DIVING PLONGEON CANADA POLICY RELATING TO CONDUCT DPC is committed to providing a sport environment that reflects DPC’s values of community, personal development, sportsmanship and excellence. Registration in DPC, and participation in its activities, brings with it many benefits and privileges that are balanced by the responsibilities and obligations of its Registrants and Participants. This policy defines the parameters for these responsibilities and obligations, and thus identifies a standard for behaviour that is expected of all Registrants and Participants. This policy also identifies procedures to be followed when this standard is not achieved. Compliance with this policy, as with all rules in a civil and democratic society, depends primarily upon understanding and voluntary compliance; secondarily upon reinforcement by peers and others; and, when necessary, upon enforcement through disciplinary proceedings. 1. Definitions (a) “DPC” means Diving Plongeon Canada. (b) “Members” shall have the meaning as set out in Article 3 of the Diving Plongeon Canada By-Laws. (c) “Participant” means a Registrant as well as a DPC director, officer, team manager, team medical personnel, staff, contractor and any other individual who participates in DPC programs, activities and events, including a parent/guardian of any athlete. (d) “Registrant” means any individual who is engaged in activities that are provided, sponsored, supported, sanctioned or recognized by the DPC or its Members. Registrants include, but are not limited to, recreational and competitive divers, members of national teams, coaches, officials, administrators and volunteers who serve on executives, committees and boards of directors of diving clubs. Registrants may pay a program fee for services rendered but the payment of such fee does not make the Registrant a Member of DPC. (e) Any reference to gender includes all gender and the plural includes the singular and vice versa, as the context requires. 2. Application of this Policy (a) This policy applies to all Participants as defined above. For further clarity, this policy applies to the conduct of Participants while engaged in programs, activities and events convened under the jurisdiction of DPC. This policy does not apply to the conduct of individuals at programs, activities and events convened under the jurisdiction of other entities, including diving clubs and provincial sections.

DPCiscommittedtoprovidingasportenvironmentthatreflectsDPC’svaluesofcommunity,personaldevelopment,sportsmanshipandexcellence.RegistrationinDPC,andparticipationinitsactivities,bringswithitmanybenefitsandprivilegesthatarebalancedbytheresponsibilitiesandobligationsofitsRegistrantsandParticipants.Thispolicydefinestheparametersfortheseresponsibilitiesandobligations,andthusidentifiesastandardforbehaviourthatisexpectedofallRegistrantsandParticipants.Thispolicyalsoidentifiesprocedurestobefollowedwhenthisstandardisnotachieved.Compliancewiththispolicy,aswithallrulesinacivilanddemocraticsociety,dependsprimarilyuponunderstandingandvoluntarycompliance;secondarilyuponreinforcementbypeersandothers;and,whennecessary,uponenforcementthroughdisciplinaryproceedings.1. 2. ApplicationofthisPolicy

(a) This policy applies to all Participants as defined above. For further clarity, this policyappliestotheconductofParticipantswhileengagedinprograms,activitiesandeventsconvened under the jurisdiction of DPC. This policy does not apply to the conduct ofindividualsatprograms,activitiesandeventsconvenedunder the jurisdictionofotherentities,includingdivingclubsandprovincialsections.

(b) DPC encourages provincial sections and diving clubs to adopt policies consistentwiththis policy, so that they may establish standards and procedures to govern conductwithintheirownjurisdiction.

(c) Notwithstandingsection(a),anyindividual,provincialsectionorclubmayrequestthatDPCconsiderapplyingthispolicytoaprovincialorlocalmatterthatwouldotherwisebeoutsidethejurisdictionofDPC.

(d) Upon receipt of such request or in such other circumstances as DPC, in its solediscretion,considersnecessaryandappropriate,DPCmayinterveneinanymatterwhichitdeemstobeofnationalorsport-wideimportance,detrimentaltothesportofdivingin Canada or the reputation of DPC, or harmful to the physical,mental or emotionalhealth and safety of Participants. Upon making such determination, DPC shall beentitledtoundertakesuchinvestigationofthesurroundingcircumstancesasDPC,initssolediscretion,deemsnecessaryoradvisable.After reviewing the resultsofanysuchinvestigation, DPC shall have the right, but not the obligation, to make a complaintwhich shall be governed by the terms of this Policy. Any decisions made by DPCpursuanttothissectionarewithinDPC’ssolediscretionandarenotappealable.

3. ExpectedStandardofConduct

(a) All Participants are expected to reflect DPC’s values of community, personaldevelopment,sportsmanshipandexcellence.

