in-charge shall be. entitled to carry out such work by his own workmen or by other contractor(s) and if such work is a work which the contractor should have carried out at the contractor’s own cost, shall be entitled to recover from thecontractortowardsthecostthereofasumequaltotheactualexpendituresoincurred bytheengineer-in-charge(whosecertificatea~totheamountoftheworkshallbefinal and binding on the parties) may deduct the same from any moneys due or that may becomeduetothecontractor.

Clause44: Ifthecontractororhisworkpeople,orservantshallbreak,deface,injureordestroyanypartofa building in which they may be working or any building, road, road-work, road structure, water supply,sewerage,anddrainageworks,sanitaryfittingsandelectricinstallations,fences,enclosures, waterpipes,cables,drains,electricortelephonepostsoranyworks,trees,grassorgrassland,or cultivated ground contiguous to the premises on which the work, or any part of itsis being executed,orifanydamageshallhappentothework,whileinprogressfromanycausewhatsoever oranyimperfectionsbecomeapparentinitwithinthespecifiedperiodofmaintenanceinitemNo. (1)ofthememorandumheretoannexedafteracertificate,finalorotherwiseofitscompletionshall havebeengivenbytheengineer-in-chargeasaforesaid,thecontractorshallmakethesamegood athisownexpense,orindefault,theengineer-in-chargemaycausethesametothemadegoodby otherworkmen,anddeducttheexpenses(ofwhichthecertificateoftheengineer-in-chargeshallbe final)fromanysumsthatmaythen,oratanytimethereaftermaybecomeduetothecontractor,or from his security deposit.

ADVANCESTOCONTRACTORS Clause45: Should the contractor, whose contract is for finished work require an advance on the security of materialofimperishablenaturebroughtbyhimtothesite,theengineer-in-chargeshallassessthe valueofsuchmaterialsandthecontractormaybepaidanadvanceuptoanamountnotexceeding seventyfivepercent(thedecisionoftheengineer-in-chargeastothispercentageshallbefinal)of the value of the materials assessed by the engineer-in-charge. The materials shall remain the propertyofthegovernmentandthecontractorshallnotremoveitfromthesitewithoutthewritten permission of the engineer-in-charge. The contractor shall be responsible for any loss to the materials due to the contractor postponing the execution of the work or to the shortage of or misuseofthematerialsandagainsttheexpensesentailedfortheirproperwatchandsafecustody.

Therecoveryoftheamountofsuchadvanceshallbemadefromthecontractor’sbillforthework done,asthematerialsareusedinthework.

Clause47: Thecontractorshallsubmiteachmonthonorbeforethedatefixedbyengineer-in-chargeabill,on the basis of measurements carried out by the contractor through his own staff for all works executed in the previous month, and the engineer-in-charge shall take or cause to be taken the requisitemeasurementsforthepurposeofhavingthesameverifiedandtheclaim,asfarasadmissible adjusted, if possible, before the expiry of ten days from presentation of the bill subject to the conditionlaiddowninitem(s)ofthememorandumofwork.Ifthecontractordoesnotsubmitthebill withinthetimefixedasaforesaid,theengineer-in-chargemaydeputeasubordinatetomeasureup theworkinthepresenceofthecontractorofotherwiseandtheengineer-in-chargemaypreparea billfromsuchmeasurements,whichshallbebindingonthecontractorinallrespect.

Clause48: At the time of making any payment to the contractor for the work done under this contract, the engineer-in-chargeshallretainfromtheamountsopayabletothecontractor,theamountofsecurity depositatthepercentageratespecifiedinitem9d)ofthememorandumofworkannexedhereto.The earnestmoneyofthecontractoroneexecutionofthecontract,willhowever,beadjustedtowards theamountofsuchsecuritydeposittoberetainedfromtheamountofhisfirstbilloftheworkdone byhimandpayabletothecontractorunderthiscontract.

Allcompensationofothersumsofmoneypayablebythecontractortothegovernmentunderthe termsofthiscontractmaybedeductedfromtheamountofhissecuritydepositofthecontractor fromanysumswhichmaybedueormaybecomeduetothecontractorbythegovernmentonany account whatsoever and in the event of his security deposit being reduced by such deductions, thecontractorshallwithintendaysthereaftermakegoodincashanysumorsumwhichmayhave been deducted sums which may have been deducted from his security deposit, or may be made goodthroughadditionaldeductionsfromhisbillordues.

