This matter comes before the Court and the Court being fully advised in

the premises finds that the parties have entered into a stipulated agreement

resolving all disputed matters between the parties, as is evidenced by their

signatures on the final page thereof. Based on that agreement the Court FINDS

that the stipulated agreement should be approved and their property and debts

distributed as hereinbefore set forth.

The Court makes the following:

FINDINGS OF FACT:

1. Petitioner’s address is 3140 370th St., Lake View, Sac County, Iowa

51450. His date of birth is September 13, 1962.

2. Respondent’s address is 614 North Court, Carroll, Carroll County, Iowa

51401. Her date of birth is March 24, 1965.

3. The parties are husband and wife having been married at Wall Lake, Sac

County, Iowa, on the 1st day of December, 2007.

4. There are no minor children of the parties whose welfare may be

affected by this action.

5. Petitioner filed his Petition for Dissolution of Marriage on August 21,

2013, and respondent was served with a copy of the original notice and petition

by personal service on August 26, 2013. No separate action for dissolution of

marriage has been commenced by the respondent; no such action is pending in

any court in this state or elsewhere; and the petition has been filed in good faith

and for the purposes set forth herein. The parties stipulate that the 90 day

waiting period set out in Iowa Code §598.19 should be waived. The Court finds

that for good cause shown the 90 day waiting period is hereby waived.

6. Both parties have been residents of the state of Iowa for the past year

and their residence in the state of Iowa has been in good faith and not for the

purpose of obtaining a marriage dissolution only.

7. The parties stipulate and agree, and the Court hereby finds, that there

has been a breakdown of the parties’ marriage relationship to the extent that the

legitimate objects of matrimony have been destroyed and there remains no

reasonable likelihood that the marriage can be preserved. The Court hereby

finds that conciliation efforts are hereby waived.

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED:

1. Dissolution of Marriage: The marriage previously existing between

Timothy Lee Gullett and Jane Ann Gullett is hereby dissolved, and each of the

parties is hereby restored to all of the rights of unmarried persons.

2. Real Estate: The parties owned no real estate.

3. Vehicles: The parties shall each receive the automobiles currently inthat party’s name and shall hold the other harmless from any indebtedness due

thereon.

4. Personal Property: The parties agree that division of their personal

property shall be according to present possession and further acknowledge that




they make no claim against the other for said personal property.

5. Alimony: Neither party shall pay alimony, spousal support, or other

personal maintenance to the other.

6. Debts: The parties have no marital debt and agree that each party shall

be responsible for any and all debts incurred by that party since the date of their

separation in September of 2011.

7. Attorney’s Fees: The parties shall pay all attorney fees incurred by that

party.

8. Court Costs: The petitioner shall pay the court costs herein.

9. Indemnification: Each party shall hold the other harmless and

indemnify that party for any claims made as a result of the other party’s failure to

perform on an obligation as outlined in this decree.

10. Documentation: Each party shall timely execute whatever

documentation is necessary in order to effectuate the terms of this decree.

This property is pre-marital property and Jane makes no claim as to the property.

Title to that property is quieted in Timothy Lee Gullett only.
