Thereisnodoubtabout:theWaronDrugswasafailure.We�lledourprisonswhiledoinglittletoaddresstherootcausesofaddiction.Asaresult,wehaveapublichealthcrisisonourstreets,oneIseeeverydayworkingintheTenderloin.Peoplearedyingonourstreets,andtheopen-airdrugmarketsarehavingamajorimpactonthoseofuswholiveandworkhere,aswellasonSanFrancisco’sreputationforbusiness,tourism,andconferences.Recognizingallofthat,Iamproposinga“ComprehensiveDrugReform”packagethatwillprovidehelpfordrugusers(safeinjectionsites,fentanylteststrips),additionaloptionsforcourtsandprosecutors(aspecialtyopioidandmethdrugcourt),whilebuildingcasesagainsttheleadersofdrugtra�ckingrings.Doingallofthesethingstogether,wecanmakeanoticeableimpactonconditionsintheTenderloin,SoMa,andMid-Marketneighborhoods.

Isupportrecenteffortstodecriminalizemarijuana,andIdon'tseedrugpossessioncasesasapriorityformyo�ce.However,whenitcomestothosewhodealfentanyl,heroin,andmethinourcity,targetingrecoveringaddictscomingintotheTenderloinforservicesandtreatment,IbelievetheDA'sO�ceneedsanewapproach.Assomeoneexplainedtomerecently:“Drugpossessionisavictimlesscrime;drug-dealingisnot.”Infact,10peoplediedoffentanyloverdosesonthestreetsofSanFranciscointhe�rst2weeksofJune2019.Soasoutlinedaboveinmycomprehensiveapproachtodrugreform,Idobelievethatthereisaroleforprosecutorstoplaywhenitcomestoorganizedringssellinglethaldrugsthatarekillingourresidents.

Wehaveacrisisofmassincarcerationatthenational,state,andlocallevelthatwemustaddressnow.Tome,there’sathoughtfulwaytoreformthecriminaljusticesystem,andthere’sarecklessway.Therecklesswayistosimplyreleasetensofthousandsofpeoplefromprison,havingdonenothingtoaddresstheirunderlyingissuesortopreparethemtore-entersociety,andthenthrowupourhandswhencrimeratesincrease—aswithpropertycrimeratesinSanFrancisco.Thethoughtfulwayisneitherquicknoreasy.Toensurelastingsafetyandjusticeforvictimsanddefendantsalike,wemustreduceincarcerationratesbyreducingcrimerates.Weneedtoaddressthesocietaldriversofcriminalconduct,andthespeci�cissuesthatcauseanindividualtore-offend.IfelectedDistrictAttorney,herearethreeareasI’dfocusontoreduceincarcerationratesandreduceracialdisparitiesinthesystem.First,weneedtomoveawayfromasystemfocusedonpunishmentandtowardarehabilitativeandrestorativejusticemodel.Thejuvenilejusticesystemprovidesapath.Thesolepurposeofourjuvenilesystemistorehabilitateyoungpeople.Everysentence,everyprobationcondition,everyplacementistargetedattheunderlyingcauseofayoungperson’sproblem,whetheritbementalhealthorsubstanceabuse,alackofeconomicopportunity,organgin�uence.WorkingtoaddressrootcauseshasallowedSanFranciscotosigni�cantlyreducethenumberofkidsenteringourjusticesystemwithoutacorrespondinguptickinjuvenilecrimerates.Infact,ourJuvenileHallissoempty,therearecallstoshutitdown(IwouldliketoturnitintoaMentalHealthJusticeCenterforthosebattlingmentalillnessinsideandoutsideourcriminaljusticesystem).Butthereisnoreasona19-year-oldshouldbedeniedthisrehabilitativefocuswhilea17-year-oldbene�tsfromit.Weshouldincrementallyexpandtheserehabilitativeprogramstotheadultpopulation,beginningwith18-to24-year-olds.Onceweshowthatsuchafocuscanreduceincarcerationandcrimeratesfor“transitionalageyouth,”wecanexpandittotherestoftheadultpopulationforqualifyingoffenses.Second,let’srethinktheprosecutor’srole,startingwiththemeasuresoftheireffectiveness.Ratherthanasingle-mindedfocusonconvictionrates,weshouldjudgedistrictattorneysontherecidivismratesofthosetheyprosecute.Bydoingso,wewouldshifttheirincentivesfromsimplyobtainingaguiltyverdicttoaddressingtheactualneedsofthedefendant.Prosecutorsarewellpositionedtohelpinthatassessment.Infact,theSanDiegodistrictattorney’so�cehashadearlysuccesswithaprojectinwhichprosecutorsworkwiththedefenseteam,probationdepartmentandcourttodevelopaplanfordefendantssotheycanseekoutthe

