Panama probe: JIT finds disparities in Sharif family income

ISLAMABAD, July 10:

A joint investigation teamthat probed the Panamagategraft case against PakistanPrime Minister Nawaz Sharifand his family has found "glar-ing disparities" between theirknown sources of income andtheir actual wealth in its finalreport submitted to the SupremeCourt today, a media report said.

The JIT that investigated theSharif family's business deal-ings has recommended that theNational Accountability Bureauopen a reference against Sharifand his family after the probepanel found "glaring disparities"between their known sources ofincome and their actual wealth,the Dawn reported.

The JIT report suggests thata reference should be filedagainst Prime Minister Sharifand his sons Hassan Nawaz andHussain Nawaz, as well asdaughter Maryam Nawaz, underSection 9 of the NationalAccountability Bureau (NAB)ordinance 1999, the daily said.

The JIT has found that theassets of all four respondentshave been found to be more thanthe sources of their income inthe probe completed today.

"Significant gap/disparityamongst the known anddeclared sources of income andthe wealth accumulated by theRespondent No. 1, 6, 7 and 8have been observed," the JITobserved in its concludingremarks.

The report said the financialstructure and health of compa-nies in Pakistan having linkageto Sharif family also do no sub-stantiate their wealth.

JIT chief Wajid Zia present-ed the report along with evi-dence to a three-member specialbench of the Supreme Courtcomprising Justice Ejaz Afzal,Justice Azmat Saeed and JusticeIjazul Ahsan.

The six-member JointInvestigation Team (JIT) wasset up in May by the SupremeCourt with the mandate to probethe Sharif family for allegedlyfailing to provide the trail ofmoney used to buy properties inLondon in 1990s.

The JIT has also probed sev-eral serving and former officialsin connection with the case.

The six-member JIT includ-ed Federal InvestigationAgency's (FIA) AdditionalDirector General Wajid Zia,Military Intelligence's BrigKamran Khurshid, NationalAccountability Bureau's (NAB)Director Irfan Naeem Mangi,State Bank of Pakistan's AmerAziz, Securities and ExchangeCommission of Pakistan's(SECP) Executive DirectorBilal Rasool and Inter- ServicesIntelligence's Brig MuhammadNauman Saeed.

Last year, the PanamaPapers revealed that three ofPrime Minister Sharif's childrenowned offshore companies andassets not shown on his family'swealth statement. The assets inquestion include four expensiveflats in Park Lane, London.

The top court took up thecase in October last year onpetitions filed by PakistanTehreek-e-Insaf, Awami MuslimLeague and Jamaat-e-Islami andreserved the verdict in Februaryafter conducting hearings on adaily basis. (PTI)

SC allows counselling,admissions to IITs

NEW DELHI, July 10:

The Supreme Court todayallowed the counselling andadmission into Indian Institutesof Technology (IITs) across thecountry on the basis of theresults of the IIT-JEE (Advance)2017 results by vacating its stayon it.

The apex court bench head-ed by Justice Dipak Misravacated its stay ordered lastFriday, but asked the high courtsnot to interfere in the petitionsregarding counselling andadmission to the IITs to avoidany confusion.

Counselling is a process inwhich a candidate, who clearsthe entrance examination,chooses the best college andstream according to his or herchoice based on their rank.

The bench, also comprisingJustices A M Khanwilkar and MM Shantanagoudar, asked theIITs to give an undertaking thatsuch mistakes will not recur andmake sure that no situation inwhich bonus marks have to beawarded arose in future.

Attorney General K KVenugopal, representing theIITs, said such a situation willnot arise in future.

The bench said the 2005judgement in Guru NanakUniversity case will not apply inthe present matter as there werea huge number of studentsinvolved and there was a systemof negative marking in theexam.

The apex court also noted thatan experts' body of IITs had mettwice to decide that bonus marksshould be awarded across theboard for the wrong questions.

The Supreme Court had onJuly 7 restrained the IITs fromconducting further counsellingand admissions saying the courtwill go by its earlier judgement

of 2005 and bonus marks cannotbe given to those who have notattempted the wrong questions.

The AG had, however,pointed out that there was nega-tive marking for every unsuc-cessful question and there maybe some students who had optednot to answer "the said vaguequestions fearing negativemarking".

Therefore, across the boardbonus marks were given to thecandidates, Venugopal had toldthe court, adding that otherwisethe IITs would have to strikedown the marks.

The AG had also said that itwas difficult to re-evaluate theanswersheets of over two lakhstudents who took the examina-tion and awarding of bonusmarks across board was themost practical solution.

The apex court had on June30 issued notice to the Ministryof Human ResourceDevelopment on a plea seekingquashing of the IIT-JEE 2017rank list.

The petition, filed by an IITaspirant Aishwarya Agarwal,had sought the court's directionto declare that the action ofawarding bonus marks to candi-dates who had appeared in theJEE (Advanced)- 2017 exami-nation was wrong and violatedher right, as well as that of otherstudents.

Since then several other stu-dents had approached the apexcourt seeking quashing of ranklist.

Several IIT aspirants in theirpleas had sought a direction forpreparation of the all-India ranklist after rectifying the scores ofJEE (Advanced) and also awardmarks for the incorrect ques-tions to the candidates who hadattempted the right answers.(PTI)Gifts worth up to Rs 50,000 by

employer exempt under GST: GovtNEW DELHI, July 10:

The Government today clarified that gifts worth up to Rs50,000 by an employer to its employees as also free membershipof clubs, health and fitness centres will not attract the Goods andServices Tax (GST).

Also, the services by an employee to the employer in the courseof or in relation to his employment is outside the scope of the newindirect tax regime, it said.

Any club, health and fitness centre membership provided by anemployer to its all employees free of charge will not be subject to the GST.

The same would hold true for free housing as part of cost-to-company (C2C) package.

Commenting on reports of gifts and perquisites supplied bycompanies to their employees being taxed under GST, the financeministry in a statement said gifts up to a value of Rs 50,000 in ayear by an employer to his employee are outside the ambit of GST.

"However, gifts of value more than Rs 50,000 made withoutconsideration are subject to the GST, when made in the course orfurtherance of business," the statement said.

While the GST law does not define gifts, the ministry said fortax purposes gift is something that is made without consideration,is voluntary in nature and is made occasionally.(PTI)
