    PARTIINTRODUCTIONSECTIONA:GENERALPERMITCOVERAGEAllpersonsdesiringtohavefacilitiescoveredbythisGeneralPermitmustregisterwiththeDivisionofWaterQuality(DWQ)bythefilingofaNoticeofIntent(NOI)andapplicablefees.TheNOIshallbesubmittedandacertificateofcoverageissuedpriortoanypointsourcedischargeofstormwaterassociatedwithindustrialactivitytothesurfacewatersofthestate.AnyowneroroperatornotwishingtobecoveredorlimitedbythisGeneralPermitmaymakeapplicationforanindividualNPDESpermitinaccordancewithNPDESproceduresin15ANCAC2H.0100,statingthereasonssupportingtherequest.Anyapplicationforanindividualpermitshouldbemadeatleast180dayspriortocommencementofdischarge.ThisGeneralPermitdoesnotcoveractivitiesordischargescoveredbyanindividualNPDESpermituntiltheindividualpermithasexpiredorhasbeenrevoked.AnypersonconductinganactivitycoveredbyanindividualpermitbutwhichcouldbecoveredbythisGeneralPermitmayrequestthattheindividualpermitberevokedandcoverageunderthisGeneralPermitbeprovided.Ifindustrialmaterialsandactivitiesarenotexposedtoprecipitationorrunoffasdescribedin40CFR122.26(g),thefacilitymayqualifyforaNoExposureExclusionfromNPDESstormwaterdischargepermitrequirements.AnyowneroroperatorwishingtoobtainaNoExposureExclusionmustsubmitaNoExposureCertificationNoticeofIntent(NOI)formtotheDivision;mustreceiveapprovalbytheDivision;mustmaintainnoexposureconditionsunlessauthorizedtodischargeunderavalidNPDESstormwaterpermit;andmustrecertifytheNoExposureExclusionannually.AnyfacilitymayapplyforneworcontinuedcoverageunderthispermituntilaTotalMaximumDailyLoad(TMDL)forpollutantsforstormwaterisestablished.ATMDLsetsapollutantloadinglimitthataffectsawatershed,orportionofawatershed,drainingtoaspecificimpairedwater.FordischargestowatershedsaffectedbyaTMDL,coverageunderthispermitmaydependonthefacilitydemonstratingitdoesnothavereasonablepotentialtoviolateapplicablewaterqualitystandardsforthosepollutantsasaresultofdischarges.IfDWQdeterminesthatdischargeshavereasonablepotentialtocausewaterqualitystandardviolations,thefacilityshallapplyforanindividualpermit180dayspriortotheexpirationdateofthisGeneralPermit.Oncethatindividualpermitiseffective,thefacilitywillnolongerhavecoverageunderthisGeneralPermit.Notethatthepermitteemustidentifyimpairedwaters(scheduledforTMDLdevelopment)andwatersalreadysubjecttoaTMDLintheSiteOverview,asoutlinedintheStormwaterPollutionPreventionPlan,PartII,SectionA.Duringtheperiodbeginningontheeffectivedateofthepermitandlastinguntilexpiration,thepermitteeisauthorizedtodischargestormwaterassociatedwithindustrialactivity.Suchdischargesshallbecontrolled,limitedandmonitoredasspecifiedinthispermit.

    SECTIONB:PERMITTEDACTIVITIESUntilcoverageunderthispermitexpiresorismodifiedorrevoked,thepermitteeisauthorizedtodischargestormwatertothesurfacewatersofNorthCarolina,ortoaseparatestormsewersystem,whichhasbeenadequatelytreatedandmanagedinaccordancewiththetermsandconditionsofthisGeneralPermit.Anyotherpointsourcedischargetosurfacewatersofthestateisprohibitedunlessitisanallowablenonstormwaterdischargeoriscoveredbyanotherpermit,authorization,orapproval.ThedischargesallowedbythisGeneralPermitshallnotcauseorcontributetoviolationsofWaterQualityStandards.Dischargesauthorizedbythispermitandsiteoperationsmustmeetapplicablewetlandstandards,asrecordedin15ANCAC2B.0230and.0231,andwaterqualitycertificationrequirementsasoutlinedin15ANCAC2H.0500.Thispermitdoesnotrelievethepermitteesresponsibilityforcompliancewithanyotherapplicablefederal,state,orlocallaw,rule,standard,ordinance,order,ordecree.