programsandskillswhileincarceratedthattheywillneedtosuccessfullyre-entersociety.Prosecutorscanalsohighlightthestaggeringcoststothetaxpayeroftheprisonindustrialcomplex,coststhatshouldbeafactorindecidingwhether(andhowmuch)prisontimeisappropriateforagivencrime.Third,weneedtoreducebarriersforformerlyincarceratedpeoplere-enteringsociety.Fordecades,wehaveerectedbarrierstohousing,jobs,votingandgovernmentservicesforpeoplewithcriminalrecords,barriersthathaveappropriatelybeendescribedas“TheNewJimCrow.”Notonlyistherenoevidencetheserestrictionsdetercriminalconduct,thereismountingevidencethattheyincreasethechancessomeonewillre-offend.Weneedtoeliminatethesebarriersand,forexample,allowtheinmateswhofoughtthedevastatingTubbs,ThomasandCamp�restheopportunitytobecome�re�ghterswhenreleased.Weshouldallowpeopleonparoletovote,justasthoseonprobationcan.Wecannotexpectreturningindividualstobuyintoasocietythatdeniesthemavoice.Suchafundamentalshiftinhowweapproachcriminaljusticewillnotoccurovernight.ButtherearenotermlimitsonDistrictAttorney,Iplantospendthenextdecadeortwosteeringthisoceanlinerinanewdirection.Ifwewantalegalsystemthatisfair,just,andrace-blind,weneedtostartnow.
AsDistrictAttorney,theprimaryhomelessnessinitiativesIwillpursuearepreventingpeoplefrombecominghomelessthroughfraudulentevictionsandbuildingaMentalHealthJusticeCenterforthoseonthestreetsbattlingmentalillness.Ifwedonotofferhousingandservicestounhousedpeoplelivingonourstreets,itisinhumanetopunishthemforengaginginbehavioranyofuswouldalsobeforcedtoundertakeoutside.Moreover,underarecentrulingfromtheNinthCircuitCourtofAppeal(CityofBoise),itisalsonowillegaltoenforcevagrancylawsagainstthehomelesspopulationuntilweendour1,000shelter-bedwaitinglist.ThiswasaprimereasonthatIwasanearlyandpublicsupporterofPropositionClastyear.AndbasedonmyparticipationwiththeHomelessOutreachTeaminthepoint-in-timecountlastmonth,thehumanitarianandpublichealthcrisisonourstreetsisasdireasithaseverbeen.

WhenIlaunchedmycampaignforDistrictAttorney,IspokewithmembersoftheJusticeforMarioWoodsCoalition.OnerecurringthemeintheircommentswasthebeliefthatthecurrentDAwasapplyingadifferentstandardtotheinvestigationandchargingofpoliceo�cersthanhewouldapplytoanyoneelseaccusedofacrime.Investigationsdraggedonforyears,withanelaboratepresentationtojustifynotchargingano�cer.Infact,notasinglechargehasbeen�ledagainstasingleo�cerforanyofthefatalshootingsthatoccurredduringtheincumbent’stenure.IwillbringthreethingstotheDArolethatwillbemeasurableimprovementsonthestatusquo.First,Iwillnothavetheinherentcon�ictofinterestofmakingchargingdecisionsinvolvingpoliceo�cersthatIusedtosuperviseasPoliceChief.Second,ratherthantakingyearstoinvestigatethesecases,Ivowtocompletemyinvestigationofanyo�cer-involvedshootingwithin6monthsandholdatownhallexplainingmydecisiontocharge,ornotcharge,theo�cer.Third,Iwillfollowtheleadofsomejurisdictionsaroundthecountrybyexploringwhetherchargesotherthanhomicidemaybebroughtthatwouldcircumventlimitationsincurrentlawthatpreventvictimsofcrimefromgettingthejusticetheydeserve.