Clause49: Ifthecontractorsodesiresandmakesawrittenrequesttotheengineer-in-chargetotheeffectthat theamountofsecuritydepositretainedfromthebillsofthecontractormaybeconvertedintothe recognisedform of profit bearing security at the cost of the contractor. theamount of security depositretainedfrombills,ofthecontractorshallbedepositedinanyofthefollowingbanks:-

Clause50:

(a) Theamountretainedassecuritydepositsshallnotberefundedtothecontractorinthe case of maintenanceworks twelve (12) months in the case of original works valuing upto5,000,000/- or even more are twelve (12) months, as may be determined by the Engineer-in-chargewiththepriorapprovaloftheProjectDirectoraftertheissueofthe certificateofcompletionoftheworkunderclause40hereofbytheengineer-in-charge. Provided that in case the contractor is required by the engineer-in-charge to rectify any imperfection,damage,defectsorotherfaultsinwork,etc.duringtheperiodofmaintenance, the security deposit shall not be refunded till the contractor has fulfilled his obligations underclause43and44hereoftothesatisfactionof:”theengineer-in-charge.

(b) Should the contractor so apply in writing to the engineer-in-charge, the amount of

Clause51: Thecontractorshallonsubmittingthebillbeentitledtoreceiveamonthlypaymentproportionate to the part thereof then approved and passed by the engineer-in-charge, subject to the condition laid down in item (s) of the memorandum, whose certificate of such approval and passing of the sum so payable, such be final and conclusive against the contractor. But all such intermediate paymentsshallberegardedaspaymentbywayofadvanceagainstthefinalpaymentonly,andnot as payment for work actually done and completed and shall not preclude the requiring of bad, unsound, imperfect or unskillful work to be removed and taken away arid reconstructed, or re- erected or be considered as an admission of the due performance of the contract or any party thereofinanyrespectortheaccruingofanyclaimnorshallitconclude,determine,oraffectinany waythepowerofengineer-in-charge,undertheseconditionsofanyofthemastothefinalsettlement andadjustmentoftheaccountsorotherwise,orinanyotherwayveryoraffectthecontract.

Clause52: Thefinalbillshallbesubmittedbythecontractorwithinonemonthofthedatefoxedforcompletion of the works, otherwise the engineer-in-charge’s certificate of the measurement and of the total amountspayablefortheworksaccordingly,shallbefinalandbindingonallparties.

Clause53: Thedepartmentmayrefuseorsuspendpaymentonaccountofaworkwhenexecutedbyafirm,or byacontractdescribedintheirtenderasafirm,unlessreceiptsaresignedbyalltheparties,orone of the partners of some other person producing power of attorney enabling him to give actual receiptsonbehalfofthefirm.

Clause54: All sums payable by way of compensation under any of these conditions, shall be considered as reasonable compensation to be applied to the use of government, without reference to the actual lossordamagesustained,andwhetherornotanydamageshallhavebeensustained.

VARIATIONINPRICESOFSPECIFIED MATERIALS

Clause55:

(1) Whereanyvariation(increaseordecrease),totheextentof5%ormore,inthepriceof any of the item mentioned in sub-clause (2) below takes place after the acceptance of tender and before the completion of contract, the amount payable under the contract shallbeadjustabletotheextentoftheactualvariationinthecostoftheitemconcerned.

(2) Nopricevariationunderthisclauseshallbeadmissible.exceptinrespectofthefollowing items:-

(3) The base price for the purposes of calculation of the price variation shall be the price

prevalent in the month during which the last day of the submission of tender falls.

(4) Thepricevariationunderthisclauseshallbeworkedoutonthebasisofthepriceofthe item

.concerned prevalent of the first day of each month as per the price list of such manufacturersofsuppliersatsuchplacesasarenotifiedbythegovernmentformtime to time. The price of the manufacturer or supplier at the place so notified shall be applicableforthewholeofthePunjab.

(5) Ifonnotificationinrespectofanyoftheitemmentionedinsub-clause(2)isissued under sub-

clause (4) no price variation shall be admissible ,inrespect of that item during that month.

(6) (1) TheamountpayableordeductableinrespectofitemNo.(i)ii(b,c&d)iii&ivof

subclause2shallbecalculatedonthebasisofthequantityactuallyconsumedon theworkduringthemonth.

(2) The percentage increase/ decrease in the price over the base price notified by M/

SPakistanSteelMillsKarachiwouldbeapplicabletothequantitiesofallspecified sizeofitemNo.iivizM.Sbars(plain&deformed)actuallyconsumedonthework eachmonth.(FinanceDepartmentNotificationNo.RO(Tech)FD-102/90dated20- 6-1991).