    PARTIIMONITORING,CONTROLS,ANDLIMITATIONSFORPERMITTEDDISCHARGES

    SECTIONA:STORMWATERPOLLUTIONPREVENTIONPLANThepermitteeshalldevelopandimplementaStormwaterPollutionPreventionPlan(SPPP).TheSPPPshallbemaintainedonsiteunlessexemptedfromthisrequirementbytheDivision.TheSPPPispublicinformationinaccordancewithPartIII,StandardConditions,SectionE,paragraph3ofthispermit.TheSPPPshallinclude,ataminimum,thefollowingitems:1. SiteOverview.TheSiteOverviewshallprovideadescriptionofthephysicalfacilityandthe

    potentialpollutantsourcesthatmaybeexpectedtocontributetocontaminationofstormwaterdischarges.TheSiteOverviewshallcontainthefollowing:

    (a) Agenerallocationmap(USGSquadranglemaporappropriatelydraftedequivalentmap),

    showingthefacility'slocationinrelationtotransportationroutesandsurfacewaters;thenameofthereceivingwaterstowhichthestormwateroutfallsdischarge,orifthedischargeistoamunicipalseparatestormsewersystem,thenameofthemunicipalityandtheultimatereceivingwaters;andaccuratelatitudeandlongitudeofthepointsofstormwaterdischargeassociatedwithindustrialactivity.Thegenerallocationmap(oralternativelythesitemap)shallidentifywhetheranyreceivingwatersareimpaired(onthestates303(d)listofimpairedwaters)orifthesiteislocatedinawatershedforwhichaTMDLhasbeenestablished,andwhattheparametersofconcernare.

    (b) Anarrativedescriptionofstoragepractices,loadingandunloadingactivities,outdoor

    processareas,dustorparticulategeneratingorcontrolprocesses,andwastedisposalpractices.Anarrativedescriptionofthepotentialpollutantsthatcouldbeexpectedtobepresentinthestormwaterdischargefromeachoutfall.

    (c) Asitemapdrawnatascalesufficienttoclearlydepict:thesitepropertyboundary;the

    stormwaterdischargeoutfalls;allonsiteandadjacentsurfacewatersandwetlands;industrialactivityareas(includingstorageofmaterials,disposalareas,processareas,loadingandunloadingareas,andhaulroads);sitetopographyandfinishedgrade;alldrainagefeaturesandstructures;drainageareaboundariesandtotalcontributingareaforeachoutfall;directionofflowineachdrainagearea;industrialactivitiesoccurringineachdrainagearea;buildings;stormwaterBestManagementPractices(BMPs);andimpervioussurfaces.Thesitemapmustindicatethepercentageofeachdrainageareathatisimpervious,andthesitemapmustincludeagraphicscaleindicationandnortharrow.

    (d) Alistofsignificantspillsorleaksofpollutantsduringthepreviousthree(3)yearsand

    anycorrectiveactionstakentomitigatespillimpacts.(e) Certificationthatthestormwateroutfallshavebeenevaluatedforthepresenceofnon

    stormwaterdischarges.Thepermitteeshallrecertifyannuallythatthestormwateroutfallshavebeenevaluatedforthepresenceofnonstormwaterdischarges.ThecertificationstatementwillbesignedinaccordancewiththerequirementsfoundinPartIII,StandardConditions,SectionB,Paragraph3.

    2. StormwaterManagementStrategy.TheStormwaterManagementStrategyshallcontainanarrativedescriptionofthematerialsmanagementpracticesemployedwhichcontrolorminimizethestormwaterexposureofsignificantmaterials,includingstructuralandnonstructuralmeasures.TheStormwaterManagementStrategy,ataminimum,shallincorporatethefollowing:

    (a) FeasibilityStudy.Anannualreviewofthetechnicalandeconomicfeasibilityofchanging

    themethodsofoperationsand/orstoragepracticestoeliminateorreduceexposureofmaterialsandprocessestorainfallandrunonflows.Whereverpractical,thepermitteeshallpreventexposureofallstorageareas,materialhandlingoperations,andmanufacturingorfuelingoperations.Inareaswhereeliminationofexposureisnotpractical,thisreviewshalldocumentthefeasibilityofdivertingthestormwaterrunonawayfromareasofpotentialcontamination.

