This Chinese festival originated hundreds of years ago when a
Chinese opera group fell ill with malaria. The idea of the nine-day
event is abstention – including no meat, alcohol, tobacco or sex –
to ensure good health and purify the mind and body. Ceremonies
include fi rewalking and body piercing. Early morning processions are
spectacular and usually gruesome. Participants puncture their cheeks
with various objects including knives and skewers and other items.

The 2014 Cape Panwa Hotel Phuket Raceweek takes place off Panwa Cape on Phuket's southeast coast, 16th – 20th July. Headquartered at Cape Panwa Hotel – the event's title and host sponsor – the 2014 edition is already starting to boast a strong line-up of local and international entries.
Last year's winner in the Firefl y 850 class, Twin Sharks, have confi rmed they will be back to defend their title, as have past-winners Moto Inzi. Regular Raceweek competitor Stuart Williamson, who placed second in IRC Racing 2 last year, will be back for another attempt at the title on his boat Skandia Endeavour of Whitby, while other regulars confi rmed include Ruby Tuesday and Grenville Fordham's Nina, another past Raceweek-winner.

Leading a crew from the Metung Yacht Club in Australia to Raceweek for the fi rst time last year was Terry Grundy, who is returning again on the chartered BeauX Esprit. They are joined by another Australian crew chartering Kinnon.
The TP52 Oi! is back to defend its IRC Racing 1 title with Peter Ahern at the helm, while newcomers Hedonist and Anchali have already signed up.
“Our early-bird entry off er has proved very successful with many boats taking advantage of the special price. Boats and crews from Australia, Singapore, United Kingdom and New Zealand have already signed up, as well as a number of local Phuket-based boats. The entry list is shaping up nicely and we look forward to welcoming another competitive fl eet,” added Jones.
The early-bird off er is open until 6th June – 10,000THB for boat and skipper and 4,000THB per crew ticket.
In line with their desire to develop Raceweek, organisers have taken the lead in environmental stewardship by offi cially becoming a Clean Regatta as approved by Sailors for the Sea, the fi rst regatta in South East Asia to become so.
“Sailing is considered to be a clean and green sport, and on the whole it is. As residents of Phuket and organisers of an annual sailing event here, the team at Phuket Raceweek are aware of the importance of the sea to Phuket's tourism and sailing industries, and we aim to ensure the marine environment is left in a better state for future generations,” explained Jones.
The Clean Regattas programme is a global certifi cation system that encourages regatta organisers and yacht clubs to manage and run environmentally responsible events. With regattas in more than 13 countries certifi ed, Cape Panwa Hotel Phuket Raceweek is the fi rst in South East Asia.

KOH PHING KAN (JAMES BOND ISLAND)Made famous by the fi lming of the James Bond movie “The
Man with the Golden Gun”, this island is now a major tourist
attraction, visited by hundreds, sometimes thousands, of
people daily.
Most come by bus then longtail boat from Phang Nga, so it is
best visited before 10:30 am or in the late afternoon, assuming
you want to avoid the crowds. Koh Phing Kan has a stunning
lagoon and some interesting rock formations, though it is no
more impressive than many other islands in the area which
the day tours ignore.
Scores of food and souvenirs vendors come from Koh Pan Yi to
set up stalls on the island during the day. A 500 baht per person
fee is levied by the Park Rangers when going ashore.

It lies just under the surface at low tide
and has been hit many, many times. Beware!

A
The best anchorage in this group is found in the channel
between Koh Raya Ring and Koh Daeng Yai. This is an
exceptionally beautiful place to awaken in the morning, when
sunlight strikes the sheer rock cliff s of Daeng Yai.
The anchorage can be approached either from the south, via
the channel formed by Koh Yang and Koh Daeng Yai, or from
the southeast, passing east of Koh Yang, distinctive due its
high, thin column of rock, visible from far south.
There is a convenient transit approaching from the southeast,
lining up Koh Lolo and Koh Khai to avoid the sand bars.
Good holding is available on a muddy bottom in 5-8 metres.
The sandbank east of the anchorage is very shallow and
almost dries at low tide. There is a current of up to 2 knots in
the channel, strongest at ebb tide.
The lagoon on the north side of Koh Phing Kan can be entered
by dinghy at high tide; otherwise access is possible by dinghy
at most tides via the jetty on the southwest side.
KOH YANG18 miles from Yacht Haven

This is a delightful, well-sheltered anchorage on a small bay
facing south with good holding on a muddy bottom in 4-5
metres. Approach from the deep channel on an easterly
heading, taking care to avoid the shallow bank approximately
600 metres south of the anchorage which often has a bamboo
stake to show its position.
There is a small community of thatched houses on the beach
and a restaurant where coconuts, fi sh, crabs or prawns can
often be bought from the villagers who maintain temporary
fi shing houses here.
Again, if moving north from here, beware of the rock that
lurks beneath the surface at all tides in the passage between
Koh Yang and Koh Daeng Yai (see chart).

