Introduction
Mill Creek Environmental Consultants, Ltd. recently completed an analysis of multiple
areas of land, which are part of the Chesterfield County Airport (FCI) and adjacent
properties. The purpose of the survey was to determine the presence of endangered,
threatened, or special concern (ETS) species of flora and fauna on the property. A
vicinity map of the project survey area can be seen at Enclosure 1.
Endangered, Threatened and Special Concerns (ETS) Species Information
The Virginia Department of Conservation and Recreation (VDCR), Virginia Department
of Agriculture and Consumer Services (VDACS), Virginia Department of Game and
Inland Fisheries (VDGIF), and the U.S. Fish and Wildlife Service (USFWS) work
cooperatively to insure the continued survival of Virginia's diverse flora, fauna, and other
elements of natural diversity. The Virginia Natural Heritage Program (VNHP: a Division
within VDCR) also works closely with other state and federal agencies, local
governments, conservation organizations, and individuals to seek adequate protection of
the State's natural heritage resources.
To achieve this protection, VNHP maintains lists of the most significant elements of
Virginia's natural diversity. These lists focus the Program's Inventory on the Natural
Heritage Resources most likely to be lost without conservation action in the near future.
Most importantly, these lists are not only useful for VNHP, but can be used by other
agencies, organizations, and individuals to guide protection and development decision
making. In formulating these lists, the program uses information from previous studies,
museum records, the observations and opinions of experts, DCR-DNH staff scientists,
and field inventories.
All plants and animals that are officially protected by Federal or State endangered species
acts are included on these lists. The Office of Plant Protection within the Virginia
Department of Agriculture and Consumer Services (VDACS) has regulatory
responsibility of the listing and protection of Virginia's endangered and threatened plants
and insects, under the Virginia Endangered Plant and Insect Act (Section: 3.1-1020
through 1030, Code of Virginia). The Act provides for the official listing and recovery of
endangered and threatened plant and insect species in Virginia. The Act also establishes a
permit system for collection of listed species. As of April 2009, there were 15 state-listed
plant species and 61 candidates for listing. A memorandum of agreement between DCR-
DNH and VDACS facilitates data transfer between agencies and allows DCR-DNH to
nominate candidate species for listing by VDACS,

The Department of Game and Inland Fisheries has regulatory responsibility for listing
and protecting Virginia's endangered and threatened animals under Virginia's Endangered
Species Act (Code of Virginia, Section 19.1-564-568). The Act prohibits the taking,
transportation, sale, etc of endangered and threatened species, except as permitted, and
provides for official listing and recovery of these species. As of June 2010, there were
126 animal species listed by the state as endangered or threatened. Additionally there are
8 species of special concern being observed statewide.
Federally listed species are protected by the Endangered Species Act of 1973, as
amended. The U.S. Department of the Interior's Fish and Wildlife Service (USFWS)
administers the Act, listing and protecting federally endangered and threatened species.
As of April 2009, there were 16 plant species federally listed as endangered or threatened
which occur or formerly occurred in Virginia. There are no plant species which are
candidates for listing. No additional Virginia plant species are formally proposed for
federal listing at this time. As of June 2010, there were 47 animal species which are
federally listed as endangered or threatened. Additionally, 6 animal species are proposed
as candidates for federal listing.
Overview of the Survey Area
The Chesterfield County Airport (FCI) is located in Chesterfield County, Virginia.
Located within the Piedmont physiographic province of Virginia, the county’s physical
characteristics resemble those typical of the region. The county is comprised of
approximately 437 sq. miles, 426 of which is land, and the other 11 being waters from
lakes, reservoirs, creeks, rivers and streams that will eventually drain to the southeast
(SE) towards the Chesapeake Bay. As of 2010, the population was over 316K
inhabitants. Land use throughout the county is generally mixed with light industrial to
suburban surrounding the US360, 60, and 150 (Chippenham Parkway) corridors, while
the western part of the county is more rural with commercial farming present. The terrain
ranges from flat to rolling hills. Chesterfield is bordered by Powhatan and Amelia
counties to the west (W), Henrico and Goochland to the north (N), and Dinwiddie and
Prince George counties to the south (S) and southeast (SE) respectively.
The project survey area consists of two distinct survey areas in the vicinity of the airport.
One survey area comprises approximately 49+ acres to the northwest (NW) of the airport
runway, while the second survey area consists of approximately 39 + acres to the
southeast (SE) of the airport runway. A map depicting these project survey areas can be
seen in Enclosure 1. The northwest (NW) survey area consists of multiple forested
parcels with a number of small creeks draining away from the airport towards Licking
Creek. The area consists of mature forested vegetation including species such as White
Oak (Quercus alba L.), hickories (Carya spp.), pines (pinus spp.), and other species of
small shrubs and groundcover. The southeast (SE) survey area is much more open and
mature and contains a predominance of emergent vegetation such as grasses, sedges and