    (b) SecondaryContainmentRequirementsandRecords.Secondarycontainmentis

    requiredfor:bulkstorageofliquidmaterialsincludingpetroleumproducts;storageinanyamountofSection313ofTitleIIIoftheSuperfundAmendmentsandReauthorizationAct(SARA)waterprioritychemicals;andstorageinanyamountofhazardoussubstances,inordertopreventleaksandspillsfromcontaminatingstormwaterrunoff.Atableorsummaryofallsuchtanksandstoredmaterialsandtheirassociatedsecondarycontainmentareasshallbemaintained.Ifthesecondarycontainmentdevicesareconnectedtostormwaterconveyancesystems,theconnectionshallbecontrolledbymanuallyactivatedvalvesorothersimilardeviceswhichshallbesecuredclosedwithalockingmechanism.Anystormwaterthataccumulatesinthecontainmentareashallbeataminimumvisuallyobservedforcolor,foam,outfallstaining,visiblesheens,anddryweatherflow,priortoreleaseoftheaccumulatedstormwater.Accumulatedstormwatershallbereleasediffoundtobeuncontaminatedbyanymaterial.Recordsdocumentingtheindividualmakingtheobservation,thedescriptionoftheaccumulatedstormwater,andthedateandtimeofthereleaseshallbekeptforaperiodoffive(5)years.

    (c) BMPSummary.AlistingofsitestructuralandnonstructuralBestManagementPractices

    (BMPs)shallbeprovided.TheinstallationandimplementationofBMPsshallbebasedontheassessmentofthepotentialforsourcestocontributesignificantquantitiesofpollutantstostormwaterdischargesandondatacollectedthroughmonitoringofstormwaterdischarges.TheBMPSummaryshallincludeawrittenrecordofthespecificrationaleforinstallationandimplementationoftheselectedsiteBMPs.TheBMPSummaryshallbereviewedandupdatedannually.

    3. SpillPreventionandResponseProcedures.TheSpillPreventionandResponseProcedures

    (SPRP)shallincorporateanassessmentofpotentialpollutantsourcesbasedonamaterialsinventoryofthefacility.FacilitypersonnelresponsibleforimplementingtheSPRPshallbeidentifiedinawrittenlistincorporatedintotheSPRPandsignedanddatedbyeachindividualacknowledgingtheirresponsibilitiesfortheplan.Aresponsiblepersonshallbeonsiteatalltimesduringfacilityoperationsthathavethepotentialtocontaminatestormwaterrunoffthroughspillsorexposureofmaterialsassociatedwiththefacilityoperations.TheSPRPmustbesitestormwaterspecific.Therefore,anoilSpillPreventionControlandCountermeasureplan(SPCC)maybeacomponentoftheSPRP,butmaynotbesufficienttocompletelyaddressthestormwateraspectsoftheSPRP.ThecommonelementsoftheSPCCwiththeSPRPmaybeincorporatedbyreferenceintotheSPRP.

    4. PreventativeMaintenanceandGoodHousekeepingProgram.Apreventativemaintenanceandgoodhousekeepingprogramshallbedevelopedandimplemented.Theprogramshalladdressallstormwatercontrolsystems(ifapplicable),stormwaterdischargeoutfalls,allonsiteandadjacentsurfacewatersandwetlands,industrialactivityareas(includingmaterialstorageareas,materialhandlingareas,disposalareas,processareas,loadingandunloadingareas,andhaulroads),alldrainagefeaturesandstructures,andexistingstructuralBMPs.Theprogramshallestablishschedulesofinspections,maintenance,andhousekeepingactivitiesofstormwatercontrolsystems,aswellasfacilityequipment,facilityareas,andfacilitysystemsthatpresentapotentialforstormwaterexposureorstormwaterpollutionwherenotalreadyaddressedunderanotherelementoftheSPPP.Inspectionofmaterialhandlingareasandregularcleaningschedulesoftheseareasshallbeincorporatedintotheprogram.Timelycompliancewiththeestablishedschedulesforinspections,maintenance,andhousekeepingshallberecordedandmaintainedintheSPPP.

    5. FacilityInspections.InspectionsofthefacilityandallstormwatersystemsshalloccuraspartofthePreventativeMaintenanceandGoodHousekeepingProgramataminimumonasemiannualschedule,onceduringthefirsthalfoftheyear(JanuarytoJune),andonceduringthesecondhalf(JulytoDecember),withatleast60daysseparatinginspectiondates(unlessperformedmorefrequentlythansemiannually).Thesefacilityinspectionsaredifferentfrom,andinadditionto,thestormwaterdischargecharacteristicmonitoringattheoutfallsrequiredinPartIIB,C,andDofthispermit.

