1. INTRODUCTION

a. PURPOSE OF THIS PROPOSAL (RFP) PROCESS

i. The purpose of the RFP is to invite qualified contractors to submit their proposals to supply driver’s education programs for the Prairie Valley Schools commencing with the 2014-2015 school years. Contractors may submit proposals on any or all locations for a two year term. See Addenda A and B.

ii. The Board will evaluate all proposals based on the objectives in this document. Following the evaluation and award process, the Board will enter into a contract with the successful proponent(s).

iii. The Board reserves the right not to accept any or all proposals. The lowest priced proposal will not necessarily be accepted.

2. PROPOSAL RESPONSES

a. Contractors must submit two copies of their RFP response by NOON on May 23,

2014.

b. Please ensure the response is clearly marked as: “PROPOSAL FOR DRIVER EDUCATION SERVICES” Delivered to: Mailing Address: Prairie Valley School Division P.O. Box 1937, 3080 Albert Street North Regina, SK S4P 3E1 Physical Address: Education Centre Hwy 6 RM of Sherwood

c. Proposals will not be accepted and will be returned unopened if they are received after

the deadline. Incomplete proposals will not be accepted. Proposals must be submitted

on the enclosed pricing sheets with additional information supplied as required. Pricing sheets list the schools and projected enrolments for fall 2012. See Addenda A and B.

d. For each instructor of your Driver’s Education Group: Proposals must include copies of

current valid evidence of Driver Training School, Driver Education Instructor and Driver Instructor Certification, as well as proof of bonding and liability insurance. Prairie Valley School Division may require references when reviewing submissions with new Drivers Education personnel.

e. Current Criminal Record Checks and Vulnerable Sector Checks for each person must

accompany your bid.

3. CONTACT INFORMATION AND INQUIRIES

4. TERMS AND CONDITIONS

The following terms and conditions will be incorporated into a contract between the successful proponent and the Board. Proponents must specifically address any requested modifications to these provisions. Unless specific modifications are requested and agreed to, all provisions will be incorporated in the contract.

a. Driver Education programs shall be operated in accordance with Part XII – Driver

Education, of “The Education Regulations 1986”. See Addendum I. b. Class sizes shall not exceed 35 students except with the prior approval of the School

Administrator.

c. Subject to approval of the Superintendent of Education, students identified as “Intensive Needs Students” may be admitted to the Driver Education Program. A fee differential will be provided as negotiated with the Division Office.

d. Scheduling for in-class and in-car instructions will be arranged between the contract and

the School Administrator.

e. Contractors may only charge Prairie Valley School Division with the in-class and in-car rates per student. All other expenses are the responsibility of the contractor.

f. Classes are expected to be held after school between 3:30 p.m. and 5:30 p.m. or as

arranged with the School Administrator.

g. In-class instruction must total at least 30 hours.

h. In-car instruction must not be less than six hours.

i. Contractors are expected to provide the students with a broad range of driving

experiences which shall include: driving in town, grid roads, highways and driving in a city.

j. Personnel providing the in-class and the in-car instructions shall be directly responsible

to the School Administrator.

k. In schools that have one in- class session per year, students may be enrolled in the program at 14 years, 9 months.

l. All contracts concluded between Prairie Valley School Division and the Contractor shall

be subject to the rules and regulations prescribed by the Ministry of Education and the Highway Traffic Board.

m. Prairie Valley School Division reserves the right to reject bids received from Contractors

who, at the sole discretion and determination of Prairie Valley School Division, have not provided satisfactory service to Prairie Valley School Division in the past.

n. Students must initial the Drivers Education Records for each class. See Addendum D.

o. The School Administrator must sign the SGI Funding Reconciliation Form prior to

remitting to Division Office. See Addendum C.

p. Contractors are paid on a monthly basis.

q. The instructor must provide proof of meeting Driver Education Instructor requirements and responsibilities as per pages eight to 10 in the Driver Training Regulations, 2011. Proof has to be included with proposal response. See Addendum J.

