WHAT’S HAPPENING ATTHE COPPER DOME

Ever heard the word Teamwork andwhat does it mean? The process of

working collaborative-ly with a group of peo-ple, in order toachieve a goal.Teamwork is often acrucial part of a busi-ness, as it is oftennecessary for col-leagues to work welltogether, trying their

best in any circumstance. Teamworkmeans that people will try to cooperate,using their individual skills and providingconstructive feedback, despite any per-sonal conflict between individuals. Youhear me use this word a lot because it'sa key word to the success of what wewant to accomplish.

Let's take the bills that we're workingon at the Capitol. This year we havethree (3) bills that we've been working

on and they're important bills because theyaffect all of us in one way or another." HB2475, Splitting of lanes. This bill isdesigned to help us in the Safety aspect." HB2033 the extension of the emis-sion bill and to eliminate Emission testing inMaricopa county. This will save us moneyand time." SB1023 Right of Way. Safety, thinkabout all the accidents and deaths that havebeen caused by right of way violations.It's difficult and at the same time it can beeasy to determine which bills you want torun. What is going to have the biggestimpact? None are easy decisions and thenteamwork comes into play. You need team-work to determine what the right bill is andto listen to all sides. Then the bill receives aSponsor and teamwork comes into playbetween the Lobbyist, Motorcycle support-ers, Legislative folks and a host of otherfolks needed to get it into place.

Once the bill has been introduced either inthe House or Senate, now Teamwork needsto come into play with your Legislative folksbecause together we need to get this billthrough. If only the Lobbyist thought it wasgood and the Legislative group didn't,where do you think this bill would end up?This process is not easy and takes a lot oftime. In my mind we have a Lobby team thatbrings a ton to the table to make it all hap-pen. It's not just one person, it's a team.Teamwork makes it happen at all levels.Each person brings something different. Ifeveryone brought the same thing you prob-ably wouldn't need a team. The Lobby teamthat we have in place includes MMA,ABATE and ACMC. Teamwork, give andtake, good communication and a desire tomake it happen.

This past month we had a problem withgetting one of our bills SB1023 on theagenda for the Transportation Committee.We called up a Call for Action with ourDefenders and members of MMA andguess what? Teamwork again took holdand everyone starting writing letters,making calls and just getting involved tomake it happen and it did happen. We gotit on the Calendar and it passed that com-mittee with a 7-0 vote. That is Teamworkin the finest.Emails going around bashing people ororganizations don't breed Teamwork.Teamwork is what we need as an organi-zation and we have it within our group.

Take a look at MMA and dig intoMembership, web site, District events andfundraisers. They don't happen by acci-dent. They are done through Teamwork.

While doing some research for something I ran across an annual report put out

by the AZCriminalJusticeCommission.The reportsstarts with, InArizona,authoritiestrack predomi-nantly threetypes ofgangs: Street,Prison and

Motorcycle. In this report: titled Gangs inArizona, the emphasis is on Street andPrison gangs. Readers are strongly cau-tioned that by narrowing the focus of thereport to Street and Prison gangs, the writ-ers in no way are minimizing the signifi-cance of Motorcycle gangs in Arizona.

The report states that although availableintelligence and information is limited andmost data on Motorcycle gangs is found in"syndicate crime" databases, future reportswould focus on the magnitude and impactof Motorcycle gangs in Arizona. Thesereports are written, Pursuant to ArizonaRevised Statute (A.R.S.) 41-2416, the pur-pose of the reports? Provide informationabout gangs and related crimes. Theintended use, develop and implementstrategies to combat gangs in Arizona.

Basically (ARS) 41-2416 says the crimi-nal justice commission shall conduct anannual statewide survey, when monies arespecifically appropriated for that purpose,designed to measure both attitudes andthe actual prevalence and frequency ofsubstance abuse by children and adultsand the prevalence of street gang activityin this state. So exactly WHAT IS A GANGin the eyes of the AZ Criminal JusticeCommission?

