BACKGROUND/DISCUSSIONThe Municipal Utility Board previously authorized the City Manager to execute a contract with Alan Plummer Associates(Plummer) to: evaluate the Water Purification Plant (WPP) treatment process; conduct a structural evaluation of the rawwater intake facility; prepare a Preliminary Design Report for future improvements including expansion of the WPPtreatment capacity; and prepare complete design plans for granular activated carbon (GAC) improvements. Plummer willpresent a summary of the Preliminary Design Report, GAC design elements, and an implementation schedule/phasing offuture improvements.

INVOCATION
Associate Pastor Lance Gerry of First Baptist Church Weatherford led the invocation. CALL TO ORDER & ANNOUNCEMENT OF A QUORUM
Mayor/Chair Paul Paschall called the meeting to order at 12:00 p.m. Present were: Mayor/Chair
Paul Paschall, Vice Chair Jeff Robinson, Heidi Wilder, Lindsey Hester, Ken Davis and Howard
McClurkin. City staff included: City Manager Sharon Hayes, Deputy City Manager James Hotopp,
Assistant City Manager/CFO Brad Burnett, City Attorney Ed Zellers and Assistant City Secretary

Service Awards

Mr. Steve Moffit of Schneider Engineering presented this update. Mr. Moffit stated that the City
of Weatherford has made wise decisions and is well-positioned for the future. He explained that
there is a tremendous increase in natural gas and renewable energy and a huge decrease in coal.
The retirement of a large number of coal plants is predicted in the foreseeable future. Increased
natural gas production has led to lower prices. Solar energy is projected to be a cost efficient non-
peak resource that will generate effectively. Mr. Moffit noted that electricity prices are expected
to fall slightly, then rebound, with dropping generation costs offset by rising transmission and
distribution costs. The ERCOT market will rely predominantly on natural gas. Twelve new gas
plants are expected to open between 2019 and 2022. Wind and solar capacity are calculated to
continue to increase. Mr. Moffit discussed the recent load and rolling blackouts. He explained that
Weatherford’s portfolio structure protects the City from peak price.

Consider approval of the minutes of the Municipal Utility Board Regular, Executive and
Work Sessions held July 25, 2019.
On the motion of Lindsey Hester, second by Heidi Wilder, the board voted unanimously to approve
the minutes as presented. Motion carried 6 - 0.

CONSENT AGENDA ITEMS
Consider and/or act upon award of Contract #512-16 for boardwalk materials and
installation to EzDock of Texas L.P. based on Cooperative Purchasing through BuyBoard.
Also to include 3% of the total project cost for bonding.
This item was removed from the Consent Agenda. Director of Parks, Recreation and Special
Events Shannon Goodman presented this item. Mr. Goodman stated that at the May meeting the
board presented questions regarding this project. One main concern at that time was public
safety/protection of the property due to location and low visibility. Mr. Goodman discussed the
following:
• 24-hour camera system to monitor remotely
• Motion-activated lighting
• Posting of park rules and ordinances so that the Police Department can enforce
• Adopt-a-Spot for Lake Weatherford Association
• Creation of Comprehensive Plan by Police Department to ensure quicker response time
Long-term maintenance cost for this recreational area will be added to the budget as part of the
ongoing current parks maintenance contract. Routine landscape maintenance cost will need to be
added to the budget. Mr. Goodman also discussed the cost savings of purchasing the equipment
all together as opposed to purchasing separately. Mr. Goodman stated the boardwalk is anticipated
to be completed next summer. The board will be making decisions in future meetings regarding
parking and other large contract items that are not included in this contract. The board will be
updated and involved in the ongoing process.
On the motion of Lindsey Hester, second by Ken Davis the board voted unanimously to approve
this item. Motion carried 6 – 0. Consider and/or act upon approval of Resolution R2019-21 amending the FY19 Adopted
Municipal Utility Budget
On the motion of Heidi Wilder, second by Ken Davis, the board voted unanimously to approve the
following item on the Consent Agenda. Motion carried 6 - 0.
• Approved Resolution R2019-21 amending the FY19 Adopted Municipal Utility Budget. REGULAR AGENDA ITEMS
Discuss and consider the appointment of a Municipal Utility Board member to the Risk
Management Committee.
After discussion the board appointed Lindsey Hester to the Risk Management Committee to
replace Paul Paschall. Discuss and consider award of Bid No. 2019-023 for the construction of the Wastewater
Rehabilitation 200 Block West Interstate 20 project.
Director of Water Utilities Rick Shaffer presented this item. Mr. Shaffer explained this project
includes replacing approximately 790 linear feet of existing 6-inch wastewater pipe and upsizing

