I. PURPOSE

ThepurposeofFranklinCountysocialmediasitesistopresentmattersofpublicinterestinthecountyforthebenefitofitsresidents, businessesandvisitors. Youarewelcometosubmityourquestions, commentsandconcernsbutpleasenotethatsocialmediaisamoderatedonlinediscussionsiteandnotapublicforum.

II. SCOPETotheextentpubliccommentsareenabledonaFranklinCountysocialmediasite, allmembersofthepublicwillbeallowedtocommentandpubliccommentsshallnotthereafterbeblocked, filtered, deleted, orotherwisecensored, exceptasprovidedbeloworallowedbylaw. AnycommentsontheCounty’ssocialmediasitesaretheopinionoftheposteronlyandthepresenceofsuchcommentsdoesnotimplythattheCountyendorsesoragreeswiththecomments.

SocialmediaisnotanofficialchannelforcontactingtheCountyofFranklinagencies, employeesandofficials. WhiletheCountymayattimesrespondtoinquiriesorcommentsonsocialmedia, staffingforthatpurposeisnot24/7. TheCountyencouragesuserstoutilizetheofficialcountywebsiteatwww.franklincountypa.govtolearnhowtoofficiallycontactgovernmentoffices.

Communicationspostedonthecounty’ssocialmediapageswillnotbeconstruedassatisfyingrequirementsforlegalnoticeorservice, shallnotbeconsideredofficialpubliccommentandshallnotbeconstruedasanofficialrequestforrecordspursuanttotheRight-to-Knowlaw.

FranklinCountymaypostlinkstootherorganizationsonitssocialmediapages. Alinkdoesnotconstituteanendorsementofcontent, viewpoint, policies, productsorservicesthatmayexistonthatsite. OnceauserclicksalinktoanotherwebsitenotmaintainedbytheCounty, theuserissubjecttothetermsandconditionsofthatwebsite.

ThefollowingformsofcontentshallnotbeallowedonanyFranklinCountysocialmediawebsite, profileorapplicationandarticleandcommentsassociatedtherein.

Profaneand/orvulgarlanguageorcontent; Contentthatpromotes, fostersorperpetuatesdiscriminationonthebasisofcreed, color, age, race, gender, religion, maritalstatus, orstatuswithregardtopublicassistance, nationalorigin, intellectualorphysicaldisabilityorsexualorientation; Sexualcontentorlinkstosexualcontent, includingaposterwithaprofilepicturecontainingnudityorsexuallyexplicitcontent;

Solicitationofcommerce; Solicitationfordonations. ThisshallnotapplytoanyofficialFranklinCountypostingprovidingthepublicwithinformationrelatedtofundraisers, activitiesandprojectsthataresupportedorsponsoredbytheCounty. Conductconstitutingorencouragingillegalactivity; Informationthatmaycompromisethesafety, securityorproceedingsofthepublic, publicsystemsoranycriminalorcivilinvestigations; Name-callingand/orpersonalattacks; Spam, suchasthesamecontentbeingpostedrepeatedly; Contentthatviolatesthelegalownershipinterestofaparty, trademarkorcopyrightlaws; orContentcontainingpersonallyprivateinformation, includingbutnotlimitedtoidentifiablemedicalinformation.

AnycontentremovedbasedupontheseguidelinesmustberetainedbytheCountyAdministrator, orhisorherdesignee, includingthetime, dateandidentityoftheposterwhenavailable, pursuanttoPennsylvaniastatelaw. UnlessotherwiseaddressedinaspecificsocialmediastandardsdocumentorCountyretentionschedules, theCountyAdministratororhisorherdesignee, shallpreserverecordsrequiredtobemaintainedforaperiodofnolessthanoneyearonaCountyserverinaformatthatpreservestheintegrityoftheoriginalrecordandiseasilyaccessible.

TheCountyreservestherighttorestrictorremoveanycontentthatisdeemedinviolationofthissocialmediapolicyoranyapplicablelaw.

FranklinCountyisprohibitedfrombanningorblockinganyuserorsubscribertoanyofficialFranklinCountysocialmediaaccountunlesstheirparticipationiscreatinganillegalorunmanageablesituation. Forexample, aposterwhorepeatedlypostssexualcontentorlinkstosexualcontentmaybeblockedifitbecomesimpossibletorepeatedlyandtimelydeletesuchunauthorizedcontent. Insuchcases, ablockmustbeapprovedbytheCountyAdministratororhisorherdesignee.

Comments, mediaorotherinformationpostedtoordisplayedontheCounty’ssocialmediasites, accounts, andcontentaresubjecttomonitoringandreviewatalltimes. Usersshouldhavenoexpectationtoprivacywithrespecttotheirpostings. Monitoringdoesnotoccurconstantlyduetostaffresources; therefore, FranklinCountyisnotliableforinappropriateoroffensivecommentsthatmaybeposted.

ThispolicyshallbeadministeredbytheCountyAdministrator.

a. TheBoardofCommissionersreservestherighttoterminate, amendoradjustthisprocessatanytimewithoutliabilitytoanypersonwhomaybeaffectedbysuchterminationoramendment. Undertheatwillstatus, noemployeeshallhaveanyvestedrighttothecontinuationofthispolicyortohavethesamecontinuedforanyreason.

b. Employeeswhosetermsandconditionsofemploymentarecoveredbyacollectivebargainingagreementwillbecoveredbysuchtermsandconditionsofthecontract. Thispolicyisnotintendedtosupersedeoroverrideanyprovisionsoftheircollectivebargainingagreement.

c. ThispolicyisnotintendedtosupersedeoroverrideanyprovisionsoftheCourtsasaresultofinherentandexclusiverightsandpowersofthejudiciaryaccordedtoitbyArticleVofthePennsylvaniaConstitutionandSection1620oftheCountyCode.