According to the AZ Criminal JusticeCommission a single definition of "gang" isdifficult to establish because of the sheerdiversity of gangs currently in Arizona. Ingeneral the report states that a gang is aloosely organized group of at least threepeople. It also says that the group usuallyhas a name and may have a leader orleaders. The group may also have identi-fying signs such as distinctive symbols,clothing, jewelry, tattoos, and colors.(Hmmm that suspiciously sounds like mostMC's, Riding Club's or Association's inArizona including the MMA).

Additionally the report states that mem-bers perceive themselves as a gang, asso-ciate regularly and collaborate in commit-ting delinquent and/or criminal offenses. (Inall honesty I have yet to hear an MC callthemselves a gang.) As we all know inthe MRO world law enforcement has beenpaying close attention to motorcycle clubs

From the Chairman here in Arizona. Most of the attentionseems to be focused on proving clubs arelinked to criminal street gang or syndicate.

A law enforcement official once told methat the AZ Gang Task Force has a list andany and all clubs linked to the AZCMC arelisted as subversive organizations. Neverthought the Bikers for Christ or theEmergency Support Riders would be con-sidered subversives (I guess any thing ispossible in this day and age).

If you read the classifications of ARS 13-2308: participating in or assisting a criminalsyndicate. In part the statute states undersubsection (G) that; a person commits par-ticipating in a criminal syndicate by: Use ofa common name or common identifyingsign or symbol shall be admissible andmay be considered in proving the combina-tion of persons or enterprises required bythis section. After reading that it wouldseem that a significant factor in the com-plex of gang activity and behavior is use ofa common name or common identifyingsign or symbol.

In the vague context of this law, it wouldbe easy for police and prosecutors to alsosqueeze perceived deviant behavior intogang behavior, and erroneously prosecutea person for gang behavior, when they areinnocent of the offense. The following istaken directly from Arizona Revised Statute(ARS) 13-105. Definitions.

Part 8. "Criminal street gang" means anongoing formal or informal association ofpersons in which members or associatesindividually or collectively engage in thecommission, attempted commission, facili-tation or solicitation of any felony act andthat has at least one individual who is acriminal street gang member.

Part 9. "Criminal street gang member"means an individual to whom at least twoof the following seven criteria that indicatecriminal street gang membership apply:(a) Self-proclamation. (b) Witness testi-mony or official statement. (c) Written orelectronic correspondence. (d)Paraphernalia or photographs. (e)Tattoos. (f) Clothing or colors. (g) Anyother indicia of street gang membership.

For analysis purposes, the following aremain elements of ARS 13-2308: "Everyperson who actively participates in anycriminal street gang with knowledge thatthe members are engaging in or haveengaged in a pattern of criminal gangactivity, and who willfully promotes, fur-thers, or assists in any felonious criminalconduct by members of that gang, is guiltyof a crime..."

So with the AZ Criminal JusticeCommission considering a gang as aloosely organized group of at least threepeople. "Criminal street gang means anyongoing organization, association or groupof three or more persons, whether formalor informal, having as one of its primary

activities the commission of a crime. Whatis on the list of gang crimes, well those arepretty loose too.To name just a few on the list AlcoholOffenses, Disorderly Conduct, Fights,Assault and Misc. Criminal Activity.

Active participation means that the person(1) must have a current relationship withthe criminal street gang that is more thanin name only, passive, inactive or purelytechnical, and (2) must devote all, or asubstantial part a (his) (her) time or effortsto the criminal street gang."

"In order to prove this crime (a gangcrime), each of the following elementsmust be proved:

1. A person actively and currently partici-pated in a criminal street gang; 2. Themembers of that gang engaged in or haveengaged in a pattern of criminal gangactivity; 3. That person knew that the gangmembers engaged in or have engaged in apattern of criminal gang activity; and 4.That the person aided and abetted mem-ber(s) of that gang in committing thecrime(s)."