    6. EmployeeTraining.Trainingprogramsshallbedevelopedandtrainingprovidedata

    minimumonanannualbasisforfacilitypersonnelwithresponsibilitiesfor:spillresponseandcleanup,preventativemaintenanceactivities,andforanyofthefacility'soperationsthathavethepotentialtocontaminatestormwaterrunoff.Thefacilitypersonnelresponsibleforimplementingthetrainingshallbeidentified,andtheirannualtrainingshallbedocumentedbythesignatureofeachemployeetrained.

    7. ResponsibleParty.TheSPPPshallidentifyaspecificperson(s)orposition(s)responsiblefor

    theoverallcoordination,development,implementation,andrevisionoftheSPPP.ResponsibilitiesforallcomponentsoftheSPPPshallbedocumentedandpositionassignmentsprovided.

    8. SPPPAmendmentandAnnualUpdate.ThepermitteeshallamendtheSPPPwheneverthere

    isachangeindesign,construction,operation,sitedrainage,maintenance,orconfigurationofthephysicalfeatureswhichmayhaveasignificanteffectonthepotentialforthedischargeofpollutantstosurfacewaters.AllaspectsoftheSPPPshallbereviewedandupdatedonanannualbasis.Theannualupdateshallinclude:

    (a) anupdatedlistofsignificantspillsorleaksofpollutantsforthepreviousthree(3)

    years,orthenotationthatnospillshaveoccurred(elementoftheSiteOverview);(b) awrittenrecertificationthatthestormwateroutfallshavebeenevaluatedforthe

    presenceofnonstormwaterdischarges(elementoftheSiteOverview);(c) adocumentedreevaluationoftheeffectivenessoftheonsitestormwaterBMPs

    (BMPSummaryelementoftheStormwaterManagementStrategy).(d) astatementthatannualtrainingrequirementsweremetintheyearpast;(e) areviewandcomparisonofsampleanalyticaldatatobenchmarkvalues(if

    applicable)overthepastyear,includingadiscussionaboutTieredResponsestatus.ThepermitteeshallusetheDivisionsAnnualSummaryDataMonitoringReport(DMR)form,availablefromtheStormwaterPermittingUnitswebsite(SeeMonitoringFormshere:http://portal.ncdenr.org/web/wq/ws/su/npdessw).

    TheDirectormaynotifythepermitteewhentheSPPPdoesnotmeetoneormoreoftheminimumrequirementsofthepermit.Within30daysofsuchnotice,thepermitteeshallsubmitatimescheduletotheDirectorformodifyingtheSPPPtomeetminimumrequirements.Thepermitteeshallprovidecertificationinwriting(inaccordancewithPartIII,StandardConditions,SectionB,Paragraph3)totheDirectorthatthechangeshavebeenmade.

    9. SPPPImplementation.ThepermitteeshallimplementtheStormwaterPollutionPrevention

    PlanandallappropriateBMPstopreventcontaminantsfromenteringsurfacewatersviastormwater.ImplementationoftheSPPPshallincludedocumentationofallmonitoring,measurements,inspections,maintenanceactivities,andtrainingprovidedtoemployees,includingthelogofthesamplingdataandofactionstakentoimplementBMPsassociatedwiththeindustrialactivities,includingvehiclemaintenanceactivities.Suchdocumentationshallbekeptonsiteforaperiodoffive(5)yearsandmadeavailabletotheDirectorortheDirectorsauthorizedrepresentativeimmediatelyuponrequest.

    10. SolventManagementPlan.FacilitiesthatimplementaSolventManagementPlanmaysocertify,andtherequirementforTotalToxicOrganics(TTO)monitoringinPartII,SectionB.maybewaived.TheSolventManagementPlanshallinclude:

    (a) anannuallyupdatedandquantifiedinventoryofthetotaltoxicorganiccompounds

    presentonsiteduringthepreviousthreeyears;(b) anarrativedescriptionoftheinplantlocationsandusesofthetoxicorganic

    compounds,themethodofdisposalincludingquantitiesdisposedonandoffsite;(c) themanagementproceduresandengineeringmeasuresforassuringthattoxic

    organicsdonotspillorleakintostormwater.

    DWQmayatitsdiscretionrequiresubmittal,review,andapprovaloftheSolventManagementPlanasaconditionofcontinuingtheTTOsamplingwaiver.ForthosefacilitieselectingtoemploytheTTOsamplingwaiver,thepermitteeshallincludethefollowingsignedcertificationstatementoneachdischargemonitoringreport:"Baseduponmyinquiryofthepersonorpersonsdirectlyresponsibleformanagingcompliancewiththepermitmonitoringrequirementfortotaltoxicorganics(TTO),Icertifythattothebestofmyknowledgeandbelief,noleak,spill,ordumpingofconcentratedtoxicorganicsintothestormwaterorontoareaswhichareexposedtorainfallorstormwaterrunoffhasoccurredsincefilingthelastdischargemonitoringreport.IfurthercertifythatthisfacilityisimplementingalltheprovisionsoftheSolventManagementPlanincludedintheStormwaterPollutionPreventionPlan.