the pipe to 12-inch and 8-inch diameter along and crossing Interstate 20 near the west 200 block.
This project will replace older wastewater lines that are currently undersized and inadequate to
convey the wastewater of future developments anticipated north of Interstate 20.
This project was designed by the City’s Engineering Division and was completed in July 2019. An
invitation to bidders for the construction of the project was advertised on July 27th and August 3rd
of 2019. The bids were opened publicly on August 20th with two bidders responding to the
invitation. The lowest, qualified, responsive bidder was Reytech Services, LLC with a total base
bid of $306,527.47, a total base bid plus added Alternate 1 of $330,019.25 and a total base bid plus
added Alternate 2 of $318,961.92. Reytech Services, LLC has completed several projects for the
City of Weatherford, and staff has found nothing to warrant the disqualification of their bid. The
construction is expected to be completed by January 2020.
On the motion of Heidi Wilder, second by Jeff Robinson, the board voted to approve this item.

Quarterly Electric Risk Management Report
Director of Electric Utilities Joe Farley presented this update. Mr. Farley stated that the August
natural gas price is $2.47 (NYMEX is $2.14), 50% of the City's natural gas is locked-in at $2.80
per MMBtu, the Rate Stabilization Fund has approximately $5.2 million and the current residential
rate is 9.25¢ per kWh with a $15 customer charge. Quarterly Project Status Update
Director of Electric Utilities Joe Farley and Director of Water/Wastewater and Engineering Rick
Shaffer presented this item. The Directors gave their quarterly update of past, present and ongoing
projects in their departments. This update was for informational purposes and no action was

Retail Rate Study
Chris Eckrut from NewGen Strategies and Solutions presented this item. Mr. Eckrut summarized
that the AMI data had been presented to the board at the June and July meetings. The utilities are
in excellent order and no changes are recommended to the utility rates. Presentation of FY20 Budget.
Finance Director Kyle Lester presented this item. Mr. Lester stated that the FY20 budget is fully
in line with where the City has been for the past several years. The City is in a very healthy financial
position. The board is welcome to contact staff should they have questions concerning the

FINANCIAL IMPACTThe chemical purchase will be funded with funds from the Department 404 operating budget. The total price per year willbe up to $139,914.00 depending on the actual amount of chemicals used.

Weatherford, Texas, and the expenses of conducting the affairs thereof for the fiscal year ending

SUBJECT: Weatherford Water Supply Reservoir Lake Lots - Rules and Regulations
BACKGROUND/DISCUSSIONThe Rules and Regulations for the Weatherford Water Supply Reservoir Lots (Lake Lots) governs the construction ofimprovements upon the City-owned lake lots such as houses, storage buildings and boat docks. The current Rules andRegulations, adopted in October 2010, also rely on the City of Weatherford's adopted Zoning Ordinances for certaindevelopment standards (see TITLE XII - ZONING ORDINANCE, CHAPTER 5 - DEVELOPMENT STANDARDS).House Bill 2439, passed by the Texas State Legislature and signed into law effective September 1, 2019, preemptsgovernmental entities from prohibiting or limiting the use of building materials if they are approved for use in a nationalmodel code published within the last three code cycles (such as the International Building Code). This bill does not prohibitprivate deed restrictions between property owners. As owner of the Weatherford Water Supply Reservoir Lots, the Citymay continue to enforce building material standards for construction on the Lake Lots.
In order to protect the value of the Lake Lots and of the existing homes built on the Lake Lots, City staff recommend thatthe building material standards continue to be enforced; and that the Rules and Regulations be amended and adopted toavoid any confusion with applicability of the Zoning Ordinance requirements. After consultation with the Director ofDevelopment and Neighborhood Services and the City Planner, the following changes are proposed (in summary): 1 . Specify building material requirements for structures constructed on Lake Lots 2. Update references to the Building Official 3. Update sizes of house numbering to be consistent with the adopted International Fire Code