(6) TheamountpayableordeductableinrespectofitemsNo.(i)to(iv)ofsub-clause(2)

(7) TheamountpayableordeductableinrespectofitemNo,(v)ofsub-clause(2)shallbe

calculated on the basis of the actual quantity or cement and steel bars used in the manufacture of the pipes during the month.

(8) Noescalationshallbeallowedtothecontractorinrespectoftheperiodextendedfor

thecompletionoftheworkduetohisownfault.

(9) If,undertheexistingcodalrules,securedadvancedisonalloranyoftheimperishable

itemsmentionedat(ii)to(v)insub-clause(2)above,nopricevariationshallbeadmissible onsuchitem(s)inrespectofthequantityorquantitiesforwhichsecuredadvancehas beenpaidtothecontractor.

toclause41hereof.Thecontractorshallincludeinsuchmonthlyreturnsparticularsofallclaimsof whatsoever kind and howsoever arising, which at the date thereof he has or may claim to have, againsttheengineer-in-chargeunderorinrespectof,orinanymannerarisingoutor,theexecution of the works, and the contractor shall be deemed to have waived all claims not included in such returnandwillhavenorighttoenforceanyclaimnotsoincluded,whatsoeverbethecircumstances.

Clause57: Noclaimforpaymentofextraordinarynature,suchasclaimofaBonusforextralabouremployed incompletionoftheworkbeforetheexpiryorthecontractualperiodattherequestoftheengineer- in-charge,orclaimforcompensationwheretheworkhasbeentemporarilybroughttoastandstill through no fault of the contractor, shall be allowed, unless and to the extent that the same shall havebeenexpresslysanctionedbythePunjabGovernment.

Clause58: Under no circumstances whatsoever shall the contractor be entitled to any compensation on accountofthecontractunlessthecontractorshallhavesubmittedaclaiminwritingtotheengineer- in-chargewithinonemonthofthecauseofsuchclaimoccurring.

Clause59: No compensation shall be allowed for any delay in execution of the work on account of water standinginborrowpitsorcompartment.Theratesinclusiveforhardorrockysoil,excavationhad, sub soil water or water standing in borrow pits, and no claim for extra rate shall be entertained, unlessexpresslyverifiedbyengineer-in-chargeandconfirmedbyProjectDirector.

REMEDIESANDPOWERS Clause60: In any case in which under any clause or clauses of the Contract, the contractor shall have renderedhimselfliabletopaycompensationamountingtowholeofthesecuritydepositorinthe opinion of the engineer-in-charge has abandoned the contract, or is not executing the works in accordancewiththecontractorispersistentlyorflagrantlyneglectingtocarryouthisobligations underthecontract,orifthecontractoremploysanyemployeeoftheGovernmentindefiancetothe provisions of clause 32 thereof, the engineer-in-charge on behalf of the government, may, after givingfourteendaysnoticeinwritingtotheContractor,rescindtheContract(ofwhichrescision notice in writing to the Contractor under the hand of the engineer-in-charge shall be conclusive evidenceandinwhichcasethesecuritydepositoftheContractor;shallstandforfeited,shouldbe absolutely at the disposal of Government. And in case the Contract shall be rescinded under the provisionsaforesaid):-

(i) the contractor shall have no claim to compensation for any loss sustained by him by

reasons of his having purchased or procured any materials, or entered into any engagement,ormadeanyadvancesonaccountoforwithaviewtotheexecutionofthe worksortheperformanceofthecontract.

(ii) Certified, after deducting there from the amount of aforesaid compensation and other

charges duly ascertained and certified by the engineer-in-charge to be payable by the contractor.Butifsuchsumpayablebythecontractorforanylosses,compensationor any other charge shall exceed and certified by the engineer-in-charge, the amount of suchexcessshallbedeemedadebtduebythecontractortotheUniversityandshallbe recoveredaccordingly.

Clause61: Ineverycaseinwhichthecontractshouldberescindedunderclause60hereofandintheopinion of the engineer-in-charge such work should be done at the risk and expense of the contractor without thereby avoiding the contract of relieving the contractor without thereby avoiding the contractororrelievingthecontractorfromanyofhisobligationorliabilitiesunderthecontractor affecting of the rights and powers conferred on the government or the engineer-in-charge by the contract,theengineer-in-chargeonbehalfofthegovernment,aftergivingfourteendaysnoticein writing to the contractor, shall have powers to adopt any of the following courses, as may in the opinionoftheengineer-in-chargebedesirable.