    SECTIONB:ANALYTICALMONITORINGREQUIREMENTSAnalyticalmonitoringofstormwaterdischargesshallbeperformedasspecifiedinTable1.Allanalyticalmonitoringshallbeperformedduringameasureablestormeventateachstormwaterdischargeoutfall(SDO).OnlySDOsdischargingstormwaterassociatedwithindustrialactivitymustbesampled(SeeDefinitions).Ameasurablestormeventisastormeventthatresultsinanactualdischargefromthepermittedsiteoutfall.Thepreviousmeasurablestormeventmusthavebeenatleast72hoursprior.The72hourstormintervaldoesnotapplyifthepermitteeisabletodocumentthatashorterintervalisrepresentativeforlocalstormeventsduringthesamplingperiod,andthepermitteeobtainsapprovalfromthelocalDWQRegionalOffice.SeeDefinitions.Table1 AnalyticalMonitoringRequirements

    IfthepermitteesqualitativemonitoringindicatesthatexistingstormwaterBMPsareineffective,orthatsignificantstormwatercontaminationispresent,thepermitteeshallinvestigatepotentialcauses,evaluatethefeasibilityofcorrectiveactions,andimplementthosecorrectiveactionswithin60days,pertheQualitativeMonitoringResponse,below.Awrittenrecordofthepermitteesinvestigation,evaluation,andresponseactionsshallbekeptintheSPPP.

    QualitativeMonitoringResponseQualitative monitoring is for the purposes of evaluating the effectiveness of the perjitteesimplenetaionoftheSPPP,andforassessingnewsourcesofstormwaterpollution,andforpromptingthe permittees response to pollution. If the permittee repeatedly fails to respond effectively tocorrectproblemsidentifiedbyqualitativemonitoring,orifthedischargecausesorcontributestoawaterqualitystandardviolation,DWQmaybutisnotlimitedto:

    PARTIIISTANDARDCONDITIONSFORNPDESSTORMWATERGENERALPERMITSSECTIONA:COMPLIANCEANDLIABILITY1. ComplianceSchedule

    ThepermitteeshallcomplywithLimitationsandControlsspecifiedforstormwaterdischargesinaccordancewiththefollowingschedule:

    ExistingFacilitiesalreadyoperatingbutapplyingforpermitcoverageforthefirsttime:TheStormwaterPollutionPreventionPlanshallbedevelopedandimplementedwithin12monthsoftheeffectivedateoftheCertificateofCoverageandupdatedthereafteronanannualbasis.Secondarycontainment,asspecifiedinPartII,SectionA,Paragraph2(b)ofthisgeneralpermit,shallbeaccomplishedwithin12monthsoftheeffectivedateoftheissuanceoftheCertificateofCoverage.NewFacilitiesapplyingforcoverageforthefirsttime:TheStormwaterPollutionPreventionPlanshallbedevelopedandimplementedpriortothebeginningofdischargesfromtheoperationoftheindustrialactivityandbeupdatedthereafteronanannualbasis.Secondarycontainment,asspecifiedinPartII,SectionA,Paragraph2(b)ofthisgeneralpermitshallbeaccomplishedpriortothebeginningofdischargesfromtheoperationoftheindustrialactivity.ExistingfacilitiespreviouslypermittedandapplyingforrenewalunderthisGeneralPermit:Allrequirements,conditions,limitations,andcontrolscontainedinthispermit(exceptnewSPPPelementsinthispermitrenewal)shallbecomeeffectiveimmediatelyuponissuanceoftheCertificateofCoverage.NewelementsoftheStormwaterPollutionPreventionPlanforthispermitrenewalshallbedevelopedandimplementedwithin6monthsoftheeffectivedateofthisgeneralpermitandupdatedthereafteronanannualbasis.Secondarycontainment,asspecifiedinPartIII,Paragraph2(b)ofthisgeneralpermitshallbeaccomplishedpriortothebeginningofdischargesfromtheoperationoftheindustrialactivity.