Koh Pan Yi, otherwise known as Sea Gypsy Village, is built
almost entirely on stilts over water to the south of the
sheer cliff s of the island. The people here are really Muslim
fi shermen, not Sea Gypsies as the tourist name suggests. The
nearest real Sea Gypsies live far south on Phuket Island.
The approach from the south is clearly marked by a light
structure on a small rocky islet at the river entrance and the
course to the village is straight. Favour the right side, if any,
to stay in deeper water. Anchor in 4-9 metres to the east of
the village, taking care to avoid the many fl oating cages
used for raising fi sh.
There are dinghy landings, many restaurants and souvenir
shops in the village, which is usually packed with up to 3,000
tourists during the lunch period, but is quiet and peaceful
in the late afternoon and evening.
Further north on the east side of Khao Khian are cave

West of Khao Khian is a shallow mangrove river that
meanders through rocky outcrops and past an awesome
sheer cliff . This river eventually leads through Tham Lot cave
approximately three miles from the village. Depths make this
only suitable for small speedboats and dinghies. Local tour
operators are frequently seen racing up and down this river
and can indicate where the deeper water is found. Keep to
the outside of blind corners and keep a good lookout for
speeding tour boats.

Not too many years ago, Phuket’s multihull
regatta secured its sponsorship due to Phuket’s
booming property market and, at the same
time, incorporated an event-within-an-event,
the Corsair Cup, paying homage to a sizeable
fl eet of Vietnam-built Corsair trimarans joining
the local boats.
Phuket’s property boom ended, the sponsorship was no more and the Corsairs disappeared. But Asia’s biggest gathering of multihull sailing boats (catamarans
and trimarans) continued, thanks to the Ao Chalong Yacht Club’s (ACYC) dogged determination, and even established its own niche as the sailor’s regatta – a ‘regatta without frills’.
This year, major sponsorship is back thanks to Multihull Solutions – and so are the Corsairs, represented in Phuket by Multihull Solutions. At this stage, three Corsairs have confi rmed entry and a fourth is available for charter at roughly half price (see box feature for details).
This year’s regatta, to be held from 10-13 July out of ACYC’s superb waterside premises, has been renamed the Multihull Solutions Regatta, in recognition of its Title Sponsor, and promises to be one of the best yet – with a few more frills than in recent years, but remaining true to its roots as the ‘sailor’s regatta’.
Described by Multihull Solutions’ Asia general manager, Andrew de Bruin, as “the best value for money sailing event in the region”, the organisers are keen to attract cruising multihulls – whether visiting Phuket or based here – to take part. But cruising yachts are traditionally reluctant to join in regattas, perhaps fearing that their skills are not up to the task – or that racing is simply too much like hard work.

INGREDIENTS for the fi sh: 165gm each 2 fresh white
snapper fi llets (skin-on); Salt to taste.
Method: Season fi sh with salt on both sides to taste. Pan sear
on high heat with 2 tbsps of grape seed oil, skin side down until
just crispy. Move the pan with the fi sh to an oven preheated to
230°C. Cook until just cooked through approx. 6-7 minutes.
INGREDIENTS for the ragout:200gm thinly sliced fresh shiitake mushrooms
4 strips of high quality bacon, chopped small
½ stalk of leek thinly sliced
3 crushed cloves of garlic (peel-on)
Salt & pepper to taste.
Method: Cook the chopped bacon in a pan over medium heat
until crispy and fat has rendered out. Reserve half the fat in the
pan and place the cooked bacon on a paper towel. In the same

1.5 tsp honey
2 tbsp whole grain mustard
INGREDIENTS for the light arugula pesto:
½ cup milk
2 cloves of garlic peeled
175 gm wild arugula
1 egg yolk
¾ cup exra virgin olive oil
Salt to taste
Method: Place all ingredients EXCEPT the olive oil in a medium
stainless steel mixing bowl. Slowly pour in the olive oil while whisking
vigorously until the sauce forms an emulsion and develops the
desired medium-thick consistency. If the sauce is still thin keep
whisking in oil until it thickens. Taste and season with salt to taste.

Lemon juice to taste
Salt to taste
Method: Simmer the garlic over low heat in the milk until soft.
Discard the milk. Poach the arugula in salted water until it changes
to a vibrant shade of green (approx. 1 minute); instantly remove and
shock in a bowl of iced water. When suffi ciently chilled, press the
water out of the arugula with your hands and discard the water. Place
the poached arugula and the softened garlic in a blender. Blend the
ingredients while slowly pouring in the olive oil through the top of
the blender lid. Taste and add a squeeze of lemon and salt to taste.
To plate the dishSpoon the mushroom ragout evenly onto two white plates. Rest
the fi sh fi llets on top of the ragout, crispy skin side up. Spoon the
whole grain mustard emulsion, beginning close to the fi sh and
draping outward. Drip the desired amount of the arugula pesto in
a line away from the fi sh.
Sit, eat and enjoy!

this stage add a touch of chicken stock or heavy cream to moisten

Long-awaited by mid-island residents, Royal Phuket Marina's boardwalk has come alive and promises to be a unique place to drink and dine ‘à la St Tropez’. We started our ‘marina evening’ at The Speakeasy – a name that conjures up 1920s-30s prohibition in the USA, when alcohol was illegal. Speakeasies blossomed and, unlike the traditional bars, welcomed men and women who wanted a few drinks, to listen to live music and to dance. Why “speakeasy”? Well, originally it was because pre-prohibition unlicensed USA bartenders would tell their customers to “speak easy” when ordering their alcohol.
Of course, there’s nothing dodgy about Phuket’s Speakeasy at Royal Phuket Marina’s boardwalk – but it does conjure up images of an Al Capone hangout; you almost expect Eliot Ness and his ‘Untouchables’ to burst through the doors.