(1) Tomeasureuptheworkofthecontractorandtotakesuchpartthereof,asshallexecuted out of

his hands and to give it to another contractor to complete, in which case any expenseswhichmaybeincurredinexcessofthesumwhichwouldhavebeenpaidto theoriginalcontractor,hadthewholeoftheworkbeenexecutedbyhim(oftheamount of which excess, the certificate in writing of the engineer-in-charge shall be final and conclusive) shall be borne and paid by the original contractor, and may be deducted fromanymoneyduetohimbytheGovernment,underthecontractorotherwise,orfrom hissecuritydepositorfromthevalueoftheperformancesecuritygivenbythecontractor underclause7hereof.

(2) Toemploylabourpaidbythedepartmentandtosupplymaterialsorsupply/arrange

toolsandplantstocarryouttheworksoranypartoftheworks,debitingthecontractor withthecostofthelabourandthepriceofthematerialsandcostofsupply/arrangement, operation and maintenance of tools and plants of the amount of which cost and price, acertificateoftheengineer-in-chargeshallbefinalandconclusiveagainsthecontractor), plus departmental charges on the amount so incurred equal to ten per cent or such smalleramountastheengineer-in-charge,(whosedecisioniwritingshallbefinal)may decide, and crediting him with the value of the work done, in all respect, in the same manner and at the same time and rates, as if it had been carried out by the contractor underthetermsofhiscontract,thecertificateoftheengineer-in-chargeastothevalue of the work done shall be final and conclusive against the contractor. Intheeventofanyoftheabovecoursesmentionedinthisclausebeingadoptedbythe engineer-in-charge, the contractor shall have no claim to compensation for any loss sustained by him by reason of his having purchased or procured any materials, or enteredintoanyengagement,ormadeanyadvancesonaccountof,bewithaviewto, theexecutionoftheworksortheperformanceofthecontract.

Clause62: Inanycaseinwhichanyofthepowers.Conferredupontheengineer-in-chargebyclause60orby para.(a)ofclause61hereof,shallhavebecomeexercisableandthesameshallnotbeexercised,the non-exercisethereofshallnotconstituteawaiverofanyoftheconditionshereof,andsuchpowers shallnotwithstandingbeexercisableintheeventofanyfuturecaseofdefaultbythecontractorfor which,byanyclauseorclauseshereofheisdeclaredliabletopaycompensationamountingtothe whole of his security, deposit and the liability of the contractor for past and future compensation shallremainunaffected.

In the event of the engineer -in-charge putting in force either of the power vested in him under clause60orpara(a)oftheprecedingclause,hemay,ifhesodesires,takepossessionofallorany tools, constructional plants, materials and stores, in or upon the works, or the site thereof, or belonging to the contractor, or procured by him and intended to be used for the execution of the workoranypartthereof,payingorallowingforthesameinaccountatthecontractrates,or,incase of those not being applicable at current market rates to be certified by, the engineer-in-charge whosecertificateshallbefinal:otherwisetheengineer-in-charge,maybynoticeinwritingtothe contractororhisclerkoftheworks,foremanorotherauthorizedagent,requirehimtoremovesuch

tools,constructionplants,materials,orstoresfromthepremises(withinatimetobespecifiedin such notice) and in the event, of the contractor failing to comply with any such requisition, the engineer-in-chargemayremovethemattheaccountofthecontractorandathisriskinallrespects and the certificate of the engineer-in-charge as to the expenses of any such removal, and the amount of the proceeds and expenses of any such sale, shall be final and conclusive against the contractor.

Clause63: If the contractor shall, in defiance of the engineer-in-charge’s instructions to the contrary or withouthiswrittenapproval,assignorsublethiscontractorattemptstodoso;orbecomeinsolvent, orcommenceanyinsolvencyproceedingsormakeanycompositionwithhiscreditors,orattempts 80todo;orifanybribe,gratuity,gift,loanprerequisite,rewardoradvantage,pecuniaryorotherwise shalleitherdirectlyorindirectlybegiven,promisedorofferedbythecontractor,orhisservantsor agents to any way relating to his office, or employment; or if any such officer or person shall become in any way directly or indirectly interested in the contract; the engineer-in-charge may thereuponbynoticeinwritingrescindthecontract,andthesecuritydepositofthecontractorshall thereuponstandforfeitedandbeabsolutelyatthedisposalofUniversityandthesameconsequence shall ensue as if the contract had been rescinded under clause 60 hereof and in addition to the contractor shall not be entitled to receive or be paid for any work therefore actually performed underthecontract.

Clause64: Anyexcesspaymentmade to the contractor inadvertently or otherwise, under this contractoron anyaccountwhatsoever,andanyotherSlimfoundtobeduetotheUniversitybythecontractorin respectofthiscontract,oranyothercontractorworkorder,oronanyaccountwhatsoever,maybe deducted from any sum whatsoever payable by University to the contractor, either in respect of thiscontractoranyworkorderorcontract,oronanyotheraccountbyanyotherdepartmentofthe government;orrecoveredfromthecontractorasarrearsoflandrevenue.

