NOW, THEREFORE, in accordance with theprovisions of Article 55 (1) of the Constitution of theFederal Democratic Republic of Ethiopia, it is herebyproclaimed as follows:

PART ONEGENERAL PROVISIONS

1. Short Title

This Proclamation may be cited as "The DiredawaAdministration Charter Proclamation No.416 12004."

2. Definitions

Unless the context indicates otherwise, in this charter,

1/ "City" means the Diredawa City;

21 "City administration" means the Diredawa CityAdministration;

31 "Mayor" means the chief executive officer whogoverns the City Administration;

41 "Municipal service" includes water and sewerageservice, road construction service, fire andemergency service, civil status record operationsencompassing other day to day services forresidents, Land development and management,City sanitation and beautification and otherservices to be designated as such by the Citygovernment;

51 "Qebele" means second administrative stratum ofthe City.

61 "Conditions of Work" means the entire relationsbetween the City Government and its officials andemployees and shall include hours of work,salary, leaves, payments due to dismissal, if any,health and safety, compensation to victims ofemployment injury, grievance procedure andother similar matters.

3. Legal personality

The City Administration shall have legal personality.Organs of Power set out by this Charter and otherbodies to be established by the City Council inaccordance with this charter shall have their ownrespective legal personality as representatives of theCity Administration.

The City shall have a boundary, which includes theexisting urban and rural Qebeles. In the event of aneed of making a change in its boundary in the future,the City Administration may delimit it as peragreements to be made with neighboring Regions.

5. Official language

The official language of the city Administration isAmharic.

6. Rights of Residents

II With out prejudice to the constitution of the FederalDemocratic Republic of Ethiopia and other laws ofthe country the residents of the City have the right;

a. to directly or through their representatives,deliberate and decide on policy, administrativeand budgetary matters of the City Government;

b. to seek and receive information; forward theiropinions, invoke questions, and receive repliesconcerning matters to be decided about the

c. have the right to get services to be rendered bythe City Administration in accordance with theprinciple of equality, transparency and equity.

21 Policies, budget, plans and directives of the CityAdministration must be publicized to residents.

7. Election

The elections of the City to be held according to thisCharter shall be conducted according to the electorallaw of the country.

8. Objectives

The City Administration shall have the objective to

1I institute good governance in which effectivenesstransparency and accountability to the residentsdwell as well as to make a city in which expedientand equitable municipal services and reliablesecurity and social harmony are ensured;

21 create favorable conditions of living and work aswell as to facilitate conditions in which residentsdetennine the overall operations of the City andbecome beneficiary of its development;

31 make a centre where Ethiopian nations,nationalities and peoples reside in equality andexpress their cultures;

41 make a city where the well-being and comfort ofresidents is safe kept and particularly wherechildren, women, persons with disabilities,elderly people and other disadvantaged segmentsof society avail of special support;

51 bring about speedy economic development throughthe encouragement and enhancement ofinvestment and research;

61 render trade, industry and various services for itssurrounding areas;

71 make the City a naturally balanced, clean, greenand favorable environment through the preventionof environmental pollution.

9. Powers and functions of the city Administration

Having powers to make laws and exercise judicialpowers specifically conferred on it by this charter aswell as executive powers and functions over mattersthat have not specifically been included in thedetails of the powers and functions of the FederalGovernment executive organs,

1/ the City Administration shall issue andimplement policies, proclamations, andRegulations as well as adopt economic andsocial development plans concerning thedevelopment of the city;

21 the City Administration shall:-

a) establish municipalbodies on the City;

and non-municipal

b) constitute pubIic enterprises as legal entitieson its own or in partnership with enterprisesof the private sector or other third parties;

c) establish Qebeles, and demarcate theirborders, as well as allocate budget~subsidy to it.

d) detennine the administration and theworking conditions of employees andofficials of the city Government as well asthe staff of other organs of power set forthby this charter.

e) identify, detennine and organize municipalservices to be delivered at the level of theCity center and Qebele; provide efficient,effective and equitable services through theuse of a variety of service deliveryalternatives and the participation of thepeople; as well as ensure that a standardizedacceptable system of service delivery is inplace;

31 administer, according to law, the land and thenatural resources located within the bounds ofthe city; expropriate, in accordance with law, aprivate property and or clear and take over landpossession designated as and object of publicinterest after having paid commensuratecompensation; .