WEATHERFORD WATER SUPPLY RESERVOIR Rules and Regulations Applicable to
Weatherford Water Supply Reservoir Lots (As amended and adopted October, 2010September 26, 2019)
THE FOLLOWING RULES AND REGULATIONS ARE INTENDED TO AND SHALL BE APPLICABLE TO ALL CITY OWNED WEATHERFORD WATER SUPPLY RESERVOIR LOTS AND ARE HEREBY AMENDED AND ADOPTED BY THE BOARD OF TRUSTEES OF THE WEATHERFORD MUNICIPAL UTILITY SYSTEM PURSUANT TO ITS AUTHORITY UNDER TITLE IX, CHAPTER 2, SECTION 9-2-22 OF TFIE CITY CODE OF WEATHERFORD.
A. General requirements and regulations
1. All structures situated upon a Reservoir Lot, regardless of their nature, shall be connected to the Weatherford Municipal Utility Systems (including water and wastewater services) if the structure contains any type of plumbing fixture. The Weatherford Municipal Utility System shall be the provider of electrical service for all Reservoir Lots.
2. Private water wells may be used only for landscape maintenance purposes on Reservoir Lots. The blending of well water and water from the municipal water supply for any purpose is prohibited.
3. The following requirements for lot identification shall apply to all Reservoir Lots:
a. Street side numbering. The licensee shall insure that the correct assigned street number for the lot is prominently displayed either on a structure or fence situated on the lot. The street numbering shall be of a minimum size of threefour inches (34") in height and shall be displayed so as to be readily legible from the street or public right of way at all times. In the event the structure or fence upon which the street number is to be displayed is more than twenty-five (25) feet from the street side lot line, the Planning and Development DepartmentBuilding Official shall determine and approve the size and location of the required street numbering.
b. Reservoir side numbering., The licensee shall insure that the correct assigned street number for the lot is prominently displayed to the reservoir either upon the main structure, an accessory or outbuilding, or upon a dock. The reservoir side street numbering shall be of a minimum size of threefour inches (34") and shall be displayed so as to be readily legible from the reservoir. In the event the structure, accessory or outbuilding, or dock upon which the street number is displayed to the reservoir side is more than twenty five (25) feet from the reservoir shoreline, the Planning and Development DepartmentBuilding Official shall determine and approve the size and location of the required reservoir side street numbering.

B. Standards for construction, alterations, improvements or additions upon Reservoir Lots
1. All construction, demolition, alterations, improvements or additions on Weatherford Water Supply Reservoir Lots ("Reservoir Lots") shall be by permit issued by the Planning and Development DepartmentBuilding Official of the City of Weatherford and shall be effected in compliance with all applicable codes, ordinances, rules and regulations for such construction. Construction, alterations, improvements or additions, for the purposes of this Section B, shall include, but not be limited to the following:
a. construction, alteration, remodeling or demolition of buildings including residential structures, accessory buildings and all types of outbuildings or appurtenances;
b. construction, alteration or repair of retaining walls and fences;
c. any type of clearing, grading or filling on a Reservoir Lot;
d. construction of permanent docks as provided by Section C below.
2. No permit shall be issued for construction, alteration, improvements or additions on a Reservoir Lot unless the holder of the Reservoir Lot License Agreement is in compliance with all applicable terms of the License Agreement on the date of the application for the permit.
3. All applications for permits for construction, alteration, improvements or additions upon a Reservoir Lot shall be accompanied by plans, in duplicate, drawn to scale, showing the actual dimensions, elevations and shape of the lot proposed to be built upon; the exact size and locations of buildings or structures existing on the Reservoir Lot, if any, and the location, elevations(s) and dimensions of the proposed structure, building or alteration. The application for permit may include such other information as may be lawfully required by the Planning and Development Department.Building Official. One copy of the plans shall be returned to the applicant by the Planning and Development DepartmentBuilding Official after being marked either as "approved" or "disapproved" by authorized City personnel.
4. Exterior construction materials used in the construction, alteration, improvement or addition to a Reservoir Lot residential structure or accessory structure greater than 200 square feet.
a. Exterior Construction Materials – Allowed construction materials include:
i. brick;
ii. natural or manufactured stone;
iii. structural clay tile;
iv. indented, hammered or split-face concrete masonry unit or combination of these materials that are laid up unit by unit and set in mortar and that are at least two (2) inches thick. ;
v. The following materials are also included are stucco, Exterior Insulated Finish Systems (E.I.F.S.), or similar exterior cladding; and
vi. concrete tilt wall, pour-in-place concrete wall and pre-cast wall that are at least two (2) inches thick and that are profiled, sculptured, fluted, exposed-aggregated or have

