1. Introduction

In 2016, Juwi Renewable Energies (Pty) Ltd applied for environmental authorisation in terms of

the National Environmental Management Act (No. 107 of 1998) Environmental Impact

Assessment (EIA) Regulations (2010) for construction and operation of the 132kV Overhead

Transmission Line Option 3 (Cuprum) for the Kronos Photovoltaic Development on Nelspoortje

Farm 103 Portion 6, Humansrus Farm 147 Portion 0 and Vogelstruisbult Farm 104 Portion 1 near

Copperton within the Siyathemba Local Municipality in the Northern Cape Province. The project

involves the construction of approximately 12.8km double circuit 132 kV overhead transmission

lines inside a 200m wide assessed corridor between the proposed Kronos Solar Park central

substation and Eskom's Cuprum Substation, and includes the following components:

• self-supporting or suspension pylons (≤60 pylons at 250m intervals) to support each

132 kV line; and

• access and maintenance tracks (gravel) along the transmission line route.

The Department of Environmental Affairs (DEA) issued an Environmental Authorisation (EA) in

terms of the 2010 EIA Regulations for the project on 9 May 2016 to juwi Renewable Energies

(Pty) Ltd.

The Environmental Management Programme (EMPr) submitted with the application for

environmental authorisation for the project was not approved by DEA in the EA dated 9 May 2016,

and the amended EMPr has not yet been submitted to DEA for approval (in terms of Condition 14

of the EA). Furthermore, the authorised activities have not commenced to date.

An amendment to this EA was issued on 4 July 2016 for the correction of a typographical error

within the project description.

Holland and Associates Environmental Consultants have been appointed by Juwi Renewable

Energies (Pty) Ltd to conduct an independent environmental audit of the above in terms of

Regulation 54A(3) of the NEMA EIA Regulations, 2014 (as amended).

2. Audit Requirement

The primary audit requirement arises as a result of an obligation imposed in terms of the NEMA

EIA Regulations, 2014, as amended. In particular, Regulation 54A(3) of the aforementioned

Regulations states:

“Where an environmental authorisation issued in terms of the ECA regulations or the previous

NEMA regulations is still in effect by 8 December 2014, the EMPr associated with such

environmental authorisation is subject to the requirements contained in Part 3 of Chapter 5 of

these Regulations and the first environmental audit report must be submitted to the competent

authority no later than 7 December 2019 and at least every 5 years thereafter for the period during

which such environmental authorisation is still in effect.”

Part 3 of Chapter 5, Section 34 states:

“(1) The holder of an environmental authorisation must, for the period during which the

environmental authorisation and EMPr [Environmental Management Programme], and where

applicable the closure plan, remain valid—

(a) ensure that the compliance with the conditions of the environmental authorisation and the

EMPr, and where applicable the closure plan, is audited; and

(b) submit an environmental audit report to the relevant competent authority.”

In addition, the EIA Regulations (2014), as amended, require that the environmental audit report

must be prepared by an independent person with the relevant environmental auditing expertise;

and comply with Appendix 7 of the EIA Regulations (GN No. R.982, as amended), which sets out

the content requirements for environmental audit reports.

In other words, all holders of Records of Decision or Environmental Authorisations (for Records

of Decision and/or Environmental Authorisations issued in terms of the previous NEMA EIA

Regulations) are required to conduct regular independent environmental audits on the conditions

of authorisation of the Environmental Authorisation and EMPr, and the content of the audit reports

must meet the requirements of Appendix 7 of Regulations (GN No. R.982, as amended), The first

audit report must be submitted to the competent authority before the 7th December 2019.