SETTLEMENTOFDISPUTES Clause65: Iutheeventofanydisagreementbetweentheengineer-in-chargeandthecontractorarisingoutof thecontract,themattershallfirstbereferredtothesuperintendingengineerfordecisionwhoshall, after making such enquiries as he may deem fit, give his decision in writing hot later than three monthsafterthereferenceismadetohim.Theperiodfordecisionofthecasebythesuperintending engineermay,however,beextendedbytheProjectDirectorunderspecialconditionsaccordingto thecircumstances,justification,availableineachcase.Thecontractorshallforthwithgiveeffectto the decision of the Project Director and shall proceedwith due diligence, whether arbitration is intendedornot.

If the contractor be dissatisfied. with the decision of the Project Director or if his decision is not forthcoming within the stipulated or extended period periods and desires arbitration under the arbitrationclauseashereinafterprovided,heshallgivenoticein,writingofsuchintentiontothe

ProjectDirectorwithinaperiodoftwentyeightdaysofthereceiptoftheProjectDirectordecision orincasenodecisionisgiven,attheendoftheperiodorperiodswithinwhichthesuperintending engineerwastogivehisdecision.Thesaidnoticeshallcontainthecause,ofaction.Materialfacts ofthecastandreliefsought,failingwhichthe,decisionoftheProjectDirectorshallbecomefinal, conclusiveandbinding,andthecontractorshallbedeemedtohaveforfeitedordepartedfromthe claiminexcessofthatallowedbytheProjectDirector. Thesubsequentinflation/increaseinthe amountofclaimoncepreferredinthesaidnoticeshallnotbeallowednorshallanyotherclaimin respectofthesameworkbeentertainedfromthecontractoratanylaterstage.

A reference to arbitration shall be made by the contractor in writing hot later than three months after the completion of the work. Failure to make such a reference within this period shall be deemedtomeanthatthecontractorhaswaivedallclaimsinrespectofalldisputes.

(a) disputeswhichmaybereferredtoarbitrationshallbelimitedto:-

(1) anyquestion,difference,orobjection,whatsoeverwhichshallariseinanyway, connectedwithorarisingoutofthecontract;or/and

(2) Themeaningsoftheoperationofanypartofthecontract;or/and

(3) The rights, duties and liabilities of either party to the contract, or/and

(4) Whetherthecontractshouldbeterminatedorhasbeenrightlyterminatedandas

regardstherightsandobligationsofthepartiesasaresultofsuchtermination.

(b) excludedfromarbitration.

(c) ThevenueofarbitrationshallbeinPunjab.

Intheeventofanydisputearisinginaccordancewiththelimitationsprovidedinsub- clause(a)ofthisclause,thesameshallbereferredtothedecisionsofasolearbitrator tobeappointedbytheProjectDirectorinchargeofthewingfromamongtheofficersof thedepartmentnotbelowtherankofUniversityEngineer,andotherthantheUniversity Engineerinchargeofthework.Incasetheclaimpreferredisforanamountuptohalfa millionrupees,thedecisionofthesolearbitratorinsuchcases

(d) shallbe final and binding on the parties concerned.

Incasetheamountoftheclaimpreferredisoverhalfamillionrupees,thedisputeshall bereferredtotheawardoftwoarbitrators,tobeappointedfromtheUniversityEngineer ofthedepartment,otherthantheUniversityEngineerinchargeofthework,onetobe nominatedbytheProjectDirectorofthewingconcernedandtheotherbythecontractor. In the case of the said two arbitrators not agreeing, the case shall be referred to the awardofanumpirewhoshallbeanofficerofthedepartmentnotbelowtherankofP.D. tobeappointedbytheUniversityintheadministrativedepartment.Thedecisionofthe two arbitrators/umpire, as the case may be shall be final and binding on the parties concerned.Wherethematterinvolvesclaimforthepaymentofrecoveryordeduction of money only, the amount, if any, awarded in the arbitration shall be recoverable in respectofthemattersoreferred.

ADDITIONALCONDITIONS

1. The contractor shall quote rates of premium/abatement for building portion and electric portion separately on thefollowingenforcedScheduleofRates:-

2. AnytypeofmistakedetectedinrespectofscheduleofratesshallbeamendedaccordingtothecorrectSchedule

ofRateswiththeamendmentsissueduptothedateofreceiptoftender.

