I. INTRODUCTION

A. Background

1. Government of Madhya Pradesh (GoMP) with a sector project loan funding from Asian Development Bank (ADB) has proposed to implement Madhya Pradesh Urban Services Improvement Project (MPUSIP), herein after referred as ‘the Project’. Madhya Pradesh Urban Development Company Limited (MPUDC) shall be the Implementing Agency (IA) and the State Urban Development and Housing Department (UDHD) shall be the executing agency for the Project. A project management unit (PMU) created under MPUDC is implementing MPUSIP.

2. The Resettlement Framework (RF) for MPUSIP outlines the objectives, policy principles and procedures for land acquisition, if any, compensation and other assistance measures for Displaced Persons1 (DPs)/Affected Persons (APs), if any. This framework reflects the borrower’s law on the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013, state government policies, ADB’s Safeguard Policy Statement (SPS), 2009 and other social safeguard guidelines. A detailed description of compensation measures and assistance is provided in the entitlement matrix.

3. An entitlement matrix, consistent with the existing norms and guidelines of the country and

the state government, and ADB’s Safeguard Policy Statement has been prepared to cover losses identified in this Project. The matrix recognizes that the lack of title/customary rights recognized under law will not be a bar to entitlement and has special provisions for non-titled persons. The eligibility for compensation will be determined through a cut-off date. People moving into the sub-project area after the cut-off date will not be entitled to compensation or other assistance.

B. Program Description 5. Coverage: MPUSIP’s physical components include (a) improvements to water in 64

project towns ; and (b) sewage and storm water collection and treatment services proposed in two (2) identified towns (Khajuraho, and Rajnagar). The project also includes an institutional strengthening component and a project management and administrative support component.

C. Scope of this Report

5. This land acquisition and resettlement due diligence report is prepared for the proposed water supply subproject for Meghnagar Municipal Parishad, located in Jhabua district, under MPUSIP. Proposed components of the Meghnagar water supply subproject include construction of Weir, water intake, water treatment plant, storage reservoir, transmission mains and distribution system. The proposed subproject will provide metered water supply for domestic, institutional and commercial users, including metered connections to each household in the town. All municipal wards of the town will be covered under the project. The total population of

the town will thus be covered 12929 population as per census 2011) and 25340 population in the design year, 2048. 6. A due diligence process was conducted to examine the land acquisition and resettlement issues in detail, in line with ADB SPS 2009. This report describes the findings and provides copies of relevant documents, maps, minutes of meetings and photographs. This land acquisition and resettlement due diligence report needs to be read along with the Resettlement Framework prepared for MPUSIP. 7. Upon project implementation, the Social Safeguards Personnel at PMU, MPUDC will be required to undertake a review of this due diligence report, prepare a confirmation letter or report documenting any modifications for the subproject and submit to ADB; and receive a ‘no objection’ confirmation from ADB prior to start of construction in the subproject.

II. POLICY FRAMEWORK, AND ENTITLEMENTS

8. The Resettlement Framework (RF) prepared for MPUSIP sets out the objectives, principles, eligibility criteria and entitlements for APs, based on ADB SPS, 2009 and LARR 2013 as well as national and state laws for protection of street vendors. Until recently, all activities related to rehabilitation and resettlement in the State of MP had been based on the Madhya Pradesh Resettlement and Rehabilitation Policy, 2002 (MPRR) and National Rehabilitation and Resettlement Policy, 2007 (NRRP-2007). GoMP adopted LARR 2013 on 3rd October, 2014 with some specifications for operationalizing its implementation in the state2. Details of policies are in the Resettlement Framework for MPUSIP.

III. SUBPROJECT DESCRIPTION 9. Project area: Meghnagar is tehsil of District Jhabua. It is located at 22054’14’’N and

74032’36’’ E. It is 23 km apart from jhabua district Town is situated at average elevation of 320 m from Mean Sea Level. The year of establishment of Meghnagar ULB is 2015. The area of the town is spread over in 5000.00 Ha (5 Sq Kms ) as per census 2011 data. The town area is divided in 15 wards. The population of Meghnagar is 12929 according to 2011 census and projected to 25340 souls in the year 2048

10. Water supply system in Meghnagar is entirely dependent on ground water source in the form of tube wells and sump wells. There is absence of dedicated water supply scheme as on today. Presently there are 10 tube wells out of which only 6 are in working condition. Water supply to town is served by 6 tube wells located at different parts of city such as Belabadi Village, Antarviliya village and Mordongra village.

11. The Nagar Parishad is having two nos. of OHT of capacity 400 KL. The condition of three OHTs are structurally good. There are 03 nos. of the sump well of total capacity 250 KL out of which 2 nos. sumps having capacity each of 100 KL in (ward no.11,9) and other one 50 KL in (ward no. 8). Total water supply in the town is 0.6 MLD at the rate of 33 LPCD after transmission losses 20%. Nagar Parishad out of 0.6 ML water, 0.2 ML water is buying from AKVN. The supply is alternate day.