41 administer, lease, develop, sale and collectincomes from houses nationalized as perGovernment Ownership of Urban Lands andExtra Houses Proclamation No. 47/1975 andadministered by the City Administration, andother houses which the City Administration hasbuilt or obtained in accordance with law;

51 the City Administration shall, in accordancewith the specific provisions of this Charter,

a) prepare, approve and administer thebudget of the city

b) detennine and collect, according to law,taxes, duties and service charges out of thesources of income specifically given to theCity Administration; revoke taxes andpenalties effective as per the law;participate in income-generating activities,and receive donations and gifts;

c) borrow money from domestic sources atthe will of the Federal Government;

61 the City Administration may establish relationsand conclude co-operation agreements with theorgans and institutions of the FederalAdministration and the Regions of the country,the Private sector and nongovernmentalorganizations as well as, at the authorization ofthe Federal Government, with variousinternational organizations;

(b) to issue Regulations either according to theauthorization of the Proclamations of theHouse of Peoples' Representatives; or, inthe absence of such authorization, wherethe Council of Ministers has not issuedRegulations for the implementation ofProclamations of the House of Peoplerepresentatives;

(c) to approve the short-term and long-termeconomic and social development plansand annual budgets of the City;

(d) to levy taxes and duties on revenue areasand set service charges specificallyindicated under this Charter;

(e) to elect from among its members thespokes person, the deputy spokespersonand the secretary of the Council and toestablish the Secretariat of the Council;

(t) to elect, from among its members, the Citymayor and the Deputy mayor;

(g) to approve the appointment of the membersof the City Cabinet upon the nomination bythe mayor;

(h) to approve the appointment of thepresident, the vice president and the judgesof the City Appellate and first InstanceCourts and the appointment of the chiefAuditor as well as to establish the JudicialAdministration Commission and todesignate its members;

(i) to approve the appointment of presidents ofother bodies having judicial powers andaccountable to it and of other officialsshoes appointments to be so approved bythe City Council as per the law;

G) to establish municipal and non-municipalbodies, including the public enterprises ofthe City;

(k) to establish the committees of the Counciland to designate their members fromamong its members;

(1) designate an external auditor from among 3candidates to be proposed by the mayor atany time and where it so requires, and toexamine and render decision upon thereport to be submitted by the externalauditor;

(m) to approve the standard of quality ofmunicipal services and service charges;

(n) to detennine the number of the members ofQebela Councils;

(0) to allocate budgetary subsidy to Qebelesaccording to the fonnula it adopts;

(p) to examine and decide upon the reports tobe submitted to it by the mayor and or byorgans that are accountable to its;

(q) to approve loan agreements with domesticsources as per the authorization of theFederal Government;

(r) to issue the Code of conduct of themembers of the Council;

(s) to conduct investigation according to theRegulations it issues, where it is allegedthat the City's mayor, deputy mayor, theCouncil's spokesperson, deputyspokesperson, the City's Cabinet members,or the chief auditor as well as othermembers of the Council have violated theCode of conduct; hear witnesses; see to itthat other evidences are produced; andrender decisions.