    2. DutytoComplyThepermitteemustcomplywithallconditionsofthisgeneralpermit.AnypermitnoncomplianceconstitutesaviolationoftheCleanWaterAct(CWA)andisgroundsforenforcementaction;forpermittermination,revocationandreissuance,ormodification;ordenialofapermituponrenewalapplication[40CFR122.41].

    a. Thepermitteeshallcomplywithstandardsorprohibitionsestablishedundersection307(a)of

    theCWAfortoxicpollutantswithinthetimeprovidedintheregulationsthatestablishthesestandardsorprohibitions,evenifthegeneralpermithasnotyetbeenmodifiedtoincorporatetherequirement.

    b. TheCWAprovidesthatanypersonwhoviolatessection[s]301,302,306,307,308,318or405oftheAct,oranypermitconditionorlimitationimplementinganysuchsectionsinapermitissuedundersection402,oranyrequirementimposedinapretreatmentprogramapprovedundersections402(a)(3)or402(b)(8)oftheAct,issubjecttoacivilpenaltynottoexceed$37,500perdayforeachviolation.[33USC1319(d)and40CFR122.41(a)(2)]

    oranypermitconditionorlimitationimplementinganyofsuchsectionsinapermitissuedundersection402oftheAct,andwhoknowsatthattimethathetherebyplacesanotherpersoninimminentdangerofdeathorseriousbodilyinjury,shall,uponconviction,besubjecttoafineofnotmorethan$250,000orimprisonmentofnotmorethan15years,orboth.Inthecaseofasecondorsubsequentconvictionforaknowingendangermentviolation,apersonshallbesubjecttoafineofnotmorethan$500,000orbyimprisonmentofnotmorethan30years,orboth.Anorganization,asdefinedinsection309(c)(3)(B)(iii)oftheCWA,shall,uponconvictionofviolatingtheimminentdangerprovision,besubjecttoafineofnotmorethan$1,000,000andcanbefinedupto$2,000,000forsecondorsubsequentconvictions.[40CFR122.41(a)(2)]

    3. DutytoMitigate

    Thepermitteeshalltakeallreasonablestepstominimizeorpreventanydischargeinviolationofthisgeneralpermitwhichhasareasonablelikelihoodofadverselyaffectinghumanhealthortheenvironment[40CFR122.41(d)].

    4. CivilandCriminalLiability

    ExceptasprovidedinPartIII,SectionCofthisgeneralpermitregardingbypassingofstormwatercontrolfacilities,nothinginthispermitshallbeconstruedtorelievethepermitteefromanyresponsibilities,liabilities,orpenaltiesfornoncompliancepursuanttoNCGSl432l5.3,l432l5.6,orSection309oftheFederalAct,33USC1319.Furthermore,thepermitteeisresponsibleforconsequentialdamages,suchasfishkills,eventhoughtheresponsibilityforeffectivecompliancemaybetemporarilysuspended.

    5. OilandHazardousSubstanceLiabilityNothinginthisgeneralpermitshallbeconstruedtoprecludetheinstitutionofanylegalactionorrelievethepermitteefromanyresponsibilities,liabilities,orpenaltiestowhichthepermitteeisormaybesubjecttounderNCGSl432l5.75etseq.orSection311oftheFederalAct,33USC1321.

    6. PropertyRightsTheissuanceofthisgeneralpermitdoesnotconveyanypropertyrightsineitherrealorpersonalproperty,oranyexclusiveprivileges,nordoesitauthorizeanyinjurytoprivatepropertyorany

    invasionofpersonalrights,noranyinfringementofFederal,Stateorlocallawsorregulations[40CFR122.41(g)].

    7. Severability

    Theprovisionsofthisgeneralpermitareseverable,andifanyprovisionofthisgeneralpermit,ortheapplicationofanyprovisionofthisgeneralpermittoanycircumstances,isheldinvalid,theapplicationofsuchprovisiontoothercircumstances,andtheremainderofthisgeneralpermit,shallnotbeaffectedthereby[NCGS150B23].

    8. DutytoProvideInformation

    ThepermitteeshallfurnishtothePermitIssuingAuthority,withinareasonabletime,anyinformationwhichthePermitIssuingAuthoritymayrequesttodeterminewhethercauseexistsformodifying,revokingandreissuing,orterminatingthegeneralpermitissuedpursuanttothisgeneralpermitortodeterminecompliancewiththisgeneralpermit.ThepermitteeshallalsofurnishtothePermitIssuingAuthorityuponrequest,copiesofrecordsrequiredtobekeptbythisgeneralpermit[40CFR122.41(h)].