As for the environment, JOBI designers’ Pui has employed her creative talents creating an ‘industrial’ feel; a long communal dining table occupies the centre of the restaurant, surrounded by high level dining ‘à deux’ tables. The décor is simple, creating the kind of unassuming atmosphere you could expect from a chic Milan city-centre eatery.
Back to that do-it-yourself pasta. If you’re like me, this kind of thing doesn’t generally appeal BUT, once we got stuck into it, there’s no denying it’s a great way to go. Take a few minutes to work out how to do it, check with your host Cathy Masson if you’re not sure what goes with what, then dive in and create your own mouthwatering experience.
My choice: penne with (base sauce) olive oil, (ingredients) scallops and mussels and (additional condiments) garlic and white truffl e oil. I’m a genius! OK, the fact that the ingredients were top quality and the chef clearly knows a thing or two may have contributed to

This atmosphere is thanks to interior designer Pui (of JOBI designers) who, with her eye for detail, has done an amazing job of recreating the authentic ‘speakeasy’ environment.
The Speakeasy is managed by Cathy Masson – one of Phuket’s best known restaurateurs whose unique ‘The Wall’ in Rawai was one of the south island’s favourite eateries in the late 90s.
What is The Speakeasy about? Well, lounge around with friends on one of the luxurious sofas, soaking up the atmosphere with a perfect gin & tonic or a cocktail from the extensive menu. Or sip a malt whisky accompanied by a good cigar outside on the boardwalk. It’s perfect for informal meetings and briefi ngs too, with a private area in the back behind the central island bar (but no, there isn’t a door into a back alley – that would be just a bit TOO authentic).
And anywhere that limits its selection of gins to Hendricks, Bombay Sapphire and Tanqueray has my vote!
my enjoyment of the best pasta meal I’ve eaten for as long as I can remember. My dining companion went against Cathy’s advice and selected smoked salmon and Parma ham – two of her favourite tastes – as her two main ingredients and said it was divine. Just goes to show: when you’re in the driving seat you can buck convention happily.
But, if you prefer to stay within the bounds of convention, feel free to go for one of the ‘Classic Creations’, where the chef does all the work. But you’ll be missing out.
Around the edges of our pasta creations, we ordered garlic bread, bruschetta and a fresh salmon salad. The former were as you’d expect, the latter simply heavenly. All was washed down with a very drinkable Santa Helena Cabernet Sauvignon and followed by desserts from nearby Les Anges bakery.
Pasta Basta is quite simply fi rst-rate waterside dining with no pretentions – just impeccably sourced and prepared ingredients and excellent service from a team that never stops smiling and is obviously happy at work. My companion’s question, “When can we come back?” says it all.

you don’t have to worry about the government and bureaucracy
being a ‘partner’ in your life.
I've never found anywhere freer in which to do business in all my
extensive travels. Of course, there are negatives, but if you enjoy the
business freedom of Phuket, then you shouldn’t whine about the
lack of rules and law enforcement. But on balance, it's a great place
to do business.
Do you have family with you? Khun Nui and I have been
together now for 15 years and I have two daughters and a son from
previous relationships. Two of my kids are grown up and settled in
relationships and good jobs, and my youngest daughter Vikki, who
starred in the pantomime on stage at The Green Man a few years
ago, is pursuing Film Studies in London.
What car do you drive? I used to have a BMW, but recently we
traded it in for the 'Battle Wagon’ – a Suzuki van that we can use to
carry all the shopping back from Makro!
What social activities and charities are you involved with? In
addition to Freemasonry, I attend the Chaîne des Rôtisseurs dining
events. But the pub is our main social life, with weekly wine tastings,
quizzes, salsa dancing and singing practices. Then there's our Saint
George Evening and Burn’s Night and various theatrical events.
How do you evaluate success? I've found myself to be extremely
happy recently and I think it’s because I keep busy doing
something that I very much enjoy… running The Green Man. I'm
now in my sixties and I think it’s a privilege to still be occupied with
work and dealing with people that one enjoys.
What do you think the future holds for you? I'm currently writing
two books; one is a sort of history of the world in seven separate
books, with chapters written by ‘voices’ from the past such as Karl
Marx and King Solomon. I'm also writing my memoires of being
a consultant all over the globe. As I'm still doing some overseas
consultancy assignments, this latter book won’t be published until
I fi nally retire from that sort of work – because it ‘pulls no punches’
about the consultancy business!
Where are you from? I grew up and went to school in the famous
English naval city of Plymouth in Devon and then to the University
of Surrey from 1964 to 1969, studying Hotel Management.
When did you fi rst visit Phuket? I fi rst came to Phuket about 20
years ago to scuba dive. I discovered Mom Tri’s Boathouse, which I
thought was wonderful and so started staying there each time that
I took a break in Phuket from my work around the region.
Why did you move to Phuket? My career involved business
consultancy working around the world for Price Waterhouse.
Specifi cally, I became the World Firm Partner responsible for Central
America, the West Indies, Africa and India and so I was looking for
a base in which to live while I travelled extensively doing my job.
I looked at Goa and the Windies, but Phuket seemed to off er the
most wonderful lifestyle and at great value too, so I opted to make
it my home.
While I loved staying at the Boathouse, I decided to buy a house in
Phuket in 1997 and I still live there.
Tell us how The Green Man came into being When Price
Waterhouse merged with Coopers and Lybrand in 2001, I decided
to take a ‘golden handshake’ and retire from the company. I had
always thought that Phuket ought to have the sort of English-style
country pub for local residents in which I personally would like to
drink. So with my partner Khun Nui, we found a great piece of land
at the base of Kata Hill and decided to build our own faux-Tudor
pub and restaurant there.
Why did you call it The Green Man? I've always been interested
in cultural and religious history and had discovered the Pagan
God known as ‘The Green Man’ many years before. He's the
embodiment of re-birth and fertility and is celebrated with dancing
around the May-Pole (in fact a huge phallic symbol) on May 1st
every year. I decided to open The Green Man pub on May 1st 2001.
The Green Man is the God of uncontrolled nature and he's the one
in charge of your being, when your conscious mind is not. I thought
that was an appropriate emblem for our pub as, after enjoying a
few ales, one may not be as in control as normal and so The Green
Man takes over your being!
I also built a replica of an Egyptian temple behind the pub; I spent
several years in Egypt studying its history and various cartouches
that are replicated on the temple walls. We use the temple for
various meetings, including that of a Phuket Masonic chapter, of
which I am currently the Master. We also stage theatrical events,
such as our famous Kiddies’ Pantomime each Boxing Day on the
stage, which we added into the temple.
How does doing business in Phuket compare with other places? The tremendous thing about doing business here is
the great freedom one has to try anything. Here we're largely
untrammeled by rules and regulations, unlike in the west, and so