3. Conditional tenders or tenders without treasury challanor deposit at call will not be considered/entertained.

4. Theprogrammefortheexecutionofwork,Thearrangementoftransport,machinery,materialsandlabourwill

havetobesubmittedalongwith~he’,tendersorimmediatelyafterit,totheEngineer-in-charge.

5. Thecontractorshallbeexpectedtomakehimselfacquaintedwithlocalfeaturesandweatherconditionsetc,and

makehisarrangementsinsuchamannerthatunfinishedworkisinnodangerfromstorms,floods,etc,Claims from the contractor on account of loss arising from weather abnormalities shall not be considered by the Department,

6. ThePercentagepremiumtenderedbythecontractorwillbeappliedonthegrossamount(Valueoffinishedwork includingcostofmaterialwhetherpurchasedfromGovernmentordirectly).

7. Theratesgiveninthetendercallnoticeofitemsforwhichcompositeratesareapplicableincludeallcarriageand

handingofmaterialtothesiteofwork,Noextrapaymentforcarriageofmaterialforsuchitemseitherarranged bythecontractororsuppliedbythedepartmentwillbemade.

8. Thedepartmentreservestherighttorejectanyorallthetenderswithoutassigninganyreason.

9. Ifthecontractorwithdrawshistenderwithin60daysofthedateoftheopeningofthetender,hisearnestmoney

willbeforfeitedtoUniversity.

10. Incaseoffirm/company,theconstitutionofthefirm/companyalongwiththenamesoftheattorney/attorneys

oftheform/companyauthorizedtorepresentthefirm/companyandtoreceivethechequealongwithpowerof attorneymustbeprovidedatthetimeofsubmittingthetenders.

11. Beforeanyconstructionalmaterialisbroughttothesiteofwork,thecontractorshallsubmittotheEngineer-in-

charge,representativesamplesofmaterialheproposestouse.Thesamplesafterapprovalwillberetainedbythe Engineer-in-Chargeinhiscustodyandthecontractorshallberesponsibleforensuringthatmaterialconforming tosuchsamplesareusedthroughoutthecontractfailingwhichthematerialwillnotbeacceptedandonwritten orverbaldirectionoftheEngineer-in-ChargemustberemovedforthwithfromthesiteoftheWork.

12. Sample of door and window fittings which the contractor proposes to use should be got approved in advance

from the Engineer-in- charge who would approve these keeping in view the samples approved bythe Project Director.ApprovedsamplesshallberetainedbytheEngineer-in-chargeinhiscustodyandthecontractorshall be responsible for ensuring that material conforming to such samples are used throughout the contract failing which the material will not be accepted and on written or verbledirection of the Engineer-in-charge must be removedforthwithfromthesiteofthework.

13. Thecontractorshallberesponsibleforhousing,sanitationandmedicaltreatmentofthelabouremployedbyhim

andshallcarryoutallthedepartmentalrulesframedonthesubject.

14. Shouldanaccidentoccurandaclaimforcompensationbeinstitutedthecontractorshallhavetopaycompensation to the injured workmen or in case of death to their hundred and twenty three Contractor should, therefore, in theirowninteresttakeallprecautionstoguardagainstaccidentontheirwork.

15. Labourwillbepaidbythecontractorregularly.Anycomplaintofarrearsduetolabourwillmakethecontractor

liabletostoppageofpaymentfromthedepartment.

16. Iftheworkisnotstartedwithin15daysfromthedateofacceptanceletter,theearnestmoneywillstandforfeited

toUniversity.

17. Thecontractor,shallbeforecommencementofanyworksetoutaccuratelythepositionasshowninthelayout

playandotherdrawings.Heshallwheneverdirectedestablishpermanentbenchmarkouttheworkthepageand othermarks,shallbecheckedbytheassistantEngineerwhoshallthencertifyinwritingthattheworkiscorrectly set out and that the construction may commence. Any work done in contravention to this, shall entirely be contractor’s responsibility and may be dismantled if required by the Engineer-in-charge at the cost of the contractor.

18. ThecontractorwillhavetomakehisownarrangementforwaterandincasewaterisusedfromUniversitytaps

thecontractorwillberesponsibletopaythechargesasfixedbytheofficerinchargeofthewatersupplyandthe samewillbedeductedfromthebillsofthecontractorifthefailstopaythewatercharges.

19. FoundationtrenchesshallhavetobegotinspectedandapprovedbytheEngineer-in-chargebeforethe

foundationsarelaid.

20. Nomasonryworkonleanconcretewillbetakeninhandunlessthe concreteisapprovedbytheAssistant

EngineerIncharge.

21. Thecontractorwillmakehisownarrangementathiscostforscaffolding,Shulleringandcentringetc,required

fortheexecutionofthework.

