Chronology of communications with SECL w.r.t. use of ash in backfilling of mines
S.No Date Details Remarks
1. 31.03.2015 JSPL letter to SECL to continue backfilling of Gare
Pelma IV/1 using ash from DCPP
-
2. 02.04.2015 Reply from SECL stating that flyash filling will not be possible
-
3. 24.04.2015 JSPL/ JPL letters to MoEF requesting to allow continuation of use of ash in backfilling of mines pursuant to requests of SECL to exempt them from use of ash
-
4. 13.05.2015 Letters to MoEF requesting to withdraw “exemption of backfilling using ash” granted to SECL for Gare Pelma IV/1 and Gare Pelma IV/2 & IV/3
Exemption to SECL was granted by MoEF&CC vide letter dated 16.04.2015
5. 11.08.2015 Request letter to SECL to use ash from TPP of JPL to
back fill Gare Palma IV/2 & IV/3 Coal mines
-
6. 27.11.2015 Letter to MoEF requesting to permit continuation of use of ash for backfilling of Gare Pelma IV/1
-
7. 09.12.2015 JPL request letter to SECL reiterating to use ash
from the TPP of JPL to back fill Gare Palma IV/2 &
IV/3 Coal mines
-
8. 18.12.2015 Reply from SECL intimating that since litigation
w.r.t. Gare Pelma IV/2 & IV/3 is in process and
hearing of Writ Petitions W.P.(C) 3001/2015 &
W.P.(C) 3002/2015 have been concluded and
judgement reserved, SECL shall wait for the
judgement for any further decision
As long as SECL is a custodian
it is mandatory on the part of
SECL to comply with the
provision of Ash Utilization
notification while
undertaking back filling of
mine
9. 30.07.2016 JPL’s letter to Chief Secretary, Chhattisgarh with a
request to direct SECL to use ash from JPL’s TPPP
while undertaking back filling in Gare Palma IV2 &
IV/3
-
10. 20.08.2016 JPL’s request to CMD, SECL, Bilaspur to use the ash
generated from JPL’s TPP in backfilling of the Gare
Palma IV2 & IV/3 coal mine.
-
11. 17.09.2016 Reply, in relation to Gare IV/2 & IV/3, from SECL
intimating that following points to be considered
before taking decision on the aforesaid subject:
The issues are irrelevant and
SECL cannot run away from
its responsibility to comply
SECL is only custodian of the mine
The matter is subjudice
Unavailability of Overburden
Dual responsibility of operation
Modified EC does not stipulate fly ash backfilling
with the Ash Utilization
Notification
12. 16.10.2016 JPL reply, w.r.t. backfilling in Gare Pelma IV/2 &
IV/3, to SECL that the concern raised are irrelevant
and not in line with the Ash Utilization Notification
-
13. 26.10.2016 JPL letter to Chairman & Member Secretary
Chhattisgarh Environment Conservation Board
Raipur and Joint Secretary ( HSMD) MoEF New Delhi
with a request to direct SECL to use fly ash in line
with Ash utilisation ,1999 ( as amended up to 2016 )
of MoEF from JPL’s TPPP while undertaking back
filling in Gare Palma IV2 & IV/3

*NOx calculations during EIA were done as per World Bank norms of 400 mg/Nm3 for Phase I
and 9kg/ ton of coal for Phase II. The proposed NOx calculations have been estimated
considering new standards for Thermal Power Plant of 300 mg/ Nm3.
#The above estimated emissions after proposed change of fuel is theoretical and the actual
emissions will be much less as evident from the existing emissions below.