r. Students should normally be 14 years, 9 months of age before attending any in-class

instruction. Students aged 14 to 14 years, 9 months inclusive must have the written consent of the School Administrator to attend the Driver Education Program.

s. A tentative timetable for the school year for both in-class and in-car instruction shall be

drafted prior to the commencement of the course and be subject to approval by the School Administrator.

t. Contracting firms will be responsible for records, wallet cards, etc.

u. Records and returns required by the Ministry of Education are to be submitted to the Division Office. Records concerning instruction should not be sent directly to the Ministry of Education.

v. Driver Education Instructions are preferred to have a minimum of three years successful

driver training experience. Please provide each instructor’s complete name, a contact number and complete driver training history.

w. No Shows are to be clearly outlined on the invoice.

x. Students withdrawing from Drivers Education must complete the Drivers Education

Student Withdrawal Form. This completed form must be faxed to SGI with a copy provided to both the School Administrator and Division Office. See Addendum F.

Addendum E

Withdrawal from Driver’s Education Program Before a student is dropped from a driver’s education class, the instructor, in consultation with the School Administrator, will ensure that every option and avenue has been considered to retain the student in the program. Should such an option not be feasible, then the withdrawal of the student should be undertaken following the guidelines establish by the school and the department. It is the responsibility of the driver’s education instructor to notify SGI immediately by completing the Withdrawal from Driver’s Education Program Form. SGI requires this form in order to update the student’s driving record and take appropriate action against his/her licence. Further, if the student is 15 years of age and in possession of a learner’s licence, they will have his/her learner’s licence cancelled and the driver’s education indicator on SGI’s system deleted. Anyone who is 16 years of age or over, will have the driver’s education indicator deleted from his/her record and be required to either redo the driver’s education program or take four hours of commercial driver training. As well, the student’s road test eligibility dates will be changes to six months from the date he/she purchased the Class 7 licence. The form is available in the Saskatchewan Government Insurance Policy Manual. The Driver’s Education Instructor must notify SGI immediately by completely the Withdrawal from Driver’s Education Form. If the student is 15 years old, his/her licence will be cancelled and they are required to either redo the Driver’s Education program or take four hours of commercial driver training. If the student is 16 years old, he/she is allowed to retain their Class 7 license, but must take commercial driver training. Completed forms are to be faxed to SGI at (306) 569-9631. A copy should be retained by the School Administrator and Division Office.

Driver education54(1) For the purposes of section 189 of the Act, a board of education and theconseil scolaire shall only offer a driver education and training program that isapproved by the person designated as administrator pursuant to The Traffic SafetyAct.

(2) Every board of education and the conseil scolaire shall retain an official recordof pupil participation in the driver education and training program offered in itsschools.(3) Every board of education and the conseil scolaire shall submit to the ministerat least once each year, in the form required by the minister, a record of every pupilwho participates in the driver education and training program offered in itsschools.

CHAPTER T-18.1 REG 9The Traffic Safety Act

Title1 These regulations may be cited as The Driver Training Regulations, 2011.

Interpretation2 In these regulations:

(a) “Act” means The Traffic Safety Act;

(b) “applicant” means a person applying to the administrator pursuant tosection 111 of the Act for a driver instructor’s certificate or a driver trainingschool certificate;

(c) “certificate” means a driver instructor’s certificate or a driver trainingschool certificate;

(d) “class” means, with respect to a motor vehicle, the class of motor vehicleas defined in The Driver Licensing and Suspension Regulations, 2006;

(e) “driver instructor” means a person who holds a valid driver instructor’scertificate;

(f) “driver instructor’s certificate” means a certificate mentioned insubsection 111(3) of the Act;

(g) “driver training school certificate” means a driver training schoolcertificate mentioned in subsection 111(2) of the Act;

(h) “educational authority” means:

(i) a board of education as defined in The Education Act, 1995;

(ii) the conseil scolaire as defined in The Education Act, 1995;

(iii) the senate of a university;