Wear a vest for the water. That’s my advice when you decide to take a visit to one of Phuket’s most interesting attractions.
The Cable Ski is a unique aquatic sporting venue in Asia and it caters for just about everyone. It consists of an oval shaped man-made lake with a cable suspended over the top, a dock fully stocked with all the wakeboarding equipment you need, a restaurant with patio seating, a running track and even an adjacent Thai massage. All of this is conveniently located just over the hill from Patong, next to Kathu Waterfall.
The Cable Ski lake itself is 410 metres long, 110 metres wide and two metres deep. It was designed specifi cally for the sports of wakeboarding and water skiing. As such, a concrete walkway surrounds the lake

at water level. This prevents the water from becoming too choppy. A cable runs suspended over the lake and is connected to machinery at four corners. At the dock, the riders will don their wake-boards and gear, then line up to ride; one-by-one the attendee will hand them a rope that's connected to the cable above.
Once an open hook arrives at the dock, the rider will be pulled away. The set speed for open riding on the lake is 28 km/hr. This is

The venue provides all the equipment you'll need for rental. This includes wakeboards, water skis, gloves and vests. There are a variety of ways a beginner can start out and Cable Ski accommodates that. For their fi rst time, most people ride on the kneeboards. These allow the rider to get a feel for being on the water, being pulled and navigating the turns. Once this is achieved, then you can try to stand.
Besides being beginner-friendly, the Phuket Cable Ski also caters for advanced riders − and occasionally a professional wakeboarder will pop in and show off his skills. The lake boasts a number of ramps for jumping and some rails to do grinds and you'll often see the more serious riders doing back-fl ips and fl ying through the air to a cheering crowd.
If you're the kind of person that worries about calorie content, then the cable ski is the place to eat. Riding the lake is a great way to burn fat, build those stabilising muscles that we so rarely use and to train

your balance. Having a good physique is helpful if you hope to become an advanced rider, but the sport itself is a great way to increase your fi tness level − and it’s more fun that hitting the gym repeatedly.
'Be prepared to fall' is the best advice for novices. Acquiring skill at the sport requires determination as well as confi dence. You can’t be afraid of falling into the water and you also have to be prepared to swim back to the sidewalk. However, you needn’t worry about having to carry your board all the way back to the dock as the staff will kindly drive out on a motorbike and return you to the starting position.
The set speed for open riding on the lake is 28 km/hr. This is set for optimal safety and is a very enjoyable cruising speed.

Lemongrass founder, Bobby Duchowny, studied aromatherapy –
a healing art that promotes massage, when combined with specifi c
herb and spice oils, as a method to reduce stress, boost energy and
heal certain physical ailments – at the American Aromatherapy
Association.
Some years ago while on holiday in Thailand, he visited an organic
farm in Petchaboon province and became interested in the natural

Chilled out by the soothing background music, I was fi lled with a
peaceful wellbeing as I enjoyed the warm traditional Sukko welcome of
the ‘Flower Floating Ritual’ – like ‘Loy Kratong’, where the idea is to fl oat
away past stresses and wish for luck and joy from that moment on
A variety of 40 spa treatments – prepared by Sukko's certifi ed Thai
Herbalist and based on ancient Thai medical theory – is off ered at

