Greater Taree City Council Pricing PolicyCouncil’s fees and charges are levied in accordance with regulation 201 of the Local Government(General) Regulation 2005.
The Council reviews its schedule of Fees and Charges on annually as part of its budget processwith the view of optimising Council's revenue base while attempting to ensure that the level offees and charges are fair and equitable for residents and other users of Council services.
The Council, when setting fees and charges, considers the nature of the service and recognisesany community service obligation and wider policy objectives including equity and social justice.
The purpose of this Pricing Policy is to outline how Council charges and recovers approved fees andcharges for:
● Supplying products, services or commodities● Giving information● Providing a service relating to the exercise of Council's regulatory functions,● Allowing use or benefit from Council's assets, possessions, facilities or enclosures.
In determining the amount to be charged for goods and services the following factors areconsidered:
● The cost of providing the service● The importance of the service to the community● Prices fixed by the relevant industry body or bodies● Any factors specified in the Local Government regulations● User–pays principle, and● Market prices
All Council's fees and charges are reviewed on an annual basis prior to finalisation of Council'sannual operating budget. However, in special circumstances, fees and charges can be reviewedand approved by Council in accordance with the Local Government Act and Regulations.
The majorconsideration in reviewing fees and charges shall be full or true cost recovery or marketprice on a fee for service (user pays) basis. However, this principle will only be applied where thecost of the service provision can be accurately determined and the end user can be easilyidentified.
Council's Pricing Policy is based on a number of pricing categories.
1. Regulatory fees and charges
These fees are fixed by legislation including the Local Government Act and the Local GovernmentRegulations. Council does not have discretion in the application of these fees and charges unless itis described in the legislation.
2. Full cost recovery
Fees and charges in this category are intended to be provided at no cost to Council. They arecharacterised by services that relate to individuals or individual sectors of the community.Non–regulatory fees in the building and development area are an example.
3. Partial cost recovery
These fees and charges usually have a component of “public benefit” and it is appropriate thatgeneral revenue from rates income is applied to a proportion of the fee or charge. The level ofcost recovery and subsidisation is determined on a case by case basis.
4. Commercial return
Commercial fees and charges are applied where Council provides a competitive or entrepreneurialservice. Principles of competitive neutrality may be applied to these fees and charges. Page 52 of 62 | GTCC Fees & Charges 2016-2017

Reduction or Waiver of FeesSection 610A(1) of the Local Government Act 1993 provides that "a council may waive paymentof, or reduce, an approved fee (whether expressed as an actual or a maximum amount) in aparticular case if the council is satisfied that the case falls within a category of hardship or anyother category in respect of which the council has determined payment should be so waived orreduced." Pursuant to section 610A(1) of the Act, Council has adopted the following policy:
A reduction or waiver of the fee will only be permitted where the person or organisation requestingit is determined by the General Manager to fit into one or more of the following categories:
Category 1 – Significant Personal Hardship
To qualify for this category the following criteria must be met:
(a) the person must be able to demonstrate that the service or product that they require willprovide them with some reasonable benefit and that this benefit is not available to them throughmeans other than council; and
(b) the person must be able to demonstrate that their personal financial situation is such thatthey are unable to pay the adopted fee or charge. This may require the production of a bankstatement or other documentary evidence; and
(c) in the opinion of the General Manager, a reduction or waiver of the fee is appropriate in thecircumstances.
Category 2 – Non–Profit Organisation With Significant Financial Hardship
To qualify for this category the following criteria must be met:
(a) the organisation must be able to demonstrate that the service or product that it requires willprovide it with some reasonable benefit and that this benefit is not available to them throughmeans other than council; and
(b) the organisation must be able to demonstrate that its financial situation is such that it isunable to pay the adopted fee or charge. This may require the production of appropriatedocumentary evidence; and
(c) in the opinion of the General Manager, a reduction or waiver of the fee is appropriate in thecircumstances.
Category 3 – Demand Stimulation/Community Benefit
To qualify for this category the following criteria must be met:
(a) the person/organisation receiving the benefit of the service or product must be eligible toreceive a subsidised or waived fee in order to provide a stimulus for the demand of the service orproduct; or
(b) the person/organisation receiving the benefit of the service or product must be eligible toreceive a subsidised or waived fee in order to promote community or environmental benefits or toassist the economic well–being of the community; and
(c) in the opinion of the General Manager, a reduction or waiver of the fee is appropriate in thecircumstances. In forming an opinion, the General Manager will give consideration to the level ofother council support available or granted to the person/organisation.
All requests for a reduction or waiver of a fee or a charge must be made in writing.
In all cases where a reduction or waiver of a fee or charge is approved, the reasons for thedecision and details of the actual fee charged will be recorded by council staff on the appropriatecouncil file. Any approval given will be on the basis of the circumstances of the individual case andwill not be taken as a precedent for subsequent requests.
