ALLEGED FAILURE TO CONPLY WITH )CONN ISSION REGULATIONS )
ORDER TO SHOW CAUSE
Kentucky Power Company ("Kentucky Power" ), which engages in
the distribution of electricity to the public, for compensation,
for light, heat, power, and other uses, is a utility under the
)urisdiction of the Commi.anion.
GTE South Incorporated ("GTE"), which engages in the
transmission over wire of messages by telephone for the public,
for compensation, is a utility under the Jurisdiction of the
Commission.
KRS 278.280(2) directs the Commission to prescribe rules and
regulations for the performance oi services by utilities.Pursuant to this statutory directive, the Commission promulgated
Commission Regulation S07 KAR Ss041, Section 3, which requires
electric utilities to maintain their plants in accordance with the
standards of the National Electrical Safety Code (1981 edition),
and Commission Regulation 807 KAR 5 ~ 061, Section 2, which
regulres telephone utilities to do likewise.
Commission Staff has submitted to the Commission an
Electrical Utility Accident Investigation Report dated August 23,
1989, attached hereto as Appendix A, which alleges<
l. On July 20, 1989, Johnny Ninks was fatally in]ured in
Lost Creek, Kentucky, when he came into contact with a 7200 volt
single phase overhead line owned and maintained by Kentucky Power.
At the time of the incident, Nr. Ninks was attempting to install a
CB antenna on the roof of a building.
2. At the time of the incident, the electric utility lines
hanging over the building, the 7200 volt single phase, a neutral
conductor, and a lash secondary line, all owned and maintained by
Kentucky Power, failed to comply with the minimum verticalclearance standards for above-ground wires and conductors as
established by National Electrical Safety Code Rule 234C2. The
communications conductor, which hung over the building and was
owned and maintained by GTE, also failed to comply with these
standards.
3. Kentucky Power violated Commission Regulation 807 KAR
5:041, Section 3, by failing to comply with the standards of the
National Electrical Safety Code.
4. GTE violated Commission Regulation 807 KAR 5<061,
Section 2, by failing to comply with the standards of the National
Electrical Safety Code.
WHEREFORE, the Commission, on its own motion, HEREBY ORDERS
1, Kentucky Power and GTE shall each submit to the
Commission a written response to the allegations contained in the
Eleotrical Utility Accident Investigation Report within 20 days of
the date oi this Order.
2. Kentucky Power and OTE shall appear on November 15, 1989
at 1~00 p.m,, Eastern Btandard Time, in Hearing Room No. 1 of the
Commission'e offices at 730 Schenkel Lane, Frankfort, Kentucky,
ior the purposes oi presenting evidence concerning the incident
which is the sub)act of the Electrical Utility Accident
Investigation Report, speci f ically the alleged violations of
Commission Regulations 807 KAR 5s041i Section 3, and 807 KAR
5i081, Seotion 2, and of showing cause, if any they can, why they
should not be subjected to the penalties of KRS 278.990 for their
alleged failure to comply with Commission Regulations.
3. The Eleotrical Utility Accident Investigation Report
dated August 23, 1989 is hereby made a part of the record of this
case ~

DESCRIPTION OP ACCIDENT Nr. Johnnv Ninks and Nr. Tom Nullins were

Minks apparentlv made accidental contact with a 7,200 volt overhead
line, while attemptinc to install top section of CB Antenna on bot-
tom section which had alreadv been installed on end of this buildinc.

unable to obtain anv information on Nr. Minks.
VIOLATIOMS OP CONNISSIOM REGOLATIONS There is a low clearance of
primarv conductor to structure, secondarv I/O lash conductor to struc-
ture and telephone conductor to structure at this location. Nr. Ed
Grecorv's Garace, Hwv. 15, Lost Creek, Kentuckv. Kentuckv Power's
sincle phase and lash secondarv lines are in violation of 807 KAR
5:041, Section 3(1) 1981 MESC Edition Table 234-1 (Vertical). (See

RECONNENOATIONS It is recommended that Kentuckv Power and General
Teleohone Comoanv take corrective action to correct these clearances
and furnish documentation as to corrective action taken. It is alsorecommended that the Commission consider action in accordance with