other non-smooth architectural concrete finish. However, exposed aggregate, smooth or untextured concrete finishes must be painted surfaces.
b. All Reservoir Lot residential structures or accessory structures greater than 200 square feet shall be of exterior construction having at least seventy-five percent (75%) of the total exterior walls above grade level and below the first floor plate line, excluding doors and windows, constructed of materials as listed in Section a. above.
c. Strict adherence to this requirement should not be such as to prevent architectural creativity for alterations or repairs. Alternative exterior materials that meet the intent of these rules and regulations may be approved by mutual consent of the Director of Water Utilities and Director of Development and Neighborhood Services.
d. Notwithstanding the above, chimneys and fireplaces on external wall surfaces shall be constructed of a minimum of one hundred percent (100%) masonry construction materials. This requirement shall not apply to chimneys for fireplaces that are not on or part of the external wall.
C. Dock Construction
1. Construction or alteration of permanent docks to service Reservoir Lots shall be by permit issued by the Planning and Development DepartmentBuilding Official for the City of Weatherford. All applications for permits for construction or alteration of a permanent dock shall be accompanied by site plans, in duplicate, to scale, showing the property lines, all buildings and structures on the property, and the locations of the existing and/or proposed dock. The Planning and Development DepartmentThe Building Official shall have authority to conduct an on-site inspection to verify any information provided in the site plan. The review and inspection of the Planning and Development DepartmentBuilding Official shall be limited to compliance with the terms and provisions of these Reservoir Lot regulations and shall not extend to or encompass inspection as to compliance with other engineering and/or construction standards for dock construction -compliance with those engineering and/or constructions standards shall be the sole responsibility of the Reservoir Lot licensee and/or the applicant. One copy of the site plans shall be returned to the applicant by the Planning and Development DepartmentBuilding Official after being marked as either "approved" or "disapproved" by authorized City personnel.
2. Docks servicing reservoir lots may be constructed to a maximum length of one hundred feet (100') measured from the location of the full pool level (896') elevation on the Reservoir Lot. An exception to the maximum length limitation may be granted by the Director of the Utility Systems if the dock construction plans include information, certified by a registered engineer, that a longer dock is necessary to assure a water depth to at least the nearest 890' reservoir contour.
3. Docks shall be constructed so as to provide a minimum of thirty (30) feet clearance and passageway for boats at all times.
4. No dock shall be constructed which will, in any manner, block any channel or slough.

5. A permit from the Planning and Development DepartmentBuilding Official shall be required for the extension of utility service to any permanent dock or dock structure.
D. Temporary Dock Extensions
When the official lake level for the Weatherford Water Supply Reservoir has been below 893 feet msl for sixty consecutive days, temporary dock extensions, beyond 100 feet, will be allowed by permit issued by the Planning and Development Department.Building Official. All temporary dock extensions permitted under this provision must meet the following criteria;
1. the temporary extension may not exceed a maximum of thirty (30) feet from the end of the permanent dock;
2. the temporary extension must be constructed of floating platform type construction materials;
3. the temporary extension must be pinned to the permanent dock;
4. the temporary extension must prominently display the street address of the Reservoir Lot for identification purposes in numbering of not less than threefour inches (34") in height; save as specifically excepted otherwise in this Section D, all other rules and requirements for permanent dock construction shall apply to temporary dock extensions allowed under this provision;
E.5. no more than one temporary dock extension will be allowed for each existing allowed permanent dock; extension of utility service to or for a temporary dock extension is expressly prohibited; and

