REGULAR MEETING - TUESDAY, FEBRUARY 26, 2019
The Board of County Commissioners of Medina County, Ohio, met in regular session on this date with the following members present:
Colleen M. Swedyk William F. Hutson Patricia G. Geissman
Mrs. Swedyk offered the following resolution and moved the adoption of same, which was duly seconded by Mr. Hutson.
RESOLUTION NO. 19-0139
ACCEPTING AND AWARDING THE 2019 MEDINA COUNTY EQUIPMENT AND LABOR BID FOR THE MEDINA COUNTY HIGHWAY DEPARTMENT
WHEREAS, bids for the 2019 Medina County Equipment and Labor bid for the Medina County Highway Department were received and publicly read in the office of the Medina County Highway Facility on Tuesday, February 19, 2019, at 1:30 p.m., Ohio time, and referred to the Medina County Engineer for review; and
WHEREAS, the Board of County Commissioners of Medina County, Ohio accepts the bids for prices for the 2019 Medina County Equipment and Labor Bid for the Medina County Highway Department; and
WHEREAS, the County Engineer has recommended the contract for the 2019 Medina County Equipment and Labor Bid be awarded to multiple bidders for the purposes of equipment availability and location as stipulated in the bid documents; and
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Medina County, Ohio, that the bids for the 2019 Medina County Equipment and Labor Bid are hereby accepted and a contract shall be awarded to Albrecht Trucking, 6809 Spencer Lake Road, Medina, Ohio 44256, and Treemasters Tree Service Inc., 6440 Lafayette Road, Medina, Ohio 44256, for the equipment and labor prices as listed in Exhibit A attached hereto.

RESOLUTION NO. 19-0140
APPROVING CHANGE ORDER #1 TO THE CONTRACT FOR MED-CR97-0.16, THE RESURFACING OF GREENWICH ROAD (CR-97)
FROM HARRIS ROAD TO SR-3, BETWEEN MELWAY PAVING AND THE MEDINA COUNTY BOARD OF COMMISSIONERS
WHEREAS, the Medina County Commissioners and Melway Paving entered into the MED-CR97-0.16 contract on April 20, 2018 in Medina County, Ohio, in the amount of $2,077,515.33; and
WHEREAS, the contract work has been intermittently completed and the Medina County Engineer has prepared and attached hereto Change Order #1 for the contract; and
WHEREAS, Melway Paving has accepted Change Order #1 as evidenced by their signature thereon; and
WHEREAS, the Change Order does not increase the original contract amount by more than the ten percent (10%) allowed by law.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Medina County, Ohio, that Change Order #1 to the MED-CR97-0.16 contract between Melway Paving and the Medina County Board of County Commissioners is hereby approved.

AUTHORIZING THE MEDINA COUNTY ENGINEER TO ADVERTISE FOR BIDS FOR ODOT ITEM 422 SINGLE CHIP & SEAL OF VARIOUS COUNTY ROADS IN MEDINA COUNTY, OHIO
WHEREAS, the Medina County Engineer has prepared and filed copies of the surveys, plans, profiles, cross-sections, estimates of costs and specifications for chip sealing of various roads in Medina County, Ohio; and
WHEREAS, the presentation of the County Engineer on this date clearly indicates need for chip sealing of various Medina County roads; and
WHEREAS, Section 5555.43 of the Ohio Revised Code authorizes the Board of County Commissioners by unanimous vote to order that all costs of such a construction project be paid out of any tax levies for road purposes on the grand duplicate of the County, or out of any road improvement funds available therefor; and
WHEREAS, the estimated cost of chip sealing of various Medina County roads will be in excess of Fifty Thousand Dollars ($50,000.00); and
WHEREAS, the Board of County Commissioners has deemed it to be in the best interest of the people of Medina County to provide such work.
WHEREAS, the Board of Commissioners of Medina County, Ohio, that the Medina County Engineer be, and is hereby authorized to advertise for bids for chip sealing of various Medina County roads.

WHEREAS, the Board of County Commissioners of Medina County, Ohio, has deemed it to be in the best interest of the people of Medina County to enter into contract(s) to purchase such material.

OF VARIOUS COUNTY ROADS IN MEDINA COUNTY, OHIO
WHEREAS, the Medina County Engineer has prepared and filed copies of the surveys, plans, profiles, cross-sections, estimates of costs and specifications for chip sealing of various roads in Medina County, Ohio; and
WHEREAS, the presentation of the County Engineer on this date clearly indicates need for MC-3000 chip sealing of various Medina County roads; and
WHEREAS, Section 5555.43 of the Ohio Revised Code authorizes the Board of County Commissioners by unanimous vote to order that all costs of such a construction project be paid out of any tax levies for road purposes on the grand duplicate of the County, or out of any road improvement funds available therefor; and
WHEREAS, the estimated cost of MC-3000 chip sealing of various Medina County roads will be in excess of Fifty Thousand Dollars ($50,000.00); and
WHEREAS, the Board of County Commissioners has deemed it to be in the best interest of the people of Medina County to provide such work.
WHEREAS, the Board of Commissioners of Medina County, Ohio, that the Medina County Engineer be, and is hereby authorized to advertise for bids for MC-3000 chip sealing of various Medina County roads.

