ASK THE ADVISORASK THE ADVISORWhat Should You Know About Establishing a Trust?
You don’t have to be a CEO or multimillionaire to benefit from a trust. In fact, many people gain advantages from establishing one — so it may be useful to learnsomething about this common estate-planning tool.
Why would you want a trust? For one thing, if you have highly specific wishes onhow and when you want your estate to be distributed among your heirs, then a trustcould be appropriate. Also, you might be interested in setting up a trust if you’d liketo avoid the sometimes time-consuming, usually expensive and always public processof probate. Some types of trusts may also help protect your estate from lawsuits andcreditors. Currently, only a small percentage of Americans will be subject to estatetaxes, but estate tax laws are often in flux, so things may be different in the future —and a properly designed trust could help minimize these taxes.
If you decide that a trust might be right for you, you should work with an experi-enced estate-planning attorney. Trusts can be highly effective estate-planning vehi-cles, but they can also be complex and varied — so you’ll want to make sure youunderstand what’s involved.
One important decision will be to choose a trustee. The trustee is legally bound tomanage the trust’s assets in the best interests of your beneficiaries, so your choice oftrustee is extremely important. Your first impulse might be to select a family member, but before doing so, consider asking these questions:• Does he or she have the experience and knowledge to manage your financial affairscompetently?• When called upon to make a decision that may affect other family members, willyour prospective trustee act in a fair and unbiased manner?• Will naming a family member as trustee create a strain within the family?• Does your prospective trustee have enough time to manage your trust? Does he orshe even want this responsibility?• Do you have other family members who are willing to serve as trustee if your cho-sen trustee cannot do so?
This last question leads to another key aspect of establishing a trust — specifically, you can name a “co-trustee” to help manage the trust, and also a “successor trustee”who can take over if the person named initially fails or refuses to act in the capacityof trustee. Again, you will want to put considerable thought into whom you ask to takethese roles.
And you don’t have to stick with individuals, either – you can decide to ask a finan-cial institution to serve as trustee. By hiring such an institution, you will gain itsobjectivity and expertise, but you still need to ask many questions about costs, serv-ices provided, and so on.
Finally, as you develop your plans for a trust, consider communicating your wish-es and ideas to your family and anyone else who may be beneficiaries of your estate. When family members don’t know what to expect, disappointment and frustrationcan follow. If you know your loved ones are on board with your estate plans, you mayfeel even more comfortable in putting these plans in place.

She may be a celebrated champion, but iconic speedskater Bonnie Blair willstep into the limelight for something muchcloser to her heart than the five OlympicGold medals she once wore around herneck.
Blair will serve as the face of the 15thAnnual American Liver Foundation’s LiverLife Walk and 5K Fun Run to be held Aug.1 in downtown Milwaukee. As this year’sAmerican Liver Foundation (ALF) LIVErChampion, Blair will share her story withthe 500 individuals expected to headdowntown for the three-mile loop aroundVeteran’s Park.
"My sister Angela (Blair-Allen) suffers
from liver disease," Blair explained in aninterview with the Express News. "Shewas diagnosed with Hepatitis C in 2001and that is why I decided to get involvedin this cause.”
The walk is open to the public andboth individuals and teams are encour-aged to attend. The event allows peopleaffected by liver disease to come togetherand raise funds and awareness for theALF, all while having fun in a festival-typeatmosphere that includes activities forkids, food and entertainment. All fundsgo to support the mission of the ALF “tofacilitate, advocate and promote educa-tion, support and research for the preven-tion, treatment and cure of liver disease.”
Blair said she is highly encouraged by
the progress she has seen in the fightagainst liver disease since her sister-whois now in remission-fell ill.
“When my sister was diagnosed, therewas one drug to help you and it wasn’tgreat. Now there are so many options. Itis amazing how far (the medical world)has come in such a short time and it iswonderful for me to have been a part ofthat even in a small way,” she said.“Unfortunately liver disease gets a badrap-‘You drank too much and ruined yourliver’-but there are over 100 types of liverdisease and an estimated 500,000 suf-ferers in Wisconsin alone. My sister is anurse and we believe she contractedHepatitis C after being pricked by a nee-dle. Events like this help educate the pub-
lic, remove the stigma and get us closerto a cure.”
Blair has had many as triumphs in herlife-“My best memory is that first Goldmedal in Calgary. There is somethingabout doing something for the first time. The power and emotion behind it is hardto capture,” she said-however, she hasalso dealt with much loss as other siblingshave succumbed to illness, and this drivesthe Olympian.
“My family has been touched by dif-ferent diseases and I’m glad I can help indifferent ways,” she said. “My life hasincluded highs and lows, sad momentsand extraordinary moments, but that’s life.