The headland is home to another elegant dining venue, Mom Tri’s
Kitchen at Villa Royale, which has a menu of Mediterranean and
Thai fl avours developed by Mom Tri’s two chefs Sura Putha and
Darren Wiper, with some dishes created under Michelin Star-level
guidance by recent guest chefs Henri Charvet, Johanna Maier
and Gerard Royant. Mr Charvet was the inspiration behind one of
Mom Tri’s most celebrated dishes, pan-grilled Phuket lobster with
aromatic ginger, lime and coriander in creamy coconut sauce.
Wine pairing is also a dream here, with more than 600 labels in

Over at Kata Centre, Two Chefs restaurant is set to celebrate Easter
in sumptuous style this month with a special buff et. On April 20,
kids will join an Easter Egg painting session while the whole family

herring, warm-smoked salmon and Swedish chocolate balls, all for
just 595 baht for adults and 395 baht for kids.
Good news for Sunday brunch fans, Centara Grand Beach Resort
Phuket, on the beachfront at Karon’s north end, is now putting on
its Sunday Family Lunch every week at Mare restaurant. Since the
resort opened last year, the Sunday lunch has been a big draw for
families, especially with the free use of the resort’s swimming pools,
lazy river, jumping cliff and water slides.
Hot SceneKata Beach has long been a surfer’s mecca, and now board riding
fans can enjoy year-round action with Surf House, Phuket’s fi rst-
ever fl owboarding venue, on the Kata beachfront. Weekly events
including Wednesday networking nights and Friday ladies nights
have coaxed a number of locals as well as visitors to try riding the
waves, and enjoy some burgers and cocktails afterwards on its
rooftop bar. A Flow Jam competition is planned for 5 April – be sure
to check in at Surf House for more details and to sign up for your
chance to win fl owboarding glory.
Just up the road in the Kata Night Plaza is a colourful little place
where surfers will also feel right at home. The newly-built Fin Hostel
off ers a comfy retreat for boarders on a budget. Though you can
stay here for as little as 500 baht a night in the dorm, Fin really
splashed out on the design, cleverly making this both a cheap and
chic place to stay. Surfer heaven.

Hot PropertyWe’ve noted the new Kata Rocks above as an innovative dining
venue, and its fl air as a resort is now emerging, too, since it started
taking bookings for its villas this January. While some villas are still
under construction, a number of rooms are now welcoming guests.
We had a peek inside and found them to amply live up to the
resort’s “infi nite luxury” tagline.
Each villa’s crisp and clean design, private pool and wide sea views
evokes a feeling of being aboard a yacht, and every detail from the
iPad-controlled entertainment and lighting system to the dishware
in the kitchen is top notch. We also had a look around the Kata
Rocks spa and fi tness centre, where no expenses were spared to
bring in the most state-of-the-art facilities, including a “sleeping
pod” – a groovy bubble of comfort that looks rather sci-fi in design,
aimed at relieving tension and stress.
Also hugging the headland is a six-bedroom private villa that’s been
in the rental market for several years yet showing no signs of dating.
Baan Kata Keeree has a lot of added character from the owner’s
personal art and décor collection and, in keeping up with the
growing private villa market in Phuket, the holiday home’s appeal
has been further enhanced by the addition of a large Jacuzzi set
under a skylight in the master bedroom and a massage room. And
the views across Kata bay? Breathtaking.
The Novotel resort brand has been expanding its presence in
Phuket of late, with new Novotel resorts opening in Patong and
Kamala last year, and now another one is under construction on
Karon Beach. Formerly a Ramada resort, the 217-room Novotel
Phuket Karon is found just across the road from the beach, and is
due to open in late 2015.
One of Phuket’s best-known resorts, Boathouse, is this year
celebrating its 25th anniversary and doing so in style with the
completion of a big makeover and rebranding as Boathouse

