About Us

Dale is a second generation Las Vegan and his son Tripp is third generation. In 2001, Dale graduated from the University of Nevada, Las Vegas with a Bachelor of Arts in Psychology. In 2004, he received his Juris Doctor Degree, graduating in the top third of his class, from the William S. Boyd School of Law.

While at Boyd, Dale defended juveniles accused of crimes as a student attorney of the Thomas & Mack Legal Clinic. Dale was involved in various criminal defenses ranging from drug possession to grand theft. Prior to forming The Hayes Law Firm, Dale served as a Judicial extern to Judge and Former District Attorney Stewart L. Bell. Dale spent his first five+ years in practice at one of Nevada’s most prestigious law firms.

Domestic Violence ArrestsNevada law requires a police officer to make an arrest, “unless mitigating circumstances exist,” where the police officer has probable cause to believe that that the person to be arrested has committed a domestic violence (battery) within the preceding 24 hours. This law requires police officers to make an arrest(s) during domestic violence investigations, even where the victim is resistant to the aggressor’s arrest and/or the situation has quieted.

Black’s Law Dictionary defines “domestic violence” as “violence between members of a household.” 

Domestic violence laws synthesize various areas of criminal law into one category.  This category of prohibited acts focuses on the relationship between the aggressor and the victim.

Domestic Violence Penalties

Nevada Domestic Violence penalties are based on a minimum-maximum system and become more severe based on the nature of your Domestic Violence offense.  

For instance, the penalties for your first Nevada Domestic Violence offense are not as severe as the penalties you would face for a second or third Domestic Violence offense.

Collateral Consequences of a DV ConvictionFamily courts are required to hold an penitentiary hearing where the person seeking custody is alleged to have committed an act of domestic violence “against the child, a parent of the child or any other person residing with the child.” 

If the Family Court determines that an act of domestic violence has been committed, this “Creates a rebut table presumption that sole or joint custody of the child by the perpetrator of the domestic violence is not in the best interest of the child.”