So in theory with all the vagueness to thisstatute if you and your club organize apoker run and it goes from bar to bar. Andsomeone from your group or club that wason the poker run gets a DUI and is convict-ed; your group or club could be screwed.He committed an alcohol offense and youtook part in facilitating it. In terms ofMotorcycle clubs a factor that needs to beadded into the analysis of the gang law isthat membership does not prove the intentto commit crimes. After all the mere pres-ence at the scene of a crime does not lenditself to the commission of the crime nordoes it amount to aiding and abetting.

Also evidence that a person was in thecompany of or associated with one or morepersons alleged or proved to have beenmembers of a conspiracy, is not in itself,sufficient proof that a person was a mem-ber of the alleged conspiracy. Associationwith out evidence does not make an indi-vidual guilty of the crimes of others, unlessthere is an act of backup. In other words,you can't convict someone as having com-mitted a crime through the concept of "guiltby association."

Another aspect that needs to be added isculpability, just because a member as anindividual commits a crime has nothing todo with his participation in his club. Casein point the trial of Nathaniel Sample of theHells Angels. Sample assaulted a man in aScottsdale bar. Prosecutors asked jurorsto find that Sample's actions were done toadvance the Hells Angels as a criminalstreet gang. County Attorney AndrewThomas released in a written statement.Scottsdale police said Sample and JoseCano attacked a Casa Grande man onMarch 28, 2008, at the Billet Bar, 3752 N.

May is motorcycle awareness month andwe need to really spread the word onmotorcycle safety everywhere we are. Withthe tragedy that happened I see that peo-ple are being more careful around bikes.All our hearts go out to the familiesinvolved and to the community that arehelping the families in need of our supportright now.

We as MMA have raised a lot of moneyto get the signs out there on the highwaysand in the valley as well as radio airplay toremind people hey we are out here andplease look out for motorcycles and beaware around you. If you look around thevalley We have booths set up at mostmajor events with all kinds or swag for youto take and promote. We are not hard tofind people spread the word and lets havea good riding season!

Now I want to take a minute to tell every-body that showed up for the Farkle Runfollowed by the Bikers Ball on SaturdayApril 3rd it was a big hit. We had a 4 stoprun which ended at the Four PointsSheraton Hotel. We ran a tight pack had asupport vehicle following us behind whichwas much needed had a busted belt inci-dent along the way. Most of all no one gothurt and it was a very smooth run. Weeven signed on a couple new people alongthe way. They loved how we ran togetheras a group and the way we handle our-selves in the public eyes around us. Iwould like to congratulate Toni Merino forhaving a score of 5400 points and winningthe Farkle-Run trophy 2010, and lastJeanette Zubicki with Epic Event Planningfor all her hard work in getting all the ven-dors involved in this event to have the suc-cess it brought to all that were part of theBikers Ball 2010. Great job Jeanette canonly get bigger from here!

I would like to invite all districts even thegeneral public to one of our meeting heldthe third Sunday of every month at Chuy’sMesquite Broiler on 95th ave. andCamelback. We would love to see newfaces and show everyone including non-members what we are doing to help raisemotorcycle awareness and involve every-one to the up coming events that are goingon. We as the MMA Eagle District haveaccomplished a lot in the past year as a

new district. I am very proud of each andever one of our members showing yoursupport and giving me that extra handwhen needed to vote on all the issues thatarise in council. Also a very special thanksto Chuys Mesquite Broiler in Glendale forsupporting us dramatically weather it is anevent or even just having our news letters,stickers, pencils, sign up sheets or whathave you sitting on the tables for anybodyto take and read/use to help promote safe-ty and awareness. The General ManagerJay Duett is a current member as well as abusiness member or the MMA and is doingall he can to build and support the causefor Motorcycle Rights.

Let’s all have a great riding season andremember be aware at all times to manypeople on their cell phones not payingattention!

Salt River DistrictGreetings to all of SRD MMA members. Ifyou haven't heard "I'M BACK". InFebruary I was elected the DistrictManager of the Salt River District. I amhappy to be back and ready to get started.

