Enforcement of Plant Quarantine Act. Incorporate new rules and policies on Plant Quarantine. Promote Plant Quarantine Activities at the check posts of the entry

points. Issuance of Phytosanitary Certificate for export of agricultural

Plant Quarantine Law & Regulations Quarantine Service Started from 14th century. In 1799 USA introduced Quarantine Act. In 1825 UK promulgated Quarantine Act. In 1914 British Indian Governor General Promulgated the Destructive

insects and pest Act. In 1951 FAO started international plant protection convention (IPPC). In 1966 Pakistan endorsed destructive insects and pests rules. In 1974 Bangladesh became the member of IPPC. In 1989 Bangladesh amended the destructive insects and pests

rules' 1966 and the rules is still on. Plant quarantine Act-2011' has been passed in 2011. New Rules yet to be formulated.

Market Access Facilities for Bangladeshi Exporters

Bangladesh as a Least Developed Country (LDC) is enjoying duty free market accessor reduced tariff rate facilities to export to various developed and developingcountries in the world. This facility is enhanced and privileged by the membership ofWorld Trade Organization (WTO).

WTO members always recognize the necessity of providing Duty Free Quota Free(DFQF) market access to LDCs. It was decided in the 6th WTO MinisterialConference held in Hong Kong in 2005.

Generalized System of Preferences (GSP): Bangladesh is getting GSP facilities from 38 countries; European Union – 28 countries. Others - Australia, Belarus, Canada, Liechtenstein, Japan, New Zealand,

Norway, Russian Federation, Switzerland and Turkey – 10 countries. EU GSP – Generalized System of Preference to developing countries and

LDCs which was adopted in 1968 and became effective in 1971. EU GSPoffers either lower tariffs or completely duty-free access for imports from 90developing countries and territories into the EU market.

Market Access Facilities for Bangladeshi Exporters

GSP Scheme of Japan and Bangladesh: Japan originally established its Generalized System of Preferences scheme (GSP) on August 1,

1971. Japan’s GSP scheme includes a general preferential regime and a special preferential regime. Japan grants preferential tariff treatment under its GSP scheme to 137 developing countries

and 14 territories. LDCs are granted duty free and quota free market access in 5415 products of which 1383 are

agricultural products and 4034 are industrial products.GSP Scheme of Australia: Duty-free and quota-free entry from the 49 LDCs and East Timor (treated as an LDC) with

effect from 1 July 2003. The preferential scheme GSP-50 for LDCs offers duty free treatment to all LDCs in case of all

tariff lines.GSP Scheme of New Zealand: Duty free quota-free (DFQF) access for all least developed countries on 1 July 2001. The preferential scheme GSP-50 for LDCs offers duty free treatment to all LDCs in case of all

tariff lines.

South Asian Free Trade Agreement (SAFTA): Singed: 06 January 2004 at 12 SAARC Summit Member States: Afghanistan, Bangladesh, Bhutan, India, Maldives, Nepal,  

Pakistan & Sri Lanka SAFTA Sensitive Lists: The Agreement provides scope for maintaining of 

sensitive lists, which are not subject to tariff reduction program. Bangladesh, India and Nepal maintain different sensitive lists for LDCs and Non‐LDCs.

Market Access Facilities for Bangladeshi Exporters

Asia Pacific Trade Agreement (APTA):Bangkok Agreement, signed in 1975, was the oldest PTA among developing countries.

Revision of the Agreement was made in 2005, and was renamed as the Asia PacificTrade Agreement (APTA).

Korea DFQF Facilities:Korea provided Preferential Tariff to 48 least-developed countries to 95% of tariff lines

in 2012. LDCs like Bangladesh enjoy DFQF access in South Korea market at 4,802 products which amounts 95 per cent of total HS codes.

China DFQF Facility: China's Duty-Free Quota-Free (DFQF) Scheme is a unilateral non-reciprocal tariff

preference scheme for Least Developed Countries (LDCs) under the agreement ofAPTA, China-ASEAN FTA and diplomatic relations with Africa. The scheme cameinto effect on 1 July 2010, and was renewed on 1 January 2011 with no date ofexpiration.

The program covers products of 4,788 tariff lines (8-digit level), accounting for 60per cent of all tariff lines of China.

Chile DFQF Facility:Chile's duty-free and quota-free (DFQF) scheme named "Eliminating Import Tariffs on

Goods from the Least Developed Countries" entered into force on 28 February 2014with no expiry date. Bangladesh started to get benefit in 1 January 2015.

