Dear Ms. Leffler:

In accordance with 23 USC §108(d) & 23 CFR 710.501(e), The Ohio Department of Transportation is hereby requesting Federal funding for early acquisition of real property interests for the project referenced herein above.

ODOT certifies that: 1. It has authority to acquire the property under State law.2. The acquisition is for a transportation purpose.3. The acquisition will not cause any significant adverse environmental impact.4. The acquisition will not limit the choice of reasonable alternatives for the project or otherwise influence

the decision of the Secretary on any approval required for the project;5. The acquisition does not prevent the lead agency from making an impartial decision as to whether to

accept an alternative that is being considered in the environmental review process;6. The acquisition is consistent with the State transportation planning process under section 135;7. The acquisition complies with other applicable Federal laws (including regulations);8. The acquisition will be acquired through negotiation, without the threat of condemnation; and9. The acquisition will not result in a reduction or elimination of benefits or assistance to a displaced

person required by the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (42 U.S.C. 4601 et seq.) and title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000d et seq.).

10. ODOT has completed the National Environmental Policy Act review with respect to the acquisition of the real property interest.