WHEREAS, Tree removal will be conducted approximately 100 feet west of Wilhite Drive (T.H. 432) and approximately 500 feet east of Wilhite Drive (T.H. 432); and
WHEREAS, Treemasters Tree Service will perform the tree removal under the direction of the Medina County Engineer; and

WHEREAS, the Board of County Commissioners of Medina County requested qualifications and proposals from consultants to assist the County in preparing the application and administering the CHIP grant if awarded to the County, and
WHEREAS, Ohio Regional Development Corporation submitted a proposal to provide professional services required for the preparation of the grant application and administration of the grant for Medina County, and
WHEREAS, the proposal submitted by Ohio Regional Development Corporation meets all the requirements as outlined in the request for proposal and is considered the lowest and best bid.

RESOLUTION NO. 19-0154
APPROVAL OF INDIGENT DEFENSE SERVICE AGREEMENTS WITH THE CITIES AND VILLAGES OF MEDINA COUNTY
WHEREAS, Ohio Revised Code Section 120.14 and 120.16 authorize a County Public Defender Commission and Board of County Commissioners to enter into agreements with municipal corporations to allow for the provision of legal representation to indigent persons charged with violations of municipal ordinances for which the penalty or adjudication includes potential loss of liberty, and
WHEREAS, the Ohio Public Defender Commission has advised the Medina County Public Defender Office that agreements with Medina County municipal corporations are required to be executed for the aforementioned purpose in order to continue the State reimbursement of cost process, and
WHEREAS, the Medina County Public Defender Office has prepared agreements for indigent defense services in the County’s two municipal courts and has forwarded the same to the various municipal corporations for review and approval, and
WHEREAS, the various cities and villages within Medina County have now executed indigent defense service agreements for the period January 1, 2019, through December 31, 2019, and
WHEREAS, the Ohio Public Defender Commission has asked that the County Public Defender Commission and the Board of County Commissioners approve and execute these revised agreements.
NOW, THEREFORE, BE IT RESOLVED by this Board of County Commissioners that the agreements with the cities and villages within Medina County for the provision of indigent defense services be hereby approved.

AUTHORIZING A REQUEST FOR QUALIFICATIONS PROCESS FOR ARCHITECTURAL DESIGN AND ENGINEERING SERVICES FOR THE
PROPOSED MEDINA COURTHOUSE PROJECT
WHEREAS, the Medina County Board of Commissioners has previously authorized various studies to estimate space required to accommodate the Medina courts and departments which are to be housed within the Courthouse, and the estimated costs of renovating and expanding the Courthouse vs. construction of a new courthouse on the existing site; and
WHEREAS, in order to further the Board’s efforts to find a reasonable solution in meeting the current and future space needs of courthouse officials and departments, the Board finds it necessary and appropriate to procure the services of architectural design and engineering professionals to facilitate the expansion and renovation of the County’s Courthouse Complex, and
WHEREAS, it is estimated that the cost of these services will exceed fifty thousand dollars and, as such, procurement rules specified in Ohio Revised Code Sections 153.65 through 153.71 shall apply to the process.
NOW, THEREFORE, BE IT RESOLVED by this Board of County Commissioners hereby authorizes the Medina County Administrator to publicly announce the availability of a contract and request qualifications from architects and design professionals for professional design services to facilitate the expansion and renovation of the County’s Courthouse Complex, substantially in accordance with the form of announcement attached hereto, by posting said public announcement on the Medina County website from today through March 15, 2019, the due date for submission of statements of qualifications.

WHEREAS, the Sanitary Engineering Department, having reviewed the bids, recommended to this Board that the bid be awarded to L&T Painting as the lowest and best bid.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Medina County, Ohio that:
Section 1. The bid submitted by L & T Painting, Shelby Township, Michigan is hereby determined to be the lowest and best bid and is hereby awarded to L & T Painting, Shelby Township, Michigan in the amount of $327,950.00.
Section 2. The Medina County Sanitary Engineer is hereby authorized to execute an agreement on behalf of the Medina County Commissioners with L&T Painting in a form approved by the Medina County Prosecutor’s Office.

RESOLUTION NO. 19-0157
AUTHORIZING THE SANITARY ENGINEERING DEPARTMENT TO LEASE TO OWN A 2019 SEWER COMBINATION TRUCK MODEL SD114
WHEREAS, the Medina County Sanitary Engineering Department has determined the need for a new sewer combination truck to be utilized by their Line Maintenance Division; and
WHEREAS, the Sanitary Engineer has received a quote from Best Equipment, Inc., North Royalton, Ohio for said combination truck, Model SD114, attached hereto as Exhibit AA@; and
WHEREAS, Pursuant to the State of Ohio Department of Administrative Services State Term Schedule Number 800524, the cost of the sewer combination truck is $404,742.93 with financing due over five (5) years with the first payment of $88,320.01 due in FY 2020 then four (4) payments due over the next four (4) years of $88,320.01 each, attached hereto as Exhibit AB@, and
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Medina County, Ohio, under the authority of Section 307.41 of the Ohio Revised Code, the Sanitary Engineer is hereby authorized to lease to own one (1) sewer combination truck, Model SD114.

APPOINTING A MEMBER TO THE MEDINA COUNTY LAW LIBRARY RESOURCES BOARD
WHEREAS, it has come to the attention of the Board of County Commissioners that there is a vacancy on the Medina County Law Library Resources Board due to the terms expiring for Bruce Hall on December 31, 2018, and
WHEREAS, Rebecca Clark has expressed interest in serving on said board and she has the support of the Law Librarian, Law Library Resources Board, and the Medina County Commissioners.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Medina County, Ohio, that Rebecca Clark is hereby appointed as a member of the Medina County Law Library Resources Board with her term expiring on December 31, 2023.
