FALL 2012

Diversity recruiting efforts yield results.

We are pleased to report that Cadwalader’s sustained efforts to recruit the best and brightest diverse talent is producing tangible results. From 2007 to 2012, the diversity of the firm’s summer associate classes increased by 100%, from 19% in 2007 to 38% in 2012. During that same period, the percentage of women in our summer associate classes increased from 29% to 47%. In fact, women comprised 50% of the 2011 summer associate class.

Many individuals contribute to these successful efforts. The members of our Hiring Committee have worked tirelessly to ensure that every hiring decision, from candidate review to selection, is examined through the lens of diversity. Our affinity groups have played a critical role in vigorously recruiting diverse law students, visiting law schools and law student organizations to speak about the firm, and helping new lawyers successfully navigate their new work environment.

While we are proud of these accomplishments, we recognize that lasting and meaningful change will materialize only with a consistent and sustained effort. By supplementing attorney recruitment and integration efforts with diversity training and professional development programs, we hope to improve upon our successes and follow through on our promise to weave diversity and inclusion principles into the fabric of our culture.

The Women’s Leadership Initiative has embarked on a signature pro bono project to assist victims of human trafficking in the United States and the advocacy community that works to secure justice for these victims.

This project begins with developing an electronic resource for the benefit of survivors of human trafficking and their advocates that will feature articles on emerging issues; interviews of leaders in the anti-trafficking community; a resource guide; discussion of cases in the news; and, eventually a Bill of Rights for U.S. trafficking victims to advance sound policy in this important area.

In furtherance of this effort, the WLI hosted a program on “Human Trafficking: 21st Century Slavery in America” on June 18, 2012. Spearheaded by the WLI Pro Bono

Committee, Debra Steinberg moderated a discussion on the scope of the crisis, responses to problems of victim identification and criminalization of trafficking victims, and the need for comprehensive legal, policy, and social services solutions for this population. Guest speakers included Bridgette Carr, Director, Human Trafficking Clinic, University of Michigan Law School; Pamela Chen, Chief, Civil Rights Section, Criminal Division, U.S. Attorney’s Office, Eastern District of New York; and Kate Mogulescu, The Legal Aid Society Trafficking Victims Legal Defense & Advocacy Project.

as well as participate in peer-group projects designed to foster collaboration and build relationships. Paying it forward, Lauren herself will serve as a mentor to the next class of Fellows. She is currently a mentor to a diverse law student.

Lauren’s mentoring extends to her participation as a panelist for programs presented by Practicing Attorneys For Law Students (PALS), a non-profit organization that is dedicated to enhancing the skills and career of minority law students and beginning lawyers. This summer, Lauren addressed a large group of diverse students about what it takes to perform at a high level as a summer associate.

In addition to being involved with groups concerned with mentoring and developing diverse attorneys, Lauren is active in bar associations and non-profit organizations that advocate for the interests of the Asian-American community. As a long-standing member of the Asian-American Bar Association of New York (AABANY), she is part of a group of AABANY attorneys led by Second Circuit Judge Denny Chin that presents reenactments of historic trials with significance to the rights of Asian-Americans. Most recently, she participated in “Race, Color and Citizenship: Ozawa & Thind,” a presentation about two related Supreme Court decisions from the 1920s concerning the citizenship rights of Asian-Americans. As a naturalized citizen herself, these two cases had particular resonance with

activism within the Asian-American community, and “Sing Your Song,” which featured the humanitarian and civil rights work of Harry Belafonte. The screenings were followed by panel discussions concerning, respectively, the Asian-American civil rights movement and the history of voting rights. She continues to mentor and encourage other Asian-American attorneys at Cadwalader to take leadership roles and become involved with CAPAA. Lauren also supports and is an active member of Cadwalader’s Women’s Leadership Initiative.

