The Hartford is proud to be your go-to market for construction contractors. To offer contractors enhanced offerings, we’re pleased to provide a comprehensive new coverage. Called CPL, this product is designed to:

• Provide contractors pollution liability coverage for bodily injury, property damage and environmental damage

• Meet the needs of contractors that may have a pollution exposure – during the course of their covered operations and unknown pollution incidents associated with completed operations (see “Target Customers” on page 4)

• Close a coverage gap by providing five primary coverage options: – Coverage A: Construction Job Site Pollution – Coverage B: Pollution Emergency Mitigation Expense – Coverage C: Construction-Related Transportation Pollution – Coverage D: Non-Owned Disposal Site (NODS) Pollution – Coverage E: Pollution Legal Liability – Covered Owned

THE NEED FOR CPL COVERAGEContractors face many pollution risks stemming from operations at their job sites. These include contaminated soil exacerbation, accidental release of fuel oil, chemicals and toxic gas spills from broken pipelines/utilities, and leaks from stationary and mobile fuel tanks, microbial matter, legionella, silt and sediment runoff, asbestos and lead exposures. Most CGL policies contain an absolute pollution exclusion, leaving contractors to face an uninsured loss. Our CPL insurance helps protect contractors from a wide range of pollution risks associated with construction projects.

PROGRAM PARAMETERS• Covers bodily injury, property damage and

environmental damage that takes place during the policy period resulting from contractors covered operations and completed operations

• Self-insured retention (SIR) programs; starting at $5,000

• Limits up to $25 million

• Available countrywide and in Canada on a non-admitted basis

• CPL can be offered as a standalone coverage on a practice or project-specific basis

• Minimum premium of $10,000

FIVE PRIMARY COVERAGE OPTIONS• Coverage A: Construction Job Site Pollution – Covers

damages for bodily injury, property damage, environ-mental damage, natural resource damage and asso-ciated remediation costs that result from a pollution incident caused by covered or completed operations at a construction job site

• Coverage B: Pollution Emergency Mitigation Expense – Covers expenses to mitigate a pollution incident caused by covered operations at a construction job site

• Coverage C: Construction-Related Transportation Pollution – Covers damages for bodily injury, proper-ty damage, environmental damage, natural resource damage and associated remediation costs resulting from a pollution incident that takes place during the course of transportation to or from a covered owned location or a construction job site

• Coverage D: Non-Owned Disposal Site (NODS) Pol-lution – Covers damages for bodily injury, property damage, environmental damage, natural resource damage and associated remediation costs that result from a pollution incident on, at, under or migrating from a non-owned disposal site

• Coverage E: Pollution Legal Liability – Owned Site – Covers damages for bodily injury, property damage, environmental damage, natural resource damage and associated remediation costs that result from a pollution incident which begins and ends within 10 days and is on, at, under or migrating from a covered owned location

SUPPLEMENTAL COVERAGESOur CPL coverage also offers optional supplemental coverages that give contractors the freedom to tailor the coverage they need. These include:

• Litigation Attendance Expense: Reimburses loss of earnings and expenses incurred while attending a hearing, deposition or trial

• Subpoena Expense: Covers the retention of counsel and associated expenses incurred to respond to a subpoena including expenses related to production of documents and giving testimony

• Corporate Reputation Rehabilitation Expense: Reimburses expenses charged by a public relations firm to restore an insured’s corporate reputation