13. Term of Office of the City Council and Itsmeeting Procedures

1/ The tenn of office of the council shall be fiveyears. The council shall have regular andextraordinary meetings and the regular meetingshall be held every three month;,

2/ There shall be a quorum where more than halfof its total members are present in a meeting ofthe Council;

3/ A decision may be passed in any meeting of theCouncil where more than half the members inattendance second it;

.4/ The meetings of the Council shall be open to the

public unless it is otherwise necessary for theprotection of the city's security and safety aswell as for the interest' of individuals andjuridical persons;

5/ The spokesperson of the Council may call anextraordinary meeting; and he shall be dutybond to call an extraordinary meeting wheremore than half the members of the Council sodemand;

61 The Council shall issue internal Regulations thatdetennine'its operations;

14. Records Keeping of the City Council

The council shall have a register for its proceedingsand decisions. The register shall be public unlessthe council decides that it endangers the security orsafety of the city or that it violates public moralityor the rights of others.

15. The Accountability and Dissolution of the Council

II The accountability of the City Council shall be tothe Federal Government and to the Residents ofthe City;

21 The dissolution of the City Council may beeffected by the House of Peoples' Representativesor by its own decision. Without prejudice toArticle 61(3) of this Charter;

31The City Council may be dissolved by the FederalGovernment,

a) where the City Council commits an act thatendangers the constitution or where the CityCouncil fails to Control security andemergency situation, the House of Peoples'Representatives may dissolve the CityAdministration, establish transitionaladministration and detennine the duration ofthe transitional administration and determinethe duration of the transitional period;

bl the Prime Minister shall ensure theimplementation of the decision under (a) ofthis Sub-Article.

41 Where the City Council dissolves by itself,

a) the City Council may, before the lapse of itstenn of office, conduct a new election;

b) where a coalition of political parties seizingexecutive power breaks up and fails tooccupy the majority seats of the Council, theCabinet shall be dissolved, and the politicalparties in the council shall be invited by theMinistry of the Federal Affairs to form acoalition Cabinet within a week. If thepolitical parties fail to fonn a new Cabinet orto continue the coalition, however, the Citycouncil shall be dissolved;

c) new election shall be held with in six monthsif the City Council is dissolved as indicatedunder (a) or (b) of this Sub-Article;

d) The new City Council shall commencework with in thirty days after theconclusion of the election.

e) The executive organ in power after thedissolution of the City Council may notmake, amend, or repeal laws exceptexecuting day-to-day functions andconducting elections.

16. The Spokesperson of the City Council

Being accountablespokesperson shall

the Council, theto

1/ have a term of years of the council but he maybe removed trom office by resignationsuspension 09r termination of his membership;and the details thereof shall be set out by theinternal regulations of the Council;

2/ direct the Secretariat of the Council;

3/ represent the Council in all its dealings with thirdparties;

4/ call and preside over the meetings of the Counciland Co-ordinate the committees thereof;

5/ prepare the budget of the Secretariat of theCouncil and implement same upon approval.

6/ employ and administer the staff of theSecretariat of the Council in accordance withcivil service law;

7/ ensure that laws adopted by the Council arepublished in the Addis Negarit Gazette;

8/ execute disciplinary measures decided by theCouncil on its members;

9/ give periodical briefings to the residents andnotify concerned organs about decisions passedby the City Council. He shall also ensure thatthe documents of the Council are available andaccessible to residents;

10/ prepare plan for capacity building of themembers of the Council and implement itjointly with concerned executive bodies;

18. The Secretary of the City Council

Being .accountable to the spokes person of the'Council, the Secretary of the Council;

11 shall prepare the agenda of the Council inconsultation with the spokesperson, and record,publish and keep the minutes of the Council;

21 shall ensure that the minutes and documents ofthe committees of the Council are recorded andkept. He shall also distribute minutes inaccordance with the internal Regulations of theCouncil;

20. The Mayor

11 Being accountable to the City Council and theFederal Government, the Mayor is the chiefexecutive officer of the city and is responsiblefor the management of the city's municipal andnon-municipal undertakings