Based on Lauren’s contributions to the firm, including her efforts to promote diversity, Cadwalader selected her as its Fellow in the Leadership Council for Legal Diversity (LCLD) 2012 Fellows Program. The LCLD, formed in 2009 to advance diversity in the legal profession, brings together the leaders of America’s most prominent corporations and law firms, including Cadwalader, to devise substantive and sustainable strategies for developing the best legal talent. The LCLD’s Fellows Program is a highly structured mentoring program designed to increase diversity at the leadership levels of the nation’s law firms and corporate legal departments by identifying high-potential attorneys from diverse backgrounds and placing them in the path of those who can teach them to lead their organizations. Over the course of her Fellowship, Lauren will have extensive contact with other LCLD Fellows and the chief corporate officers and managing partners of the members,

LAUREN LEE

Lauren U. Y. Lee, Special Counsel in the firm’s Litigation Department, believes that the legal profession should reflect the diversity of

the society in which we live and work, and, as a result, has been a staunch advocate of fostering diversity not only within Cadwalader but in the legal profession at large.

To that end, Lauren co-founded Cadwalader’s Asian-Pacific American Attorney Resources Group (CAPAA) in 2008. CAPAA was formed to promote the recruitment, professional development, and retention of Asian-American attorneys at the firm; and to provide a forum for members to discuss and share information regarding issues that are important to the Asian-American legal community and the Asian-American community at large. Lauren has helped to welcome the summer and fall Asian-American associates to the firm by organizing CAPAA receptions, and volunteered with other CAPAA members at immigration law clinics. She was instrumental in CAPAA’s sponsorship of two documentary film screenings at the firm—“Vincent Who?,” which centered on the murder of Vincent Chin, a case that galvanized political

the opportunity to become involved in the firm’s diversity efforts, continuing his practice of assuming leadership positions in organizations that support his Latin heritage. Born and raised in San Juan, Puerto Rico, Rafael moved to the U.S. to attend Georgetown University, where he concentrated on international law, institutions and ethics. While at the University’s Edmund A. Walsh School of Foreign Service, he served as President of the Puerto Rican Student Association and Director of Financial Affairs for the Latin American Student Association, and was active in the International Relations Club.

After college, he remained in the U.S. to pursue a legal career, following in the footsteps of his grandmother, father, and two brothers. At Cornell Law School, Rafael was a member of the Latin American Law Student Association and active in moot court competitions. He returned home to serve as a clerk to the Honorable Gustavo Gelpi, U.S. District Judge for the District of Puerto Rico, before beginning in private practice in New York.

Rafael’s interest in diversity comes from a strong desire to remain connected to his Puerto Rican roots and to help people who face hardship because of their race or nationality. This commitment is evidenced by his joining Cadwalader’s Association of Social Engineers (CASE) affinity group when he arrived at the firm in August 2011. As a member of CASE, he has been active in recruiting and has participated in the firm’s PALS (Practicing Attorneys for Law Students) and SEO (Sponsors for Educational Opportunity) programs. Even though his tenure at Cadwalader has been short, he was named a co-chair of CASE, a role in which he will be instrumental in helping to promote the mentorship, leadership, advocacy, and professional and personal development of African-American and Hispanic associates.

Battered Women’s Legal Services recognized Lauren’s pro bono work by presenting her with the award for Excellence in Pro Bono Advocacy, which honors attorneys who have provided outstanding pro bono representation and advocacy to victims of domestic violence.

In addition to her participation in numerous diversity and pro bono projects, Lauren is an accomplished complex commercial litigator with significant experience representing major financial institutions and other businesses in a variety of matters, including, but not limited to, derivative shareholder law suits, bankruptcy adversarial proceedings, complex commercial disputes involving breach of contract and business tort claims, lawsuits arising out of complex structured financial products, employment discrimination actions, commercial lease disputes, FCPA investigations, reinsurance cases, corporate governance disputes and cases involving antitrust conspiracy claims.

Lauren received her B.A., magna cum laude, from the University of Pennsylvania, and her J.D., magna cum laude, from Temple University Beasley School of Law, where she was a recipient of various academic scholarships, a member of the Temple Law Review and a legal writing teaching assistant. Prior to joining Cadwalader, Lauren clerked for the late Honorable Judge James McGirr Kelly in the United States District Court for the Eastern District of Pennsylvania.