Most individuals just a decade shy of100 don't celebrate their birthday on a
treadmill, but that's exactly whatMenomonee Falls resident Mary Tulachkadid. The health enthusiast celebrated her90th birthday earlier this month with a
Fitness Birthday Party at her favoritehang-out, Anytime Fitness located atSilver Spring Drive and Lilly Road.
With her actual birthday, July 12,spent with her children, Mary was withher adopted family a few days later asfriends gathered to wish her well andwatch her blow out the candles on hercake at the gym July 15.
"I can't say enough about thisplace," Mary said of the health club, which is co-owned by Lynne McElfreshand Lisa Schmidt, along with their hus-bands Chris and Jeff, respectively. "Thegirls who work here are out of this worldand everyone is so friendly. They feel likefamily."
Mary joined the club a year ago aspart of the Silver Sneaker Program andhas been working out faithfully eversince. She comes to the gym at leastthree times a week and exercises forabout an hour and a half, moving fromcardio to strength training to stretching, and she was named the club's first"Member to Inspire." She serves as aninspiration for members half her age notonly with her fitness, but even moreso
with her effervescent personality."The fact that I can still get out of bed
and stand up is my main accomplish-ment," Mary said with a laugh.
As impressive as her spry 4'11"physique is, more awe-inspiring is Mary'spositive and humorous approach to life. Awidow for 22 years, she speaks animat-edly of her husband of 40-plus years,Norbert, whom she met at MarquetteUniversity where she earned her Master'sDegree in teaching.
"He was a square dancer and a friendbrought me to meet him and I tripped onthe skirt of the square dancing dress I waswearing and literally fell at the feet of myfuture husband," she shared.
The pair went on to get married andhave two children-son Greg, who is a den-tist in Darlington, Wis., and daughterJackie, who works in the pharmaceuticalfield in Massachusetts-and eventuallyseven grandchildren who are all in vari-ous stages of successful lives yet still maketime for Grandma.
"They call me often and fly me out to
see them and we make a point to stayclose," she said. In fact, Mary's real birth-day gift was a surprise trip to Mexico, with both children and their spouses andall the grandkids, which Mary learned ofonly after she was cryptically told to "getmy Passport ready."
As she looks back on a life well lived,Mary said, "I don't believe I am as old asI am and all the events and things I havelived through. But my best piece if adviceis to be nice to people and open up yourheart. Do what you set out to do and don'tgive up."

Waste Management is seeking regu-latory approval to construct a landfill on42 acres of property just east of theexisting Orchard Ridge landfill site inMenomonee Falls.
The process and potential timelinefor the landfill was explained during ameeting of the Menomonee Falls SitingCommittee July 10. Under state law, thestate Department of Natural Resources(DNR) has final say in where landfillfacilities will be located and how theywill be operated. Local communities cancreate a Siting Committee to negotiateother conditions related to the landfill.
Dan Otzelberger, site engineer forWaste Management, summarized sever-al landfill sites in the area that are nowclosed. There is a nine-acre portion ofthe Orchard Ridge facility that is yet tobe constructed. He said that once theliner system is installed and the nine-acresite is filled beginning late next year orearly in 2017, that will be the last build-out for Orchard Ridge. Otzelberger saidthat portion of the site will have a threeto four year lifespan before it is closes.
According to information fromOtzelberger, in July 2012 WasteManagement submitted a feasibilityreport to the DNR regarding a 42-acreproperty east of the Orchard Ridge
Landfill and just west of 124th Street. Thesite for the proposed landfill includes thecurrent offices of Waste Management, which would be moved if the DNRapproved the landfill.
According to information fromOtzelberger, in April 2014, the DNRissued an "incomplete" letter to WasteManagement, seeking more informationof how to address wetland areas. WasteManagement is working though thosematters at this time and is going througha wetland permitting process,Otzelberger indicated.
Otzelberger said that for the poten-tial landfill to proceed, WasteManagement will need to receive a fea-sibility determination and a wetland per-mit from the DNR. While the landfillapproval is granted by the DNR at thatpoint, Waste Management would thenhave to submit a plan of operation to theagency which addresses design andconstruction aspects before any workcan begin.
Otzelberger indicated that any con-struction would not occur until 2017 or2018. If approved, the landfill at the 42-acre site would have a site life of five tosix years.–By Thomas J McKillen, ManagingEditor

"Thankfully we played our best ball atthe right time, that's what this is all about,"Hansen said.