(b) AssuchallParticipantswill:

(i) Demonstrate through words and actions the spirit of sportsmanship, sportsleadershipandethicalconduct;

(ii) Treatotherswith respectand refrain fromnegativeordisparaging remarksorconduct;

(iii) Notknowinglyplacethemselves inasituationthatcouldgiverise toaconflictbetweenpersonalinterestsandtheinterestsofDPC1;

(iv) Avoidthenon-medicaluseofdrugsortheuseofperformance-enhancingdrugsormethods;

(v) Refrain fromanybehaviour that constitutesharassment,whereharassment isdefinedascommentorconductdirectedtowardsanindividualorgroup,whichisoffensive,abusive,racist,sexist,degradingormalicious;

(vi) Refrain from any behaviour that constitutes sexualmisconduct, where sexualmisconduct is defined as (i) the use of power or authority in an attempt tocoerceanotherpersontoengageinortoleratesexualactivity,includingexplicitor implicit threats of reprisals for non-compliance or promises of reward forcompliance, or (ii) engaging in deliberate or repeated unsolicited sexually-oriented comments, anecdotes, gestures or touching that are offensive orunwelcome, that create an offensive, hostile or intimidating environment, orthat can reasonably be expected to be harmful to the recipient or toteammates;and

(vii) Complyatall timeswiththebylaws,policies,andrulesandregulationsofDPCandFINA,asadoptedandamendedfromtimetotime,includingcomplyingwithanycontractsoragreementsexecutedwithorbyDPC.

(c) Athletes,coachesandofficialshaveadditionalresponsibilities.

(i) Coacheswill:

A. Consistently display high personal and professional standards andprojectapositiveimageofthesportandofcoaching;

B. Ensure a safe training environment by selecting activities andestablishing controls that are suitable for the age, experience, abilityandfitnesslevelofathletes;

C. Activelyassistinsustainingthepresentandfuturehealthofathletesbycommunicatingandcooperatingwithregisteredmedicalpractitionersinthe diagnosis, treatment and management of injuries and otherassociatedhealthorfitnessproblems;

D. Educate athletes about the dangers of drugs and performance-enhancingsubstances;

E. Accept and promote athletes’ personal goals and, as need andopportunity arises, refer athletes to other coaches and sportsspecialists;

F. In the case of minors, communicate and cooperate with theparents/guardians of athletes and involve them to an appropriatedegreeindecisionspertainingtotheathlete’sdevelopment;

G. Considertheacademicpressureplacedonstudent-athletesandrespecttheimportanceofacademicsuccess;

H. AdheretoDPCandFINArulesregardingclothingandlogos;and

I. Avoidanybehaviour thatabuses thepower imbalance inherent in thecoachingpositionto(i)establishormaintainasexualrelationshipwithan athlete that he or she is coaching, or (ii) encourage inappropriatephysical or emotional intimacy with an athlete, regardless of theathlete’sage.

(ii) AthleteswhohavebeenselectedtoateamofDPCwill:

A. Report any health- or fitness-related problems in a timely fashion,where such problems may limit the athlete’s ability to travel, train,competeor, inthecaseofcardedathletes, interferewiththeathlete’sabilitytofulfillrequirementsundertheAthleteAssistanceProgram;

B. Participateinallcompetitions,events,activitiesorprojectstowhichtheathletehasmadeacommitment;and

C. AdheretoDPCandFINArulesregardingclothingandlogos.

(iii) Officialswill:

A. Conduct all events according to the rules of DPC and FINA, with theintegrityofthesportandeachathlete’sperformanceinmind;

B. Workincooperationwithotherofficials;

C. Assistlessexperiencedcolleagues;and

D. Refrainfrompubliccriticismofotherofficials.

4. TypesofInfractions

(a) FailurebyaParticipanttoachievetheexpectedstandardssetoutabovemayresult inan infraction and the imposition of discipline. Infractions are divided into two types,minorinfractionsandmajorinfractions,whicharedealtwithusingdifferentprocedures.

(b) Minor infractionsare incidentsoffailingtoachievetheexpectedstandardsofconductthatgenerallydonotresultinharmtoothers.Examplesofminorinfractionsinclude,butarenotlimitedto:

(i) Single instances of disrespectful comments or behaviour directed towardsothers;

(ii) Singleinstancesofunsportsmanlikeconduct;

(iii) Being late fororabsent fromDPCeventsandactivitiesatwhichattendance isexpectedorrequired;and

(iv) Singleinstancesofnon-compliancewiththepoliciesandrulesofDPCorFINA.

(c) All disciplinary situations involving minor infractions will be dealt with by theappropriate person having authority over the Participant involved. This person mayinclude,but isnot restricted to,acoach,meetoreventofficial, teammanager,Boardmember,orseniorstaffmember.

