Dred’s Background Contd.Emerson died in 1843 and Dred and his wife are le# to Mrs. Emerson who lived in the slave state of Missouri.

Dred offers her $300 for his and his wife’s %eedom. Mrs. Emerson declines.

Dred Goes to CourtThe first time Dred went to court to sue for his %eedom was in 1847. He lost on a technicality. It couldn’t be found in writing that Mrs. Emerson lega$y owned Dred.

Dred went through the St. Louis Circuit Court, Missouri Supreme Court and the United States Circuit Court in Missouri. They went back and forth on his ruling.

Dred took the case to the Supreme Court.

Supreme Court of 1856

7 Justices were appointed by pro-slavery presidents. 5 out of 9 were %om slave owning families.

Chief Justice Taney had a big influence on the decision. He was %om Maryland and supported slavery.

Supreme Court’s DecisionThe ruling in 1857 was as fo$ows: blacks, no matter what territory they are in can sti$ be held in slavery. It was ruled that the Missouri Compromise was unconstitutional.

Congress couldn’t do anything about slavery because slaves were considered property and the 5th Amendment protected the people against the government taking property that they had rights to.