(iv) the persons responsible for the operation of a school for Indianchildren established by the Minister of Indian Affairs and NorthernDevelopment pursuant to the Indian Act (Canada); or

(v) the persons responsible for the operation of a private college orschool that is recognized by the administrator;

(i) “in-car instruction” means instruction that provides a student withpractical driving experience at the driving controls of a motor vehicle underthe direction of a driver instructor;

(j) “retraining” means retraining a person in the operation of a class ofmotor vehicle for which that person holds a driver’s licence;

(k) “simulation instruction” means instruction employingelectromechanical devices and films designed to simulate the driver’scompartment of a motor vehicle and the experience of driving a motor vehicle;

(l) “student” means a person who is receiving instruction from a driverinstructor for the purpose of qualifying for any class of driver’s licence or forthe purpose of improving his or her skills in the operation of a motor vehicle;

(m) “upgrading” means training a person who holds a driver’s licence inthe operation of a class of motor vehicle that requires a higher class of driver’slicence.

Non-application3 These regulations do not apply to:

(a) an employee of an employer who provides retraining or upgrading toother employees of the same employer; or

(b) a person who provides instruction without compensation.

Restrictions4 No person shall provide driving instruction in a vehicle unless that person:

(a) holds a class 1, 2, 3, or 4 driver’s licence, if he or she is providinginstruction to a student who is seeking to obtain a class 5 driver’s licence;

(b) holds a class 1 driver’s licence, if he or she is providing instruction to astudent who is seeking to obtain a class 1, 2, 3 or 4 driver’s licence; and

(c) holds an M endorsement, if he or she is providing instruction to a studentwho is seeking to obtain an endorsement to operate a motorcycle.

Driver instructor certificate5(1) An application for a driver instructor’s certificate must:

(a) be on a form provided by the administrator; and

(b) be accompanied by:

(i) the results of a criminal record check respecting the applicant,satisfactory to the administrator, that is on a form provided by theadministrator and signed by a peace officer or an officer of the R.C.M.P.detachment or the Town Constable of the municipality in which theapplicant carries on business;

(ii) the fee set out in The Traffic Safety Act Fees Regulations;

(iii) proof of the applicant’s successful completion of a written test and aroad test approved by the administrator for a driver instructor’scertificate; and

(iv) a driving record that is satisfactory to the administrator, andevidence of driving experience that satisfies the administrator that theapplicant is capable of providing driving instruction for a particular classof driver or driver’s licence endorsement.

(2) In addition to the requirements in subsection (1), a driver instructor mustprovide evidence of the successful completion in the preceding 12 months of a driverinstructor training course approved by the administrator.

(3) An application for renewal of a driver instructor’s certificate must:

(a) be on a form provided by the administrator; and

(b) be accompanied by:

(i) a signed declaration, on a form provided by the administrator,indicating if the applicant has in the past 24 months been charged withan offence under the Criminal Code and, if a conviction was obtained, theoffences for which that person was convicted; and

(ii) the fee set out in The Traffic Safety Act Fees Regulations.

(4) In addition to the requirements set out in subsection (3), a driver instructormust provide evidence of the successful completion of any continuing professionaldevelopment requirements established by the administrator within the 24 monthspreceding the application for renewal.

(5) An application to renew a driver instructor’s certificate must be filed with theadministrator not more than 60 days and not less than 10 days before the expiry ofthe current certificate.

(6) In addition to the requirements set out in subsections (1) to (4), theadministrator may require an individual applying for a driver instructor’scertificate or renewing a driver instructor’s certificate to provide a certificate offitness that:

(a) is in a form provided by the administrator;

(b) verifies that the applicant is physically and mentally fit; and

(c) is completed by a duly qualified medical practitioner acceptable to theadministrator.

(7) If the administrator is satisfied that an applicant has complied with therequirements of this section and the other requirements set out in the Act and theseregulations, the administrator may, in accordance with the application:

(a) issue a driver instructor’s certificate to the applicant; or

(b) renew the applicant’s driver instructor’s certificate.