Consumers of products and goods in Thailand frequently
ask legal counsel whether liability can arise from
‘misleading advertisements.’ Essentially, the question is
posed as such: "I was promised something in an advert
I saw and the product I purchased due to the advert is not what
was promised. Do I have any claim for compensation?"
One legal mechanism that has been used to ‘police’ advertisements
in Thailand is the Consumer Protections Act of 1979, which created
a number of rules about the advertising of, and the sale and
purchase of, goods and services in Thailand. The Act also created a
so-called ‘consumer protection board’ to accept complaints from
consumers about the sale and purchase of goods and services.
Generally, the Consumer Protections Act provides certain rights to
‘consumers,’ which are defi ned as "person[s] who buy or obtains
services from a businessman or person[s] invited by a businessman
to purchase goods or obtain services…" Therefore, in order to
qualify for protection under the Act, a person must be a ‘consumer’
and must have purchased, or at least have been off ered for
purchase, goods or services. Once falling under this defi nition, the
Act provides broad protections, and indeed Section 4 of the Act
specially states that a consumer is entitled to the following:
1. The right to receive correct and suffi cient information and
description as to the quality of goods or services;
2. The right to enjoy freedom in the choice of goods or services;
3. The right to expect safety in the use of goods or service;
4. The right to a fair contract, and
5. The right to have injury considered and compensated under law.
Because the Act protects consumers from incorrect ‘information,’
it naturally deals with advertisements for goods and services,
which by their very nature are intended to deliver information on
a product, whether it be a good or a service. Indeed, section 22 of
the Act states that "an advertisement may not contain a statement
which is unfair to consumers or which may cause adverse eff ect
to the society as a whole" and then goes on the specify that an
advertisement is unfair or causes adverse aff ect to society if it is
(1) exaggerated or false; or (2) causes misunderstanding in the
essential elements of the goods. The Act specifi es other ways an
advertisement can be harmful, but for the purposes of this short
brief, the above two points are the most relevant.
The role of the Consumer Protection Board in determining
which advertisements off end the provisions of the Act is broad.
Consumers who feel they have been mislead by an advertisement
can petition the board for consideration of their case and redress.
In fact, the board can ultimately enjoin the use of an advertisement
it ultimately deems to be ‘harmful to consumers,’ or order the
advertiser to clarify statements found to be misleading, and
where not clear, they have the power to order the advertiser to
substantiate what they have claimed about such advertised good
or services. Advertisers who are found to be in violation under
the Act, may also liable for injury compensation at law to those
who have purchased their goods or services as a result of the
advertisements.
As such, it is important for business people making statements and
representations in advertisements about products in Thailand to be
off ered to consumers, to ensure that such statements be reviewed
for compliance with the Consumer Protection Act. The good news
for advertisers who are unclear is that they have the opportunity
to pre-empt action by submitting their intended advertisements
to the Board for an opinion and feedback. Opinions generally must
be supplied within 30 days, or the advertisements submitted are
deemed to be acceptable and not in violation of the Act.
In Phuket, the question of misleading advertisement often arises
in connection with purchases of property – be it a condominium
or a villa. Purchasers ask if the Act’s provisions apply to such
property ‘products,’ and the general response from lawyers is, yes –
‘potentially.’ However, due to the often complex nature of property
investment, combined with the complex provisions of the Act, it is
important for consumers to check with legal counsel as to whether
the factual circumstances of a property purchase and related
advertisements fall within the Act’s provisions.

On yet another long road trip for a Helicam job, the crew set off for Trat province, south of Pattaya – a two day drive from Phuket.
Once reaching Trat, all helicopter gear and cameras are loaded onto a passenger ferry for arrival at Koh Kood island.
Koh Kood is Thailand’s fourth largest Island, just south of Koh Chang and close to the Cambodian border. The Soneva Kiri Resort is situated on the western side of the island, occupying an entire headland, set within a jungle landscape providing challenges for photography.
The Helicam crew visit a selection of the properties to launch one of their new drone helicopters. Stunning images are captured while the electric drone fl ies slowly around the properties. A 360 degree image is taken centrally above the property to provide an interactive tour for the resort website. Active links are placed on various locations to allow viewers to visit diff erent villas / restaurants / spa locations.

What does 'long term rental or lease' actually mean? A long
term rental or lease normally means to rent or lease a property
for a minimum of one year or more. To many property owners
in Phuket, this is the preferred rental compared to short term
holiday rentals, where the property is rented out to holiday
makers on a daily or weekly basis.
Property owners looking to rent out their property for long
term rental usually prefer to do so fully furnished. Most would-
be tenants also prefer to rent a property fully furnished as they
need not worry about pots, pans, plates etc. Having said that
some tenants tend to ship their personal belongings, which
could include more furniture, paintings, photos etc as they
plan to stay for at least a year or longer and make the property
as home-like as possible.
Therefore a tip for property owners would be not to furnish
the property with too much furniture or alternatively to have
some storage space or room to store the unwanted furniture,
decoration etc (no matter how nice or how expensive it may
be) should the tenant require some additional space for their
personal belongings – which have been known to include a
baby grand piano.
To secure a long term rental, a tenant would normally be
required to sign a Tenancy Agreement and pay a refundable
security deposit of two months rental amount and one month
rental upfront before commencing the rental. Certain Tenancy
Agreements have a 'break' clause and would require one-
three months notice prior to leaving the property before the
contracted period is completed. Some Tenancy Agreements
have no 'break' clause and, should the tenant be unable
to complete the contracted period, the security deposit is
forfeited.

The monthly rental fee usually excludes utilities like electricity,
water, telephone and maid services; in some instances
wifi and cable TV is also excluded. What is usually included
in the monthly rental is the common area fee (security
services, garbage removal) should the property be in a gated
community and also pool cleaning and gardening. However
the property owner and the tenant can negotiate any other
services to be included or excluded.
The new international school term for the academic year 2014-
2015 in Phuket begins in August 2014, with some schools
starting the new school term earlier or later that month. Prior
to the month of August there is usually a higher demand for
long term rental properties as parents who have decided to
school their children for the academic year in Phuket will be
looking for a suitable property to settle down in.
Rental properties closest to the school or within a 10-15 km
radius are usually the fastest to be snapped up. A popular
area is the BangTao/Laguna area, where there is a good local
expatriate community as well as restaurants, bakeries, shops,
banks, beach clubs etc all within easy driving distances.

by a new generation network of Phuket-based designers and

What were you doing / where were you living & working before? I'm a native Phuketian and studied for an architecture
degree in Bangkok, where I worked for three years before returning
to Phuket.
What’s special / diff erent about The Attitude Club? What are its unique points? We're developing a distinct permaculture property
niche in Phuket.
The Attitude Club team is fortunate to have among the dedicated
team members some of the best architects and designers in the
country. As locals with a global outlook, we all share a passion for
unique, bespoke designs.