3. Audit Methodology

The key tasks conducted for this independent audit included the following:

• Review of the statutory requirements for the Audit Process as set out in Section 34 and

Appendix 7 of the 2014 NEMA EIA Regulations (as amended);

• Review of all applicable reports, permits and authorisations, including the EA and EA

amendments;

• Compilation of an environmental audit checklist against which to measure compliance;

• Review all applicable documentary records of compliance as provided by the holder of the

EA;

• Compilation of an audit report which meets the objectives and content requirements

outlined in Appendix 7 of the 2014 NEMA EIA Regulations (as amended), including

reporting on compliance with the conditions of the EA and EMPr (if approved) and

identifies gaps in terms of alignment with conditions and provides recommendations to

address gaps or non- compliance.

4. Assumptions and Limitations

The assumption is made that the information received from the holder of the EA on which this audit

report is based (specialist and project information, as well as information about the holder of the

EA) is accurate and correct.

5. Details and Expertise of the Authors

Ross Holland

Qualifications: BSc Environmental and Geographical Science and Economics; BSc (Hons) Environmental and Geographical Science; MSc Environmental and Geographical Science; The Framework Program for Education & Training in Water. Certificates of competence held with distinction, in “Water Quality” and “Aquatic Ecology”

Experience in years: 16 years

Experience: Ross Holland is the founder of Holland & Associates Environmental Consultants. Ross is a founder member of the Environmental Assessment Practitioners of South Africa (EAPASA), a Green Star SA Accredited Professional, and is a member of the South African affiliate of the International Association for Impact Assessment (IAIAsa).

Ross has extensive environmental auditing and environmental assessment experience, and has been involved in over 120 environmental processes, including water supply dams, housing, resort, and commercial developments, renewable energy facilities, new roads and road upgrades, pipelines, a municipal waste site, and a shooting range. Ross has also undertaken the independent review of a number of Scoping and Environmental Impact Reports and NEMA S24G applications.

For the past 11 years Ross has been involved as a contributing lecturer to a number of academic courses in Environmental Management. In particular, Ross is a contributor to the UWC Geography Departments postgraduate (honors) module on Environmental Management and also contributes annually to the Environmental Management Module which is presented to postgraduate students enrolled in the Masters of City and Regional Planning Degree, at UCT.

Ross has also been involved in a wide spectrum of other environmental work including the undertaking of capacity building within the National Department of Environmental Affairs’ Marine and Coastal Management Directorate (now known as DEA Oceans and Coasts), the undertaking of environmental opportunity and constraints analysis, environmental due diligence investigations and risk analysis, as well as, drafting of numerous Environmental Management Plans/ Programs (EMPr) and Environmental Control Officer (ECO) work.

Kelli Ross

Qualifications: BSc Environmental Management (Zoology & Geography) and BSc (Hons) Marine Biology

Experience in years: 2 years

Experience: Kelli Ross is a member of the South African affiliate of the International Association for Impact Assessment (IAIAsa).

Kelli’s academic background has equipped her with valuable knowledge on environmental sustainability and management as well as the ability to understand ecological processes and apply these to environmental issues.

Kelli has assisted in the compilation of Basic Assessment Reports and Environmental Impact Assessments within the agricultural sector, Conservation of Agricultural Resources Act (CARA) application processes and the development of Environmental Management Plans/ Programmes (EMP). Kelli has also been involved with various amendment applications, for the amendment of environmental authorisations for renewable energy projects. For the past 2 years Kelli has also assisted in environmental due diligence investigations as well as Environmental Control Officer (ECO) work on agricultural and urban projects.

14. The Environmental Management Programme (EMPr) submitted as part of the Basic Assessment Report (BAR) is not approved and must be amended to include measures as dictated by the final site lay-out map and micro-siting, and the provisions of this environmental authorisation. 7. Conclusions and Recommendations