12. There are three sump wells and two over head tanks in Nagar Parishad.. Total capacity of three OHT’s in Meghnagar is 400 KL through which water is supplied to Nagar Parishad which covers 50% area of Nagar Parishad. Water is stored in over head tanks by pumping from two nos. of sump well.

13. Water is distributed once in two days for 1 hour in the town with a minimum rate of water supply i.e. 33 lpcd which is below the prescribed standard of 70 lpcd. The major reason behind inadequate supply is inadequate and unreliable source of water supply, uneven distribution of water and age old distribution network. The total length of the distribution network is 5 km about (50% of the total road network in the town).

14. The distribution network covers 60 per cent of the developed area. Water is supplied for a total of 1 hour in alternate day. Meghnagar has very infrequent and interrupted water supply due to water source and treatment facility and distribution network. 15. Irrespective of supply from ELSR, every ward is getting the direct supply from remaining tube wells and hand pumps. The assessment made by the officials at Nagar Parishad, Meghnagar suggests that the distribution and transmission losses are about 20 per cent. 16. There are total 1621 nos. water connection in Meghnagar out of which domestic connections are 1620 nos. and rest of 1no. are commercial connections. B. Proposed Water Supply System 17. The primary objectives of the proposed water supply subproject include:

(i) service improvements to achieve safe and sustainable water services both in terms of services to residents and cost recovery.

(ii) conservation of precious water resources. The project envisages providing 100 percent coverage of population with continuous, pressurized and safe drinking water services and achieving progressively increased cost recovery by expanding the coverage and increasing operating efficiency.

IV. FIELD WORK AND PUBLIC CONSULTATION

A. Public Consultation 20. Stakeholder mapping was undertaken as the first step and the major potential stakeholders listed:

(a) The municipality, its elected members and staff who will be required to

oversee the construction of the distribution networks and WTP as well as be directly responsible for the maintenance of the installations

(b) Concerned government departments (Water Resources Department, Revenue

Department) (c) Local residents who will take initiative to connect their houses with the water

distribution line. (d) Local business people and traders (e) School Students and College Students

(f) Opinion makers or prominent citizens/residents, who are intimately acquainted to and well regarded by the community. They need to be enlisted in spreading environmental awareness within the community as well as in conveying the benefits of the project.

21. Consultations were undertaken with key stakeholders in line with ADB’s requirements pertaining to environment and social considerations. Tools used for consultation were formal stakeholder meetings and focus group discussions (FGD). Extensive consultations with stakeholders (municipality, concerned government departments, community members including slum dwellers, and traders associations) including individual face to face interviews and public consultations were conducted. No users (boatmen and washermen) were found at the intake site which is vacant and unused, hence no special consultation was conducted with them. 22. Field visits were made to all proposed sites and pipeline alignments and the potential impacts and mitigation measures discussed with stakeholders. These consultations helped identify the felt needs/concerns and apprehensions of the communities related to the project and priorities of concerned stakeholders. Discussions were held with people residing at and/or having businesses at/near the proposed subproject locations. Consultations revealed that people are aware of the problems of the existing water supply system in the city as they are getting 35 lpcd and are willing to cooperate in the proposed project. The field visits and interactions helped ascertain that no further survey and inventories are required. Appendix 2 provides a summary of consultations and discussions held.

V. LAND AVAILABILITY AND INVOLUNTARY RESETTLEMENT IMPACTS

23. No land acquisition or resettlement impacts are anticipated for any of the proposed civil works for Meghnagar water supply subproject. Weir is proposed on Anas river. Proposed Intake

well constructed on the bank of river Anas. Total Water demand of the town is 1.06 mcm(for 365 days) in Yr.2068 and storage required in during non rainy period is 0.84 mcm (water demand in Yr.2068 is 2.90 MLD, required storage capacity for 240 days with 20% losses is 0.84 mcm) in Yr.2068. Hence after survey and investigation Weir of 6.0 m height and 200 m long is proposed on Anas river. No impact on downstream users. 24.The permission from Water Resource Department for extraction and construction of Weir is to be taken, making sure that its conditions for granting of NOC are met. All other sites are owned by GoMP, hence only transfer is required from the Revenue Department. Pipe alignments are proposed along roads within the jurisdiction of Meghnagar Nagar Parishad. 24. In Meghnagar town, raw water abstraction will be undertaken from Anas river then treated and supplied to the town. Construction of proposed intake well, raw water pump house

will be undertaken on land belonging to Water Resource Department (WRD). The land for proposed WTP has been in the Revenue Department’s possession for many years and was not acquired in anticipation of ADB funded MPUSIP, as revealed through discussions with the Revenue officer of revenue Department during visit on 28.04.16

25. 100 KL Capacity of clear water sump well is proposed at WTP for storing Clear water after treatment from WTP. Land belongs to revenue department.