Duty Free Tariff Preference of India:India became the first developing country to extend this facility to all Least Developed

Countries (LDCs). India’s Duty Free Tariff Preference (DFTPI-LDC) Scheme forLDCs came into effect in August 2008 with tariff reductions spread over five yearson 4,430 items (at 6-digit HS code level), which constitutes 85% of total tariff lines.

Control of Export of Products :The Export of products under this policy will be controlled in the following ways, such

as; Export Prohibited Products: Unless otherwise stated, products prohibited under this policy cannot be exported. the

list of export prohibited products in given at Annex‐1; Conditional Export: Products which are exportable subject to fulfilling certain conditions can be exported

after fulfilling those conditions. The list of such products is given at Annex‐2. Exportable Products: Unless otherwise stated, all other products except for the products under prohibition

as listed in Annex‐1 and the products under conditional export as listed in Annex‐2shall be freely exportable.

Rules & regulations as stated in this policy shall not be applicable to the followingcases: Store, equipment or spare parts of ships, vehicles or aircrafts bound forabroad, and products declared as part of their kitchen, or the baggage accompaniedby the sailors or the crew and passengers of those ships, vehicles or aircrafts;

Export of samples subject fulfillment of the following conditions* All products that are not included in the prohibition list; *  A maximum of US$10,000 worth products per exporter annually (except   medicine) based on the FOB (free on boar) price; 

*  Products sent free of cost as samples, provided that, in case of medicine: * Any registered exporters who are member of the registered associations can send a maximum of US$ 70,000 worth products as sample, without export L/C (Letter of  Credit); * Medicine worth 10% of the total value of each L/C or a maximum of US$ 15,000  whichever is less;

* Examining on a case‐to‐case basis, Bangladesh Bank, if necessary, can increase these limits. 

* Subject to the approval of Bangladesh Bank, for 100% export‐oriented garment  industry, a maximum of US$ 15,000 worth samples of readymade garment per year;

Pre-shipment Obligations:Unless otherwise stated, pre-shipment certificate is not obligatory for export of any

product Quality Control Certificate: Quality control Certificate issued by the competent authority (Bangladesh Standards

and Testing Institution/Department of Fisheries/Department of AgriculturalExtension/Bangladesh Council of Scientific and Industrial Research) shall have to besubmitted to the Customs Authorities in case of export of products for which qualitycontrol certificate is obligatory.

Agriculture Sector: Contract Farming will be encouraged for the production of exportable

products, such as vegetables, potato, betel leaf, fruits including mango, plantand plant products;

Production of modern and scientific packaging materials necessary for exportof vegetables, flower & foliage and fruits will be encouraged, and steps willbe taken to provide loan at low interest rate to establish cold storage forpreserving exportable plant products;

Necessary steps will be taken to meet requirements (Phyto-sanitaryrequirement) of the importing countries for the export of potato, betel leaf,mango and other fruits and vegetables;

Training programme for the producers and exporters of vegetables, flower &foliage and fruits will continue;

In the case of export of agro-based products, initiative will be taken to exportproducts free from all kinds of contaminations. Department of AgriculturalExtension will play the leading role in this regard;

Department of Agricultural Extension will take necessary measure to makeSalmonella free betel leaf available for export;

Initiative will be taken to establish Central ‘Warehouse & Packing’ Centre atShyampur, Dhaka by following cool chain system;

Appropriate steps will be taken so that no plant and plant products areexported without fulfilling the import requirements of the importingcountries and exporters and cultivators will accordingly be informed throughtrainings;

Initiatives will be taken to build Pest Free Area (PFA) and Area of Low PestPrevalence (ALPP) for producing exportable products, such as potato, fruitsand vegetables;

Initiative will be taken to establish production area based packing house; and Initiative will be taken to make phyto-sanitary activities efficient and

stronger, and E-phyto-sanitary certificate will be introduced and widened.

Current Rules, Procedures and RequirementsIncluding Sanitary and Phyto‐sanitary (SPS) forExporting Agri‐Food‐Products to SelectedInternational Markets.Plant Quarantine Act, 2011An Act to make provisions, in the context of international traffic in plants and

plant products, for preventing the introduction of insects or pests into, andspread thereof within, Bangladesh and for the matters relating tophytosanitary and other measures incidental and ancillary thereto

National Plant Quarantine Authority(1) For the purposes of this Act, the Government shall establish an authority to be called the National Plant Quarantine Authority.

(2)The Director, Plant Protection Wing, Department of Agricultural Extension, shall be deemed to be the National Plant Quarantine Authority and shall exercise all the powers of the Authority under this Act until an independent National Plant Quarantine Authority is established under sub-section (1).

(3) All the officers and employees of the Plant Protection Wing, Department of Agricultural Extension shall act as the officers and employees of the Authority until a separate organization established under sub-section (1).