And what do you like least…? Anything repetitive that does not

What do you see as your biggest successes to date? I believe
we've enhanced and put a fresh perspective on Phuket's property
and hospitality market with some unique concepts, especially our
most recent additions – Foto Hotel in Kata and Saturday's condo
development in Saiyuan, near Nai Harn beach.
To what extent did the global fi nancial mess aff ect your business? It did impact us at fi rst, but we've weathered the storm
well by continuously evaluating and adapting to market demands.
Is The Attitude Club involved in any CSR (Corporate Social Responsibility) programmes? As Phuketians, our hearts are with
the local community so we're involved CSR projects on the island
that bring together local experts and businesses in conservation
eff orts, as well as helping to preserve Phuket's unique culture.
We run a Phuket Old Town Sketch Walk and we participate in the
annual Vegetarian Festival. We also invite other businesses to join us
on regular beach clean-ups.
Please give us an overview of your typical day ‘at work’. I try
to keep a balance between hard work and taking time to relax
and refl ect. Mornings are typically fast-paced and busy with lots
of meetings, phone calls, decision-making and tying up loose
ends. This gives me time in the afternoons to be more relaxed and
focused on nurturing ideas and letting inspiration fl ow.
How would you describe your leadership style? To motivate and
coach team members to bring out the best in them.
What's your over-riding ambition at this stage in your life? That
our success is also a long-term success with benefi ts for the local
community as a whole. The Attitude Club's legacy is a showcase of
local empowerment, a guardian of global standards with grass-
roots appeal and genuine long-term sustainability.

YanuiJust across Nai Harn Bay from Ao Sane,
between Nai Harn and Rawai beaches along
the coastal road, sits the tiny Ya Nui bay. Not
exactly a hidden spot, it can get crowded
through the sunny season with rows of rental
chairs full of sunbathers. Even on its busiest
days, however, the beach is a breathtaking
sight with its silken sands and dramatic
surrounding landscape including a rocky cape
jutting out from its centre and a lush green
hill topped by a wind turbine rising up steeply
from one end.
There’s one main restaurant at Ya Nui, which is
actually very good for a beach eatery (try the
chicken paeneng), and there’s a scattering of
vendors off ering drinks, snorkel equipment
and rental kayaks. When viewing Ya Nui from
the wind turbine lookout point, it looks as
perfect as a well-cut emerald gem.
As many visiting holidaymakers know, Phuket is an island blessed with
some big beaches. The kilometres-long stretches of tropical west-coast
beaches, including Patong, Kata, Karon and Kamala, are famous around
the world and their sands have been trodden by millions of bare feet.
Though few undiscovered places remain in Phuket, there are plenty of
smaller, more remote beaches off ering barefoot travellers some peaceful
and picturesque escapes. Here are some of our favourites.

Laemka BeachLess than one kilometre north of Rawai Beach, Laemka has
long been a popular haunt for locals looking for a scenic
picnic spot, but it’s often overlooked by tourists. Arriving to
Laemka’s main beach at the end of Soi Laemka Yai, there’s
a rather spooky sense of dereliction. On the beachfront
sits a restaurant long since shut down and there are some
empty, decaying bungalows up the hillside. The beach itself,
however, is a fi ne patch of sand with a few vendors selling
coconuts, drinks, snacks and renting out sun beds. A fi ne
family escape, the tiny bay is shallow and safe for swimming.
There are some annoyances here, namely boats motoring to
shore a bit too close to swimmers and uncollected trash in
places, but overall an afternoon spent at Laemka is sure to
soothe the senses.

Ao SaneAo Sane rates as the beach with the most bizarre access
point in Phuket. Getting here fi rst requires cutting through
the covered car park at the Phuket Yacht Club hotel in Nai
Harn, then taking a well-paved but very narrow lane for a
kilometre or so. With a scattering of broken coral, Ao Sane’s
sand is not quite as fi ne as nearby Nai Harn’s, but the scene
is quaint and tranquil and the snorkelling’s good around
the rocks just off shore. The beach itself is strewn with large
boulders, giving it a more rugged, wild appearance. Sun
beds are available for rent, while those wishing to linger a
while longer may dine at the Ao Sane restaurant, or even
rent a bungalow here or at Baan Krating resort a bit further
along, across a rickety bridge.

Ao YonAn ideal spot for early risers to catch the sunrise, found on
Cape Panwa on Phuket’s east coast. Like most of the east
coast, Ao Yon retains a distinctly local feel and only a small
fraction of Phuket’s millions of tourists will ever come here
or know about it. Due to the pearl farm activities in the
bay, the water is not always so clear, but at high tide it’s
possible to take a refreshing dip in the sea. Our favourite
Ao Yon dining spot is the Secret Cove, where parents can
enjoy a relaxed lunch and drinks while the kids frolic safely
in the shallow, protected bay. Families could also walk down
the beach and stop by Topper Sail to arrange a Hobie cat
dinghy lesson, a fantastic way to introduce the young ones
to the sport of sailing.
Hua BeachHua Beach, some two kilometres up the "Millionaires’ Mile" in
Kamala, might well have been the last truly secret beach on
Phuket. But since a small handmade sign was posted at its
entrance, the secret’s out. The 300-metre lane leading to the
beach takes you through a lush landscape with thick trees
arching over the road, ending at a small car park area next to a
basic restaurant. Tall casuarina and palm trees line the beach,
reaching out over Hua’s golden sand.
Next to the restaurant is a concrete foundation that looks like it’s
been long abandoned to the jungle – someone’s dream tropical
villa that didn’t quite come to fruition perhaps. Aside from
the restaurant, some bundles of fi shing nets and a few plastic
dinghy boats scattered about, there’s nothing here but sand and
sea. If you time it right you might have this beach all to yourself,
aside from the resident kittens racing across the sand.