2/ Without prejudice to the generality of theprovisions of Sub-Article (1) of this Article, theMayor shall;

a) execute decisions, laws, annual plans andbudgets adopted by the City Council;

b) propose to the City Council various policies,economic and social development plans,and annual budget after consultationthereon by the Cabinet and ensure theimplementation thereof upon approval;

c) represent the City as an ambassador thereofand sign agreements made with Sister-City;

d) ensure the observance of law and order inthe city;

e) recruit and seek the Council's approval ofthe appointment of Cabinet members;

f) propose three external auditors to the CityCouncil where the latter resolves, as maybe necessary, to appoint an externalauditor;

g) hire the City manager by a contract ofemployment for a definite period of timeon the basis of his professionalcompetence and in consultation with theCabinet;

h) hear pressing problems of residents andtheir grievances;

i) represent the City in national ceremoniesand public holidays;

j) ensure, in consultation with concernedbodies, the preparation of public forumswhere plans, budget and workperformances are presented for andcommented by the public;

k) submit annual report to the Council., Heshall also submit to Council periodicalreport as necessary as may be determinedby the latter. Likewise he shall submitreport to the Ministry of Federal Affairsaccording to the provisions of Article 61(6) of this Charter;

l) ensure that a standardized and equitableservice delivery alternative isimplemented;

m) prepare and propose to the FederalGovernment the amount -of support neededfrom the latter after consultation thereonby the City Cabinet;

n) prepare and propose drafts ofproclamations and Regulations to theCouncil after consultation thereon by theCabinet;

c) initiate citywide policies and drafts ofproclamations and regulations;

d) deliberate over the annual plans and budgetsof the City and forward to the City Councilits recommendations thereon as well asinsure the implementation thereof up onapproval;

e) decide on the organizational structure of theexecutive bodies of the City government; .

t) issue Regulations according to the authoritygiven to it by proclamations the councilmakes;

g) perform other functions assigned to it by theMayor and by the Council

2/ The term of years of the Cabinet shall be theterm of office of the council.

23. The City Manager

1/ Being accountable to the mayor, the Citymanager is the executive of municipal services;

2/ Without prejudice to the generality of theprovisions of Sub-Article (1) of this Article, theCity manager shall;

a) propose to the mayor to establish municipalbodies accountable to the City managerand to implement other service deliveryalternatives,

b) propose the appointment of the heads ofmunicipal bodies. Upon the approval oftheir appointments, he shall supervise theiroperations and discharge them inaccordance with law;

c) hire, administer, and discharge competentprofessionals as qebele managers bycontract of employment for a definiteperiod of time. He shall also receive,examine and decide upon annual reportsand, where necessary, periodical reportsfrom Sub-City managers,

d) prepare and submit to the mayor actionplans and budget proposals concerningcitywide and inter-qebele municipalservices and implement them upon theendorsement thereof,

24. The Deputy City Manager

Being accountable to the City manager, the deputyCity manager shall

25. The Office of the City Chief Auditor

1) There shall exist the Office of the chief auditor ,which inspects and reports to the City Councilthe efficiency, performance effectiveness,resource utilization and administration of theCity Government.

2) The office of the Chief auditor shall perform itsfunctions independently.

3) The chief auditor shall not be removed from hisoffice before he retires, except for hisresignation or for resignation or for reasons setforth below:

a. disciplinary fault, grave incompe tence- orpoor performance;

b. proven inability to fulfil his responsib- ilitiesbecause of illness; Qr

c. where the City Council decudes by majorityvote to theat effect.

4) The chief auditor shall preoare and submit to theCity Council the budget of his office andacminister it upon the approval thereof.

26. The Dire dawa Administration Police Commission

1) The Dire dawa City Police Commission shall beestablished by Regulations the Council ofMinisters issue in accordance with the FederalPolice Commission Establishment Proclama-tion.The Dire dawa Police Commission shall,

(a) be accountable to he Federal PoliceCommission;

(b) be accountable to the City Administrationby delegation conferred through thisCharter and the Regulations of Council ofMinisters; the Mayor shall be responsiblefor the daily follow up of the oprations ofthe City Police Commission;

(c) prepare and submit its plan and budgetproposal to the Mayor and to the FederalPolice Commission, and implement sameupon approval by the City Council.

