Prez signs ordinance to amend EPANEW DELHI, Jan 8:
An ordinance to amend the47-year-old Enemy Property Act(EPA) has been approved byPresident Pranab Mukherjee toallow custodians to continue tohold sway over such properties.
The ordinance amends theprovisions of the Act declaringthat all "enemy property" vestedin the 'custodian' would contin-ue to vest in the custodian irre-spective of the death or extinc-tion of the enemy.
The custodian of enemyproperty in the country is anIndian Government departmentthat is empowered to appropri-ate property in India owned byPakistani nationals.
After the Indo-Pakistani Warof 1965, the Enemy PropertyAct was promulgated in 1968.
The Enemy Property
(Amendment and Validation)Ordinance, 2016, which amendsEnemy Property Act,1968 andthe Public Premises (Eviction ofUnauthorised Occupants) Act,1971, has been promulgated bythe President yesterday, officialsources said today.
The Narendra ModiGovernment, following the foot-steps of the previous UPAGovernment, has been keen toamend the Enemy Property Act.
A new section has beeninserted in the ordinance to saythat "the Custodian, may, aftermaking such inquiry as he deemsnecessary, by order, declare thatthe property of the enemy or theenemy subject or the enemy firmdescribed in the order, vests inhim under this Act and issue acertificate to this effect and suchcertificate shall be the evidenceof the facts stated therein".
While the UPA governmenthad promulgated the EnemyProperty (Amendment andValidation) Ordinance, the Billintroduced in Parliament couldnot be passed due to variousissues, including differenceswithin the government itself.
Since assuming charge inMay 2014, the NDA govern-ment has taken the ordinanceroute at least a dozen times, withthe first nine ordinances beingpromulgated in the first eightmonths of the government.(PTI)