Prohibition6 No person shall engage in giving instruction for hire, tuition or salary in thedriving of a motor vehicle or in the preparation of a person for examinationsauthorized by the administrator for a driver’s licence unless he or she is the holderof a driver instructor’s certificate and:

(a) is employed by a driver training school registered pursuant to theseregulations;

(b) is the owner or operator of a driver training school registered pursuant tothese regulations; or

(c) is employed by an educational authority.

Evaluation7(1) Every driver instructor shall successfully complete a performance evaluationapproved by the administrator within 12 months after the date of issue of his or herfirst driver instructor’s certificate.

(2) The administrator may, at any time it considers appropriate, require a driverinstructor to successfully complete a performance evaluation approved by theadministrator.

Reporting8(1) Every driver instructor shall report to the administrator, within five daysafter its occurrence, if:

(a) the driver instructor is charged with an offence pursuant to the CriminalCode or The Alcohol and Gaming Regulation Act, 1997; or

(b) the driver instructor is subject to an administrative suspension pursuantto the Act or any regulation pursuant to the Act.

(2) If a driver instructor is charged with an offence pursuant to the Criminal Codeor The Alcohol and Gaming Regulation Act, 1997, the administrator may refuse toissue or renew a driver instructor’s certificate until the charge has been disposed ofor the time making any appeal respecting the charge has elapsed.

Identification9 At the request of a peace officer, a student or the administrator, a driverinstructor shall produce a valid driver instructor’s certificate.

Driver Training Schools10(1) An application to obtain a driver training school certificate or to renew adriver training school certificate must:

(a) be on a form provided by the administrator; and

(b) be accompanied by:

(i) a penal bond for the protection of the contractual right of thestudents that is:

(A) in the principal sum of $10,000;

(B) on a form approved by the administrator; and

(C) written by a company authorized to do business pursuant toThe Saskatchewan Insurance Act;

(ii) evidence of insurance coverage required pursuant to section 11that:

(A) is in the form of a certificate of the insurer that is acceptable tothe administrator; and

(B) stipulates that the insurance shall not be cancelled except on30 days’ prior written notice to the administrator; and

(iii) the required fees as set out in The Traffic Safety Act FeesRegulations.

(2) For the purposes of subclause (1)(b)(i):

(a) the total liability of the surety under the penal bond for all breaches ofthe conditions of the bond must not be less than the principal sum of $10,000;and

(b) the surety shall not cancel the bond except on 30 days’ prior writtennotice to the administrator.

(3) An application to renew a driver training school certificate must be filed withthe administrator not more than 60 days and not less than 10 days before theexpiry date of the current certificate.

(4) If the administrator is satisfied that an applicant has complied with therequirements of this section and the other requirements set out in the Act and theseregulations, the administrator may, in accordance with the application:

(a) issue a driver training school certificate to the applicant; or

(b) renew the applicant’s driver training school certificate.

Liability Insurance11(1) No person shall operate a driver training school unless the driver trainingschool has a motor vehicle liability insurance policy or a bond of guarantee thatinsures the owner of the driver training school, every driver training instructor andany person taking instruction against the liability for bodily injury, death andproperty damage that is imposed by law and arises out of the ownership, use oroperation of the vehicle.

(2) The insurance policy or bond of guarantee mentioned in subsection (1) mustexceed by $2,000,000 the amount required pursuant to The Automobile AccidentInsurance Act against liability for bodily injury, death and property damage for anyone accident.

Duties12 Every person who holds a driver training school certificate shall:

(a) notify the administrator, in writing, of any change to its name or addresswithin 15 days after the change;

(b) ensure the instruction in the driver training school meets the standardfor instruction approved by the administrator; and

(c) notify the administrator, in writing, of any of the following changes within 15days after the change:

(i) if any new driver instructor is employed by the driver training school;

(ii) if any driver instructor ceases to be employed by the driver training school.