29. Boundaries of Qebekes

I) Without prejudice to the provisions of Article 4 ofthe Charter, the boundaries of Qebles shall bedelimited by the City Council.

2) The City Council may either establish newQebele, or reorganize existing Qebeles takingin to account the opinions of respectiveresidents, the suitability of service delivery, theurban development plan at stake,and the size ofthe population.

30. Powers and functions of Qebele Administration

I) Qebele Administration shall be accountable tothe residents of the respective Qebele and theCity Administration.

2) The power and functions of the QebeleAdministration shall be determined by the lawthat the City Council specifically issues.

(a) offences committed upon fiscal matters setout under Article 52 of this Charter;

(b) cases arising out of traffic and other pettyoffences;

(c) remand in custody and bail applications butwithout prejudice to the jurisdiction ofFederal courts on federal offences;

(d) cases of execution of penalties imposedupon petty offences by the executivebodies of the City Government, providedthat the other provisions of this Charterremain effective.

34. Conflict of Jurisdiction and Power of Cassation

11 The Federal Supreme Court shall decide onconflict of jurisdiction that arises between theDiredawa city courts and Federal Court.

2/ A party alleging a fundamental error of law ina final judgment of the Diredawa CityAppeallate Court rendered on an appeal casemay institute before this Court a case whichis the subject matter of power of Cassation.

A party alleging a fundamental error of law inthe ultimate judgment of The Diredawa CityAppeallate Court subject to the power ofcassation may insttute before the FederalSupreme Court an application for the powerof cassation.

37. Appointments and Term of Office of Judges

II The city Judicial Administration Commission hasthe responsibility to primarily shortlist judgesfor appointment and solicitthe the views ofthe Federal Judicial AdministrationCommission respecting the candidates andthen to forward such views to the CityCouncil through the Mayor, together with itsrecommendations. If the Federal JudicialAdministration Commission does not submitits views within three months, the shortlist ofthe candidates shall be forwarded to the cityCouncil for appointment.

21 No judge shall not be removed from his officeexcept for termination by resignation or forthe following conditions:

(b) Where it decides that a judge can nolonger carry out his responsibilities onaccount of illness; and

(c) Where the City council approves by amajority vote ~ decision of the JudicialAdministration Commission.

38. Labour Relations Board

The provisions of the labour Proclamation shallapply with respect to the jurisdiction, organizationand procedures of the Labour Relations Board of theCity Government.

39. The Civil Service Court

1/ The Civil Service Court of the City Governmenthas the power to entertain appeal cases of TheCivil Servants of the City Government lodgedbefore it in accordance with the Civil Servicelaw of the City Government.

1/ The Tax and Urban Land Clearance appealsCommission of the city shall have the power toentertain appeals lodged before it concerningtaxes and duties collectable by the CityGovernment and justiciabe issues under leas-hold laws.

2/ Without prejudice to the provisions of tax andleas-hols laws, the organization and theprocedures of the Commission shall be definedby law the City Council makes.

41. Qebele Social Courts

1/ Qebele Social Courts shall have jurisdiction overcases regarding property and money claimswhere the amount involved does not exceedBirr 2000 (two thousand). There civiljurisdiction may not, however, includenegotiable instruments and insurance claims.

2/ The jurisdiction of Qebele Social Courts over thecity hygiene and public health contraventionsand other similar petty offences shall bedetermined by law the City Council makes.

The fiscal year of the. City Administration shall 'bethat of the Federal Government.

