Important Health Warning About Playing Video GamesPhotosensitive seizuresA very small percentage of people may experience a seizure when exposed to cer tainvisual images, including ashing lights or patterns that may appear in video games.Even people who have no history of seizures or epilepsy may have an undiagnosedcondition that can cause these photosensitive epileptic seizures while watchingvideo games.

These seizures may have a variety of symptoms, including lightheadedness, alteredvision, eye or face twitching, jerking or shaking of arms or legs, disorientation,confusion, or momentary loss of awareness. Seizures may also cause loss ofconsciousness or convulsions that can lead to injury from falling down or strikingnearby objects.

Immediately stop playing and consult a doctor if you experience any of thesesymptoms. Parents should watch for or ask their children about the above symptomschildren and teenagers are more likely than adults to experience these seizures. The riskof photosensitive epileptic seizures may be reduced by t aking the following precautions:Sit farther from the screen; use a smaller screen; play in a well-lit room; do not playwhen you are drowsy or fatigued.

IMPORTANT - READ CAREFULLY: THE ACCOMPANYING PROGRAM(WHICH INCLUDES COMPUTER SOFTWARE PROGRAM, THE MEDIA

AND RELATED DOCUMENTATION IN PRINTED OR ELECTRONICFORM) IS LICENSED TO YOU ON THE TERMS SET FORTH BELOW,WHICH CONSTITUTES A LEGAL AGREEMENT BETWEE N YOU AND THECODEMASTERS SOFTWARE COMPANY LIMITED. (CODEMASTERS).BY USING THE PROGRAM, YOU AGREE TO BE LEGALLY BOUND BYTHE TERMS OF THIS AGREEMENT WITH CODEMASTERS.

THE PROGRAM is protected by the copyright laws of England,international copyright treaties and conventions and other laws.The Program is licensed, and not sold, and this Agreement confersno title or ownership to the Program or any copy thereof.

1. Limited Use License. Codemasters grants you the non-exclusive, non-transferable, limited right and license to useone copy of the Program solely for your personal use.

2. Ownership. All intellectual property rights in and to the Program(including but not limited to video, audio and other contentincorporated therein) and title to any and all copies thereofare owned by Codemasters or its licensors, and you receiveno right or interest therein other than the limited license inparagraph 1 hereof.

YOU SHALL NOT:

* Copy the Program.

* Sell, rent, lease, license, distribute or otherwise transfer or makeavailable to any other person the Program, in whole or in part, oruse the Program or any part thereof in any commercial context,including but not limited to using in a service bureau, cyber cafe,computer gaming centre or any other commercial location inwhich multiple users may access the Program. Codemasters mayoffer a separate Site License Agreement to permit you to make theProgram available for commercial use; see the contact informationbelow.

* Reverse engineer, derive source code, modify, decompile,disassemble, or create derivative works of the Program, inwhole or in part.

* Remove, disable or circumvent any proprietary notices orlabels contained on or within the Program.

LIMITED WARRANTY. Codemasters warrants to the originalconsumer purchaser of the Program that the recording mediumon which the Program is recorded will be free from defects inmaterial and workmanship for 90 days from the date of purchase.If the recording medium of a product is found defective within 90days of original purchase, Codemasters agrees to replace, free ofcharge, such product within such period upon its receipt of theProduct, postage paid, with proof of the date of purchase, as longas the Program is still being manufactured by Codemasters. Inthe event that the Program is no longer available, Codemastersretains the right to substitute a similar program of equal orgreater value. This warranty is limited to the recording mediumcontaining the Program as originally provided by Codemastersand is not applicable and shall be void if the defect has arisenthrough abuse, mistreatment, or neglect. Any implied warrantiesprescribed by statute are expressly limited to the 90-day perioddescribed above.

EXCEPT AS SET FORTH ABOVE, THIS WARRANTY IS IN LIEU OF ALLOTHER WARRANTIES, WHETHER ORAL OR WRITTEN, EXPRESSOR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY,SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE ORNON-INFRINGEMENT, AND NO OTHER REPRESENTATIONS OR CLAIMSOF ANY KIND SHALL BE BINDING ON OR OBLIGATE CODEMASTERS.

When returning the Program for warranty replacement pleasesend the original product discs only in protective packaging andinclude: (1) a photocopy of your dated sales receipt; (2) yourname and return address typed or clearly printed; (3) a brief notedescribing the defect, the problem(s) you encountered and thesystem on which you are running the Program.

LIMITATION ON DAMAGES. IN NO EVENT WILL CODEMASTERS BELIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGESRESULTING FROM POSSESSION, USE OR MALFUNCTION OFTHE PROGRAM, INCLUDING DAMAGES TO PROPERTY, LOSS OF

GOODWILL, COMPUTER FAILURE OR MALFUNCTION AND, TO THEEXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURIES,EVEN IF CODEMASTERS HAS BEEN ADVISED OF THE POSSIBILITYOF SUCH DAMAGES. CODEMASTERS LIABILITY SHALL NOT EXCEEDTHE ACTUAL PRICE PAID FOR THE LICENSE TO USE THIS PROGRAM.SOME STATES/COUNTRIES DO NOT ALLOW LIMITATIONS ON HOWLONG AN IMPLIED WARRANTY LASTS AND/OR THE EXCLUSION ORLIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SOTHE ABOVE LIMITATIONS AND/OR EXCLUSION OR LIMITATION OFLIABILITY MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOUSPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS WHICH

VARY FROM JURISDICTION TO JURISDICTION.

TERMINATION. Without prejudice to any other rights of Codemasters,this Agreement will terminate automatically if you fail to complywith its terms and conditions. In such event, you must destroy allcopies of the Program and all of its component parts.

INJUNCTION. Because Codemasters would be irreparablydamaged if the terms of this Agreement were not specificallyenforced, you agree that Codemasters shall be entitled, withoutbond, other security or proof of damages, to appropriate equitableremedies with respect to breaches of this Agreement, in additionto such other remedies as Codemasters may otherwise haveunder applicable laws.

INDEMNITY. You agree to indemnify, defend and hold Codemasters,

its partners, affiliates, contractors, officers, directors, employeesand agents harmless from all damages, losses and expensesarising directly or indirectly from your acts and omissions to act inusing the Program pursuant to the terms of this Agreement.

MISCELLANEOUS. This Agreement represents the completeagreement concerning this license between the parties andsupersedes all prior agreements and representations betweenthem. It may be amended only by a writing executed byboth parties. If any provision of this Agreement is held to beunenforceable for any reason, such provision shall be reformedonly to the extent necessary to make it enforceable and theremaining provisions of this Agreement shall not be affected. This

Agreement shall b e governed by and construed in accordancewith the laws of England and you consent to the exclusive

jurisdiction of the courts of England.