Records13(1) Every driver training school shall maintain records with respect to each studentshowing:

(a) the student driver education certificate number;

(b) the student’s name, address, date of birth and SGI-issued customer identificationnumber;

(c) if the student is attending a secondary school, the name of the secondary school;

(d) the dates and number of hours of in-car instruction and simulation instruction;

(e) the dates and number of hours of in-class instruction;

(f) if required by the administrator, the student’s vision test results;

(g) the class of licence or endorsement with respect to which instruction was given;

(h) the student’s attendance;

(i) the student’s marks on all examinations; and

(j) if the student is receiving driving instruction for the operation of a commercialvehicle, the log books required to be maintained during training and student progressreports or evaluations; and.

(2) Every driver training school shall maintain, on a form acceptable to the administrator,records showing the success and failure rate of the students of each driver instructoremployed by the school.

(3) Every driver training school shall make any records kept pursuant to subsections (1)and (2) open to inspection by the administrator at all reasonable times.

(4) Records kept pursuant to this section are for the confidential use of the administrator.

(5) A driver training school shall maintain any record respecting a student for at least fiveyears after the date on which the record was made.

(6) If a driver training school ceases operation, all records held by the driver trainingschool pursuant to this Act must be transferred to the administrator.

Reporting14 Every driver training school shall provide to the administrator, on a form acceptable tothe administrator, a report showing the results of driver licensing examinations for eachstudent on the completion of every course.

Prohibition15 No driver training school, no operator, agent or employee of a driver trainingschool and no driver instructor shall state or imply that a driver’s licence isguaranteed on completion of the course of instruction.

Expiry of certificate16(1) A driver instructor’s certificate expires on the date set out on the certificateunless it is sooner suspended or revoked pursuant to the Act or these regulations.

(2) A driver training school certificate expires on the date set out on the certificateunless it is sooner suspended or revoked pursuant to the Act or these regulations.

Standards for vehicles17 No driver training school and no educational authority shall operate or causeto be operated a motor vehicle for the purpose of practical instruction to trainstudents in the driving of motor vehicles unless the motor vehicle:

(a) is maintained in safe operating condition; and

(b) meets all the requirements of the Act and the regulations made pursuantto the Act.

Standards for class 5 motor vehicles18(1) In addition to the requirement set forth in section 17, every class 5 motorvehicle used in driver training by a driver instructor to train a student to drivemust have the following:

(a) special rear-view mirrors firmly affixed to the vehicle to allow a driverinstructor a clear and unobstructed view of the highway to the rear of thevehicle;

(b) a sign at the rear of the vehicle that is conspicuously and clearly visiblefrom a distance of 30 metres and that contains the words “Student Driver”in letters not less than 7.5 centimetres in height; and

(c) dual brakes.

(2) Notwithstanding subsection (1), the following students may receive instructionin a vehicle the student owns:

(a) a student with a physical disability that impairs his or her ability to drivea motor vehicle and who requires a vehicle equipped with special or modifiedcontrols designed to overcome or compensate for the physical impairment;

(b) when the administrator determines it is appropriate, a student whorequires assistance from a driver training school to improve his or her skill inoperating a class 5 motor vehicle for the purposes of training or retrainingthat student; and

(c) a student who is seeking to improve his or her skill in operating a class 5motor vehicle for the purposes of training or retraining that student if thestudent owns a vehicle with a standard transmission.

Employee training20 Notwithstanding sections 18 and 19, an employee who is undergoing trainingby an employee of the same employer or by a person who is under contract to anemployer to train employees may receive instruction in the employer’s vehicle.

In-car instruction21(1) For the purposes of this section, “driver training program” means aprogram of instruction for new drivers, offered by an educational authority, thatincludes 30 hours of classroom instruction and six hours of in-car instruction.

(2) For the purposes of providing in-car instruction, four hours of simulationinstruction is deemed to the equivalent of one hour of in-car instruction.

(3) In a driver training program, not more than three hours of in-car instructionmay be substituted by the use of simulation instruction.