43. Fiscal Powers

The City Administration shall have the followingFiscal Powers, and it shall

11 assess and collect, according to law, incometaxes trom incomes earned in employmentwithin the bounds of the City but with theexception of the employees of the OromiaRegion, the Federal Govemmerit organs,including federal public enterprises.

2/ set and collect land use fees.

3/ levy taxes on incomes trom agriculturalactivities in the City.

4/ assess and collect, accord,ing to- law, tromindividual tradesmen located in the City profittaxes, excise taxes,.and turn over taxes.

16/ assess and collect, according to law, capital ginstax from a property situated in the city.

44. Revenues Generation

The City Administration shall

1/ generate revenues by means of the operations of theCity or by undertaking through special permitincome earning activities, such as jointinvestment, fund investment, rentals and fund-raising from donors, so long as such is nototherwise prohibited by law.

2/ participate through contractual comm- itments in avariety of remunerative activities.

1/ The City Administration may, as per theauthorization of the Federal Government,borrow directly from domestic and externalsources by short-term and long-term repaymentarrangement or by selling bonds.

2/ Qebele Administrations may not undertakeborrowing.

3/ The City Administration may constitute,according to law, micro financing and Savingsas well as Development Bank by forgingpartnership with governmental and non-governmental organizations as well as withQebeles.

46. Financial Support from the Federal Government

11 The City Administration may be granted by theFederal Government emergency, rehabilitationand development aid where necessary, with aview to enabling it to properly discharge itsresponsibilities. It may also be assisted by theFederal Government with respect toexpenditures for programmes havingcountrywide developmental impact.

2/ The Federal Government shall have power toaudit and make sure whether the loans andfinancial supports granted by it have beenproperly utilized by the City Administration.

47. Foundations

The City Administration may establish foundationsand trusts as well as authorize others to establishsuch according to law.

48. Decentralized finance System

1/ It shall be ensured that the revenue sharingsystem of Qebeles be based on a formula whichencourages competitiveness an effectiveness aswell as that which takes into account equity.

2/ Qebeles shall be granted by the City Councilcenter specific grant set aside for a specificpurpose and block budget. A certain portionof such budget shall be disbursed for theQebele municipal bodies. Such a sharingshould take into account service delivery andthe Qebeles lagging behind in theirdevelopment.

31 The City CoU1\cil may grant subsidy toQebeles to cover expenditures of projects thatit desires to exceptionally encourage.

4/ Initial capital shall be set aside for the publicenterprises .ofthe City.

5/ Those revenues to be collected and utilizeddirectly by Qebeles shall be specified bX,theCity Council.

49. Financial Administration1/ The financial Administration of the City shall be

conducted according to accepted accountingnorms, the country's finance law and the lawthe City Council makes.

2/ The City Administration shall have an internalcontrol system which ensures the properhandling of the resources of the City and itsutilization according to law.

3/ The Mayor shall submit to the City Councilannual and periodical reports.

4/ The City Administration and the Qebeles shallmaintain complete original [mancialdocuments as well as accurate and completebooks of accounts.

5/ All collected funds shall only be deposited inbank accounts opened as per theauthorization of finance laws.

6/ The City Administration and Qebeles shallhave bank accounts to be opened in theirnames.

7/ The City Administration shall have power tolawfully revoke taxes, interests and fines aswell as to write off debts.

50. Budget Preparation and Administration

1/ The city budget administration shall follow thebudget principles of the Federal Government.

2/ The City budget shall be prepared transparentlyand in a manner that ensures the participationof residents. Budgetary offices and otherconcerned organs shall give their opinions ona budgetary proposal before it is approved.Mass media shall be employed to maximizethe participation of residents. The meetingsof the Council deliberating over budgetproposal shall be open to residents.

31 The City Council shall allocate contingencybudget. The Mayor shall allocate thecontingency budget for the required work.

PART NINEINTERGOVERNMENTAL RELATIONSHIPS

51. The City Administration and the FederalGovernment

1/ The City Administration shall be part of theFederal Government the City Administrationshall be accountable to the FederalGovernment.