An independent audit has been conducted for this project which meets the requirements of

and Section 54A(3) of Regulation 982 of the 2014 EIA Regulations, as amended. The only

non-compliance identified relates to an administrative error in the notification of the decision

and the right to appeal. The letter of notification to I&AP’s as well as the published notice,

notifying I&AP’s of the decision incorrectly notes that the EA was issued on 5 May 2016, when

in fact the EA is dated 9 May 2016. It is noted that the effect of the incorrectly noted EA date,

was to foreshorten the specified deadline for the submission of the Notice of Intent to Appeal,

which was calculated from the incorrect, earlier, date. In the Auditors opinion, this

administrative error was not materially prejudicial to I&AP’s, since any I&AP who was intent

on lodging a Notice of Intent to Appeal, would have been able to access the actual EA decision

and would have been entitled to lodge a notice of a Notice of Intent to Appeal, within 20 days

of the de facto decision date. Furthermore, in the Auditors understanding, any I&AP, who on

becoming aware of the error, had reason to believe that they had been prejudiced, would have

been entitled to apply to the Minister for condonation of a late appeal, which request is likely

to have been granted in the circumstances. It is noted that according to the Holder of the EA,

no appeals were lodged. No corrective action for the above has therefore recommended.

Since no approved Environmental Management Programme (EMPr) exists for the authorised

project, it is not possible to evaluate the effectiveness thereof, or provide any

recommendations. Once an amended EMPr is approved by the Department, the following

Audit will address these aspects.

(approximately 50km southwest of Prieska). The EA’s are issued in terms of Regulation 45 of the 2010

Environmental Impact Assessment (EIA) Regulations (Government Notice (GN) No. R544, R.545 and

R.546 of 18 June 2010) of the National Environmental Management Act (Act No. 107 of 1998) (NEMA).

The EA outlines the conditions of authorisation, reasons for the authorisation, recommendations, and

Ross holds a BSc in Environmental and Geographical Science and Economics (UCT), a BSc (hons) in Environmental and Geographical Science (UCT) and an MSc in Environmental and Geographical Science (UCT). Ross also holds certificates of competence in the fields of Water Quality and Fresh Water Ecology, with distinction. Ross has also undertaken the independent review of a number of Environmental Assessment Processes, across a diverse range of projects.

For the past 11 years Ross has been involved as a contributing lecturer to a number of academic courses in Environmental Management. In particular, Ross is a contributor to the UWC Geography Departments postgraduate (honors) module on Environmental Management and also contributes annually to the Environmental Management Module which is presented to postgraduate students enrolled in the Masters of City and Regional Planning Degree, at UCT.

Ross has also been involved in a wide spectrum of other environmental work including the undertaking of capacity building within the National Department of Environmental Affairs’ Marine and Coastal Management Directorate, the undertaking of environmental opportunity and constraints analysis, environmental due diligence investigations and risk analysis, as well as, environmental auditing, drafting of Environmental Management Plans/ Programs (EMPr) and Environmental Control Officer (ECO) work.

2017 Environmental Risk Advisor

Environmental Risk and Compliance Advice to Nine Chromated Copper Arsenic (CCA) Timber Treatment Facilities and a Creosote Plant, situated across the Provinces of Mpumalanga and KwaZulu Natal. Appointed by a prominent chemical manufacturer to provide environmental compliance and risk management advice to a number of their premier clients in the timber treatment industry. Tasks and responsibilities involved undertaking detailed inspections of each plant in order to gain a thorough understanding of any shortcomings in facility design or operational procedure, that could give rise to avoidable risks of environmental contamination and pollution. Tasks included an analysis of Environmental Authorization Conditions, for those plants that had been constructed post the advent of South African EIA legislation, as well as an analysis of the each plants obligations and potential vulnerabilities when viewed against (inter alia) the Duty of Care obligations imposed under S28 of NEMA, as well as the pollution prevention provisions under S19 of the National Water Act. Furthermore, each plant was analyzed against the Environmental Best Practice requirements for Timber Treatment facilities, as set out within SANS10255. The culmination of the project was the compilation of an environmental compliance and risk advice report for internal use, for each facility, which outlined the identified vulnerabilities, and set out recommendations and priorities to address these.