Go surfingThe good news for surf lovers is that surfing in Phuket is great; the waves at most beaches are predictable and fun to ride during this southwest monsoon season, so even if you're beginner you can find plenty of great beaches like Kalim, Kata, Karon, Patong and Nai Harn to hone your skills. These beaches have become popular surfing destinations and now offer surf shops and tuition centres for all skill levels. enjoy bird-watching in phuket
Phuket offers many birdwatching opportunities. The terrain includes mangrove forests, marshland and secondary and old-growth jungle. The best time of the year to visit Phuket for bird-watching is from about the middle of October through April. At this time, many species of migratory birds will be present.
Over two hundred species have been seen on Phuket. Full day and overnight tours offer the birder a variety of habitats in which to see exotic birds. Apart from Phuket, you can also add a day of birding in Phang Nga Province or Khao Sok National Park. Thale Noi and Krabi are also destinations. Tours are educational, easy and fun.

Try muay Thai (Thai boxing)Saphan Hin Stadium in Phuket City stages regular demonstrations by well-trained martial arts experts and there are plenty of schools on the island offering training in Muay Thai. If you prefer a quiet gym, then Rawai Muay Thai Camp or Tiger Muay Thai & Mixed Martial Arts on Chaofa West Road in the south of the island might be suitable for you. If you plan to watch a Muai Thai fight for real, you should visit the boxing stadium located in Bangla Road, Patong. Bouts are held every Friday evening from about 8pm.

Check out Karon ViewpointSometimes referred to as the 'Three Bay Viewpoint', it's located between Nai Harn and Kata Noi Beaches.
This is a tastefully developed facility with a Thai-style sala, which offers superb views on several levels. From here Kata Noi, Kata and Karon beaches can be seen and out to sea is Koh Poo (Island). Without doubt one of the island's best views!
how to get there: Karon Viewpoint is located along the road between Kata and Nai Harn Beach, just five kilometres from Kata Beach.
horse ridingIf you are here with your family, horse riding is a relaxing and romantic way for you all to explore Phuket's natural scenery. In contrast, a brisk canter along the beach is most invigorating.
There are two clubs on the island:
Phuket International Horse Club, easily spotted at the entrance to Laguna Resort, is open seven days a week from 8am until 6pm.
Phuket Riding Club is located in the southern part of the island on the road to Rawai Beach, and offers riding tuition for all levels of ability including children. The Club is open daily from 7am until 6.30pm.

Visit phuket Thai hua museumThe oldest Chinese school in Phuket, Thai Hua School was built in 1911 and has now become the Thai Hua Museum, serving as a community and exhibition centre for Baba arts and culture.
The museum is a two-storey building with the upper level balconied internally to look down on the ground floor. Many of the exhibits and artifacts relate to the art and culture of China. Some of the old schoolrooms still remain as they were in the past, with old school desks and photographs of former students.
The Phuket Thai Hua Museum is on Krabi road. It’s open on Tuesday through Friday from 1 to 8pm and Saturday and Sunday from 9am to 8pm. Entrance is free. It's certainly worth a visit.

The recent experience of a 73-year-old Canadian on holiday in Phuket, enjoying a tour boat trip to Phi Phi, is yet another example of the inability of some tour boats to meet minimum standards expected elsewhere in the world. Sheer luck saved this man's life and, as the list of incidents grows every month, it’s time to recognise that many vessel owners and operators cannot be relied upon to protect their passengers and crew on their own. A system of inspections, that establishes an enduring national policy of regulation and standards that regulate in the interest of marine safety afloat, is needed.
In fact, in most countries, it's only due to a robust marine safety regulatory system of vessel standards, crew training and certification and compliance inspections that countless passengers are able to ply waterways safely, assured that every reasonable measure has been taken to safeguard the most precious cargo: their lives.
Duncan Stewart, Safer Phuket founder states, “In Phuket, tour boat safety currently falls within the realms of a number of government bodies, and Safer Phuket has been told by these organisations themselves that they operate without cohesion and communication – like five fingers without the hand joining them.”
But the situation can change and not all tour boat operators are the same, which is why Safer Phuket is currently working with a number of leading tour boat companies and hotels, with the aim that the tour boat companies will agree and establish a new international standard Code of Practice for tour boat operators. The participating hotels will use only these participating and certified tour boat companies, safe in the knowledge that their guests are in the safest possible place to enjoy our wonderful islands.

One reason why Safer Phuket believes that this will drive change lies in the views of the insurance industry, with guests who choose non-certified tour operators not being covered by insurance. In Mike Reynolds' case, the potentially crippling financial costs of the incident were covered by insurance, but in future this may not be the case if visitors use unregulated and uncertified operators.
