San Leon MUD Update

San Leon and the nation are being impacted by COVID-19. The San Leon MUD is here to offer assistance to those in the community in this time of need. There have been no cut offs for non-payment in March, April & May, but cuts offs for non-payment have resumed as the nation and the county return to regular operations. Please contact the office to arrange payment if your account is not current.

Answers to Frequently Asked Questions

There have been a number of questions brought up to the District, both in person and online, so we wanted to take some time to address those in a broader forum in the event other residents in the community had similar questions or concerns.

Why are we expanding the wastewater treatment plant? Is it really necessary?

Chapter 305.126 of the Texas Administrative Code states: “whenever flow measurements for any sewage treatment plant in the state reaches 75% of the permitted average daily or annual average flow for three consecutive months, the permittee must initiate engineering and financial planning for expansion and/or upgrading of the wastewater treatment and/or collection facilities. Whenever the average daily or annual average flow reaches 90% of the permitted average daily flow for three consecutive months, the permittee shall obtain necessary authorization from the commission to commence construction of the necessary additional treatment and/or collection facilities.” The District’s flows have exceeded the state permitted discharge in 2017, 2018, and 2019. While the TCEQ worked with the District to allow time to reduce inflow and infiltration (I&I), the mitigation efforts were not enough due to growth in the community and deterioration of our aging system, so the expansion was deemed necessary.

Why did the cost estimates for the expansion differ so much from the bids?

The estimates to expand the treatment plant were developed by the District’s engineering firm and confirmed to be accurate by an independent construction firm that was not bidding on the project. Those estimates came in at $19,736,500 and resulted in a bond proposal last May to sell $22,750,000 to cover the construction estimate and $3,013,500 in capitalized interest, State and TCEQ fees, and insurance. The vote passed 64.69% for and 35.31% against, enabling the District to sell the bonds necessary to expand the treatment plant in compliance with State of Texas requirements. The District’s tax rate was increased from $0.45 to $0.63 to offset the debt obligation incurred by the bond sale, an increase in $0.18 per $100 of taxable value. (Prior to that increase, the District tax rate had not changed since 2007.) Sealed bids were opened on June 4, 2020, and vetting of the contractors was performed including construction cost analysis, completed project history, and general ability to successfully complete the project on time. After discussion with the contractors regarding the low bids, it was determined that the cost of construction materials had decreased since the initial estimates were performed, plus many companies were forced to lower their costs in order to stay in business and retain their experienced staff due to the COVID situation. The winning bid from LEM Construction Co, Inc. came in at $12,187,876.20 compared to the original estimate of $19,736,500.

What happens to the extra bond money that is no longer needed for the expansion?

Once the treatment plant is completed, the District will be able to apply to the TCEQ to reallocate those funds towards other projects in the District. Our capital improvement plan has projects lined out to improve our infrastructure and reduce our monthly I&I expense. The District could potentially even reduce our tax rate in the future by pre-paying some of the outstanding bond indebtedness at its September 1, 2026 call date.

What else is being done to improve the financial status of the District?

As mentioned in April’s meeting, the District is moving forward with refunding the 2013 bonds, which will result in a savings of approximately $700,000 in interest. More details will be available as the refunding process nears completion in the future. Director Tyson Kennedy is the Pricing Officer for this project.

Can anything be done about my increasing taxes?

While Galveston Central Appraisal District is the entity who assesses home values, you can always verify the exemptions you have on file with them as the District offers two exemptions to residents that can reduce the amount of your MUD taxes. Please contact Andrew at the MUD office for more details.

Is there a way to stay informed about District operations and meetings?

The District meetings are open to the public and held on the third Wednesday of every month at 6:30 PM. Agendas can be found three days before the meeting at the MUD office or online at www.slmud.org. Always be sure to check our website or Facebook page for the most accurate and up to date information.

No Debate At SL FD At the recent San Leon Fire Dept. board meeting, Mr. David Jetelina representing the Haskett campaign for the San Leon MUD board was turned down in his request to hold a candidate debate at the firehouse. Apparently the department had previously agreed to allow a debate to take place there prior to elections being rescheduled as a result of the virus. As it turns out, according to the board, the Haskett campaign did not comply with the terms of their earlier agreement, leaving a question of trust with the department. While a motion was put forth to allow the debate to occur, it died for lack of a second.

San Leon MUD Meeting

The recent regularly scheduled board meeting was unfortunately again a tele-meeting which EPP joined while it was in progress thus rendering this reporting partially incomplete. EPP did learn that the board will return the meetings to the third Tuesday of the month as they had been held at points in the past. The contracts have been executed for the construction of the sewer plant expansion with costs substantially below projections. The board is seeking state authorization to use leftover bond funds to finance other projects within the district and tabled the awarding of a contract for a grant administrator. The board stated that after review of software and systems, the unaccounted for water is a reasonable 3% not the much higher figure previously reported to the public. It is notable that due primarily to requests from Haskett and Jetelina some 2000 documents of around 5000 total pages have been produced to satisfy their records requests entailing about 48 hours of administrative time.

It is with great concern for our employees/volunteers and the citizens of the Bayshore area that Galveston County has decided to cancel the Heavy Trash Event scheduled for July 31st and August 1st. This decision is based on the rising number of COVID 19 cases in the county. We will reschedule this event at a later time. BAYSIDE LIONS LOOKING FOR FLAG DONATIONS

As many of you know, Bayside Lions maintains the flagpole and flag at FM 646 and SH 146.

Each flag flies for approximately 3 months, then is sent in for repairs due to wind damage.

We currently have 4 flags in rotation but some are nearing end of life and must be replaced. The halyard that raises and lowers the flag is also in need of replacement.

Bacliff MUD Meeting On July 14th at 6:00 pm Bacliff MUD held its regular meeting, live and in person at the building on Jackson in Bacliff. The usual housekeeping and administrative chores were handled quickly. Of substance, the board voted on various measure to allow some of the existing bond debt to be refinanced. When the process is complete, a savings of around $450,000 is expected over the life of the bonds. In other business, the contract with Decker Disposal was agreed to with price guarantees and an extended end date part of the agreement. The board voted not to sell a small portion of land near a lift station that would have brought no benefit to the district by its sale, but could have caused future difficulty. Of note, water cutoffs for non payment have resumed and a troubling approximately 103 disconnects were done in June. It was reported that few delinquent account holders were contacting the MUD to make payment arrangements or fulfill the agreements they had already made. The meeting adjourned after about an hour.
