FINANCIAL FOCUSBe Prepared for Return of Estate Tax

There’sneverreallyabadtimetodoestateplanning.Butinthemonthsahead,youmayhaveanextraincentivetolookatyourestateplans.Why?Becausechangesarecomingtoestatetaxlaws—soyou’llwanttobeready. Changeisnothingnewintheworldofestatetaxes,whichhavebeeninastateoffluxforyears.Asthelawnowstands,thereisnofederalestatetaxin2010.Then,in2011,theestatetaxisscheduledtoreturn,withanexemptionamountof$1millionandatoprateof55percent.Yet,thesefiguresarehighlylikelytochange;ultimately,wemayseeareturntowhatexistedin2009:a$3.5millionor$5millionexemptionandatoprateof45percent. Ofcourse,yoursusceptibilitytotheestatetaxwilldependonthesizeofyourestate.Butnomatterwhatyourlevelofassets,you’llwanttohaveyourestateplansinorder.Firstofall,youalmostcertainlyneedawill.You’llalsoneedtomakesureyou’venamedtheproperbeneficiariesinallyourlegaldocuments. Now,let’sreturntotheestatetaxissue.Specifically,howcanyouhelpreduceanypotentialestatetaxburdenyourheirsmayface?Herearesomeideastoconsider:

•TakeAdvantageofYourExemptionsYouandyourspouseeachreceiveanexemptionfromthefederalestatetax.Asmentionedabove,thisexemptioncouldbeanywherefrom$1millionto$5million,startingin2011.Tomaximizetheseexemptions,youmaywanttocreateacreditsheltertrust.Inanutshell,here’showitworks:Whenyoudie,youfundacreditsheltertrustwithassetsequalinvaluetoyouravailableexemption; ifyouhaveotherassets,youcan leave themtoyour spouse, freeofestatetaxes.Yoursurvivingspousecandrawincomefromthetrust’sassetswhileheorsheisalive.Uponhisorherdeath,thetrustdispersestheassetstoyourchildrenorotherbeneficiaries,takingadvantageofyouroriginalestatetaxexemption.Yourspouse’sestatewillalsodisperseassetstobeneficiaries,usinghisorherexemptiontoreduceoravoidestatetaxes.

•UseLifeInsuranceIfyouowneda$1milliondollarlifeinsurancepolicy,anditwassubjecttoanestatetaxrateof55percent,yourbeneficiarieswouldreceiveadeathbenefitofjust$450,000.Butifyouestablishedanirrevocablelifeinsurancetrust(ILIT)withanewinsurancepolicy,thetrustwouldownthepolicyanddistributetheproceedstothebeneficiariesyou’vechosen.ByusinganILIT,you’dkeepthelifeinsuranceoutofyourtaxableestate.

“Cardiovasculardiseaseistheleadingcauseofdeathinpatientswithdiabetes,anddiabetesistheleading cause of heart diseasein America,” said Dr. AlanGarber, professor of medicineinthesectionofendocrinologyatBCM.

To r educe th e r i s k o fcardiovascular disease, patientswith diabetes must maintainan exceptionally low level ofLDL cholesterol, the “bad”cholesterol, and a lower targetbloodpressure.