The powers and functions of the Authority shall be as follows:-a. To regulate the import of plants or plant products, beneficial organisms and packing

materials for preventing the introduction of quarantine pests into Bangladesh fromother countries;

b. To regulate the export of plants or plant products, pests, beneficial organisms andpacking material according to the phytosanitary requirements of the importingcountry in consistence with international Agreements;

c. To inspect and supervise the consignments of plants or plant products, beneficialorganisms and packing materials which are in international traffic and mayincidentally be used as carriers of pests;

d. To inspect growing plants, areas under cultivation, and plants or plant productsremaining in storage or in transit and to take regulatory measures in order toprevent the outbreak and spread of pests;

e. To make arrangement for issuing phytosanitary certificates in accordance with thephytosanitary requirements of the importing countries;

f. To conduct treatment formalities for disinfestations or disinfection of pests of theconsignments of plants or plant products and their containers, packing materials,conservation stores or conveyances;

beneficial organisms, the importation of which is prohibited and restricted intoBangladesh, with a view to updating and harmonizing phytosanitary measures;

l.To exchange technical information, opinion and report with recognized international,regional or other national plant protection organizations and to keep abreast of thelatest advancements in the field of plant protection and quarantine;

m. To conduct activities regarding diagnostics, detection and identification of particular pests;

n. To conduct activities regarding promotion and control of integrated pest managementin Bangladesh;

o. To comply with the international agreements, protocols, conventions, etc. onphytosanitary measures, of which Bangladesh is a party or a signatory country, andto conduct implementation activities thereof, and to follow, conduct and coordinatethe activities regarding conservation of plant bio-diversity;

p. To undertake risk analysis of the trans boundary movements of genetically modifiedorganisms (GMOs), living modified organisms (LMOs) and alien invasive speciesand their introduction and to control them;

q. To undertake surveys and surveillance on plant quarantine pests present inBangladesh and to conduct plant quarantine research;

r. To preserve pest related information about plants or plant products withinBangladesh, information about preventive and controlling measures of theirinfestation and infection and information of the matters relating thereto;

s. To take the following measures if there is reasonable grounds to believe that anoffence has been, is being or is about to be committed under this Act or anyconditions of import permit or phytosanitary certificate is being breached, such as:-(i) To collect extract from the register and record kept under the custody of theconcerned person, and to seize and keep 6 the registers under its custody for a certainperiod if required to prove the offence;(ii) To search the body of a person, or to search, examine and seize any materialscarried by the person or conveyance at the time of entry and exit of Bangladesh;(iii) To prohibit the distribution, sale or use of any plants or plant products for acertain period;

t. To maintain and develop plant quarantine laboratories; and u. To do any other act as may be assigned to it by the Government.

Pre-export examination: (1) In case of export of plants or plant products, each and every consignment shall have

to be examined by the plant quarantine officer.(2) Each consignment of plants or plant products submitted for export shall be

examined by a plant quarantine officer in such manner as may be prescribed by rulesin accordance with the phytosanitary requirements of the importing country.

(3) If the consignment submitted deems to be fit for issuance of a phytosanitarycertificate, the plant quarantine officer shall issue a phytosanitary certificate in suchmanner as may be prescribed by rules.

Prohibition against export(1) No exporter shall export any plant or plant product without a phytosanitary

certificate issued by the Authority.(2) The Authority may, with prior approval of the Government, from time to time,

prescribe the procedure for exportation of plants or plant products.(3) The Authority may, with prior approval of the Government, by notification in the

official gazette, from to time, exempt certain plants or plant products from theconditions for export.

Power to Make the Rules of Plant Quarantine

(1)The Government may, by notification in the official Gazette, make rules to carry out the purposes of this Act.

(2)Without prejudice to the generality of sub-section (1), such rules may also provide for the following matters, namely:-(a) Procedures for detection of pests which are likely to be introduced into Bangladesh

being transmitted with plants or plant products or packing materials;(b) Determination of entry or exit points of importation and exportation and the matters

relating to establishment of plant quarantine stations;(c) Obligations to be complied with by the plant quarantine officers in exercising their

powers;(d) Matters relating to inspection, supervision, treatment, destruction and removal;(e) Procedures for submission of applications for obtaining import permits or certificates,

disposal thereof and for preferring appeal and disposal of appeal;(f) Matters relating to phytosanitary certificates;(g) Matters relating to declaration of controlled areas and payment of compensation;(h) Matters relating to training, establishment of laboratories and security systems;(i) Procedure of collection of fees and charges; and(j) Any such other matters as may be required under this Act.