WEATHERFORD WATER SUPPLY RESERVOIR Rules and Regulations Applicable to
Weatherford Water Supply Reservoir Lots (As amended and adopted September 26, 2019)
THE FOLLOWING RULES AND REGULATIONS ARE INTENDED TO AND SHALL BE APPLICABLE TO ALL CITY OWNED WEATHERFORD WATER SUPPLY RESERVOIR LOTS AND ARE HEREBY AMENDED AND ADOPTED BY THE BOARD OF TRUSTEES OF THE WEATHERFORD MUNICIPAL UTILITY SYSTEM PURSUANT TO ITS AUTHORITY UNDER TITLE IX, CHAPTER 2, SECTION 9-2-22 OF TFIE CITY CODE OF WEATHERFORD.
A. General requirements and regulations
1. All structures situated upon a Reservoir Lot, regardless of their nature, shall be connected to the Weatherford Municipal Utility Systems (including water and wastewater services) if the structure contains any type of plumbing fixture. The Weatherford Municipal Utility System shall be the provider of electrical service for all Reservoir Lots.
2. Private water wells may be used only for landscape maintenance purposes on Reservoir Lots. The blending of well water and water from the municipal water supply for any purpose is prohibited.
3. The following requirements for lot identification shall apply to all Reservoir Lots:
a. Street side numbering. The licensee shall insure that the correct assigned street number for the lot is prominently displayed either on a structure or fence situated on the lot. The street numbering shall be of a minimum size of four inches (4") in height and shall be displayed so as to be readily legible from the street or public right of way at all times. In the event the structure or fence upon which the street number is to be displayed is more than twenty-five (25) feet from the street side lot line, the Building Official shall determine and approve the size and location of the required street numbering.
b. Reservoir side numbering. The licensee shall insure that the correct assigned street number for the lot is prominently displayed to the reservoir either upon the main structure, an accessory or outbuilding, or upon a dock. The reservoir side street numbering shall be of a minimum size of four inches (4") and shall be displayed so as to be readily legible from the reservoir. In the event the structure, accessory or outbuilding, or dock upon which the street number is displayed to the reservoir side is more than twenty five (25) feet from the reservoir shoreline, the Building Official shall determine and approve the size and location of the required reservoir side street numbering.
B. Standards for construction, alterations, improvements or additions upon Reservoir Lots
1. All construction, demolition, alterations, improvements or additions on Weatherford Water Supply Reservoir Lots ("Reservoir Lots") shall be by permit issued by the Building Official of the City of Weatherford and shall be effected in compliance with all applicable codes,

ordinances, rules and regulations for such construction. Construction, alterations, improvements or additions, for the purposes of this Section B, shall include, but not be limited to the following:
a. construction, alteration, remodeling or demolition of buildings including residential structures, accessory buildings and all types of outbuildings or appurtenances;
b. construction, alteration or repair of retaining walls and fences;
c. any type of clearing, grading or filling on a Reservoir Lot;
d. construction of permanent docks as provided by Section C below.
2. No permit shall be issued for construction, alteration, improvements or additions on a Reservoir Lot unless the holder of the Reservoir Lot License Agreement is in compliance with all applicable terms of the License Agreement on the date of the application for the permit.
3. All applications for permits for construction, alteration, improvements or additions upon a Reservoir Lot shall be accompanied by plans, in duplicate, drawn to scale, showing the actual dimensions, elevations and shape of the lot proposed to be built upon; the exact size and locations of buildings or structures existing on the Reservoir Lot, if any, and the location, elevations(s) and dimensions of the proposed structure, building or alteration. The application for permit may include such other information as may be lawfully required by the Building Official. One copy of the plans shall be returned to the applicant by the Building Official after being marked either as "approved" or "disapproved" by authorized City personnel.
4. Exterior construction materials used in the construction, alteration, improvement or addition to a Reservoir Lot residential structure or accessory structure greater than 200 square feet.
a. Exterior Construction Materials – Allowed construction materials include:
i. brick;
ii. natural or manufactured stone;
iii. structural clay tile;
iv. indented, hammered or split-face concrete masonry unit or combination of these materials that are laid up unit by unit and set in mortar and that are at least two (2) inches thick;
v. stucco, Exterior Insulated Finish Systems (E.I.F.S.), or similar exterior cladding; and
vi. concrete tilt wall, pour-in-place concrete wall and pre-cast wall that are at least two (2) inches thick and that are profiled, sculptured, fluted, exposed-aggregated or have other non-smooth architectural concrete finish. However, exposed aggregate, smooth or untextured concrete finishes must be painted surfaces.
b. All Reservoir Lot residential structures or accessory structures greater than 200 square feet shall be of exterior construction having at least seventy-five percent (75%) of the total exterior walls above grade level and below the first floor plate line, excluding doors and windows, constructed of materials as listed in Section a. above.

