Labor Warranty
Thisisanexpresslaborwarranty(“warranty”)providedbyGliddenConstruction(“GLIDDENCONSTRUCTION”)toyou,theoriginalconsumerpurchaser(“Owner”).Thedurationofthiswarrantyisoneyear. GLIDDENCONSTRUCTIONstandsbehindourwork100%.Weemployhighlyskilledlaborersandcraftsmanoneveryproject,anduseonlyhighquality,long-lastingmaterials.
GLIDDENCONSTRUCTIONwarrantstotheOwnerthatmaterialsandequipmentfurnishedundertheContractwillbeofgoodqualityandnewunlessotherwiserequiredorpermittedbytheContractDocuments,thattheWorkwillbefreefromdefectsnotinherentinthequalityrequiredorpermitted,andrequireorpermitotherwise.GLIDDENCONSTRUCTIONfurtherwarrantsthattheWorkwillconformtotherequirementsoftheContractDocumentsandwillbefreefromdefects,exceptforthoseinherentinthequalityoftheWorktheContractDocumentsrequireorpermit.Work,materials,orequipmentnotconformingtotheserequirements,includingsubstitutionsnotproperlyapprovedandauthorized,maybeconsidereddefective.TheContractor’swarrantyexcludesremedyfordamageordefectcausedbyabuse,modificationsnotalterationstotheWorknotexecutedbytheGLIDDENCONSTRUCTION,improperorinsufficientmaintenance,improperoperation,ornormalwearandtearandnormalusage.

Pleasebeawarethatcondensationonanywindoworpatiodooristhenaturalresultofexcessivemoistureinthehouse,anddoesnotindicateadefectiveproductorfaultyinstallation.Excessivecondensationmayevenresultinfrostappearingonwindowsinverycoldweather.GLIDDENCONSTRUCTIONisnotresponsibleforcondensationandthiswarrantydoesnotapplytocondensation,itscausesoritseffects.Pleasetakestepstoproperlyventilateareaswherenewwindowproductsareinstalledforatleast48hoursafterinstallationtoavoidpossiblesensitivitiestocaulkingodors.

info@glidden-construction.comtorequestwarrantyservicing.ClaimsmustbesubmittedtoGLIDDENCONSTRUCTIONpromptlyafterdiscoveryoftheclaimedlabordefect.GLIDDENCONSTRUCTIONwillthenscheduleanappointmenttoinspectthewarrantyclaimwithinareasonableperiodoftimeafterhavingreceivedtheclaim.Ifafterinspection,GLIDDENCONSTRUCTIONdeterminesthatavalidclaimexistsunderthewarranty,GLIDDENCONSTRUCTIONwillrepair,re-install,re-place,orrefundthepriceofthefailingGLIDDENCONSTRUCTIONservice,atGLIDDENCONSTRUCTION’soption.IfGLIDDENCONSTRUCTIONdeterminestoreplaceanyorallproduct(s),andifsuchproduct(s)asoriginallyinstalledarenolongeravailable,GLIDDENCONSTRUCTIONshallhavetherighttosubstituteproduct(s)designatedbyGLIDDENCONSTRUCTIONtobeofequalquality.Replacementofaproductorcomponentdoesnotrenewthelaborwarrantyperiod.Minorcolorvariationsmayexistbetweenreplacementproductandtheoriginallyinstalledproductandarenotindicativeofadefectiveproductoralabordefect.If,atGLIDDENCONSTRUCTION’soption,arefundisconveyedtotheOwner,thenallwarrantiesareterminated,andrepair,replacementorremovalofGLIDDENCONSTRUCTIONproductsshallbecomethesoleresponsibilityoftheOwner.NowarrantiesarevalidunlessanduntiltheOwnerhasmadefullpaymentundertheoriginalGLIDDENCONSTRUCTIONsalesagreementandalladdendathereto.Non-warrantycallsforrepairoradjustmentmayresultinaservicecharge.
WhatIsNotCovered:
ThesewarrantiesaregrantedbyGLIDDENCONSTRUCTIONtotheOwneronly.Allwarrantiesterminateimmediatelyuponthetransferofhomeownership,otherthaninaccordancewiththetransferabilitydirectionsdescribedherein.AllwarrantiesassumenormalandreasonableuseofGLIDDENCONSTRUCTION-installedproductsorcomponents.Minorcolorortexturalvariationsfromlot-to-lotofproductarenotproductorinstallationdefects.Thesewarrantiesdonotcoveranyotherdamage,workmanship,ormaterialfailurebeyondthecontrolofGLIDDENCONSTRUCTIONincluding,butnotlimitedto,damagecausedbyoccurrences,suchassettlementofthebuilding,failureofthestructure(includingfoundationsandwalls),useofincompatibleaccessories,removal,repair,orre-installationofanyGLIDDENCONSTRUCTION-installedproductsorcomponentsbyotherthanGLIDDENCONSTRUCTION,normalweathering,corrosiveeffectsofsaltairandchemicalpollutants,normalfading,deteriorationofcaulking