22. Thecostofmaterialreceivedfromdismantling,ifany,willbedeductedfromthebilloftheconcractoratmarket

rates(asdecidedbytheProjectDirectorwhosedecisionshallbefinal),ifitisusedbyhimonconstructionwork. If the contractor does not return the unused dismantled materials, its cost will be recovered from his bill at doublethemarketrates.

23. All rates unless otherwise specified .include the cost of the following and any fluctuation thereof:-

Royalty,malkana,octrol,terminaltax,salestex,watersupertaxcustomsandexciseduty,emergencytax, watertax,andanyothertollstaxesandleviesimposedbyCentralorprovincialGovernmentandLocal Authorities.

24. Thecontractorshallstudythedrawingandbendingschedulesandreportanyaccuracyindimensionsoris

concordance.

25. Thequantitiesofitemsshowninthebidscheduleandtheestimatedcostoftendercanbedecreasedor increasedbytheEngineer-in-charge(theincreaseinamountbeinglimitedtotwentyfivepercentoftheestimated cost of tender) or to take away any item or part of work at any time if it is deemed necessary by him without assigning any reason and reallot it to any other agency after giving notice to the contractor and this shall ‘:tot invalidatethetendernoreffectthetenderedratesinanycase,noranyclaimonthisaccountshallbeentertained.

26. Thecontractorshallfaithfullycarryouttheworkasperplansuppliedtohimandnodeviationoralternationwill

beacceptedunlessexecutedwiththewrittenpermissionoftheEngineer-in-charge.

27. Thedepartmentreservestherighttoarrangeandissueanymaterialavailableinstoresatstockissueratesplus storagechargeasapprovedbytheEngineer-in-chargeoratthemarketrateswhicheverismore,forbonafideuse onwork.

28. Itshallbetheresponsibilityofthecontractortoremovedebrisfrom’thesiteofworksandleavetheplaceneat andtidyafterthecompletionofwork.Nothingextrashallbepaidforit.

29. ThecontractorshallberesponsibletothedepartmentforgivingexactaccountofmaterialsissuedfromGovernment stores

is any used by him on the construction work. In case of excessive use of material or some pilferage or outside sale by the contractor having been detected, the contractor shall have to pay the cost of such material at penal rates which shall be double the issue rates plus ten percent supervision charges in addition to the storagechargesasworkedoutandapprovedbytheEngineer-in-charge.

30. Theplantandmachinerysuchasmechanicalconcretemixer,bandmixers,vibrators,waterpumpingsets,screens,

measuringboxes,compactionandgradationcontrolequipment,steelmouldsforcubesetc,requiredforthework shallbearrangedbythecontractorhimselfathisowncost. Anyplant,andmachinery,ifavailablewiththe department may be issued to the contractor, at the discretion of the Engineer-in-charge on hire, at approved rates and the contractor will be responsible for its carriage from the place, it is delivered and returning it in workingcondition.Hewillalsoberesponsiblefortheworkingchargesofcrewandhirecharges.Theidledays which happen to occur on account of natural causes or major break down in machinery will be charged to the contractorprovidedtheSubDivisionalofficercertifiessuchperiod.

31. AnyamountduetotheGovernmentfromthecontractorforthisworkorotherwisewillberecoveredfromany

amountduetohimfromanyworkinthesamewillberecoveredasarrearsofLandrevenuesincaseofdefaultby thecontractor.

32. Thecontractorshallmakeadequatearrangementsforpropercuringthroughpumpingsets,hosepipesetc,ofall

cementconcrete,reinforcedcementconcreteandbrickworketc.

33. Consumption of cement brought by the contractor will be controlled by the Engineering-in-charge. However,

watchandwardofthestoresshallbetheresponsibilityofthecontractor.

34. Thecontractorshalluncoveranypartorpartsoftheworksormakeopeningsinorthroughtheworkorsearch

forthecauseofanydefects,imperfectionorfaultsintheworksastheEngineer-in-chargemayfromtimetotime directandshallreinstateandmakegoodaftersuchuncoverings,openings,tothesatisfactionoftheEngineer- in-charge.Nothingextrabepayableonthisaccount.

35. Thewashingplatforms,watertanks,stackingplatformsandmaterialbinsforstoringscreenedandwashed

materialwillhavetobeprovidedbythecontractoratsiteattheirowncostinsizeandnumbersufficienttobe adequateforconstructionpurposes.

36. The proper type of screens, test sieves, templates and measuring boxes will be arranged by the contractor at

theirowncostandgotapprovedfromtheEngineer-in-chargebeforeusingthoseatsite.