RAFAEL SANTOS-HERNANDEZ

Although a young attorney who had just joined Cadwalader, Rafael Santos-Hernandez quickly took

Lauren. In addition to helping draft the script, Lauren read the part of George Wickersham, one of Cadwalader’s founding members, who argued on behalf of the petitioner in the case of Ozawa v. U.S. before the U.S. Supreme Court. The Ozawa & Thind reenactment, which the group first presented in late 2011 at the National Asian Pacific American Bar Association’s annual convention in Atlanta, was reprised at Cadwalader in early 2012.

Since 2008, Lauren has served on the board of the Asian American Legal Defense & Education Fund (AALDEF), a national non-profit organization that, through litigation, advocacy, education and organizing, protects and promotes the civil rights of Asian Americans and secure human rights for all. She co-founded, and is currently a co-chair of, the Young Professional Committee of AALDEF, which was formed for the purpose of engaging young professionals to become educated about, and to get involved with, the protection of civil and human rights of all. For many years, Lauren also served as Cadwalader’s Event Committee member for AALDEF’s summer fundraiser, which has long been sponsored by Cadwalader. Lauren also actively supports the Korean American Family Services Center (KAFSC), a non-profit organization dedicated to helping battered women and children in the Korean American community in the greater New York area, and has served on KAFSC’s annual gala committee for several years.

Lauren also dedicates her time to helping low-income Korean-speaking women who are victims of domestic violence to obtain legal citizenship status for them without the support of their abusers under the Violence Against Women Act. Lauren’s multi-cultural perspective, formed in part by her own immigration experience, and knowledge of the Korean language are essential tools in assisting these women. JOE TOBIAS

What interests you about a career in the law?

I am interested in the law because of the variety of career options that are available with a law degree. I believe a legal career will provide for intellectually stimulating and impactful work that will keep me motivated.

Any thoughts on what you might like to do when you graduate from law school?

I am certainly interested in working at a private law firm, but I am keeping an open mind about the particular area of law I want to practice. The exposure created by the SEO program has been extremely influential in this decision already because I have been exposed to many interesting areas that I might otherwise have overlooked.

What kinds of projects have you been working on at Cadwalader?

I have worked on research on ERISA and Sarbanes-Oxley, and prepared information for a “Country Conditions Report” for an asylum case.

How did you hear about the SEO program?

I learned about the SEO program from various online sources in my research leading up to applying for law school.

What is the best part of the SEO program?

The best part of the SEO program is that it is an unparalleled opportunity to gain early exposure to life at a law firm, while also having the opportunity to meet and interact with attorneys from different firms, practice areas, and backgrounds throughout the summer. All of these aspects of the program highlight the organization’s dedication to preparing all of the interns to achieve success in law school and their future careers.

How are you enjoying life in New York City? What have you been doing in your free time?

My entire life up until now was spent in very small rural towns, so New York City has been quite a change. But, I would definitely say that it has been a change that I’ve enjoyed. I love the city and have spent my free time doing many different things ranging from simply exploring all that the city has to offer to spending time with the summer associates at Cadwalader and the other SEO interns in the city.

Can you describe your upbringing?

I grew up in very small towns in rural Texas with populations averaging a few thousand per town. I am from a blue-collar family that, despite their own limited educational backgrounds, stressed the importance and value of continued education. I am very grateful for their support and every opportunity that has allowed me to become a first-generation college graduate and graduate student.

Any interesting prior work experiences?

My most interesting work experience was an internship through the Entrepreneurship Department at Oklahoma State University. I had the opportunity to work with a local high-growth and innovative company, where I experienced, first hand, the difficulties

facing a small business operating in multiple states. I really enjoyed this experience because I was a vital part of that organization for an entire semester and had the opportunity to make substantive suggestions for the company moving forward.

What do you enjoy doing in your free time?

I enjoy spending time with friends, racquetball, bowling, and going to the movies. I am also an avid sports fan, so I like to watch college football, the NFL, the NBA, and soccer.

Tell us something that people may not know about you that might surprise them.

I have seven siblings.

What is the last book you read? Last movie?

Confessions of an Economic Hit Man and Pulp Fiction.

What song or artist is on your most-played list right now?

Jay Z.

Joe received his undergraduate degree from Oklahoma State University and is now attending Stanford University Law School.

What is the best part of the SEO program?