Thank you Rick "Burnout" Wilson and offi-cers for your hard work and dedication thepast year. I hope you will stay in touch andstay active in the MMA. We need your sup-port.

Currently our meetings are held the 2ndSaturday of every month at Smokies Bar &Grill in Mesa at 1pm. Officers meet at11am before the meeting. APRIL MEET-ING HAS BEEN CHANGED TO APRIL 17.Please join us and help get the word out.

The weather is getting better; spring ishere making it perfect to ride again.

April brings us Bike Week events begin-ning April 9th thru the 18th, check out yourlocal hangouts for biker specials or go tothe www.azbikeweek.com website.

On May 22, 2010 we have an SRDMotorcycle Awareness Poker Run eventplanned. It will be a 3 stop run with thelast two cards drawn at the end party at

Smokies. The cost is $15.00 per bike; allproceeds will go to support our BruceHarradence Down Rider Fund.

Motorcycles on Main, in Mesa, on May 7,2010 from 6pm-10pm - 1st Friday of everymonth. There is Sturgis style parking formotorcycles, 4 beer gardens, 4 live bands,great food and vendors. We are planningto have a booth for MMA-SRD and will bedistributing Motorcycle Awareness/MMAgoody bags thru out the crowds.

We are looking for volunteers for both ofthese events. If you would like to help outfor either of these events, contact TenActivities Officer or Bob MembershipOfficer.

Hello Fellow Riders and Freedom Fighters,Another month has gone by and the rid-

This last month we had our A.D.O.T.clean up and had 18 members show up tohelp. Afterwards we took everyone to thepark where we served sub sandwichesmade by our activities officer Deb. Thanksto all those who came out to help.

White Mountain District

We had a rather festive April meeting. Wedecided on our T-shirts for our Run withthe Wolf Rally which runs June 18-20 atthe American Legion on Rt. 60 inSpringerville. We also discussed our Runwith the Wolf flyers and plaques for givingout to winners of events at our rally. Weneed more Vendors for our Rally. If anyoneis interested in being a vendor please con-tact Carlene at 928-245-6427.

We are having a club camaraderiepot luck get together at Coyote CreekRestaurant on Rt. 60 in Springerville onMay 1st at 1 P.M. Our White MountainDistrict of the MMA patches came in andthey are beautiful. They are being sold for$6 each, available at our meetings.Everyone was reminded that they should

have a motorcycle endorsement on theirdrivers' license and everyone should havemotorcycle insurance. If we want to pushfor motorcycle riders rights then we shouldhave EVERYONE following the rules of theroad.Our summer meetings will be held at 10A.M. at the VFW in Eagar on the firstSunday of the month. Our next meeting willbe held on Sunday May 2nd at 10 A.M.Our meeting participation has seen anincrease with the good weather. The sum-mer time is a great time to ride thereforewe have changed our meeting times toreflect the good riding of the season. Wewill be scheduling a ride after each meet-ing during the summertime. Everyone have a great Spring and drivesafely.

Thisprocess will help us in the long run to man-age our needs.

Let's look at another area that falls intoTeamwork. Ever heard the word THANKYOU? Ever had someone come up to youand say Thank you for what you're doing?Does it mean anything? Does it make youfeel good? MMA is a volunteer organizationand everyone belongs to it because theywant something out of it. It is probably a dif-ferent reason for everyone but they take thetime to get involved in helping and some putin a lot of hours. I think about our web site,membership, finance, Patriot, Chairman,District events and meetings. A lot of timeput in to these and it's on their own time.Take the time to THANK them for what theydo. Think about how good it feels to you tojust have someone thank you and appreci-ate what you're doing. I always tell someonethat is a volunteer, which is why you getpaid the big bucks…. We do it because wewant to and we care. Not for the dollars.Thank these people, they've earned it.There is nothing better than a Volunteer tohelp make it successful.TEAMWORK-MMA pulling together as vol-

A few more examples to make this point,a member carries a weapon for self-protec-tion, but his being armed has nothing to dowith his affiliation.