    9. PenaltiesforTampering

    TheCleanWaterActprovidesthatanypersonwhofalsifies,tamperswith,orknowinglyrendersinaccurate,anymonitoringdeviceormethodrequiredtobemaintainedunderthisgeneralpermitshall,uponconviction,bepunishedbyafineofnotmorethan$l0,000perviolation,orbyimprisonmentfornotmorethantwoyearsperviolation,orbyboth.Ifaconvictionofapersonisforaviolationcommittedafterafirstconvictionofsuchpersonunderthisparagraph,punishmentisafineofnotmorethan$20,000perdayofviolation,orbyimprisonmentofnotmorethan4years,orboth[40CFR122.41].

    10.     thedischargesuchthatthedischargenolongerqualifiesforageneralpermit;c. Thedischargeviolatesthetermsorconditionsofthisgeneralpermit;d. Achangehasoccurredintheavailabilityofdemonstratedtechnologyorpracticesforthe

    controlorabatementofpollutantsapplicabletothepointsource;e. Effluentlimitationsarepromulgatedforthepointsourcescoveredbythisgeneralpermit;f. Awaterqualitymanagementplancontainingrequirementsapplicabletosuchpointsources

    isapprovedaftertheissuanceofthisgeneralpermit;g. TheDirectordeterminesathisorherowndiscretionthatanindividualpermitisrequired.

    4. WhenanIndividualPermitMaybeRequested

    Anypermitteeoperatingunderthisgeneralpermitmayrequesttobeexcludedfromthecoverageofthisgeneralpermitbyapplyingforanindividualpermit.Whenanindividualpermitisissuedtoanowner/operatortheapplicabilityofthisgeneralpermitisautomaticallyterminatedontheeffectivedateoftheindividualpermit.

    5. SignatoryRequirementsAllapplications,reports,orinformationsubmittedtothePermittingIssuingAuthorityshallbesignedandcertified[40CFR122.41(k)].

    a. AllNoticesofIntenttobecoveredunderthisgeneralpermitshallbesignedasfollows:

    TheissuanceofthisgeneralpermitdoesnotprohibitthePermitIssuingAuthorityfromreopeningandmodifyingthegeneralpermit,revokingandreissuingthegeneralpermit,orterminatingthegeneralpermitasallowedbythelaws,rules,andregulationscontainedinTitle40,CodeofFederalRegulations,Parts122and123;Title15AoftheNorthCarolinaAdministrativeCode,Subchapter2H.0100;andNorthCarolinaGeneralStatute143215.1etal.Afterpublicnoticeandopportunityforahearing,thegeneralpermitmaybeterminatedforcause.Thefilingofarequestforageneralpermitmodification,revocationandreissuance,orterminationdoesnotstayanygeneralpermitcondition.TheCertificateofCoverageshallexpirewhenthegeneralpermitisterminated.

    7. CertificateofCoverageActions

    Thegeneralpermitmaybemodified,revokedandreissued,orterminatedforcause.Thenotificationofplannedchangesoranticipatednoncompliancedoesnotstayanygeneralpermitcondition[40CFR122.41(f)].

AnnualAdministeringandComplianceMonitoringFeeRequirementsThepermitteemustpaytheadministeringandcompliancemonitoringfeewithin30(thirty)daysafterbeingbilledbytheDivision.Failuretopaythefeeintimelymannerinaccordancewith15ANCAC2H.0105(b)(2)maycausethisDivisiontoinitiateactiontorevokecoverageunderthegeneralpermit.

    SECTIONC:OPERATIONANDMAINTENANCEOFPOLLUTIONCONTROLS1. ProperOperationandMaintenance

    Thepermitteeshallatalltimesproperlyoperateandmaintainallfacilitiesandsystemsoftreatmentandcontrol(andrelatedappurtenances)whichareinstalledorusedbythepermitteetoachievecompliancewiththeconditionsofthispermit.Properoperationandmaintenancealsoincludesadequatelaboratorycontrolsandappropriatequalityassuranceprocedures.Thisprovisionrequirestheoperationofbackuporauxiliaryfacilitiesorsimilarsystemswhichareinstalledbyapermitteeonlywhentheoperationisnecessarytoachievecompliancewiththeconditionsofthispermit[40CFR122.41(e)].

    2. NeedtoHaltorReduceNotaDefense

    Itshallnotbeadefenseforapermitteeinanenforcementactionthatitwouldhavebeennecessarytohaltorreducethepermittedactivityinordertomaintaincompliancewiththeconditionofthisgeneralpermit[40CFR122.41(c)].