(d) Major infractionsareinstancesoffailingtoachievetheexpectedstandardsofconductthatresult,orhavethepotential toresult, inharmtootherpersons, toDPCortothesportofdiving.Examplesofmajorinfractionsinclude,butarenotlimitedto:

(i) Repeatedminorinfractions;

(ii) Activitiesorbehavioursthatinterferewithacompetitionorwithanyathleteorcoach’spreparationforacompetition;

(iii) Pranks,jokesorotheractivitiesthatendangerthesafetyofothers;

(iv) DeliberatedisregardforthepoliciesandrulesofDPCorFINA;

(v) Conductthatintentionallydamagestheimage,credibilityorreputationofDPC,includingenteringintoaconflictofinterest;

(vi) Behaviourthatconstitutesharassmentorsexualmisconduct;and

(vii) Abusive use of alcohol, any use of alcohol by minors, use of illicit drugs andnarcotics, or use of banned performance-enhancing drugs or methods, otherthanformedicalconditions.

(e) Major infractionswill be reviewed and dealt with in accordancewith the disciplinaryproceduressetoutinthispolicy.

(f) Major infractionsthatoccurwithincompetitionmaybedealtwith immediatelybytheappropriatepersonhavingauthority,suchasanofficial,coach,teammanager,orseniorstaff person. In such situations, disciplinary sanctions will be for the duration of thecompetitiononly.Furthersanctionsmaybeapplied,butonlyafterreviewofthematterusingthedisciplinaryproceduressetoutinthispolicy.

5. ReportinganInfraction

(a) Any individual may report to an “Official” of DPC a complaint of an infraction. Suchcomplaintmustbeinwritingandmustbemadeinatimelymanner.ForthepurposesofthisSection,an“Official”isanypersoninaresponsiblestafforvolunteerpositionwithinDPCoraProvincialSection.

(b) Upon receiving a complaint, the Official will provide it immediately to the ChiefOperatingOfficer (COO)ofDPC. If theCOO isnotavailableornotable to receive thecomplaint,thecomplaintmaybeprovidedtotheChiefTechnicalOfficer(CTO)ortoanyBoardmember.

(c) Uponreceivingacomplaintofamajorinfraction,theCOO(ordesignate)willreviewthecomplaintandmay:

(i) Dismiss the complaint if he or she considers it to be trivial, vexatious oruntimely;

(ii) Determinethatthecomplaintdoesnotfallwithinthejurisdictionofthispolicy,andreferittotheappropriatebodyhavingjurisdiction;

(iii) Directthatthecomplaintbedealtwithinformallyasaminorinfraction;or

(iv) Refer the matter to a Discipline Committee to be established pursuant tosection6hereof.

6. DisciplinaryProcedures

(a) Upon referral of amajor infraction to a Discipline Committee pursuant to subsection5(c)(iv)hereof,aDisciplineCommitteeshallbeestablishedasfollows:

(i) TheDisciplineCommitteeshallbean independenttribunalcomprisedof threepersons,establishedsolelyforthepurposeofadjudicatingthemajorinfractionsbroughtbeforeitpursuanttothisConductPolicy;

(ii) ForpurposesofestablishingaDisciplineCommitteefromtimetotime,DPCshallmaintainaroster(the“Roster”)ofindividualswhohavebeennominatedbyitsProvincial Section Members and who are prepared to sit on a DisciplineCommitteeandtoadjudicatecomplaintsofmajorinfractionsfromtimetotime;

(iii) OnememberoftheDisciplineCommitteeshallbeselectedfromtheRosterbythepersonmakingthecomplaint(the“Complainant”);

(iv) OnememberoftheDisciplineCommitteeshallbeselectedfromtheRosterbythepersonwhothecomplaintismadeagainst(the“Defendant”);

(v) ThethirdmemberoftheDisciplineCommitteeshallbeanindividualselectedbyagreement of the two Discipline Committee members selected by theComplainantandtheDefendant;

(vi) The thirdmember of theDiscipline Committeemay, but does not necessarilyneedtobeanindividualontheRoster,providedthatifthethirdmemberoftheDisciplineCommittee isnotapersonon theRoster, thecost, if any,ofhavingsuch person sit on the Discipline Committee shall be shared equally by theComplainantandtheDefendant;

(b) TheDisciplineCommitteeshallhaveoverallresponsibilitytoensureproceduralfairnessisrespectedatalltimesduringthedisciplinaryprocess,andtocarryoutthisprocessinatimelymanner.

(c) TheDisciplineCommitteewilldetermine the formatof thedisciplinaryprocess,whichmay involve written submissions, an oral hearing in person, an oral hearing bytelephone,ahearingbasedonwrittensubmissionsoracombinationofthesemethods.

(d) TheDisciplineCommittee shall have the right to suspendaDefendantpendinga finaldecision,where it determines that thealleged infraction is of such seriousness that itwarrantsthesuspensionoftheDefendant,pendinginvestigation,hearingandthefinaldecisionoftheDisciplineCommittee.