compounds,fire,flood,lightening,highwinds,windblownobjects,earthquake,hurricanes,icedams,iciclesand/oricestorms,atmosphericconditions,orweatherofcatastrophicnatureasdefinedbytheUSWeatherBureau,otheractsofGod,intentionalacts,unreasonableuse,vandalismorpollution.Thesewarrantiesalsowillnotapplytodamagesresultingfromthefailuretoprovidereasonablemaintenance,includingfailuretocleantheproductormaintainsealing,paintingand/orcaulkingasreasonablynecessary.GLIDDENCONSTRUCTIONisalsonotresponsibleforexistingordevelopingsporeormoldgrowth.Moldandmildewmaybeduetocondensation,whichmayformonorwithinwallsorothersurfacesresultingfrompre-existingconditionsintheOwner’shome.
WhatVoidsTheseWarranties:
Installation,removal,repair,adjustment,tamperingorre-installationofanyGLIDDENCONSTRUCTIONproductsorcomponentsbyotherthanGLIDDENCONSTRUCTIONvoidsanyandwarrantieswithinthisdocument,andGLIDDENCONSTRUCTIONexpresslydisclaimsanyliabilityforanycosts,defects,ordamageswithrespecttosuchactions.
RemediesandRights:
ThesewarrantiesofGLIDDENCONSTRUCTIONservicesaretheonlyexpressedwarrantiesprovidedbyGLIDDENCONSTRUCTION.Noemployee,representative,agent,noranyotherperson,hasauthoritytoassumeorincuronbehalfofGLIDDENCONSTRUCTIONanyobligation,liability,orresponsibilityinplaceoforinadditiontothesewarranties.INNOEVENTSHALLTHEDURATIONOFANYIMPLIEDWARRANTYOFMERCHANTABILITYORFITNESSFORAPARTICULARPURPOSEBELONGERTHANTHEDURATIONOFTHEEXPRESSWARRANTYSTATEDHEREIN.EXCEPTFORTHEWARRANTYPROVIDEDHERE-INGLIDDENCONSTRUCTIONMAKESNOWARRANTYOFANYKIND,EXPRESS,IMPLIEDORSTATUTORY,INCLUDING,WITHOUTLIMITATION,ANYWARRANTYOFNONINFRINGEMENT,MERCHANTABILITY,ORFITNESSFORAPARTICULARPURPOSE.GLIDDENCONSTRUCTION’SLIABILITYTOOWNERUNDERTHISDOCUMENTISLIMITEDTOTHEAMOUNTSRECEIVEDBYGLIDDENCONSTRUCTIONFORSERVICESRENDEREDUNDERTHESALESAGREEMENTORPURCHASEORDERWITHTHEOWNER.SOMESTATESDONOTPERMITANYLIMITATIONONTHELENGTHOFANIMPLIEDWARRANTY,ANDTHEREFORETHEIMMEDIATELYPRECEDINGSENTENCEMAYNOTAPPLY.INNOEVENTSHALLGLIDDEN

GoverningLawandChoiceofForum
ThiswarrantyisgovernedbythelawsoftheStateofNewJersey.Anydisputesand/orlitigationarisingoutoforrelatedtothiswarrantymustberesolvedinCamdenCounty,NewJersey.
MediationandArbitration
Ifadisputearisesoutoforrelatestothiscontract,orthebreachthereof,andifthedisputecannotbesettledthroughnegotiation,thepartiesagreefirsttotryingoodfaithtosettlethedisputebymediationadministeredbytheAmericanArbitrationAssociationunderitsCommercialMediationProceduresbeforeresortingtoarbitration,litigation,orsomeotherdisputeresolutionprocedure.
Anycontroversyorclaimarisingoutoforrelatingtothiswarranty,orthebreachthereof,shallbesettledbyarbitrationadministeredbytheAmericanArbitrationAssociationinaccordancewithitsCommercial[orother]ArbitrationRules[includingtheOptionalRulesforEmergencyMeasuresofProtection],andjudgmentontheawardrenderedbythearbitrator(s)maybeenteredinanycourthavingjurisdictionthereof.
HowToTransferThisWarranty:
Subjecttotheothertermsandconditionscontainedinthisdocument,thiswarrantyistransferablebytheOwner.ThiswarrantymaybetransferredbytheOwneronlyonce,andthetransfereewillthenstepintotheshoesoftheOwnerforpurposesofthiswarranty.Totransferthiswarranty,theownermustrequest,inwritingbymailbyregisteredmailtoGLIDDENCONSTRUCTIONat107PlymouthPlace,Merchantville,NJ