other herbs. Where vegetation is present, the species are generally younger and shorter in
height than those in the survey area to the northwest (NW). All precipitation falling in the
southeast (SE) survey area eventually leads to Reedy Creek, then Falling Creek, and into
the James River.
Summary of Findings
A physical inspection of the survey area did not reveal any of Virginia’s listed Natural
Heritage Resources. Additionally, none of the listed species identified as federally
endangered (LE) or threatened (LT) were discovered during the physical survey.
Findings Reviewed
In addition to the physical inspection of the survey area, input for Endangered and
Threatened species information was solicited from the US Fish and Wildlife Service
(USFWS), the Virginia Department of Game and Inland Fisheries (VDGIF), and the
Virginia Department of Conservation and Recreation (VDCR). The USFWS confirmed
that there are no federally listed species associated with the project area. This
confirmation and documentation can be seen in Enclosure 2.
The search report generated through VaFWIS, an online system containing the most
current information on Virginia’s wildlife, revealed only one species, the Barking
Treefrog (Hyla gratiosa), with a state status of threatened, that is confirmed to occur
within 4 miles of the project survey area. The confirmed occurrence of the Barking
Treefrog is located approximately 4 miles to the southwest (SW) of the project survey
area in Pocohontas State Park. This location and the VDGIF report can be seen in
Enclosure 3.
In addition to soliciting input from USFWS and the VDGIF, a project review was also
submitted to VDCR to determine if there were any potential impacts to natural heritage
resources within the survey area. Following a project review, DCR confirmed that the
project does not appear to impact any natural heritage resources or plant and insect
species of concern. This confirmation can be seen in Enclosure 4.

project review under the National Environmental Policy Act of 1969 (P.L. 91-190, 42 U.S.C.

Eagle Act conclusions. These conclusions resulted in “no effect” and/or “not likely to adversely

required” determinations for eagles regarding potential effects of your proposed project. We
certify that the use of the online project review process in strict accordance with the instructions
provided as documented in the enclosed project review package results in reaching the

The enclosed species list identifies threatened, endangered, and proposed species, designatedcritical habitat, and candidate species that may occur within the boundary of your proposedproject and/or may be affected by your proposed project. The species list fulfills therequirements of the U.S. Fish and Wildlife Service (Service) under section 7(c) of theEndangered Species Act (Act) of 1973, as amended (16 U.S.C. 1531 ).et seq.
New information based on updated surveys, changes in the abundance and distribution ofspecies, changed habitat conditions, or other factors could change this list. Please feel free tocontact us if you need more current information or assistance regarding the potential impacts tofederally proposed, listed, and candidate species and federally designated and proposed criticalhabitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 ofthe Act, the accuracy of this species list should be verified after 90 days. This verification canbe completed formally or informally as desired. The Service recommends that verification becompleted by visiting the ECOS-IPaC website at regular intervals during project planning andimplementation for updates to species lists and information. An updated list may be requestedthrough the ECOS-IPaC system by completing the same process used to receive the enclosedlist.
The purpose of the Act is to provide a means whereby threatened and endangered species andthe ecosystems upon which they depend may be conserved. Under sections 7(a)(1) and 7(a)(2)of the Act and its implementing regulations (50 CFR 402 ), Federal agencies are requiredet seq.to utilize their authorities to carry out programs for the conservation of threatened andendangered species and to determine whether projects may affect threatened and endangeredspecies and/or designated critical habitat.
A Biological Assessment is required for construction projects (or other undertakings having
similar physical impacts) that are major Federal actions significantly affecting the quality of thehuman environment as defined in the National Environmental Policy Act (42 U.S.C. 4332(2)(c)). For projects other than major construction activities, the Service suggests that a biologicalevaluation similar to a Biological Assessment be prepared to determine whether the project mayaffect listed or proposed species and/or designated or proposed critical habitat. Recommendedcontents of a Biological Assessment are described at 50 CFR 402.12.
If a Federal agency determines, based on the Biological Assessment or biological evaluation,that listed species and/or designated critical habitat may be affected by the proposed project, theagency is required to consult with the Service pursuant to 50 CFR 402. In addition, the Servicerecommends that candidate species, proposed species and proposed critical habitat be addressedwithin the consultation.