The SEO extends beyond the valuable work experience to a range of networking opportunities, an institute dedicated to preparing interns for law school, and professional development panels. The totality of the experience is what makes the SEO summer unique.

Any interesting prior work experiences?

I played professional basketball in Copenhagen, Denmark. Previously, I worked as a graphic designer and marketing strategist.

Who has been a role model for you?

My parents and brothers are my role models. My parents epitomize a life of hard work and dedication, and my brothers (both West Pointers) and I really challenge each other to strive for excellence.

What do you enjoy doing in your free time?

I have a passion for athletics and have recently become interested in cycling, specifically long-distance touring.

Tell us something that people may not know about you that might surprise them.

I’m a great cook.

What is the last book you read? Last movie?

The pre-law classic, Getting to Maybe, and Safe House.

What song or artist is on your most-played list right now?

A little bit of Adele and a little Lupe Fiasco.

Jaimie McFarlin received her B.A. and M.B.A from Washington University and is studying at Harvard Law School.

JAIMIE MCFARLIN

What interests you about a career in the law?

The legal profession is dynamic and intellectually challenging. A legal career will not only harness my passion for reading and writing, but also reward and hone my abilities as a great communicator and team player. There are very few professions where the power of the pen has such an integral role.

Any thoughts on what you might like to do when you graduate from law school?

I am definitely interested in clerking after law school to improve and refine my analytical, research, and writing skills. I look forward to learning the differences between good and bad advocacy from reading briefs, watching oral arguments, and assessing their effects on judicial decision making.

What kinds of projects have you been working on at Cadwalader?

I have been working on an internal investigation of a municipal agency and a pro bono Social Security and immigration case.

How did you hear about the SEO program?

I received a mailing from SEO while applying to law schools.

What is the last book you read?

James Baldwin’s first book Go Tell it on the Mountain and Hunger Games. (I have since vowed never to see a movie based on a book I’ve read. I’ll just never prefer someone else to do my imagining for me!)

What song or artist is on your most-played list right now?

This is like asking a parent to pick their favorite child! I love so many artists right now, but “As” by Stevie Wonder will always be the most meaningful song in my collection.

Victoria White graduated from Spellman College and is enrolled at Harvard Law School.

How did you hear about the SEO program?

I heard about the SEO program through a friend who was going through the law school application process with me. I’m so thankful for her willingness to share this once in a lifetime opportunity with me.

What is the best part of the SEO program?

Every part of the SEO program is great—from the networking opportunities, to meeting SEO alumni, to learning the ropes of daily life in a corporate law firm—everything and everyone that I’ve been exposed to thus far have taught me invaluable lessons that I can apply practically in law school and throughout my legal career.

Any interesting prior work experiences?

Before coming to Cadwalader, I worked for the Congressional Black Caucus Foundation. There, I served as Special Projects Coordinator and organized the Emerging Leaders Series, a dynamic set of trainings and workshops on civic engagement, education, economics and other pressing issues for emerging leaders in various stages of their careers. It was rewarding work that allowed me to really see the fruits of my labor. In this role, I also had the opportunity to work closely with Members of Congress on a number of projects and events to raise funds for scholarships awarded to talented young people around the country.

Tell us something that people may not know about you that might surprise them.

I jumped out of a perfectly good plane last year—skydiving was probably the most adventurous thing I’ve done yet.

VICTORIA WHITE

What interests you about a career in law?

I believe that a law degree is the most versatile degree that one can receive. I recently heard that “an attorney can be a businessman, but a businessman can’t be an attorney.” I think this speaks to the variety of choices, which is especially important to my generation who believes in turning our passions into our enterprise.

Any thoughts on what you might like to do when you graduate law school?

I have a keen interest in Intellectual Property law, as it is a cutting-edge field that constantly changes and challenges those who practice. I am also interested in pursuing a clerkship, which I’ve learned can be a great stepping stone to a diverse range of career choices.

What kinds of projects have you been working on at Cadwalader?

I’ve most enjoyed the pro bono work—having the opportunity to work on an asylum case, training to be a courtroom advocate, and helping transgendered individuals with name changes underscores how much good can be done in a corporate law setting.
