What is a Development Permit?

A Development Permit (DP) is a type of development approval given by Council. Spe-

cific areas of the District of Hope have been designated as DP Areas in the Official Com-

munity Plan. Each of these areas has a set of development guidelines which specify the

District’s development objectives for that area. DP’s are permitted by Section 919.1 of

the Local Government Act for the following purposes:

Protection of the natural environment, its ecosystems and biological

diversity

Protection of development from hazardous conditions

Revitalization of an area in which a commercial use is permitted; and

Establishing objectives for the form and character of commercial, industrial,

multi-family residential, and intensive residential development

The majority of DP’s in the District of Hope are for the protection of development

from hazardous conditions, namely flood and geotechnical hazards.

DP’s are in addition to normal zoning, servicing, building code and fire code regulations.

They may supersede Zoning Bylaw requirements by setting terms and conditions that dif-

fer from or supplement those in the Zoning Bylaw. However, a DP may not vary the

permitted uses or densities of land use prescribed by existing zoning regulations.

When is a Development Permit Required?

A DP is required for most work done on a property within a Development Permit Area

(DPA), including but not limited to:

1. Prior to the subdivision of land;

2. Prior to site preparation or soil movement;

3. Prior to locating of any mobile or modular home;

4. Prior to any construction or alteration of a building or structure, landscaping, or

additions, unless specifically exempted in section 7 of the District of Hope Of-

ficial Community Plan (OCP) (contact District Planning Staff for details).

5. When you want to significantly amend an existing DP; or

6. When District Staff determines that your development proposal requires a DP.

DPAs are described in detail in section 7 of the OCP and are identified as

1. Downtown Hope Development DPA #1,

2. Old Hope-Princeton Way DPA #2,

3. Silver Creek-Flood DPA #3,

4. Hope Intensive Residential DPA #4,

5. Flood & Erosion Hazards DPA #5,

6. Hope Geotechnical Hazards DPA #6, and

7. Hope Environmental and Riparian Areas Protection DPA #7.

Remember that DPA requirements are IN ADDITION TO Zoning Bylaw require-ments.

A Develop-ment Permit is not a Building Permit

When is a Development Permit Required?

A DP for a proposal shall be approved and issued once Council is

satisfied that the project meets all guidelines and conditions for

the DP Area.

A DP is not a Building Permit.

A DP must be approved and issued before a building permit can

be obtained, although both processes can occur concurrently.

You must apply for a building permit before you can proceed to

construction. Please contact the Building Inspector in the Com-

munity Development Department to determine the information

required at the building permit stage. Typically, building permit

plans require a higher level of detail than development permit

plans and some buildings require drawings prepared by a regis-

tered architect or engineer.

Exemptions

District Planning Staff can advise you when a DP is not required, and would be happy

to answer any questions you may have.

How is an Application Made?

Utilize this application package as it outlines the required information, drawings and fees.

In order to avoid unnecessary delays, it is important to make an appointment with Plan-

ning Staff before submitting a formal application. Staff will be pleased to review require-

ments and provide you with information. This will ensure a complete application and pre-

vent any unnecessary delays.

Please note that the attached Development Application Form requires both the civic ad-

dress and the legal description. A complete description of the development or use

you propose should be indicated and described.

If the applicant is not the owner, an “Owners Authorization to Assign an Agent” form

(included in this package) is required.

A Development Application Checklist is included in this guide for your convenience,

and is required to be completed and submitted with your application.

What are the Application Costs?

The DP Applicant is responsible to pay for the following costs (where applicable):

An application fee. Please see the “Guide to Development Application Require-

ments” chart included in this package for specific charges.

Security in the form of an Irrevocable Letter of Credit to ensure that landscaping is

carried out in accordance with approval plans shall be submitted prior to the build-

ing permit for the proposal being approved by Staff.

For large projects, off-site engineering costs can be expected to complete applica-

tion requirements. This may include site plans, building plans, or any plans neces-

sary to illustrate the variance being requested in the application.

Consultant fees (engineers / architects / solicitors, etc. are typically hired for large

projects).

Any documents / plans or information required in order to make a decision.

Any legal fees associated with the application.

In Flood or Geotech DPAs, a covenant fee will be charged in addition to the DP.

How Long does the Process Take?

District of Hope staff do their best to ensure that applications are dealt with in a timely

manner. DP applications can take approximately four (4) to fifteen (15) weeks to proceed

through the evaluation and approval process. It is, though, dependent on the complexity

of the project and the preparedness of the applicant. The clock “starts” when all the

necessary documents have been received, and the necessary fees paid.

Additional information may be requested by the District at any time during the process

and the application cannot proceed before that information is provided. An applicant

can considerably reduce any delays by supplying prompt replies with complete in-

formation.

What is the Development Permit Application Process

It is important to remember that submitting an application does not guarantee approval.

The major stages in the Development Permit Application Process are:

Step 1: Pre-application Meeting

Before submitting your development proposal, you are strongly encouraged to contact

or meet with Planning Staff in the Community Development Department to review by-

laws, policies, and regulations that may affect your project. Planning Staff will be

happy to meet and answer any questions.

Check the Zoning Bylaw, Official Community Plan (OCP) (available at www.hope.ca)

and other applicable District Bylaws to determine the regulations for your property. In

some cases, you may need to hire a qualified consultant to address specific concerns

with your application. Such consultants may include engineers, architects, biologists, or

planners, depending on the location of your property and the nature of the proposal.

Step 2: Submission of Complete Application

Please refer to the “Guide to Site Plan Requirements” and the “Guide to Develop-

ment Application Requirements” included in this package to ensure a complete appli-

cation.

A signed and completed Development Application Checklist is required to be com-

pleted and submitted with your Development Application. Incomplete applications

will result in delayed processing as staff will not begin work until all required informa-

tion is provided.

Step 3: Technical Review / Project Evaluation

The Community Development Staff coordinate the review of your application. It may

also be circulated to a number of other entities such as:

This overall review could result in more information having to be provided to support

your application, which may extend the timeline of your application.

Step 4: Development Review

Once all external referrals are received, your proposal will be evaluated by District Staff

from the various departments.

Step 5: Report to Council

The Community Development Department will prepare a report, including an analysis

of the application, a recommendation and an outline of the requirements which need to

be satisfied.

This report is considered by District Council during a regular Council Meeting. These

meetings are usually held the second and fourth Monday of every month at 7:00 p.m.

and are open to the public (see www.Hope.ca > Council Meetings to see Council meet-

ing dates). The applicant is recommended to be in attendance.

If District Council denies an application, re-application for the same amendment or

permit shall not be considered within twelve months immediately following the date

of such denial unless by an affirmative vote of at least 2/3 of the Council members the

time period is varied or waived (as per Procedural Bylaw No. 13/93).

Step 6: Approval / Issuance

Following approval at a Council Meeting, the DP will be issued and you will be noti-

fied in writing. The District of Hope will also file a Notice of Permit with the Land Ti-

tle Office.

As per section 926 of the Local Government Act, if construction does not substantially

commence within two years of the DP issue date, the permit will lapse. After this two-

year period, you will be required to submit a new DP application complete with updated

report or documents if you wish to proceed with the development.

Please note that “the clock starts” once the DP is approved by Council. If physical

works have not significantly begun in 2 years, then the DP will be considered expired.

the Director of Community Development and you will be notified in writing.

The District of Hope will also file a Notice of Permit with the Land Title Of-

fice.