37. NoitemofworkwillbecommencedunlessEngineer-in-chargeforisinformedbeforehandandheauthorizes

commencement after satisfying that the arrangements with regard to setting out, materials, labour, machinery andT&Petc,arecompletedandadequateinallrespect.

38. AnyotheritemnotprovidedintheB.O.Q.canbegotexecutedatthetenderedpremiumifitisascheduleitem.

Incaseofnonscheduleitems,thesameshallalsobeexecutedbythecontractoraftergettingthenonschedulerateapprovedfromProjectDirector.

39. The work of building construction will have to be co-ordinatedwith the work of water supply, sanitary and

electrification.Nothingextrashallbepayabletoanycontractoronthisregard.

40. The security deducted from the bills of the contractor may be deposited with National Bank of Pakistan as

interestbearingsecurity,ifthecontractormakeswrittenrequestinthisregard.

60. SamplesofsteeltobeusedinreinforcedcementconcreteworkshallbegottestedbytheEngineer-in-chargeand

thecontractorwillhavetobeartheexpensesforsuchtests.Thereshouldbeatleasttwosuchsamplesforeach batch received at site.

61. The slump tests should have to be carried out while concerting and the slump maintained for various items as

perspecificationsorasslumptestingapparatusforthesameattheircost.Anyworkdoneagainstheinstructions will.beliabletoberejectedoutright.

62. NopouringofconcreteforReinforcedCementconcreteshallbepermittedwithouttheuseofproperconcrete

mixers,vibratersandpropercentringandshuttering,thereshouldbeatleastadoublesetormixersandvibraters whentheconcreteisbeingpouredtohaveatleastasstandby.

63. CuttingaridbindingofM.SbarswillhavetobedonebythestrictlyEngineer-in-charge.Nosuperfluouslength or lap

spaces etc., nor any wastage will be payable to the contractor.

64. Thetestingofconcrete,toensurethatthespecifiedstrengthasperspecificationorasdesiredbytheEngineer- in-

charge,isbeingachievedwillbegotdonebythecontractorathisowncost.Thiswillincludethepreparation ofcubeswithuniformsquareface,theirpreservationwithoutanydamage,curing,transportationtobeapproved laboratoryandthetestingchargesofthelaboratory.Thetestresultingforthecompressivestrengthofconcrete cubeswillhavetobesubmittedregularlywhiletheworkproceeds.

65. Theraisingofcolumnsandmemberssimilartothese,willnotbepermittedexceedingthreetofourfeetinheight.

66. Reinforcing steel shall be of intermediate grade deformed bars with yield stress not less than 40000 Lbs. per

square inch. This shall be supplied by M/S PECO, Lahore, M/S Abdul QayyumFazalMuhammad Limited, Lahore or IttefaqIndustries Lahore or similar approved. Received for purchase from such suppliers shall be enclosedwiththebills.

67. SourceofstoneforuseinstonemasonerywillbeapprovedbytheEngineer-in-charge.

deposit retained by the government in the above work or such portion of the security of the security deposit as the engineer-in-chargeshalldeterminewithrespecttoapartofthework,havingregardtorelativevalueofsuchpartofthe work can be released to the contractor, provided the contractor produces a bank guarantee from the Bank of Punjab/ ScheduledBankofPakistanofanamountequaltotheamountofhissecuritydepositasaforesaid,totheeffectthatthe contractorshallrepairandreplaceathisexpenseallthedamagesandimperfectionswhichmaybecomeapparentinall or any of the work mentioned in the contract within the balance period of maintenance after a certificate, final or otherwiseofIstcompletionhas,beengivenbytheengineer-in-charge.

FORMOFBANKGUARANTEEFORMOBILIZATIONADVANCE

WHEREAS,acontractforworkhasbeenawardedbytheGovernmentofthePunjabactingthrough

theGovernmentofthePunjabDepartment(hereinaftercalledtheGovernment)to M/s(hereinaftercalledtheContractor).

ANDWHEREAS,underthetermsofthesandcontracttheGovernmenthasagreedtoadvanceasumof Rs.tothecontractorforexecutionofthesaidworkandthisamountinclusiveofinterestattherate of10%perannumofthereducingbalancesistoberecoveredinfiveequalinstallmentsfromthefiverunningbillsof thecontractor,andifthenumberscomingbillsislessthanfive,thenthebalanceisrecoverablefromthefinalbillofthe contractor,tillentireamountisrecovered.

AND WHEREAS, the Government has desired the contractor to furnish a bank Guarantee for seeuringthe

paymentofthesumadvancedtogetherwithinterestthereon:-