c. Strict adherence to this requirement should not be such as to prevent architectural creativity for alterations or repairs. Alternative exterior materials that meet the intent of these rules and regulations may be approved by mutual consent of the Director of Water Utilities and Director of Development and Neighborhood Services.
d. Notwithstanding the above, chimneys and fireplaces on external wall surfaces shall be constructed of a minimum of one hundred percent (100%) masonry construction materials. This requirement shall not apply to chimneys for fireplaces that are not on or part of the external wall.
C. Dock Construction
1. Construction or alteration of permanent docks to service Reservoir Lots shall be by permit issued by the Building Official for the City of Weatherford. All applications for permits for construction or alteration of a permanent dock shall be accompanied by site plans, in duplicate, to scale, showing the property lines, all buildings and structures on the property, and the locations of the existing and/or proposed dock. The Building Official shall have authority to conduct an on-site inspection to verify any information provided in the site plan. The review and inspection of the Building Official shall be limited to compliance with the terms and provisions of these Reservoir Lot regulations and shall not extend to or encompass inspection as to compliance with other engineering and/or construction standards for dock construction -compliance with those engineering and/or constructions standards shall be the sole responsibility of the Reservoir Lot licensee and/or the applicant. One copy of the site plans shall be returned to the applicant by the Building Official after being marked as either "approved" or "disapproved" by authorized City personnel.
2. Docks servicing reservoir lots may be constructed to a maximum length of one hundred feet (100') measured from the location of the full pool level (896') elevation on the Reservoir Lot. An exception to the maximum length limitation may be granted by the Director of the Utility Systems if the dock construction plans include information, certified by a registered engineer, that a longer dock is necessary to assure a water depth to at least the nearest 890' reservoir contour.
3. Docks shall be constructed so as to provide a minimum of thirty (30) feet clearance and passageway for boats at all times.
4. No dock shall be constructed which will, in any manner, block any channel or slough.
5. A permit from the Building Official shall be required for the extension of utility service to any permanent dock or dock structure.
D. Temporary Dock Extensions
When the official lake level for the Weatherford Water Supply Reservoir has been below 893 feet msl for sixty consecutive days, temporary dock extensions, beyond 100 feet, will be allowed by permit issued by the Building Official. All temporary dock extensions permitted under this provision must meet the following criteria;
1. the temporary extension may not exceed a maximum of thirty (30) feet from the end of the permanent dock;

2. the temporary extension must be constructed of floating platform type construction materials;
3. the temporary extension must be pinned to the permanent dock;
4. the temporary extension must prominently display the street address of the Reservoir Lot for identification purposes in numbering of not less than four inches (4") in height; save as specifically excepted otherwise in this Section D, all other rules and requirements for permanent dock construction shall apply to temporary dock extensions allowed under this provision;
5. no more than one temporary dock extension will be allowed for each existing allowed permanent dock; extension of utility service to or for a temporary dock extension is expressly prohibited; and
6. temporary dock extensions shall not be allowed in areas which block any channel or slough and all such temporary dock extensions shall provide a minimum of thirty (30) feet clearance and passageway for boats at all times.