21 The Ministry of Federal Affairs shall, as an agentof the Federal Government, follow up theperformances of the City Administration and shallsupport the capacity-building undertakings of theCity.

31 The City Administration shall submit to theMinistry of Federal Affairs annual andperiodical reports concerning its plans, budgetand the overall status of the city.

41 The organs of the Federal Government situated inthe City have the duty to respect theProclamations and Regulations of the CityAdministration.

51 Services concerning the City and run by federalinstitutions shall be effected in partnership andagreement with the City Administration.

52. Relations ,with Other Cities and Regions

1/ The City Administration may establishrelations with other cities and regions athome as well as with cities abroad.

21 The City Administration may co-operate andexchange experiences with cities and regionsat home in respect of policies, infrastructureand service delivery in order to promote theinterests of residents.

31 The City Administration may establishrelations with sister cities abroad.

PART TENMISCELLANEOUS PROVISIONS

53. Public Enterprises of the City/

II The public enterprises of the City shall bedirected by a respective board.

21 The public enterprises of the City areinstitutions which shall be governed as perthe appropriate law.

31 The Mayor shall designate board chairpersonsand members from among candidatesnominated by the City manager; and theaccountability of boards shall be to the Citymanager.

41 Public enterprises shall report to the Citymanager.

54. Amendment of the Charter

The Amendment proposal on this charter may beinitiated by the City Council or by the appropriateorgan of the Federal Government. The PrimeMinister shall present the amendment prOposalsfor the deliberation of the Council of Ministersand, upon approval, he shall ensure that it bedecided upon by the House of PeoplesRepresentatives.

55. Transitory Provisions

1/ The Diredawa Administration Council andExecutive Committees that were functional atevery level of the city before this Charter takeseffect shall be dissolved at the instance of theconstitution of the Diredawa City ProvisionalAdministration in accordance with Sub-Article(2) of this Article.

21 A provisional City Administration which shallremain in power up to one and half a year as ofthe effective date of this charter shall bedesignated by The Prime Minister. TheProvisional Administration shall take over thepowers and functions of the CityAdministration and shall have the powers andfunctions of the City Council and City Cabinetdefmed by this Charter. The Mayor of theProvisional Administration shall have thepowers and functions given to the Mayor andthe spokesperson of the City Council in thisCharter.

3/ The provisional Administration

(a) shall designateAdministration

(b) shall implement Qebele delimit- ations inaccordance with this Charter;

(c) shall reorganize municipal and non-municipal bodies, including publicenterprise of the City; shall'reassign, hireand dismiss their employees inaccordance with the organizationalstructure it approves;

(d) may establish during the transition periodCity center and Qebele AdvisoryCouncils in which residents andrepresentatives of different parts ofsociety shall participate to enhance theorganized p~rticipation of residents indevelopment, building of democracy,and service delivery as well as to renderdecisions which meet the interests of thepublic. the details thereof shall be set outby the Provisional Administration.

4/ The City provisional Administration shall

(a) Adopt civil Service Law applicable for thereorganization and selection of its staffboth in recruitment and appointmentpositions. As a result, The federal CivilServants laws shall not be applicable to theCity Administration during the transitionperiod.

(b) issue labour relations regulations, which setout the details under which the LabourRelations law becomes applicable in theprocess of reorganizing the publicenterprises of the City.

5/ The rights and duties of the organs or institutionsof the City Administration replaced oramalgamated as per the law and theorganizational structure to be adopted by theProvisional Administration shall be transferredto the organs or institutions established, or itshall be decided by the ProvisionalAdministration, as the case may be.

6/ Cases pending in the Federal Courts and fallingunder the jurisdiction of the City Courts inaccordance with this charter shall continue tobe entertained by the Federal Courts. Whereas,new cases shall be brought before' theappropriate judicial organs of the CityAdminis- tration.