26. The proposed raw water rising main is 6474 m long 200 mm dia. DI K9 proposed from Intake well to proposed WTP will be laid within the road ROW of PWD. The Clear water feeder main of total 3895 m long (1847 m length of 250 mm dia.,1290 m length of 200 mm dia. and 758 m length of 150 mm dia. pipe) also proposed to be laid within the Meghnagar nagar parishad road ROW. The pipelines will not cross any private land along the alignments. 27. One OHT of 200 KL is proposed for Zone-3 .The ULBs shall apply for No Objection Certificate (NOC) from WRD for raw water extraction and construction of Intake well at source. The other sites are revenue land (GoMP), for construction of the proposed water works ULB has to take NOC or transfer of land.

28. New distribution pipelines (length 20485 m ) are proposed to be laid along existing road

ROWs. Proposed pipe diameters range between 110 mm to 250 mm HDPE pipe, hence width of required excavation is anticipated to be a maximum of 0.7 m. Pipe laying activity on roads in the most congested market areas and densely built-up areas has been carefully planned to avoid IR impacts including temporary economic impacts to hawkers, shops and businesses. 29. Measures will be taken to minimize excavation, disturbance to pedestrians and traffic and avoid income loss to businesses, while minimizing road reconstruction costs. Temporary impacts to traffic/access to shops and residences due to digging of pits for pipe laying are possible during construction; however, these will be mitigated by ensuring access to properties through provision of pedestrian planks, provision of adequate signage, and careful traffic management.

30. Mobile hawkers will be assisted to move to places nearby, to ensure their earnings are not affected. The weekly market day will be avoided for construction. Only mobile vendors will be shifted to a nearby location during the period of construction and assistance to shift will be provided by the contactor. No income loss is anticipated. 31. In case temporary shifting of vendors with temporary structures is necessary, such shifting will be undertaken on a weekly holiday, to avoid income loss on the day(s) of shifting. The vendors will be assisted to shift and will be able to continue plying their trade during the construction period at the alternative location. Potential disruption of water supply to existing consumers is possible during construction, and will be mitigated through supply by water tankers. 32. House Service connections: Provision of house service connections will involve tapping from a distribution main/ sub-main including one tapping saddles, elbows, service pipe from tapping point to the chamber near property boundary or inside the property boundary as per the direction .The work will involve excavation and road restoration. Each connection will include a domestic water meter: Installation of AMR compatible water meters for each house service water connection (2394 nos.), is envisaged. 33. Proposed distribution pipe-laying on roads in the town will not have any permanent or temporary IR impact. Hawkers and vendors have been witnessed along the road side for some part of the distribution network pipe alignment, but they are mobile vendors and are not likely to be affected. Laying of transmission mains and distribution network pipelines in the project area has been carefully planned to minimize disturbance to pedestrians and traffic and avoid income loss to businesses. 34. Potential temporary impacts to traffic/access to shops and residences due to digging and excavation for pipe laying are possible during construction; however, these will be mitigated by ensuring access to properties through provision of pedestrian planks, provision of adequate signage, and careful traffic management. VII. CONCLUSIONS

A. Summary and Conclusions

36. No negative IR impacts are assessed at identified sites for sub-project components, as adequate vacant land is available for the proposed facilities, within the compounds of government lands. The Weir and intake well is proposed to be constructed on Water Resource Department Land, for which NOC is under approval. The proposed site for Water Treatment plant and OHT is under the possession of revenue Department. The land record of this sites are appended to the DDR. For linear components (pipe laying) or those proposed along government road ROWs, temporary disruption to road users, pedestrians and community members will be avoided. In the most congested zones of Meghnagar, safety measures and simple mitigation measures during construction by the contractor such as provision of planks for pedestrian access to shops, avoidance of weekly haat days for construction, undertaking construction on weekly market holidays, and proper traffic management and information sharing with the public, will be adopted. A budgetary provision is made for costs likely to be incurred for impact mitigation.

B. Next Steps

37. The DDR needs to be updated with the following information:

NOC from Water Resource Department for proposed intake well at Anas river

NOCs from concerned department for WTP, OHT etc

Details of land transfer to ULB.

In addition to the above, in order to improve the quality of consultations, local community organizers will be appointed for the subproject under the package; record of consultations held with local communities and other stakeholders to be included in updated/final DDR.

The area has insufficient and inadequate drinking water supply. Water from two tube wells is presently supplied to the area/community. The area faces severe water crisis during the summer season when the ground water level drops.

The community welcomed the project and expressed need for it. However, they were apprehensive that their economic condition would prevent them from paying water user charges.

Possibility of exempting the poor and vulnerable from user charge payment.

Note: Boatmen and washer men were not observed near the proposed intake well location on Anas river, hence need for a separate consultation with them was not perceived.
