import in the US was in 1984, mostly from Chile and Bolivia. In 1994 Peru opened their doors. In 1998 the import has been closed. Today there are over 100,000 alpacas in the USA. Alpacas are DNA tested for registration to maintain the bloodlines and value. Alpacas are a Camelid, which means Llamas and Camels are their cousins. They are about 1/3 the size of a Llama. They produce one of the most luxurious and strongest fi bers in the world. Alpaca fl eece has a cashmere-like feel and is 5 to 7 times warmer than wool. The prime blanket is virtually free of guard hair. They do not have any oil or lanolin, which makes alpaca garments wonderful to wear next to your skin, especially for those who have allergies
or cannot wear wool. They are the only fi ber bearing animal that comes in 22 different colors and variations.Alpacas have been domesticated for 5,000 to 6,000 years. They have a pallet with a few bottom teeth and padded feet with two toenails. Biting and butting are not issues. They are very gentle creatures with wonderful dispositions. This is a key issue for the American Farm Bureau
Federation (AFBF), as well as Minnesota Farm Bureau and their sister organizations throughout the United States. I join them in strongly opposing this intrusion upon private property
rights, as well as the expanded jurisdiction of the federal government on intrastate waters.
The Clean Water Act (CWA), enacted in 1972, limits federal jurisdiction to “navigable” waters of the United States. The U.S. Supreme Court, in 2001 and 2007, reaffirmed those limits. The Environmental Protection Agency (EPA), through regulations, guidance and other means, is seeking to expand its authority beyond the limits approved by Congress.
Over the past two decades Supreme Court decisions have reaffirmed that “navigable waters” under the CWA does not extend to all waters. The EPA continues to assert that the proposed rule would “clarify confusion” following decisions in the U.S. Supreme Court cases. Instead of clarifying confusion, the rule has the potential to create more confusion for farmers and call into question whether a farmer will need a permit in order to farm.
There are two primary reasons why legislative action has been stymied. First, leaders from both parties continue to strongly support the structure and goals of the CWA and do not want to see EPA intrude on traditional state prerogatives relating to land use planning and economic growth. Second, the legislation aggressively pushed by environmental groups would allow the EPA to use the CWA to regulate activities on dry land – and even when those
activities are not connected to interstate commerce.The EPA proposal would grant itself effective regulatory
control over virtually all waters, assuming a breadth of authority Congress has not authorized. Such a shift in policy would mean the EPA could regulate any waters found within a state, no matter how small or seemingly unconnected that water might be to a federal interest.
This is yet another example of the federal government becoming overly intrusive and of the executive branch circumventing Congress in order to advance a regulatory agenda that an agency cannot achieve via the legislative process. Congress should not permit the EPA to expand its authority beyond the limits approved by Congress.
I simply do not agree with giving the EPA, or any other Agency, the authority to regulate any or all waters found within a state. It is even more egregious when those waters are unconnected to the federal interest or interstate commerce.
Congress must exercise the fundamental role of oversight of the executive branch, including authorization, appropriations, investigative and legislative hearings by standing committees and reviews and studies by the Congressional Research Service (CRS).
Congressional oversight is an integral part of the American system of checks and balances and the “waters of the United States” proposal is just the type of overzealous regulation that should be reigned in by Congress.

creates confusion and is bad for agriculture. I joined my colleagues in a bipartisan letter asking EPA to withdraw the WOTUS rule and have also co-sponsored legislation (H.R. 5078 and H.R. 5071) that would require the EPA to pull the WOTUS rule.
Minnesota’s farmers don’t need Washington bureaucrats telling them how to farm. In Minnesota, we have worked closely with USDA’s Natural Resources Conservation Service (NRCS) to increase voluntary conservation efforts. If this rule advances, the NRCS could become the de facto enforcement agency for the EPA and Army Corps of Engineers, effectively ending the positive relationship between farmers and NRCS.
We need to work together to address these issues. I’ve worked with colleagues on both sides of the aisle to ensure that our farmers won’t be regulated out of business. The 2014 Farm Bill is an example of what can be done when we work together, and I will continue to push forward to reduce red tape, eliminate uncertainty and improve conservation outcomes.

As I travel across Minnesota’s 7thCongressional District, from the northern stretches to the southern
farms, I keep hearing the same thing from the people I talk to: folks are increasingly worried about how government overreach is affecting their daily lives and the way they do business. Federal agencies, like the Environmental Protection Agency (EPA), are enacting sweeping regulations and delaying vital infrastructure projects, often with insufficient explanation or justification. The negative impact government overreach has on Minnesota’s farmers and families is clear to anyone who has traveled the region as I have. People are facing increased uncertainty, are anxious about higher costs, and have less trust that their government represents and respects their interests.
Nothing exemplifies the problem with the EPA’s overreach as the agency’s recent attempt to redefine waters of the U.S. under the Clean Water Act. When Congress passed the Act decades ago, it was clear as to what bodies of water would fall under the EPA’s jurisdiction, but recent Court cases have spurred the agency to try and expand the definition, bringing a whole host of new bodies of water under federal regulation. This expansion would place everything from small ponds to ditches in a farmer’s field under EPA rules, through the agency’s own mandate, not through Congressional action. In fact, Congress recently considered a similar proposal, but decided it wasn’t the right policy for the country.
The role of Congress should be twofold: first, to conduct rigorous oversight of federal agencies that overstep their legal bounds, and second, to pass laws that define the responsibilities for those agencies. Congress, not unelected, unaccountable bureaucrats, should be deciding the laws of the land. The EPA should ditch the proposed rule, and Congress should act to rein in agencies with a pattern of out-of-control regulations.

The Constitution sets out a clear set ofresponsibilities for each branch of government, and for over 200 years the legislative branch has
passed laws that the executive branch is supposed to enforce. But all too often recently, we’ve seen examples where executive branch agencies like the EPA or the IRS have overstepped and over-regulated.
Our part of Minnesota has seen some of the damaging consequences of these sorts of regulations, and proposed rules like the “waters of the US” rule could have even
bigger impacts on our farming families. When you have unelected bureaucrats in federal agencies passing “rules” that have real costs for farmers, workers, and Minnesotans, something’s not working. Congress should be working to scale back the power of these federal agencies and bring back balance to our political system.