    3. BypassingofStormwaterControlFacilities

    BypassisprohibitedandtheDirectormaytakeenforcementactionagainstapermitteeforbypassunless:a. Bypasswasunavoidabletopreventlossoflife,personalinjuryorseverepropertydamage;andb. Therewerenofeasiblealternativestothebypass,suchastheuseofauxiliarycontrolfacilities,

    retentionofstormwaterormaintenanceduringnormalperiodsofequipmentdowntimeordryweather.Thisconditionisnotsatisfiedifadequatebackupcontrolsshouldhavebeeninstalledintheexerciseofreasonableengineeringjudgmenttopreventabypasswhichoccurredduringnormalperiodsofequipmentdowntimeorpreventivemaintenance;and

    c. Thepermitteesubmittednoticesasrequiredunder,PartIII,SectionEofthisgeneralpermit.

    IftheDirectordeterminesthatitwillmeetthethreeconditionslistedabove,theDirectormayapproveananticipatedbypassafterconsideringitsadverseeffects.

    SECTIOND:MONITORINGANDRECORDSl. RepresentativeSampling

    Samplescollectedandmeasurementstaken,asrequiredherein,shallbecharacteristicofthevolumeandnatureofthepermitteddischarge.Analyticalsamplingshallbeperformedduringameasureablestormevent.Samplesshallbetakenonadayandtimethatischaracteristicofthedischarge.Allsamplesshallbetakenbeforethedischargejoinsorisdilutedbyanyotherwastestream,bodyofwater,orsubstance.MonitoringpointsasspecifiedinthisgeneralpermitshallnotbechangedwithoutnotificationtoandapprovalofthePermitIssuingAuthority[40CFR122.41(j)].

    3. FlowMeasurements

    Whererequired,appropriateflowmeasurementdevicesandmethodsconsistentwithacceptedscientificpracticesshallbeselectedandusedtoensuretheaccuracyandreliabilityofmeasurementsofthevolumeofmonitoreddischarges.

    4. TestProcedures

    TestproceduresfortheanalysisofpollutantsshallconformtotheEMCregulationspublishedpursuanttoNCGSl432l5.63et.seq,theWaterandAirQualityReportingActs,andtoregulationspublishedpursuanttoSection304(g),33USC1314,oftheFederalWaterPollutionControlAct,asAmended,andRegulation40CFR136.Tomeettheintentofthemonitoringrequiredbythisgeneralpermit,alltestproceduresmustproduceminimumdetectionandreportinglevelsandalldatageneratedmustbereporteddowntotheminimumdetectionorlowerreportingleveloftheprocedure.Ifnoapprovedmethodsaredeterminedcapableofachievingminimumdetectionandreportinglevelsbelowgeneralpermitdischargerequirements,thenthemostsensitive(methodwiththelowestpossibledetectionandreportinglevel)approvedmethodmustbeused.

    5. RepresentativeOutfall

    Ifafacilityhasmultipledischargelocationswithsubstantiallyidenticalstormwaterdischargesthatarerequiredtobesampled,thepermitteemaypetitiontheDirectorforrepresentativeoutfallstatus.Ifitisestablishedthatthestormwaterdischargesaresubstantiallyidenticalandthepermitteeisgrantedrepresentativeoutfallstatus,thensamplingrequirementsmaybeperformedatareducednumberofoutfalls.

    6. RecordsRetentionQualitativemonitoringshallbedocumentedandrecordsmaintainedatthefacilityalongwiththeStormwaterPollutionPreventionPlan(SPPP).Copiesofanalyticalmonitoringresultsshallalsobemaintainedonsite.Thepermitteeshallretainrecordsofallmonitoringinformation,including

    o allcalibrationandmaintenancerecords,o alloriginalstripchartrecordingsforcontinuousmonitoringinstrumentation,o copiesofallreportsrequiredbythisgeneralpermit,o copiesofalldatausedtocompletetheNoticeofIntenttobecoveredbythisgeneralpermit.

    Theserecordsorcopiesshallbemaintainedforaperiodofatleast5yearsfromthedateofthesample,measurement,reportorNoticeofIntentapplication.ThisperiodmaybeextendedbyrequestoftheDirectoratanytime[40CFR122.41].Ifthisvolumeofrecordscannotbemaintainedonsite,thedocumentsmustbemadeavailabletoaninspectoruponrequestasimmediatelyaspossible.

    7. InspectionandEntry
