CAPACITORS PURCHASER ANTITRUST LITIGATION

Current eligible purchase dates*: January 1, 2005 to Present (end date yet to be determined) Case Description: The plaintiffs are alleging that the defendants had conspired to fix, maintain or stabilize prices for both tantalum and aluminum capacitors. These include tantalum capacitors and aluminum electrolytic capacitors (Capacitor Products) sold in the United States. Capacitors are passive electronic components which are used to store electricity and release it on demand. Capacitors are incorporated into almost every electronic device, including audio/video equipment, telecommunication equipment, computers and automobile electronics.

Proposed Class: All persons that purchased Capacitor Products in the United States directly from any of the defendants, their subsidiaries, affiliates, or joint ventures from January 1, 2005 through the present (defined as the “Class Period”). Excluded from the Class are Defendants, their parent companies, subsidiaries and affiliates, any co-conspirators, and governmental entities