(e) TheDefendant:

(i) willbegivenreasonablenoticeoftheformat,aswellas(inthecaseofanoralhearing in person or oral hearing by telephone) day, time and place of thehearing;

(ii) will receive a copy of the Investigation Report if an investigation was carriedout;

(iii) maybeaccompaniedbyarepresentative;and

(iv) will have the right to present evidence and argument before the DisciplineCommittee.

(f) Afterhearingthematter,theDisciplineCommitteewillreachadecisionastowhetheran infraction has occurred and if it has, what the sanction should be. The DisciplineCommittee will issue a written decision, including reasons, for distribution to theDefendant,theComplainantandtheCOO.

(g) Wheretheconductbeingreviewedbythispolicyisofasensitivenature,theDisciplineCommittee and DPC will keep all proceedings under the policy confidential, except:wherepublicationis:

(i) orderedaspartofthesanction;

(ii) stipulatedbytheCanadianAnti-DopingProgram;

(iii) requestedbySportCanada;

(iv) requiredbylaw;or

(v) inthebestinterestsofthepublic.

(h) Infulfillingitsduties,andwiththeapprovaloftheCOOpriortoanycostsbeingincurred,theDisciplineCommitteemayobtainindependentadvice.

7. DisciplinarySanctions

(a) Thefollowingisanon-exhaustivelistofexamplesofdisciplinarysanctionsthatmaybeapplied,singlyorincombination,whereitisfoundthataninfractionhasoccurred:

(i) Verbalorwrittenreprimand;

(ii) Requestforverbalorwrittenapology;

(iii) ServiceorothervoluntarycontributiontoDPC;

(iv) Removalofcertainprivilegesofregistrationoremploymentassociatedwith,orfullterminationofregistrationoremploymentwithDPC;

(v) Suspension from certain DPC activities such as competing, coaching orofficiatingforadesignatedperiodoftime;

(vi) Publicationofthedisciplinarysanction;

(vii) RemovalofDPCorSportCanadafunding;

(viii) SuspensionfromallDPCactivitiesforadesignatedperiodoftime;or

(ix) ExpulsionfromDPC.

(b) It is understood that the above are representative penalties only, that they may bemodified to fit the circumstances of the infraction, and that they are presentedgenerallyinorderofseverity.

8. CriminalConvictions

(a) AParticipant’sconviction,atanytime, foranyof thefollowingCriminalCodeoffenseswill be deemed an infraction under this policy andwill result in immediate expulsionfromDPC,withouttheneedforfurtheractiononthepartofDPCandremovalfromDPCprograms,activitiesandevents:

(i) Any offense involving trafficking of illegal drugs or substances listed on theCanadianAnti-DopingProgram’sProhibitedList;

(ii) Anyoffenseinvolvingchildpornography;

(iii) Anysexualoffenceinvolvingaminor;

(iv) Anyoffenceofassaultinvolvingaminor;or

(v) Anyoffenceofphysicalorpsychologicalviolenceinvolvingaminor.

(b) AParticipant’sconviction,atanytime, foranyof thefollowingCriminalCodeoffensesmaybedeemedaninfractionunderthispolicyasdeterminedbytheboardofdirectorsandwillresultinimmediateexpulsionfromDPC,withouttheneedforfurtheractiononthepartofDPCandremovalfromDPCprograms,activitiesandevents:

(i) Anysexualoffenseotherthaninvolvingaminor;

(ii) Anyoffenceofassaultotherthaninvolvingaminor;

(iii) Anyoffenceofphysicalorpsychologicalviolenceotherthan involvingaminor;or

(iv) Anyoffenceinvolvingtheftorfraud.

9. Appeals

(a) AppealsfromdecisionsoftheDisciplineCommitteemadepursuanttosection6hereofshall bemade to Sport Dispute Resolution Centre of Canada (“SDRCC”) and shall be governed by the Canadian Sport Dispute Resolution Code (the “Code”) which outlines the procedural rules under which all disputes submitted to SDRCC must take place.

(b) Appeals of all other decisions rendered under this Conduct Policy may be made inaccordancewiththeDPCAppealPolicy,providedthatexpulsionandremovalfromDPCprograms,activitiesandeventspursuanttosection8(a)and8(b)arenotappealable.

10. Applicability

(a) This Conduct Policy, and the process for dealingwith complaints ofminor andmajorinfractions established hereunder, shall apply to all complaints which have notpreviouslybeenresolvedpursuanttoDPC’sConductPolicy,regardlessofwhethersuchcomplaints relate to alleged infractionswhich took place before or after the date onwhichthisConductPolicybecameeffective.
